There were no objections. 00" M/S/C: WALDO/GREGORY COUNCILMAN KING EXCUSED 00- It was the time and place set for a public hearing on an Appeal from the Decision of the Planning Director on Minor Variance 40-B an application for a Minor Variance to reduce the side yard set back by 2Q% or from 5' to 4' on property located at 4222 and 4228 Bogart Avenue. Applicant: Larry Koopmans; Appealed by City Council. Publications, mailings and postings had been accomplished There were no written protests. Director of Planning Kitgour referred to his report on th< Appeal of Minor Variance MV-40-B, which reviews the location of the development proposal, the request, the minor variance hearing, the action of appeal, the actions of the City Council, staff analysis, and some of the historical facts of the case. The plot plan, minutes of the minor variance meeting and letter of approval from the Planning Director to Mr. Koopmans were included with the staff report. He said he had also distributed a copy of that portion of the zoning ordinance which refers to variances required by the Baldwin Park ordinance and complemented by the state laws. He referred to Municipal Code, Section 9471, Burden of Proof, and the following 4-point listing under which a zone variance shall be granted. He said that all 4 questions must be answered to the satisfaction of the Council before the variance shall be granted. LARRY KOOPMANS; APPEALED BY CITY COUNCIL PUBLICATIONS, MAILINGS & POSTINGS NO'WRITTEN PROTESTS BIB] 37658-U01 1976-U02 02-U02 23-U02 CC-U02 MIN-U02 LI1-U03 FO9591-U03 FO9725-U03 DO9834-U03 C4-U03 MINUTES1-U03 2/5/2003-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 1976 02 23 CC MIN(ÌìÏópe00006^ Adjourned Regular Meeting of the Baldwin Park City Council Larry Koopmans, owner of the two vacant lots at 4222 and 4228 Bogart and applicant for the minor variance, address given as 5029 Azusa Canyon Road, stated that he and his partner are investing quite a lot of money into the two proposed units and felt they would add about $80,000 to $10,000 evaluation to Baldwin Park. The two lots have been vacant for years and were a weed abatement and dumping problem. There has been no development on Bogart Street for about 10 years and the building standards are much more restrictive than before. The area is zoned R-3, but the neighborhood is still a basic single family area so he said they would like to conform by building a nice-looking unit. He said they have cut 1 ft. of area off the house to get a 9 ft. side yard so that they could get vehicles to the back yard or get back there to pick up trash. The driveway radius is needed to give additional room so the neighbors won't have any problem with backing out of the driveway. He feels the extra 2 ft. of space will make the difference in being able to back out easily or make it rough on the neighbors. Cart Boyarn distributed floor plans of the proposed units for examination by the Council. The plans are on file in the Building Department. He stated these were the only units in the block with double garages. T. E. Carpenter, 4346 Jerry, stated that the Council had in some cases overruled the Planning Commission on rear yard and side yard set backs. He favored granting this minor variance. Director of Planning Kilgour clarified that the minor variance had not gone to the Planning Commission as the appeal process brings a minor variance directly to the City Council. The Staff's recommendation was for approval, but had been appealed by the property owner, Mr. Frank. Laurence Frank, 1025 Serenade, West Covina, wished to correct a statement in the minutes of February 4, 1976, as Councilman King had said he felt that 6 inches on either side was such a negligible variance that it didn't warrant that much consideration. Mr. Frank pointed out that it was not 6 inches but rather 1 ft. on either side. He said he felt there was some kind of undercurrent in the Planning Department because Mr. Koopmans already has the footing and the foundation dug and is ready to pour within 4 ft. of his property tine as though it is already in the bag. City Attorney Ftandrick assured Mr. Frank that if the variance was denied, Mr. Koopmans would receive a tetter from the City Manager advising him to remove this. Mr. Frank said he thinks he understands that the 4 points Mr. Kilgour mentioned involve health and welfare. He referred to the tetter written on December It to Mr. Koopmans with a copy to Mr. Frank, agreeing that if the 4 ft. setback was approved that a 5 ft. wait would be built at the south property line of tot 6 along the entire length of the residential structure. In talking with Mr. Kitgour's assistant, he found that the word residence" is not mentioned in the zone code book. The words dwelling" and garage" are used. He said that now his front apartment win be exposed to that 4 ft. variance with no buffer zone in between. He stated that if the variance was granted, paragraph 3 of the letter should read from the back of the dwelling to the forward portion of the garage" in regard to where the 5 ft. high masonry or plaster wall should be built, and not just cover the dwelling area. Mr. Koopmans stated that originally he and Mr. Boyarn had been willing to build a block wall, but since the case has been appealed they decided to eliminate the wall. City Attorney Ftandrick clarified that if the City Council grants the variance there wilt be some conditions of approval. He understands that the applicant, Mr. Koopmans, is opposed to paragraph 3 of the December 11th tetter and Mr. Frank is saying that, if granted, he feels that it is an essential condition and wants it clarified as to the exact location of the wall. Mr. Koopmans pointed out that after 3 months a minor variance becomes a major variance. He said that almost 3 months have gone by and a minor variance has been made into a major project and putting up the wait becomes another major problem of more expense to them. The minor variance becomes expensive and he does not agree to trade one thing for another. Councilman Waldo asked Mr. Koopmans how much the delay has cost and whether they had tried to borrow money to build. Mr. Koopmans said he and Mr. Boyarn had their own money and there is no loan on the property. The Bank of America on Amar in La Puente agreed to lend additional money if needed before completion, but the loan company in Baldwin Park would not talk to them about building units. West Covina said there was no money available for this area. Councilman McCaron stated that initially he had no objection to the 4 ft. setback, except that they were using 8 t. for a driveway that would be for use between both occupants of the property. If at any time a fence was put up between the two units, 8 ft. would be in- adequate to run a car or anything else to the rear lot. So now they have reduced the width of each building 1 ft., which gives 9 ft., enough to allow vehicles, especially trailers, to be stored in the rear yard; therefore, he said he has no further objections. Councilman Gregory said she had very seldom seen a garage that anyone could be proud of and she did not tike the layout of 4-car garages on both sides as it was like airing dirty linen at a11 times. She doesn't see that this kind of a development will be an asset to the community. She said she was not opposing the 4 ft., just the development itself. Councilman Waldo said there must be at least 10,000 structures with the garages in front in Baldwin Park and to object on that was not feasible. He would want his car parked in the front and this would leave plenty of room for storage for recreational vehicles in the back. Mr. Koopmans explained that the garages are not facing the front and that the garage has a big window in front so that it looks as if it is part of the house. As there was no further testimony in favor of or in opposition to the appeal from the decision of the Planning Director on a proposed minor variance Case No. MV-40-B), Mayor Hamilton declared the public hearing closed. Council discussion followed concerning the conditions and masonry wall in question. City Attorney Flandrick summarized that the applicant, Mr. Koopmans, was objecting to putting up the wall at all, while Mr. Franks wants a wall running the length of the entire building structure in front of the garage and to the rear of the whole structure, and that any motion to grant should include reference to those conditions, as well as findings and facts to justify it. t Director of Planning Kilgour said that the block wall was originally intended to be just adjacent to the residential units, not adjacent to the garage. This was a condition that was worked out in the office with the applicant and'Mrs. Frank. The wall was to be about 30 ft. long and 5 ft. high and be used as a buffer. There is an existing wooden fence on Mr. Frank's property line which runs the length of the property and in light of this Mr. Kilgour said the new masonry wall may not be needed. Mayor Hamilton said all of the conditions would have to be approved or eliminate No. 3. He didn't see why the builder should be burdened with building a wall if there was already a fence there. REOPEN PUBLIC HEARING. M/S/C: MC CARON/MALDO. There were no objections. Mr. Frank explained that he had 3 closed garages, side by side, and an apartment that faces the street in front. He has a 7 1/2 ft. setback from his wooden fence on the side and a patio area there with a 5 ft. sliding door to get out on the patio. He said that area is where Mr. Koopman's garages will be. Behind that apartment are the three garages that are hidden from the street and are 5 ft. from the property line. The apartment behind that faces the driveway and there is another apartment that is at right angles to the second apartment and its door looks down the driveway. He stated that his fence is in good repair as fences go. He felt the second fence was necessary for the health and welfare of his tenants and that it would serve as a two hour or three hour fire wait which he said was required in any other city as you move back off the setback line. He stated that a house had burned down on that piece of property and his fence had been burned, although the house had been set back a lot further than the proposed building. Mr. Kilgour recommended that if the Council was planning to take positive action and consider the burden of proof, the following should be included: access to rear yards of 50 ft. lots is necessary to provide full use of the property; other properties in the area are constructed less than 5 ft. from the property tine; the development conforms to the General Plan, and will contribute to the economic health and welfare of the community. City Attorney Flandrick suggested that if approval for the variance was moved that Mr. Kilgour's statements be incorporated as finding and fact and indicate that the conditions of approval would be 1, 2, 4 and 5 of the letter of approval. APPROVE THE ZONE VARIANCE AS REQUESTED BASED UPON THE FINDINGS OF FACT WHICH INCORPORATES REFERENCES BY THE PLANNING DIRECTOR THAT THE CONDITIONS OF APPROVAL OF THE GRANT OF THE VARIANCE BE THOSE SET FORTH IN THE DECEMBER 11TH LETTER, ITEMS 1. 2, 4 AND 5. M/S/C: WALDO/MC CARON. Roll Call. Ayes: WALDO/ MC CARON/HAMILTON. Noes: GREGORY. The motion carried. Councilman King was absent. February 23, 1976 Page 5 PUBLIC HEARING CLOSED APPROVE ZONE VAR. AS REQUESTED BASED UPON FINDING OF FACT WHICH INCORP. REFS. BY PLANNING DIR. THAT CONDITIONS OF APPROVAL OF GRANT OF VARIANCE BE THOSE SET FORTH IN DEC. 11 LETTER. ITEMS 1, 2 4 AND 5. It was noted that Item 4 should be corrected to state 9 ft. reciprocal access easements rather than 8 ft. Councilman Gregory asked to have it reflected in the minutes that her no vote was not just because of the front garages which she finds objectionable, but also because of the reciprocal driveway which has always caused problems in the past. 00- C1ty Manager Mitchell said they have one quote on life Insurance coverage, but the others haven't sent theirs back yet and there are not enough of them in to justify an evaluation. He said they had spoken to the PERS office in Sacramento regarding the individuals on which they are having difficulty in getting coverage and they are requesting that Blue Cross provide those in question coverage for another 30 days. He thought there was a reasonable chance we might get that, but said there is no guarantee as. they didn't have a chance to get back a response on that. He said inquiries are being made on dental insurance but they are not pushing that. Mr. Mitchell said no solution has come up for coverage for the Planning Commissioners. One member was covered by Ross Loos in the past and they will continue to cover him while Blue Cross will not. The Council can be covered for hospitllization as soon as their memberships are processed. CITY MANAGER AUTHORIZED TO OBTAIN MAJOR MEDICAL & HOSPITILIZATION COVERAGE FOR COUNCIL MEMBERS. M/S/C: WALDO/GREGORY. There were no objections. C.M. AUTHORIZED TO OBTAIN MAJOR MEDICAL & HOSP. COVERAGE FOR COUNCIL MEMBERS City Manager Mitchell said they are checking three or four brokers to try to cover employees for life insurance, since individuals can not keep life insurance under the old coverage. Councilman Waldo requested that City Manager Mitchell investigate life insurance and negotiate with a new company so that when a life insurance policy is obtained the individual may convert that policy to a private policy and pay for it himself, whether at any time the City or the individual terminates the policy conversion privilege). This is for the benefit of an employee who is uninsurable and may have no other insurance. City Manager Mitchell said that he would investigate that kind of coverage, but there would be a lapse of coverage between 12:01 a.m. March 1, 1976 and the time Council acts upon it. Finance Director Haltoway said that his understanding of what Councilman Waldo is suggesting is that the City Manager investigate the possibility of getting a group plan and making the individual responsible for the payment of the policy, rather than the City paying for it. Mr. Mitchett said that normally an insurance company will not take it this way as they prefer to pay for all employees on a group insurance plan. Mayor Hamilton said he would not want to make an issue of the loss of the $3000 life insurance coverage by transferring to PERS, because both associations had agreed to it and the Council had voted for it last Council Meeting. CITY MANAGER TO INVESTIGATE LIFE INSURANCE COVERAGE TO PERMIT INDIVIDUAL COVERAGE WITH CONVERSION PRIVILEGE. 00- City Manager Mitchell said Mr. Hale had just informed him that Captain George S.
