Invocation was given by Pastor Aureiliano Flores, Iglesia del Redentor. Mayor Pro Tern Kitchen pointed out that the Consortium meets sometimes several times a week and demands daytime hours and asked if there was any other Councilman who would like to fill the other vacancy. Discussion followed that it was probably not in the By Laws that only elected Councilmen could serve but that attendance was mandatory. Councilman Blewett said there would be about $2 Million involved and that it was important that Baldwin Park got its fair share. He stated he knew there were going to be several job slots in the community and it would be incumbent upon the members from Baldwin Park to help determine where those job slots are going to go. Appointees should attend meetings regularly. Councilman Hamilton said that he would serve, but could not always attend the meetings. He suggested that Leo King be left on the Consortium. Fetter demanding a written statement in answer to requests from E. Phi Hip Hale and Robert Mitchell indicating the reasons for their dismissal Acting City Attorney stated that he had not responded as the letters had been addressed to the City Council and the City Council had indicated by a majority that they did not wish them to serve. He said there was nothing under the law that states that a reason for discharge be given, but that Mr. Fe.ffer is probably entitled to the courtesy along the lines of how each Council member voted and felt on this matter. The City Employees Association have recommended Mr. William Smith and Mr. Robert G. Honken letter in of field I files). Mrs. Balkus read the letter and explained that 5 members serve on the Personnel Board of the City of Baldwin Park and that 2 members are Council recommendations, 2 are employee recomnendations and the 4 recommend the 5th one. There were no objections. 00- Director of Public Works Lathrop referred to a Traffic Committee Report which requested red curbing of 80 feet along the easterly curb of Syracuse Avenue south of Ramona Boulevard, as the traffic backs up on Syracuse Avenue due to cars parking at the curb up to the intersection and cars are unable to approach the intersection to turn right when cars are waiting to turn left. The Traffic Committee recommended that the red curbing be approved by adoption of the Resolution. NO. 76-29 ADOPTED Director of Public Works Lathrop referred to a request for approval of sidewalk construction adjacent to the curb submitted by petition signed by alt residential property owners on the east side of Puente Avenue south of Howellhurst Drive. He said that last year the City Council had established that the City should have a policy regarding the location of sidewalks and had directed the Planning Department and Planning Commission to make a study of this. The study is now in progress and will be submitted to the Council soon. He said he would inform the property owners that at present the City will allow them to construct sidewalks next to the curb but that after the City Council policy is established they may be required to construct sidewalks also on the property line. They have been required to leave a tree well if constructing next to the curb. He said three property owners have since taken out permits to construct sidewalks along the curb. He recommended that the Council take no firm action at this time on the location of sidewalks but that property owners may be allowed to construct sidewalk adjacent to the curb with the provision that they understand that sidewalk adjacent to the property line may be required of them following the recommendation of the Planning Department and Planning Commission. Councilman Hamilton said if they have room he would be opposed to constructing sidewalk next to the curb because it is inconvenient for people walking or women with baby buggies. continued) PETITION REQUEST FOR APPROVAL OF SIDEWALK LOCATION, PUENTE AVE. Councilman Btewett agreed with Councilman Hamilton regarding the difficulty in walking when sidewalks are not constructed uniformly. He said he would tike it noted by Mr. Kilgour and the Planning Commission what the comments of the Council were and that he thought it would be advisable to define a policy. SIDEWALKS MAY BE CONSTRUCTED ADJACENT TO CURB WITH PROVIS- ION SIDEWALKS MAY LATER BE REQUIRED ADJACENT TO PROPERTY LINE 00- Director of Public Works Lathrop referred to a petition signed by residents of Monterey'Avenue south Of Palm Avenue regarding a walkway which extends from the cul-de-sac at the end of the street into the school district property. Signers of the petition are requesting that the walkway be closed as young people using it are causing numerous problems while passing through. The walkway is actually a covered drainage culvert. He said that recently the Acting Assistant City Manager Philip Sexton had talked to representatives of the home owners and that they had stated that they would see if they can not work out the problem among themselves and that if they fail to do so they will again request assistance from the City. He said that the Staff investigating the situation have recommended that the City assist by placing chain link fence across the culvert between the two existing sections of the fence, thus creating a physical barrier. The cost of erecting the chain link fences would be approximately $40.00. Councilman Blewett suggested giving Mr. Lathrop carte blanche to handle the problem in whatever manner he deemed necessary. Councilman Hamilton asked for clarification regarding 20 signatures on the petition which indicated to him that the property owners were requesting a closure. Discussion followed with Mr. Lathrop reiterating that the homeowners will attempt to handle the problem themselves and may be coming back for assistance from the City. DIRECTOR ALLOWED TO SOLVE PROBLEM HOWEVER HE DEEMS NECESSARY 00- Chief of Police Adams referred to the Propane Conversion bid package and said the various bids had been evaluated since last Council meeting. He stated that Globe Gas and Empiregas of Pomona bids were tied at 27.9 cents per gallon of propane but Globe Gas provided for a flexible rate based on their own actual cost and spelled it out in detail how they would arrive at this cost, while Empiregas left a sliding scale without the possibility of reduction, although they talked of passing along whatever the manufacturer would charge them in the form of an increase. He stated the total package amounts to $13.445 plus $806.74 for the 6% California sates tax. He requested that the total amount of $14,252.34 be an appropriation from the unappropriated reserve for contingency account as the conversion system had not been considered when the budget was prepared last year. He stated that more than this amount can be cut from the current budget because the projected fuel costs have been based on price alone and just the savings between the 27.9 cents for propane and over 60 cents per gallon that would have to be paid for unleaded fuel for new cars is about half. He said the fuel bill for patrol cars alone runs about $20,000 a year. Other cities have advised against using the dual system and the advantage of using a total propane system is that alt smog devices on the vehicles can be removed, thereby boosting their power. He stated that many cities have since adopted the same type of Ordinance. It is an Ordinance that makes it a misdemeanor under the Municipal Code for anyone to knowingly and maliciously make a false report of any employee's conduct in relation to that complaint. He referred to the additional statement without a reasonable belief in the truth thereof" in the Ordinance and said that the reason it was put in there was because the young people who make the complaints will te11 their parents and their parents wilt come forward with the complaint with the honest belief that their child has been abused. He said the citizen has the protection that they need by adding the two statements, knowingly and maliciously" and without a reasonable belief in the truth thereof" and so do the policemen, the Public Works people and a11 employees of the City. He stated that if the Ordinance is in effect, citizens will not try to get out of criminal charges by bringing a false report against any employee of the City. Councilman Hamilton asked for a comment by Acting City Attorney Ritchie about whether this was proper within the statutes of the laws of California. continued) ORD. NO. 729. He said he shared the Chief's concern about complaints that are being made and the Council will have to balance the question of unduly inhibiting the citizens in making what they consider are valid complaints. He stated if the'Ordinance is adopted it would have to be administered with caution.' Councilman Hamilton asked if a citizen would be informed of the Ordinance if he came in to make a report. Mr. Ritchie said if he were not informed, it would be in violation of the Ordinance which says Every person who, having been advised of the provisions of this section, signs a written statement declaring the contents thereof to be true Councilman Aguilar inquired if a person came in and truly believed that he had a complaint when he made it and after an investigation it turned out that nothing really happened would he be liable under this action? Chief Adams said that it would be very hard to prove if he knowingly and maliciously" brought the complaint without knowing it to be the truth," but stated they would probably prosecute with proof that someone had willfully tied or been forced to lie. In the majority of cases it is a protection for the Police Department, and when someone comes in with the honest belief that there has been a violation, he said they try to go back to them and explain what really did take place and what the findings were whether the officer was going to be disciplined or whether they felt he was acting within the scope of his duties so if they want to take further action they wilt have to take it within the civil courts. Councilman Blewett said that he had mixed emotions, recognizing the problems of the Police Department, but that he hoped it would not discourage a good, honest citizen from making a good, honest complaint. He stated that if the Council granted the Police Department this power they would be placing more faith in their handling the complaint really well. He said he would probably vote for the Ordinance because he thought they would administer it fairly but that it scares him if not handled properly. Chief Adams agreed that he would be the first to ask to rescind the Ordinance if it turned out to be a bad Ordinance. He referred to an order he had issued in 1974 which outlines the manner in which they will investigate a11 citizen complaints. He said Special Order 74-7 is in effect right now and every complaint is investigated that comes in. He explained that the Police Department is the department most involved in dealing with citizens under adverse conditions but that it could be a planning man in the field trying to enforce a zoning ordinance or a building inspector or any other employee of the City where a citizen might try to get around something by bringing a complaint against that person. He said he must handle each complaint as it comes in, before it is dispatched to an investigator to follow up, and that it is important to maintain one or two people which he presently has, to do nothing but this type of investigation. He feels these men have done an excellent job in cases so far and that they have recommended that men be disciplined or that the personnel have acted in a very proper manner and laid out specifically why the complaint is false. He said so far there have been no adverse problems after going back to the person who has made the complaint and explaining the findings. He said complaints run in cycles and that they may get as high as 7 or 8 a month or go a couple of months with none. He said an investigation is conducted even if someone drops charges after they have been made, because he wants to know whether he has a man out there that is not treating the citizens they way they should be treated. Jn that case, he stated he would not file charges under the Ordinance if he found the charges were groundless and confirmed that in any event if any charges were brought under the new Ordinance in his department, they would be brought only after a decision by Chief Adams. Councilman Kitchel said that in this day and age there are many forces in play that are attempting to dis- credit the Police force to the point where they are totally ineffective and he believes this type of precautionary measure must be taken to protect their rights or that of any other public official. RESOLUTION NO. 76-30, DENYING A ZONE VARIANCE APPLICATION CASE NO. ZV-309; APPLICANT: C. LES PERANCE) RESOLUTION NO. 76-30 ADOPTED AND FURTHER READING WAIVED. M/S/C: BLEWETT/AGUILAR. There were no objections. 00- City Clerk Balkus stated that at the meeting of April 7, 1976 the Council made appointees to various organizations and that Councilmen had been appointed to Civil Defense, Area D. She said that for some years Glint Crawford had been the Deputy and the Code reads that the City Manager is the Director of Civil Defense and that he would have an assistant. She suggested adoption, with this change, of RESOLUTION NO. 76-31, AMENDING RESOLUTION NO. 76-23 DESIGNATING THE CITY'S REPRESENTATIVES AND ALTERNATES TO CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS ADOPT RESOLUTION NO. 76-31 AND WAIVE FURTHER READING. M/S/C: BLEWETT/HAMILTON. There were no objections. 00- Councilman Aguitar stated that he had been asked to make a trip to Sacramento but that when he had asked Mr. Sexton for an advance of $340 Mr. Sexton had said there was no money for traveling expenses for Council- men and that he should spend his own money and come back and be reimbursed. He suggested having a fund set aside for Councilmen. Councilman Btewett said that was not entirely correct as both Mayor Waldo and Mr. Sexton had received advances to travel to Washington, D.C. and that Councilman Aguilar was co-equal to them and should have been entitled to a travel advance for City business. Acting City Manager Sexton stated that the fund used for this purpose contains only $500 and appears to not be sufficient for expenditures. Occasionally it has been necessary for City business to be carried out on personal funds which have been reimbursed. Director of Finance Halloway stated this fund is a Revolving Checking Account which contains a $500 balance and is replen- ished with' the Warrants every Council Meeting. There was only $50 left in the fund when the travel money was requested so a check could not be written. He said he had discussed the matter with the auditor and he had recommended increasing the balance of the fund, as sometimes it is depleted when money is requested. continued) RES. The account had contained $500 for years and it was decided to increase that amount so that any employee who had prior approval from Council to travel could receive an advance. M/S/C: HAMILTON/ INCREASE REVOLVING FUND FROM $500 TO $1000 00- Councitman Blewett stated that the public relations man on board had been requested to come back to the Council with recommendations on a newsletter the cost breakdown and when and how it is to be done. He said he had strong feelings on guidelines he wanted implemented into the newsletter to maintain its viability and not destroy its credibility. He said the first offering of the public relations man seemed to be more in the nature of political buildup than straight public relations for the City itself more for individual advancement than City advancement. He asked when it would be brought before the Council to establish policy. Mayor pro tern Kitchel asked Mr. Sopicki if it would be possible to put a newsletter proposal before the City Council at the next regular meeting for discussion and possible implementation of guidelines. Councilman Btewett said that among the things he would tike to see included in the newsletter were 1) that no City newspaper should go out within 60 days prior to any election within the City and a couple of other suggestions which he would list to maintain neutrality. Mr. Sopicki agreed to present a newsletter proposal at the next regular City Council meeting. CITY NEWSLETTER LEO SOPICKI WILL PRESENT NEWSLETTER PROPOSAL AT NEXT REGULAR C.C. MTG. 00- Tony Serghides. 4323 Fit hurst, requested a copy of the report from Chief of Police Adams on the propane conversion recommendations. Mr. Serghides was told that a copy would be available for him. 00- Tom Carpenter, 4346 Jerry, said that in his opinion the adoption of the Ordinance regarding the making of false statements or reports to city officials put the people in jeopardy and scares them off. He said that certain Council men have been glorified in the papers; the people have been cut down on their time to speak; the packets have successfully been cut off and yet the Council wants to communicate with the people. The railing has been torn down in the Council Chambers but he said it is all meaningless. He suggested putting a loudspeaker out in the square and then just letting the people listen because no matter what they say they are paid no attention. Now with this ordinance just rammed through, he said,everybody is being threatened and they will just be fed the newsletter that will glorify everyone of them and they are going to tear the City down so low that people will have no faith in the Council at all. 00- TONY SERGHIDES REQUEST FOR REPORT FROM C.O.P.
