Director of Finance Halloway said the major item was for poloroid film, bulbs, cubes and 8 x 10 paper. Chief of Police Adams said they use colored polaroid film ort an assault or any injury for evidence in court. They are money ahead by buying polaroid because regular colored film has to be sent out to be processed, he said, and that they use a pack or two a day. He read the history of the subject properties and surrounding zoning and land use and stated the by approving the zone change from C-2 to R-1, both the General Plan and the Zoning Ordinance will be made consistent as required by State Law. The Planning Commission has recommended that this zone change b^ approved. He referred to the attached Land Use and Zoning Map» proposed Parcel Map #890, and statements from the applicant about the intended use of the property. Joseph Battaglia, 9832 East Rush Street, El Monte, apresenting the applicants, said the basis for their \ equest is that they have immediate use for the property / n the R-1 zone. He said this zoning is in conformance ith the General Plan and the Planning Commission recom- nds approval. They have specific plans as evidenced by he parcel map filed and have accepted the requirements imposed on the property by the Planning Commission. Councilman Blewett asked if this development was planned similar to th6 development on property at Merced and Elwin. Mr. Battaglia explained that this is a cul-de-sac plan while Merced was a T" shaped plan, but it would be the same type of single family housing. As there was no further testimony in behalf or in objection to Z-392, Mayor Waldo declared the Public Hearing closed. Councilman Hamilton had hoped this property would develop commercially, but it appears to be too far from the down town area. The owner pays taxes and has a right to develop For the benefit of the City he concurred with the Planning Commission's recommendation. Councilman Kitchel concurred. Councilman Blewett asked whether he should abstain on this case as he had done business with this firm, but not for over a year. Acting City Attorney Pitch ie said that since it had been over a year. Code Sections 1090 and 1091 and Proposition 9 would not apply. Mayor Waldo asked if it was strictly financial when you decline to vote. Mr. Ritchie said yes, unless there was some other reason which would affect an objective decision. A reason for abstaining is not required, City Clerk Balkus read by title: ORDINANCE NO. 730. M/S/C: HAMILTON/BLEWETT. Roll Call. Mayor Waldo abstained. There were no objections 00- It was the time and place fixed for a public hearing on Modification of SP-3 A modification to add or delete such rights-of-way as necessary to accomplish surface vehicular access to properties within the subject area described as: The area bounded on the south by Los Angeles Street, on the east by Merced Avenue and on the west by Walnut Street. The northerly boundary is parallel to and 580 feet northerly of Los Angeles Street. Initiated By: Planning Comnission. Publications, mailing and postings had been accomplished. There were no written protests. Mr. Kilgour reviewed the Planning Report in the agenda, In 1966 the City, through tax sale. acquired a 30 ft. strip of property at the rear of Mr. Delianedis" property at 13735. 1373E?s. 13735 3/4, 13737. and 13737^ Los Angeles Street, for the purpose of a recommended alley as indicated 1n SP-3. A dwelling unit was constructed in 1958 upon the dedicated but unimproved right of way. The Planning Connission recommended approval of the modification and of selling the property back to the owner. Mr. Delianedis said he acquired the property in 1962 and has paid taxes a11 this time, unaware that there were two parcels. He was selling the property when the buyer, upon measuring the land, found that the house was on City property. He had not been aware that he was not paying the taxes on the back portion as he thought it was all one parcel that he had purchased. The back portion the City easement) was sold for delinquent taxes. As there was no further testimony either in favor of or in opposition to SP-3, Mayor Waldo declared the Public Hearing closed. The recommendation was in three parts: 1. Format of News Letter 2. Frequency of Publication 3. Determination and definition of policy for content. The decision on the format is a budgetary one. He presented mock-up of formats for counsel's selection. INS. He said No. 1 would be the most effective; No. II would reduce costs but would only reach about 11,000 homes and would include Irwindale. As an insert, it would be competing with merchants tabloid inserts. This could be placed in grocery stores. He said No, III would be Treasure Chest produced. It would be the least effective, being a throw away and does not reach every household. It should be determined whether publication wilt be bi-monthly or quarterly. Quarterly would be historical and old news. Bi-monthly is the most effective. A summary of the newsletter could be included and published in Spanish. In summary. Council would decide on formats 1,2 or 3; frequency, content and policy guidelines, and a decision on funding. Discussion followed on costs of each option, bi-monthly versus quarterly, funding and part bilingual. Councilman Blewett questioned personnel and Mr. Sopicki said this would vary from time to time depending upon content, pictures, etc. Councilman Hamilton favored bulk mailing bi-monthly about $36,000 yearly but did not see how the City could afford this. He would consider quarterly. He approved a newsletter but felt the City could not afford this. Councilman Aquilar did not favor quarterly distribution. In answer to Councilman Kitchel, Mr. Sopicki stated Option I quarterly would cost $9,200 and bi-monthly $13,800. Councilman Kitchel favored bi-monthly distribution. Discussion followed that an attractive newsletter is helpful to a City. Councilman Hamilton felt a'newsletter could be put out in house as the City cannot afford a publicist. Discussion followed that the publicist was hired to analyze the feasibility of a newsletter and that the individual can be used the other 50% of the time in other areas. Councilman Hamilton objected to the creation of a new department and spending more money. He objected to hiring a man when the funds are not budgeted. He questioned what would be cut in the budget and where the money would come from. He might consider the position after the budget is presented if the cost is justified. He questioned whether this position was payment of a political debt. Mayor Waldo proposed that the Council donate their monthly salary to defray this cost. Councilman Blewett said we would not object, but he questioned the Mayor's source of income which does not show in the disclosure of assets. Councilman Kitphel compared this cost to the money which has been expended for a proposed City Hall for which there is no method of financing. Councilman Blewett concurred, but agreed that the City needs a newsletter. He proposed a newsletter similar to Lakewood's, 4-page tabloid, book stock, print 14,000 with 10,000 distributed through newspaper and 4,000 put in stores, produced bi-monthly. Discussion followed concerning the number to be produced and the distribution method. Councilman Blewett said inserts in the Treasure Chest are $28.00 a thousand and $25.00 a thousand in the Tribune. Councilman Kitchel favored Option I, using bulk rate mailing on a bi-monthly basis, byt would compromise on the quarterly basis. Councilman Hamilton requested clarification of costs on Option I. He said the City mails once a year for Recreation & Parks and suggested they pay their fair share. He asked that the motion be amended to Option II on book stock which can be more easily expanded, using bulk mail on. a quarterly basis. Mayor Waldo suggested adding bilingual and possibly including the Chamber of Commerce in the newsletter to defray cost. AMEND MOTION TO SUBSTITUTE OPTION II. Councilman Blewett stressed that present staff can handle the newsletter. He did not believe a City the size of Baldwin Park should hire a Public Information Officer. Councilman Hamilton agreed. Councilman Blewett asked 1f this would be revenue sharing money, were we over budget for the year and would we be taking from any reserves of the City? Mr. Sexton said no" and referred the question to Mr. Halloway who stated that there were savings in the present budget this year. Discussion followed regarding news articles and Councilman Blewett said he preferred to know what is going on in the City artd not have to read it In the paper^ Roll Call on the motion. The motion carried. 00- Acting City Manager Sexton requested ratification of the escrow agreement executed on April 28th and authorization to purchase the church) Community Center. Title report, closing costs and relocation matters will be resolved during the 30-day escrow period. The $118,000 from the Federal Government was transferred to Bank of America on April 28. CENTER 00- Mr. Sexton said that as a result of the Council/Planning Commission meeting, Mr. Lathrop had a report on property maintenance and public nuisance abatement. Mr.'Lathrop said Public Nuisance Abatement was discussed at the joint meeting. The Public Works Department initially conducted the program on a routine basis up until about two years ago. Weeds, trash, cars, etc. were declared a Public Nuisance. The property owner was given notice to abate and if not, there were hearings and the City abated the nuisance. This program was reduced to a low level. The staff is taking steps to increase the program and is presently studying staff and financial requirements to implement the program. Councilman Aguilar questioned the owner's ability to pay the cost and Mr. Lathrop said the owner would be responsible, but once the HCD program is implemented, some assistance will be available for property nuisances. Councilman Blewett said the majority of Public Nuisances will be rental occupied. People's rights regarding entrance to the property should be observed. The City of South El Monte, through Mr. Ralph Esparza is developing a HUD program, and he felt information would be available from him relative to use in this City. Councilman Hamilton concurred regarding rentals and stressed that the enforcement officer in the field must use discretion and the City Manager should set up a procedure whereby Constitutional rights are not violated. Vacant rental homes should be inspected before being reoccupied. Mayor Waldo said that concerning cities that have made some headway with redlining" they found there were fewer and fewer out of town owners. More people are buying homes and fixing them up now that they are able to get conventional loans. Mr. Lathrop explained that to fully implement the Property Maintenance Ordinance it will be necessary to amend the Code. Also, there must be an amendment to differentiate between a minor and a major nuisance. 00- Mr. Sexton said there was a Team Development Workshop for City Manager Mayor/Council members near Monterey on June 3 through 5th. He asked if there wasn't a Western Law Institute that handles law suits. Mr. Ritchie said there was the Western Center on Law and Poverty, but he did not know if we would qualify. He suggested waiting for the reply from Rutan & Tucker and forwarding this to Western Center, asking if they could help this cause. 00- Councilman Kttchet said it should be established as to a time and place to discuss who is to participate on the various committees. Discussion followed and a tentative date of May 24, 1976, 7:30 p.m. was set to consider at least two commissions. 00- Councilman Kitchel said the City Attorney had been suspended and no further action taken. f Mr. Ritchie said the action to suspend was at the request of Associate Attorney Barbosa to allow Mr. Flandrick an opportunity to express his views on the subject. Mr. Flandrick sent a letter expressing regret at Council's action and indicated that his firm stood ready to serve the City, but did not resolve the question. He did not tender his resignation, so it is still pending. The action to clarify the status would be to reinstate him or terminate him. TERMINATE ROBERT FLANDRICK AS CITY ATTORNEY. Counsel representing Rudy Marquez, DENNIS CASSO REP. owner of Country Liquor Store, 12744 Ramona, was RUDY MARQUEZ RE concerned about construction of a center divider on LEFT TURN POCKET Ramona Blvd. without a left turn area in front of Mr. Marquez1 ON RAMONA BLVD. store. He presented a drawing of the area. Without a left turn area his business will be seriously hampered. Today, due to construction, his gross was $100 less than normally. He presented tetters from Mr. Snyder of In-N-Out Burgers and from Mr. Cotwick who had a liquor store on Francisquito. Both letters indicated that any prohibition of ingress or egress does serious damage to the gross income of a business such as Mr. Marquez. Mr. Marquez has been in business at this location 21 years and a resident 10 years. He has 200 resident's signatures indicating a desire for a left turn area. Signatures were not presented) Most of his business comes from the east, requiring a left turn. At 5 p.m. cars would have to proceed west to Syracuse for a U turn back to the store or continue south to a poorly tit alley. Ramona traffic off the 605 Freeway eastbound makes a U turn almost impossible. He has brought the City revenue sales tax, the business is a convenience to residents and his business will decrease. At Syracuse and Ramona the divider strip was removed as the Service Station lost business. The divider will create a hazard and be inconvenienced. Director of Public Works Lathrop said Mr. Marquez had contacted him in September, 1975 concerning the median. It was explained that the median is continuous from Francisquito to the East city limits. There are no median breaks other than street intersections. A study of the Service Station determined that the station was basically Freeway oriented and there was a traffic hazard involved with traffic that was westbound trying to get into the station. This was discussed with the State Division of Highways and the Federal Highway Administrators, who are providing funds for this project, and the left turn into the Mobil Oil Station is being removed. Mr. Marquez* property does not meet traffic engineering standard criteria for a left turn pocket within a raised median. The property can be reached by a left turn at Barnes through the alley or by a U turn at Syracuse. Mr. Lathrop further explained that this project is 83% Federal Highway funded. A mid-block median break will cut funding 50%, $34,000, and it is not known whether the Federal government will approve a change order. If approved, the change order would cost an additional $1,500. He said if a median break was provided for this property it would be necessary to provide a median break for others. He said the Staff cannot recommend that a left turn pocket be provided. Mr. Dennis Casso said he took exception to the comments on the change order and toss of Federal money. He said, to his knowledge, this would be an exceptional circumstance and would not result in loss of money although it could cost $1500. He questioned the traffic study which general- ized that this would not be a hazardous traffic situation and the suggested use of the alley. He felt Mr. Marquez deserved more attention than just saying the property does not fit a survey pattern and that the U turn would cause accidents. There is also the problem of egress as well as ingress and there is no way to reach this location across town as the railroad tracks are across the street. Mayor Waldo said if we decide to give the man what he wants and enlist the aid of our Congressman and are not successful and wind up $30,000 + in the hole, is Mr. Marquez prepared to pick up the deficit? Mr. Casso answered no". i Mayor Waldo said the median and street realignment at Ramona/Pacitic/Sterling Way had increased his business therp and there were less accidents. They had been concerned that they would lose business, g Mr. Casso said the point is, there is no planning as to safety factors the way it i"s planned now. Councilman Hamilton had visited Mr. Marquez1 place and understood his concern*, however the divider had not hurt Councilman Hamilton's business and he did not believe it would hurt Mr. Marquez1business. If the alley is dangerous then we can tight the alley. The big market on Ramona has hundreds of cars a day and cars have to go to the intersection to get there. The divider did not hurt his business nor the hardware store either and he could see no reason to make an exception for one business. We would set a precedent. Mr. Lathrop said Syracuse would not be signalized and Councilman Blewett said there was no way he could make a U turn there with his car expect ally at 4 or 5 in the afternoon. COUNCILMAN BLEWETT MOVED THAT THE CITY MANAGER AND THE DIRECTOR OF PUBLIC WORKS BE DIRECTED TO GO TO THE FEDERAL AUTHORITIES AND TELL THEM WE WOULD LIKE TO PUT THE BREAK IN MEDIAN AS WE THINK IT IS IN THE BEST INTEREST OF SAFETY AND WE TRY TO WORK OUT AN AGREEMENT WITH THEM AND IF THEY ARE UNABLE TO THEN CONTACT OUR CONGRESSMAN'S OFFICE AND HAVE THEM MAKE THE CONTACT IN OUR BEHALF. In answer to Mayor Waldo, Mr. Lathrop stated that the pavement was broken out today and was being hauled away and the crew wilt start pouring curbs before the end of the week and he thought the median would be curbed in the next ten days or less. If it is not allowed by the federal authorities there is a chance we may not get any federal funding. If the contractor is told to proceed with the rest of the median and leave that part undone, it will cost extra; if they have to come back back and pour the curbs, it will cost the city extra dollars. In answer to Mayor Waldo, Mr. Marquez said he would not want to see the City lose the $34,000. 00- Michael Dargus, 13260 Francisquito, objected to the Public Information Officer. If you spend $30,000, that would pay two policemen who are needed more. Other cities in the Valley use the staff to handle public information. We had a newsletter in 1965 and it was discontinued in 1966 as it became a political rag and that's what this wi11 turn into. He said it would not be necessary to create a new city image if a bad image had not been created by a group with garbage pickers. The hiring of a public information officer is paying off a political debt and he was concerned that the next budget would go to $1.00 on property taxes. He stated that a large staff was never mentioned by the Director when he appeared before the CRA Committee. The referendum was a mandate for 19 acres, not the whole city and he felt there would be more districts. MICHAEL DARfillS 00- Gloria Zook, 4817 North La Rica, noticed Mrs. Igna in the audience and understands she was recently on T.V. She is aware of Mrs. Igna's business and the police problems but she questioned if the push to clean the property up again had anything to do with the fact that several months ago you were pushing this property to a former Councilman and City Manager as a new home for our only new car dealer, under CRA? Mayor Waldo said no." Councilman Btewett said many years ago he had shown this property to a Toyota dealer but the proposal was rejected as access is not good. Regarding the T.V. coverage, this was instigated by a lady who wrote a tetter to Channel 7 they contacted the City. The City did not initiate this. 00- Tom E. Carpenter, 4346 Jerry, said medians were not needed. They create problems and cost taxpayers money and require maintenance. He objected to a newsletter which the City cannot afford. Ten dollar agenda packets cannot go out of the library so the people can know what is going on. He said money is being spent like it is going out of style and he referred to Warrant No. 4900 for Mr. Sexton $702.91. He asked if Council was aware of what they approved. Under Fair Political Practices Act sales people with contacts with elected officials are very limited on entertainment expense. He felt this was morally wrong and that an accounting would have to be made to the taxpayers. He stated he would check other expense accounts. 00- Joe Cale, 4457 N. Maine, approved of the newsletter concept as people miss what is in the newspaper. He felt the money could come from other areas in the budget for instance median maintenance. He said medians are not necessary and some merchants have lost business due to them. Money for the newsletter could come from revenue for permits on trucks delivering in the City. Baldwin Park Blvd., holds a certificate in Labor Relations from Cat Tech University and has been an employer. A man cannot do a job when he is continually criticized for expenses. Compliment the employees we have. It wilt be difficult to recruit employees with the reputation the City is getting. She was also surprised at the rudeness and the firing of employees whereas Council- men newly elected have 3 months before action can be taken against them. They did not give the people a chance. It seems like they are following Mr. Waldo and not doing their own thinking. Money for a newsletter was so easily allocated. It could have waited until the new budget. A newsletter is for communication and communication is a two way street, not for just telling people what you think is going on. The county projects that the number of animals captured during 1976 amounts to 8,184 22 animals a day. We would not have complaints from citizens if they were capturing that many animals. He suggested study of the problem and that a decision be made at the next meeting. Councilman Btewett suggested a Committee be appointed to study this; possibly a Mid Valley Consortium would be the solution. Other cities are having similar problems and possibly the City Manager could contact them and find a solution. Councilman Hamilton suggested that the City Manager contact other cities regarding a consortium. The City Yard property being acquired would be an ideal spot for a pound and if other cities participated we could build a pound. He requested a report by the next meeting. 00- Councilman Blewett asked for a report from the Acting City Attorney on setting up the direct election of the Mayor and presenting that to the voters of the City. Mr. Ritchie said he would make a report. 00- Councilman Blewett asked for a report on the progress of advertising for the City Manager and Assistant City Manager positions. Mr. Sexton said the ad was submitted to Western Cities and other trade journals, soliciting resumes for City Manager. The Assistant would be recruited by the City Manager. 00- Councilman Blewett asked for information on the pending law suit for sales tax reform and Mr. Sexton said information received from Mr. Daht had been forwarded to Council about a week ago and that there would be a report in about 30 days. His conclusion was not conclusive, but seeking to change the law with the funding expressed by cities did not appear to be sufficient to carry this through to its final con- clusion, and if it was done they were pessimistic as to the end result but this could change when we receive the final report. Councilman Blewett sa-id the legal fee was estimated at about $40,000 50 cities at about 3( per capita) and he wondered what they considered a sufficient legal fee. Mr. Sexton continued) C. M.
