OF A CONTRACT WITH THE B.P. POLICE ASSOC. RESOLUTION NO. 76-56, ADOPTING A BASIC SALARY PLAN UNCLASSIFIED SERVICE POSITIONS) RESOLUTION NO. 76-56 ADOPTED AND FURTHER READING WAIVED. M/S: KITCHEL/AGUILAR. Councilman Btewett stated he opposed the adoption of the Resolution and said he personally did not want to give a 6% increase in salary to all Department Heads and particularly to the Acting City Manager. He said he was opposed to increasing the salary of the Acting City Attorney, as he said Mr. Ritchie agreed to come here at that rate and should honor that Agreement. Councilman Hamilton agreed to bringing the salary increase of the Director of Recreation and Parks up to the average, but wanted to hold the other Department Head's salaries as is," and said if a survey were taken in other cities the salaries of the Acting City Manager and Assistant City Manager would be top salaries as compared to other cities the size of Baldwin Park. Councilman Kitchel said he was in agreement with the salary increase and did not think Management should be singled out and classified in an area totally unrelated to the overall effectiveness of the administration. He said if the City is to function effectively it must have effective operation by its management. Without that, he did not think the City could move forward and carry out the mandates of the City Council. He said a morale booster is needed at City Halt and that the proposed pay increase was on a par with most communities and that that is where Baldwin Park should be in competition and in a league with other communities. He felt it must be illustrated in administration and said he was in total agreement with increases for the administrators and for the legal counsel. He said if Baldwin Park is to win in court, it must have a winning attorney and Baldwin Park won't win with some sort of deterrant pay scale. Councilman Aguilar said the Department Heads had been doing a great job and that they have to support their families as the prices go up. If their pay is cut off. their morale wi11 go down and they will not go out and put out more for the City. They will go out and say the Council didn't care about them. He asked how you could expect a man to go out and push more without giving them a little extra treat? Mayor Waldo said that for years Baldwin Park was under par with other cities, not only with the Police Department. If you don't have the brains, you don't have the progress. Councilman Hamilton asked that the Administrative Assistant on Communications be deleted completely from the budget, as he didn't feel this position was necessary. Councilman Blewett suggested a substitute motion that the Administrative Assistant on Communications be deleted from the budget. Councilman Hamilton said he would second it Councilman Aguilar said the discussion was on Resolution No. 76-56 and not on the budget itself. He did not wish to rescind his second on the motion on the Resolution. Councilman Blewett asked if the Administrative Aide that was referred to was the Administrative Aide for Communication. Mr. Sexton said that Administrative Aide was the dual function of the City Clerk along with being an elected official. He said this was a basic salary range and a family of positions that identify that in its family positions, so it is included in the Resolution to that extent. Director of Finance Halloway said it was not in the Resolution before the Council. The position itself appears in the budget, but there are other Administrative Assistants in that same salary range which was already previously passed. Councilman Blewett withdrew his motion and Councilman Hamilton withdrew his second. It was determined that the position of Administrative Assistant, Comnunicat ions, could be discussed later in the budget. Councilman Aguilar said that to prove we need topnotch men, the problem with the Chamber of Commerce is that they never had enough money to pay a Manager that knew what he was doing and that that is why the Chamber is in the position that it is in now. For 3 years those people have received a total of $60,000 to perform for the City, but they haven't and the reason is that they do not have the money to pay a top notch man. Councilman Blewett rebutted by saying the salaries were excellent and comparable to other cities. Councilman Hamilton objected to paying more than the City of West Covina for a City Manager and said he wanted to leave the salaries of the City Manager and Assistant City Manager at their present level. The motion carried. 00- Acting City Manager Sexton said another survey has been made on mileage and information updated, showing Baldwin Park at 10< a mile and Pomona paying 19tf a mile. June 29, 1976 Page 4 BALDWIN PARK 1976-77 BUDGET Councilman Blewett referred to Page 6, Meetings and Confer- ences, and said he did not think the U.S. Conference of Mayors, National League of Cities, and NAHRO were necessary but that anytime the Council could go to Sacramento and learn something about the legislature it would be time well spent. He said he knew how each local Congressman voted on revenue sharing without going to Washington. Mayor Waldo and Councilman Aguilar disagreed regarding the necessity of attendance in Washington. Mayor Waldo said at least 1/5 of the people on their trip to Washington, excluding mayors and Congressmen, were going back from cities to fight for different grants. He stated there are thousands and millions of dollars out there that the City of Baldwin Park is entitled to but doesn't do anything about.Councilman Aguilar said that you could have a beautiful proposal but it was not what you know it is who you know." Councilman Hamilton said it was not done by talking to a lawmaker in Washington, but by qualifying with the necessary information. He said each time he had been in Washington to obtain grants from HUD on the Conmunity Center, he had taken City Hall staff with the expertise to obtain the $118,000. Mayor Waldo said qualifying here was the first step and that it was necessary to go as a team and lobby for it. Councilman Hamilton asked for a definition of Other, Page 6, for $325 and $650. Mr. Haltoway explained it was for various monthly meetings and committees not spelled out by name which are attended and reimbursed. DELETE TRAVEL EXPENSE TO NAHRO, NEW ORLEANS, FOR $500; NAHRO, NEW ORLEANS FOR $300 AND CONFERENCE IN WASHINGTON. D.C. FOR $200 FROM THE BUDGET. M/S/C: HAMILTON/BLEWETT. Rol1 Call. Councilman Blewett said he felt that $40,000 could have been saved from the City Manager's budget by deleting 3 additional positions and filling the City Manager's position and have Mr. Sexton resume his duties as Industrial Development Director. He strongly objected to hiring the Administrative Assistant, Communications, and stated he felt it was a campaign pay off, as he didn't think that serving as a campaign coordinator qualifies someone to become a communications expert. He said he considered it presumptive to add new people to the City Manager's office without having a permanent City Manager. Mayor Waldo said that the Communications Officer was the only one here and that the others probably wouldn't be hired until the new City Manager is aboard. Councilman Kitchel said if these areas are not set aside now in the budget, it means that the mandates of the City Council, which were to improve communica- tions and to enhance development in the cormunity, are once again going to be prolonged a period of 1 year. Councilman Btewett asked him to make that the Council majority when talking about the mandates of the Council. Councilman Aguilar said this country was based on that the majority rules. Councilman Hamilton said he was in favor of the Administrative Assistant/Development because he had always been a strong advocate of development but asked for the role of the Administrative Analyst to be clarified. Mr. Sexton clarified that the position of Administrative Assistant/Development had been eliminated by the other administration a year ago in favor of priorities on personnel matters in other sections of City effort, while a de-emphasis was made in Development. It is proposed that this position be restored so that Development can again be re-emphasized in the community. He said the Administrative Analyst is proposed to assist the City in obtaining grants from the Federal or State government or wherever they might be. He felt that this could be a very important position and that the salary of $10,776 would be a small price to pay to jet even one grant of any substantial size. When the budget is finalized, these positions will be listed as CETA and will be obtained with CETA funding, if possible; if not, they will stilt have the flexibility to hire these people to help do the job of broadening the tax base for the next year. He said next year the City may not be in a position to balance the budget, because they may not have the revenue sources to keep up with inflation and other costs of government. Councilman Hamilton replied that he thought there were people on our staff that were very well qualified for this position, but that he did not think the position for the Administrative Assistant/Communications could be justified. Mayor Waldo referred to a recent industrial show he had attended in Anaheim, attended by people a11 over the country with products to sell to local industrial- ists. He said he saw no booths from cities trying to attract developers, but that he had talked to 2 people out of 12 people who were interested in larger facilities. He said one of these people has been contacted about coming to Baldwin Park. The product that Baldwin Park has is land and there are services along that line that could be rendered. He suggested a program be put together to participate in these industrial shows. Councilman Aguilar said he had seen cities operating for this purpose at home shows In the past very successfully and that if each city just got one developer it would be worth it. Mayor Waldo said Baldwin Park has land and a labor force as well as a public relations department to offer an.industrialist. continued) DELETE POSITION OF ADMIN. ASSIST., COMMUN. He said it would be like advertising to set up a booth when there is a show. He thought this was part of the Chamber of Conmerce's task and that they should be involved in it. Councilman Kitchel said that anytime Baldwin Park can stand to gain from development, commercial and industrial, it should do so vigorously. He said the Staff should be directed to pursue it. Acting City Manager Sexton comnented that part of the preparation for the booth and promotional materials that would be used, along with communication media needed to market and promote land and its accessability in Baldwin Park,would be part of the functions of the Administrative Assistant for Comnunications. He would prepare, design and oversee the production of these kinds of promotional aids such as booths, slides or motion pictures. He said the Council may come back and ask for a budget amendment to allocate the necessary funding needed as the program develops. Councilman Aguilar referred to Page 20 and said since they are CITY CLERK going to have a City Manager and an Assistant City Manager, P. 20 he couldn't see any reason to need an Administrative Aide. PULL OUT AMOUNT OF $10,188., ADMINISTRATIVE AIDE. M/S: AGUILAR/KITCHEL. Councilman Blewett said that by striking that position you are going to be taking a full time Department Head from the City Clerk's office and reducing it so that she performs her task in her own time and in her own way. She will not be required to keep 8-5 hours and you are going to have to provide supervision for that office. Councilman Aguitar said that there is a full-time Deputy City Clerk and 2 secretaries and a City Clerk in that office. He was pretty sure that the Deputy City Clerk, being a full-time employee, could handle that office. Councilman Btewett asked if he thought it was a good idea for the Deputy City Clerk to make more than the City Clerk? Councilman Aguilar said that $4200 was a fixed budget for the City Clerk and that the Council can't change that. Councilman Hamilton said that could be changed by vote. Councilman Kitchet said that some time ago this issue had come up to the old City Council and at that time he was the only one in the audience to express disagreement over the dualistic role of a City Clerk and an Admin- istrative Aide. He thought this area needed to be corrected because there was a Conflict of Interest. He said the past City Council took the Municipal Code and contorted it in such a way that unclassified employees were eligible to run for office. He said he thought this reflects a Conflict of Interest, as one is either a full time administrator or he is an elected official, but can not hold two positions in the same comnunity. Councilman Hamilton said he thought this salary of $4200 was set years ago by the first City Council. Mayor Waldo said he was pretty sure the Council doesn't have the right to raise that salary as it is an elected position. continued) PULL OUT $10,188, ADMIN. To get a full time City Clerk is an appointed position. There is no way to get an efficient person in that office to do the job that Mrs. Balkus is doing for $14,388. This is not costing the City any extra money. He said that office is run very efficiently and that he had never had a complaint. You get full cooperation with all your questions answered and no runarounds. He said if someone is hired to do the job you are going to pay them at least $20,000, because that is one of the very important offices in City Hall. He said he thought maybe the new Councilmen are not aware of everything that goes on over there and maybe they are. He said if they think they are going to save the City money, deleting this and hiring somebody to do this job because there is no way she is going to put in 8-hour days for that kind of money. He thought it would be safe to say that she put in 12-hour days on most occasions. He said she was elected in the last election by the people and in all fairness to her, if she ran for the office and that alone, then there should have been a salary adjustment at the time of the election to bring that office up to what is normally paid throughout the Valley here for people that are doing the same job. He stated he absolutely opposed any change in that particular part of the budget. Councilman Kitchel clarified his position that it was not a matter of saving the dollar, but a matter of principle. He didn't believe it was ethical. Councilman Hamilton said he didn't agree with that. Councilman Kitchel said he believed it was a Conflict of Interest. If the City Clerk's position requires full time attendance here at City Hall for doing an effective job, then he thought we ought to think very seriously of going to the voters and change the position of the City Clerk to make it appointed by the City Council, because it goes against good political standards. One is elected and one is appointed. It is not a question of effective- ness. He said he thought Mrs. Balkus has done a fantastic job and that it was not a question of money it is a question of, is it right? Councilman Waldo asked if he was saying that they should go to the voters and have it upped to a viable wage. Councilman Kitchel clarified that he meant to have it be an appointed position and set the salary. Councilman Hamilton said that can only be done by the vote of the people. Councilman Kitchel said he thought it could be done, but didn't think we could go haphazardously down this path; it is something that needs to be corrected. Councilman Hamilton said he didn't entirely disagree with Councilman Kitchel's thinking on this but thought this was the wrong time to bring it up. He said at the end of her term, in the next election coming up, he would consider this request, but not at this time. He said this is one of the most important offices, with alt the legal- ities and things, and you can't just go out and pick one of these people. He said this was not right, morally or any other way, to set rules for certain employees that could run for City offices. He said he had nothing against Mrs. Balkus and that she was doing a good job, but that it is not right to say that someone could run for City office, but a lower person can not run. That is the question Councilman Hamilton said that is already over; she did run and was elected. Councilman Aguilar said that, according to the notes he got from Mr. Mitchell, if an employee of Baldwin Park was going to run»that person had to resign the day she put in an application. That was turned around and made special privileges. Councilman Kitchel said that is why the law was changed. Councilman Aguilar said that was not right. Councilman Blewett said he thought the Council would be doing the wrong thing. It would be a terribe dis- service to a woman who has spent a lot of years here in the City. He did not agree that she should be an appointee of the Council, but thought it should be treated much the same as any other Staff job. He said he thought it should be an appointive position, because when Mrs. Balkus is gone the electorate may not be so lucky as they are right now. He stated he felt very strongly that if they wiped her out of this office it would be unconscionable. He said he really believed that. Mayor Waldo asked for a roll call. Roll Call. The motion carried. 00" Councilman Blewett said he would like to see a complete study of Data Processing done by Mr. Halloway, including how much down time is being used on the computer, what the possibilities are on renting the computer out, and what it would cost to have these same services done in some other manner. He said there is more good rapport on the Mid-Valley Mental Health Board than any Board he serves on, and the cities that have common problems can get together and work their problems out. Councilman Hamilton questioned that Dr. Ultah had made the statement before the Council at last year's budget meeting that that would be the last year the money would be needed and whether the Federal funding had come about as planned. Councilman Blewett said it hadn't. Mayor Waldo said that Dr. Utiah had told him there was a possibility that he may not need the $10,000, but that he would like to have it there in case it was needed. He asked Councilmen Blewett and Aguilar if there could be a Conflict of Interest in their being members of the Board and members of the City Council when money is being given. Councilman Blewett said there was no Conflict of Interest because they were appointed by the Council. He said he had checked this out with the previous City Attorney, and he had indicated there was no problem because they were appointed to represent Baldwin Park and are there to protect their $10,000. Councilman Blewett said that one of hau told him that Mid-Valley Mental valuable when they have someone who help with them. The Motion carried 00- Councitman Aguilar said there had been a lunch meeting with the Chamber of Conmerce on Friday and that the Council had asked for a Master Plan to see what the Chamber could do for the City of Baldwin Park. He said the Chamber is asking for an extension of time to get together with the City Council and the Board of Directors to devise a plan that wi11 make the Chamber of Commerce an effective body. He said the Chamber of Commerce would have to close the doors on July 1st and he suggested funding them for $3400 for 2 months until they come up with a Master Plan. Councilman Kitchel said he had expressed his opinion on the performance of the Chamber of Commerce and would like to reiterate that he thinks before the Council funds them, they should come up with something concrete in the way of a Master Plan that would justify the expend- iture of $2100. He was in favor of allowing the Chamber of Commerce one month in which to produce; if after a month they can show a plan, funding could be continued, Councilman Hamilton said the Chamber was in the process of hiring a Chamber Manager and that it wi11 create a problem as they have no assurance that they are going to have money to hire a qualified Manager. If this were done satisfactorily the Council would re-fund them up to $30,000. and he said the Council should give them en- couragement. Mayor Waldo said that what is lacking now is the Master Plan and some goats. Their problem is keeping the doors open and paying their secretary and housekeeping bills. They are not in debt. In the past they received $1750 per month, which included the past Manager's salary. He suggested giving them $950 per month to keep their doors open until the Council could get together with them and they have a viable plan. Council discussion followed regarding whether $950 would be enough for expenses and initiating a Master Plan or whether to pay the usual amount. Mayor Waldo said that when the Chamber Manager left, 5 years ago, the City continued to pay the full amount contracted at that time and the Board kept the money but didn't replace the Manager. He said he had received the $78,000 estimate several months ago when he was putting the budget together, but the broker has told him that when he went out trying to seek insurance for the City he has ex- hausted alt possibilities and the premium will now be $87,590. Mayor Waldo asked Finance Director Halloway if, in his opinion, the City can afford the Code Enforcement program. Mr. Hatloway said the cost of $68,000 should be addressed rather than the $42,000, although the clerk typist was already on board and the Service Contract money would be recovered, because he doubted if it would be recovered in the first year of operation. It is collected when taxes are collected. He confirmed that the City could afford $56,000 for the program, if it was the wishes of the Council to take it from the surplus fund. Mr. Sexton stated that the $100,000 coming from HCD has not been integrated into the budget and the Council has not had the opportunity to review the HCD Committee's recommendations relative to priorities for the use of those funds. He asked if this activity might possibly be included for use of these funds, depending upon the Council's direction. Director of Planning Kilgour said the HCD funds for the second year have been pretty well established by the way the applications have been submitted. There is $17,000 to be allocated for an inspector regarding housing quality, home loans and similar activities of a building inspector. He said this can tie into this kind of a program, but the inspector is not allowed to do a blanket program over the whole City. He is limited to about half the City, so $17,000 could assist in half of the City the first year, with more available the second year. He did not feel this would deter from the direction of the HCD Committee, as they were highly concerned with the quality of maintenance of residences and commercial properties throughout the community. He said he would investigate it. 00- Councilman Blewett referred to Police Department, Page 71, and noted that the 1975-76 Budget had approved $1,710,639 with the expenditure being roughly $80,000 less. He said that, assuming there might be a similar salary savings, he would like to add more members to the Police Department. ADD MORE PATROLMEN TO THE POLICE DEPARTMENT. M: BLEWETT. Mayor Waldo asked Lieutenant Cheltino if the Police Depart- ment had the extra vehicles on hand in case they got the extra patrolmen, and if he would calculate the cost of additional patrolmen, including compensation and fringe benefits. Lieutenant Cheltino said it would take 1 more car and 1 more radio for 4 additional patrolmen and it would depend on how many patrolmen were on the street. If each shift were increased by 1 man, another vehicle would be needed. Councilman Blewett stated he was not a believer in the one-man car and felt it would be more effective to have 2 men in a car so that they would not have to wait for a back-up officer. Mr. Halloway estimated the cost of the addition of 1 patrolman to be $17,000, including about 25% fringe benefits. The cost would be $51,000 for 3 patrolmen and $68,000 for 4 patrolmen. Councilman Blewett asked if it was conceivable that there might be similar salary savings in this next budget year. Mr. Hatloway said he thought the Police Department had some open positions and recruitment takes time, in that there is sometimes a salary saving between the time the employee is hired. He stated the bulk of the savings was in Personnel Services last year, with a savings of $50»000, due in part to the Captain's position being vacant and some change's in patrolmen's positions. Mayor Waldo requested that a study be made of the cost and a report brought back to the Council. Mr. Sexton said they were not prepared to deal with the question as it had been proposed. Inspection would be made of grounds covered with rubbish or overrun with weeds, or if exterior of premises are run down and affecting the value of the neighborhood, the property owner will be informed that the nuisance must be abated or that the structures must be improved. If there is good reason to believe that there are substantially substandard conditions within the house, an inspection will be made and corrections ordered, if necessary. He said Staff investigation has indicated that the following personnel would be needed: a Code Administrator with a salary of $18, 892, 1 Field Inspector with a salary of $17,716, 1 Clerk Typist position which is already included in the Table of Organization. One compact sedan is needed for transportation, at an estimated cost of $4900 plus operating costs of $365. He said additional funds are necessary for Lot Book Guarantees, postage, office supplies, paper and printing, estimated at $1900. and a Service Contract, estimated at $12,000, is required. The Service Contract is a contract with an outside firm to come in and dean up rubbish, weeds, and do the necessary grounds clean up as required in order to satisfy Code requirements. The cost of the Service Contract is a recoverable cost. He said the total funding requirements for the program are estimated to be $68,728, with-recoverable costs amount- to $13,800 under the Service Contract and administrative costs and an additional $12,760 in salaries. The net additional cost to the City $42,168. The property maint- enance program would prevent the neighborhoods and community from being dragged down to the lowest level, by stopping the deterioriation of individual properties and bringing them up to a minimum, acceptable level for the community. Councilman Btewett stated that in the past there was one man on Staff who covered the City by sections on nuisance abatement. This man looked for the most obvious cases. Discussion followed regarding the necessity for weed abatement in the Market Basket parking lot, the railroad right-of-way, Baldwin Park High School tennis court and City property there, and removal of election sign on Maine Street. Mr. Lathrop explained that when one man was working on nuisance abatement, he was closely supervised by the Building Regulations Supervisor, Mr. Cunningham, who then spent about 90% of his time on the abatement program, at the expense of the Building Division's remaining duties. Since that time, the building activity has more than doubted in the community and Mr. Cunningham no longer has the time to supervise the abatement program. He said the supervision would be almost a full time job. Mr. Sexton said this budget was based on an optimum level of success in dealing with the problem in the community.
