An invocation was given by Pastor C. S. Lovett, Personal Christianity Chapel. NO. 76-60 ADOPTED 00- Councitman Agutlar requested that the Acting City Manager make a study to see if there is anything Baldwin Park can do to reduce the property tax rate and give a report at the next City Council meeting. 00- Mayor Waldo referred to Item 6 on the Consent Calendar relative to the Housing Advisory Commission, and said one person has indicated he would like to serve on the remaining vacancy. He said voting for one appointment would be accomplished by secret ballot and that any Council man may vote for anyone of their choice, so that this name can be included in the Resolution on the Consent Calendar. Councilman Blewett referred to the past procedure of accepting applications and resumes and questioned the policy of simply appointing people to the Commissions. Mayor Waldo said the City Council has been asked to submit names of people who have said they would serve and that is the way it has been done with all the new Commissions. Director of Planning Kilgour stated that the property owner was requesting a change of zone on the entire shopping center, from C-1 to C-2 in order to increase the list of potential tenants on the property. A negative declaration had been filed and the zone change will be consistent with the General Plan. The Planning Commission h?d recommended approval. He suggested the Public Hearing be continued to a definite date. A representative of the applicant referred to a similar zone change granted by the City Council a few months ago and stated that it seemed highly unusual that this should be required in this Instance and not in the other. Mr. Sexton said that the distinction is that the Redevelopment Plan at the time the application for the King's Lodge Motel was submitted was being tested in the courts and the developer chose to go the City route as to zoning questions. He said since that time the Redevelopment Plan has been adjudicated and is in effect, so that it governs the uses that will be permitted in that project area. He explained that the land uses for the other hotel proposal were consistent with the Redevelopment Plan and that is not the case in this instance, so there will have to be some determinations made by the Redevelopment Agency prior to any continuing effort as to Council action. The representative said that the application for Sixpence Inns was being considered at that time and they were advised by the Council that approval would be granted by simply filing the application. There was no protest given on the zoning change at that time. Mr. Sexton said he didn't think there was any problem, but that legal procedures would have to be followed. The answer can be given following the September 1 CRA Meeting and City Council Meeting. Councilman Blewett asked the representative if he had a time problem in regard to financing or if it would slow him down from starting his project. The answer was no." There were no objections. 00- Acting City Attorney Ritchie referred to an Ordinance he had prepared relative to Bingo in accordance with the requirements of the Penal Code and said it had all the provisions required by State law. He said he had left open the amount of the license fee. He summarized the Ordinance by stating that it provided for games for organizations that are exempt from taxation; it is a misdemeanor to get any profit, wage or salary from a Bingo game and there is a $10,000 fine if this provision of the Ordinance is violated; the City can enjoin any violations; no minors can partic- ipate; any non-profit organization can conduct a Bingo game only on property owned or leased by it in which property is used as an office or in the performance of the organization's purposes; all games shall be open to the public and not limited to the members of the non-profit, charitable organ- ization; Bingo games shall be staffed only by members of that organization and they shall not receive any profit, wage or salary; no individual corporation except the one authorized to conduct the game may have any financial interest in the game; all profits derived have to be kept in a special fund and accounted for and may not be co-mingled with any other funds of the organization; the organization shall obtain a license from the City to conduct the game and the license shall specify the date and location of the game. A separate license and a separate fee shall be paid for every day that an applicant Intends to conduct a Bingo game. He said a Bingo game means a series of individual games making up the total on any given day and the total payoff for any one individual game for all prize winners could not exceed $250. He said he assumed that the City could work out an application so that an applicant who held games on a regular basis could make one application and be issued an annual license. Mayor Waldo asked if there was anything in the State Ordinance prohibiting an organization from having atchoholic beverages on the premises while a game was in operation. Mr. Ritchie said there was not. He clarified that minors may be present but may not participate in the game. It was agreed that a copy of the Ordinance should be made available to persons applying for a license. Mr. Ritchie explained that thp Bingo Ordinance could be adopted as an Urgency Ordinance to become effective immediately if the Urgency Ordinance would enhance the safety and general welfare of the community and if 4 affirmative votes were received. A paragraph could be added to the Ordinance, and if it was tested in court it would only be delayed 30 days. Discussion followed as to what an application would look like and what information would have to be extracted, and what the license fee should be. Mr. Ritchie said he had recommended that San Gabriel charge a license fee of $25 a game but they had adopted $25 a year, which will probably not get back their costs. George Lowe, 4520 Phelan Avenue. Commander of American Legion Post 241, spoke in favor of an Urgency Ordinance on Bingo and listed Baldwin Park organizations who would benefit from charitable funds. He stated that other cities have listened to the people's vote in the State of California and that he wanted to see something done here as he thought the VFW, American Legion and church organizations present would a11 stand in favor of An Urgency Ordinance on Ordinance No. 741. Mayor Waldo asked all people in favor of an Urgency Ordinance to stand up and upon seeing the audience stand en masse said that the Council gets the message. Acting City Attorney Rttchie said the grounds of the Urgency would be incorporated as the final paragraph of the Ordinance, and that if the Ordinance was intro- duced there would be a change in Paragraph K to conform to the change in fee. He said he felt that the people in town who were opposed to Bingo should have their opportunity to express their views when it comes up for second reading after it is introduced as a regular ordinance. Acting City Attorney Ritchie clarified that if it was not adopted as an Urgency Ordinance, second reading of the Ordinance could take place not sooner than 5 days from this Council Meeting, and that there would be a 30-day waiting period thereafter before it becomes effective. Mayor Waldo stated that $1800 could be lost to the organizations that just Post 241 supports if it was not made an Urgency Ordinance. Councilman Kitchel said the actions of the Council should not be judged by what has taken place in the past if Urgency Ordinances were not adopted for the welfare of the community, and that he felt that the Urgency Ordinance should not be halted when the people stood to gain from it. Councilman Hamilton said the people who lose their money and go home broke do not stand to gain from it. Councilman Kitchet said the people had gone to the polls and mandated that they wanted legalized Bingo in the state, and that the Council would be implementing their wish. This Association represents 3 supervisorial districts and over a million people and can be very strong in their efforts if the cities get behind them. He said they wish to take an active part in the State and County government on various ordinances and legislation. He said they meet monthly and urged as many Councilmen to attend as possible to support the Association. 00- Councilman Hamilton said that he was the City's representative to Southern California Association of Governments SCAG) and that he is unable to attend their meetings which are held from 9:30 a.m. to 2:30 p.m. on Saturdays. She said a man was killed there several years ago when he was unable to make the turn. Mayor Waldo said the Traffic Committee would be asked to research it immediately. 00- Leonard Brandon, 4023 Virginia, said he had requested that curbs and gutters be installed in front of his home, and had been told several months ago by the Council that there was no money for them. He stated the curbs and gutters had been approved 2 1/2 years ago. and asked when something could be done. Director of Public Works Lathrop explained that Mr. Brandon had dedicated his right-of-way when he had been contacted, at the time the City had an active Curb and Gutter program. They were negotiating with other property owners to dedicate their right- of-way in exchange for curbs and gutters, and the policy at that time was not to put in the improve- ments on a street until a11 the right-of-way had been obtained. He said the Curb and Gutter funds ran out and the City still did not have a11 the right-of-way. He stated there has been a small amount of funds allocated in the recent budget to complete the Curb and Gutter obligations they had committed themselves to at that time, and that he would contact the property owners on Virgina Avenue in an effort to get the total dedication rights. Mr. Brandon said there was only one un- dedicated parcel. QO- Michaet Dargus, 13260 East Francisquito, requested that the Council pass a Resolution or Ordinance to control the expenses of the City officials wasted on dinners and travel. He said enough money had been spent to hire a policeman for a full year. He stated that in 1958 the City voted to take over the City Parks, and the people voted a 25t tax to operate Parks and Recreation; since then the tax has gone up to almost 40<t. He opposed the taking of Parks and Recreation money to put in the General Fund and said the City Park needs refurbishing and that this money could have done a lot for the senior citizens and the youngsters of the town. He asked why the City Cc-ncit had approved a zone change on Datewood Avenue, which was in the same CRA project that they had turned down on Garvey. 00- George Lowe, 4520 Phetan Avenue, spoke in rebuttal to the Council deciding not to pass an Urgency Ordinance. He stated that it seemed odd that other towns could do this, but Baldwin Park could not, and said he didn't know why Baldwin Park didn't take the front seat and drive that car tonight. She stated there is a motor court with a shack next door that has mattresses and bedding piled in front, and said that it is no wonder people don't settle in Baldwin Park. The address is 4709 North Maine Avenue. She referred to the speeding at night on School Street as hazardous and said she was afraid some of the children in the neighborhood would get killed. Mayor Waldo said the City Council wilt ask the Traffic Committee to look into this. 00- Raul Zayas, 12815 Finchley Street, served a11 members of the Council, Acting City Manager Sexton, Acting City Attorney Ritchie, and City Clerk Balkus on behalf of the City of Baldwin Park, with a Petition for Writ of Mandamus; Points and Authorities in Support Thereof Complaint for Declaratory Relief, Injunctive Relief; and Damages from Robert Mitchelt, former City Manager. 00- Tom Carpenter, 4346 Jerry, predicted the Council would make Mr. Sexton the City Manager and said he and others objected to allowing persons to apply under the guise that they might get the job. He stated that City Clerk Balkus had served nearly a year as Acting City Manager; she had done a beautiful job and performed her duties without friction. He stated she was the only eligible one for the job, but had been repaid by cutting her salary to $350 a•month because of a conflict of interest. He stated roughly 35% of the cities within California have such a conflict of interest. 00- James Garrow, 1011 North Baldwin Park Boulevard, suggested praise for City employees because he said the budget was submitted on time and with no increase in taxes. He said Mr. Sexton was one of the finest men he had ever encountered in City government and complimented the Council publicly for the fine job they had done. 00- Leo King, 3830 Grace Avenue, rebutted Mr. Garrow's statement regarding the timeliness of the budget and stated the budget is supposed to be adopted with the funds available. He stated his Council had had the same funds available to balance the budget, but had not taken them because they were for Park purposes. He said the past Council had been told by Mr. Mitche11 before they were out of office that they would have a balanced budget, without taking funds from any other source and leaving revenue sharing funds for a new Police facility.
