The City Council of the City of Baldwin Park met in adjourned regular session at the above place at 7:30 p.m. Roll Call: Present: COUNCILMEN AGUILAR, BLEWETT. HAMILTON, KITCHEL AND MAYOR WALDO ACTING CITY MANAGER SEXTON, DIRECTOR OF FINANCE HALLOWAY AND CITY CLERK BALKUS Also Present: ACTING CITY ATTORNEY RITCHIE, DIRECTOR OF PUBLIC WORKS LATHROP. DIRECTOR OF PLANNING KILGOUR, CHIEF OF POLICE ADAMS AND CITY TREASURER MONTENEGRO Absent: 00- INVITE COMMUNITY REDEVELOPMENT AND HOUSING ADVISORY COMMISSION MEMBERS TO ATTEND AUGUST 24, 1976 COMMUNITY REDEVELOPMENT AGENCY ADJOURNED MEETING, 7:30 P.M. MTG. f:30 P.M. 00- Councilman Hamilton requested that the Acting City Manager make available copies of the preliminary Northwest Industrial Development Study of the Baldwin Park Redevelopment Agency to developers and interested parties. 00- A.C.M. NO. 741, AUTH. CERTAIN BINGO GAMES WITHIN CITY BOUNDARIES BY CHARITY ORG. Mayor Waldo explained that Councilman Hamilton had expressed one reason for not favoring an Urgency Ordinance being that interested citizens should be allowed to give their input. He proposed that anyone in the audience who so desired be allowed to speak on Ordinance No. 741. There were no objections. George Lowe, 4520 Phelan Avenue, Commander of American Legion Post 241, spoke in favor of Bingo and urged Councitmen Btewett and Hamilton to consider it as an Urgency Ordinance. GEO. LOWE IN FAVOR OF BINGO &AN URG. ORD. John Donavan, Commander of V.F.W. Post 3197, spoke in favor of Bingo to provide funds to aid charitable programs and asked the Council give them a hand. Lee Scarlett. Past Commander of V.F. W. City Clerk Balkus said yes," and that it would be a pro- tection for the City to have both. FURTHER READING OF ORDINANCE NO. 741 WAIVED. M/S/C: KITCHEL/BLEWETT. There were no objections. ORDINANCE NO. 741 ADOPTED. M/S/C: AGUILAR/KITCHEL. Roll Call. There were no objections. Councilman Hamilton expressed his opinion that an Urgency Ordinance in this situation would be a violation of the City Code as the health, safety and welfare of the community are not at stake. He said he did not see a great harm in gambling for charitable uses if it is well controlled, but that he does not gamble for money and has talked to many people who are not in favor of gambling. Councilman Blewett referred to a newspaper item which quoted a Legionnaire as saying that he was told that one of the Councilmen had asked the Police to raid the Bingo game. He said neither he nor Councilman Hamilton had asked to have the Bingo game raided, and that meant that one of the 3 other Councilman was guilty or the Legionnaire had received misinformation from someone. He stated that he was not in favor of an Urgency Ordinance as what was existing now would continue to exist until it became legal. Mayor Waldo said he felt it concerned the welfare of the community in that charities who support the veter- ans and the youth get about $5000 a month from Bingo games and want it to be legal. Councilman Hamilton stated that the losers in gambling are often those who can least afford it and that while some people would be helped by this form of charity, there was no doubt in his mind that others would be hurt. Councilman Aguitar said if the organizations who donate money and have programs for youth who are on the streets and in trouble can save one life. It is worth an Urgency Ordinance. He said most citizen go to the games to relax, talk to friends and maybe spend four or five dollars. Councilman Kitchel said the Ordinance had already been voted on as a regular ordinance and that it was not necessary to digress and talk about the religious aspects of gambling. He referred to what had been published and said he especially would question the validity of what was printed about the American Legion and legalized Bingo. He said that the Urgency Ord- inance would be an enactment of the wishes of the voters who wish to make Bingo a local option. It would be fulfilling that mandate. He said he felt it should not be a controversial, front-page issue, but that the Urgency Ordinance should be enacted so that the organizations can proceed with plans for the forthcoming year. continued) ORD. NO. 742 ORDINANCE. COUNCILMAN KITCHEL SECONDED. Roll Call. Ayes: URGENCY) AGUILAR/KITCHEL/BLEWETT/WALDO. Noes: HAMILTON. The motion carried. Mayor Waldo urged the Council to be considerate of the organizations and said it would not break their Code of Ethics. Councilman Blewett stated the report on Bingo had been around for a month before it was brought on the agenda. He said he was quite sure the Police Department would not do anything adverse to the wilt of the Council, who have voted 5-0, and that the organizations can go ahead and plan for their year. He said he hoped Bingo would be as good a fund raising idea as the organizations want it to be. Mayor Waldo said Baldwin Park is a part of the County, and that the County Sheriff's Department can go into any part of the County on a complaint and close down an operation and confiscate equipment. He said this can be eliminated by passing an Urgency Ordinance. Councilman Blewett said he doubted that the County would come into a City that had just passed an ordinance legalizing it or that they will be looking at Bingo games after what the State has just done. Councilman Aguilar explained that the Acting City Attorney had been on vacation for three weeks and had to do some studying before he drew up the Ordinance. Councilman Hamilton said cities have local option for draw poker and that his information from cities who have it is that it attracts undesirables. He said that he hoped he was wrong, but that with this new Council he was afraid draw poker would be next. He stated he was concerned because the moral fibers of the nation are weakening year after year, espec- ially from gambling, as people can lose their homes and their families, and that voting for a Bingo Ordinance had been a hard decision to make. Councilman Kitchel said this was political rhetoric and was purely speculation, as the Council was not advocating any legalized poker playing. They are talking of legalizing Bingo with the proceeds going to charity. He stated that the American Legion, V.F.W. and other service organizations are doing what many churches are doing. They are raising money to help all mankind. He said this was not immoral and that all the Council was doing was to give them the go-ahead and support to do it. ADOPT ORDINANCE NO. 742 URGENCY).
