FILE AND MINUTES BOOK FROM: CITY CLERK BALKUS SUBJECT: SPECIAL CITY COUNCIL MEETING SEPTEMBER 23, 1976 As neither Deputy City Clerk Winchester or myself were present at the Special City Council Meeting of'September 23, 1976, the minutes were taken by Mrs. Crawford, secretary to Acting City Manager Sexton. Deputy City Clerk Winchester was fold that it was not necessary that she be present. The City Council Meeting was called for 7 p.m. but did not commence until 7:10 p,m and adjourned at 7:30 p.m. to reconvene at 9:15 p.m. The CRA Meeting began at 7:30 p.m. and adjourned at 7:50 p.m. At 9:15 p.m. the Council reconvened to listen to.comments from the public on youth and gang activities. Mrs. Crawford was totd by the City Attorney that she need not be present at the 9:15 session, so no minutes were taken. Comments were taken from tapes loaned to this office by Mr. Tom Carpenter. These comments do not appear as part of the official minutes as there was no minutes clerk, and only the business for which the Special Meeting had been called could be transacted. Council approval of their minutes of the September 23, 1976 meeting wi11 make them official. t^" Thetma L. As neither my Deputy or myself were present, the Minutes cannot be certified to as Official City Council Minutes by this office I understand your secretary, Mrs. Crawford, took the Minutes as Deputy City Clerk Winchester was told it was not necessary that she be present. In the absence of the City Clerk or the Deputy, the usual procedure is for the City Council to appoint a Clerk pro tern. I have discussed this with Mr. Ritchie and he concurs that the Minutes would come from your office and that after Council approves the Minutes the Resolution and Agreements can then be signed. Roll Call: Present: COUNCILMEN AGUILAR, HAMILTON, KITCHEL AND MAYOR WALDO Absent: COUNCILMAN BLEWETT SEPTEMBER 23, 1976 7:00 P.M. FLAG SALUTE ROLL CALL Also Present: ACTING CITY MANAGER SEXTON, ACTING CITY ATTORNEY RITCHIE, DIRECTOR OF PUBLIC WORKS LATHROP. ASSISTANT PLANNER MONTOYA, DIRECTOR OF FINANCE HALLOWAY, LIEUTENANT CHELLINO AND CITY TREASURER MONTENEGRO Also Absent: DIRECTOR OF PLANNING KILGOUR AND CITY CLERK BALKUS ABSENCE OF COUNCILMAN BLEWETT EXCUSED: M/S/C: KITCHEL/ HAMILTON. There were no objections. 00- Acting City Manager Sexton stated that the City has had working drawings for construction of a new public services building, soil tests were made and efforts have been made to fund the cost for construction of the complex. An Environmental Impact Report and an Architectural-Engineering Report are required by law to maximize the City's opportunities obtaining the necessary financing. He recommended that the Council accept the bid of Envista, a company which specializes in these kinds of studies and was the lowest acceptable bid. ACCEPT CONSULTANT PROPOSAL OF ENVISTA FOR AN ENVIRONMENTAI REPORT FOR FEE OF $3750. M/S/C: KITCHEL/AGUILAR. Ron Call. Tnere were no objections. Councilman Blewett was absent. 00- Mr. Sexton said a revised consultant agreement was needed with the city's public service building architect, Maurice Fteishman and Associates. Their architectural and engineer- ing report will itemize in detail the cost of labor and materials used for the construction of the facility. The amendment and revision in the contract win be $12,500. AUTHORIZE AMENDMENT AND REVISION IN THE CONSULTANT AGREEMENT WITH MAURICE H. FLEISHMAN AND ASSOCIATES FOR $12,500. M/S/C: AGUILAR/KITCHEL. Ro11 Call. There were no objections. Councilman Blewett was absent. 00- Mr. Sexton referred to a Resolution authorizing $60,000 to be loaned from the Administrative Fund to the Redevelop- ment Agency to cover costs that will be incurred in proceed- ing with the study of the Northwest Industrial Area. He said if the development takes place, the monies win be repaid with interest and should be considered an investment. COUNCILMAN BLEWETT EXCUSED ACCEPTANCE OF CONSULTANT PROPOSAL FOR PUB. SERV. M/S/C: HAMILTON/KITCHEL. Roll Call. There were no objections. Councilman Blewett was absent. 00- Mayor Waldo referred to a statement in the Newsletter which stated it cost $1800 to produce the Newsletter. He said the cost of mailing the Newsletter was unintention- ally omitted. 00- Mayor Waldo referred to a request from concerned citizens who wished to come before the Council. They were attending a Rosary and requested that the Council reconvene after 9:15 P.M. to discuss a recent shooting. Councilman Hamilton stated that he wanted to discuss the Newsletter first. He said he wanted the total cost of producing the Newsletter given to the citizens before asking for a poll on whether they want a monthly, semi- monthly or quarterly Newsletter. He requested a proof of the Newsletter a week before it is to be published in order to make changes. Acting City Attorney Ritchie advised that the Council could adjourn for the purpose of hearing from the people who had requested that the Council reconvene, but that only the business for which the Special Meeting had been called could be transacted during a meeting.
