Councilman Blewett led the salute to the flag. INVOCATION FLAG SALUTE ROLL CALL Mayor Waldo read a statement regarding allegations of felonous acts committed by former or present C-ity employees and the on-going investigation conducted by the District Attorney, City and Police Department. He asked that all members of the City Council submit to depositions giving information pertaining to any illegal acts. 00- Acting City Attorney Ritchie stated that on the suit brought against the City by former City Manager Robert MitcheTl, Superior Court Judge Norman Dowds had ruled that there was no legal basis for reinstate- ment or damages. An appeal wilt be filed with the Appellate Court. He recommended that the City Council authorize him to issue a subpoena for attendance of Mr. Mitchell at a departmental investigation being conducted by Chief of Police Cheltino and to authorize him, as Acting City Attorney, to take steps to secure his attendance. AUTHORIZE ACTING CITY ATTORNEY TO ISSUE A SUBPOENA FOR THE ATTENDANCE OF ROBERT MITCHELL AT A DEPARTMENTAL INVESTIGATION AND AUTHORIZE ACTING CITY ATTORNEY TO TAKE NECESSARY STEPS TO SECURE HIS APPEARANCE BEFORE THE CHIEF OF POLICE. Councilman Kitchel referred to Councilman Blewett's request for access to the tapes and questioned his affiliation with Robert Mitchetl, and with Mr. Hale and Mr. Ftandrick. He said Councilman Blewett had not shown any substantiation for discrediting Mr. Ritchie or taking away the in-house investigation. Roll Call. There were no objections. The motion carried. Mayor Waldo asked Acting City Attorney Ritchie if it would be possible for all 3 tapes to be heard by the public. Mr. Ritchie said the Police Chief is conducting and investigation and is doing an excellent job which has received no criticism from the District Attorney. Information is generally available under the Public Records Act, with an exception being material involved in pending litigation, so he would not recommend Mayor Waldo's suggestion until he had given it more thought. He said what he had heard on the tapes would not reflect uncreditably on any member of the City Council or any participant except perhaps the individual who caused the recording to be made. 00- Mayor Waldo declared a Recess at 8:00 p.m. 00- At 8:12 p.m. the Regular Meeting of the Baldwin Park City Council reconvened. There were no objections. 00- Acting City Attorney Ritchle arrived. 00- City Clerk Balkus administered the Oath to those in the audience desiring to be heard during the meeting. 00- It was the time and place fixed for a Public Hearing on the Draft Environmental Impact Report on the Proposed Public Services Building for the City of Baldwin Park. Proper publications and postings had been accomplished. There were no written protests. Director of Planning Kilgour referred to the Staff report on the Environmental Impact Report and Its schedule. He said the draft Environmental Impact Report had gone to the Planning Commission for their review as a concerned Agency and had received their unanimous approval. He explained that State law mandated a 30-day review period be required before the completion of certification of the Report in order to allow a11 interested agencies and persons to comment, but that no person or agency had filed any comment to date on the draft. He said it was the Staff's recommendation, in concurrence with the Planning Commission, that the City Council approve the Draft Environmental Impact Report for the Public Services Building and that all comments received during the review period and during the Public Hearing be incorporated with the Draft Environmental Impact Report to form'the final Environmental Impact Report. Acting City Manager Sexton said that the Planning Department had undertaken the research of a new City Hall for several years and if funding can be arranged, the City can embark upon a construction program for a larger facility to accommodate more people and bring a new image to the downtown area. He explained that reports are prepared for major projects within communities in order to assure that all possible is done to mitigate any negative impact the project may have. He listed the areas reviewed and found that in all cases, the new facility would improve those conditions for the City of Baldwin Park and have a positive impact upon the community and expand the improvement of the commercial fore. Susan Gray, 4600 North Walnut, asked if the Impact Report covered all of Baldwin Park. Mr. Carr said it covered only the City Ha11 property. Tom Carpenter, 4346 Jerry, stated he was opposed to the acceptance of the Draft Environmental Impact Report for the construction of the proposed City Halt because the major funding of about $2 Million to be used was the money that was laundered from the legally advertised usage to have been for Police safety Revenue Sharing funds as reported to the Federal government. There were no objections. 00- Acting City Manager Sexton referred to an escrow the Citv had entered into for the purchase of a City Maintenance Yard on property owned by Henry Littlejohn. He said there had been problems with the purchase due to an easement of the Department of Water and Power that transverses the property, and that recently Mr. Littlejohn had requested that the escrow be cancelled. CANCEL ESCROW AGREEMENT BETWEEN CITY AND HENRY LITTLEJOHN. M/S/C: AGUILAR/BLEWETT. There were no objections. 00- Director of Planning Kilgour referred to the Housing and Community Development third year grant application and his agenda report on the outline of the public hearing process required to accompany the application. He said the Staff's recommendation is for approval of the process and appoint- ment of HCD Review Panel members. Acting City Manager Sexton explained that under HCD rules and regulations it was necessary that a Review Panel be appointed by the Council to conduct hearings and act as a resource panel in connection with utilization of special Revenue Sharing funds obtained under the County umbrella. amounting to $750,000. There were no objections. 00- Director of Public Works Lathrop referred to the disposition of City-owned property north of Olive Street between Lante and La Sena Avenue. He said residents had registered complaints regarding problems of weeds, trash and burglaries resulting from the stretch of City-owned property located at the rear of their property. The Staff had been requested to vacate or sell the property back to the adjoining property owners to allow them to fence the property and abate the nuisances. He said the Staff had reached the conclusion it would not be in the best interests of the City to dispose of the property because this land had been acquired to provide a future street to serve the deep lots off Lante Street, and that it was very conceivable that a street might be required there in the future. He suggested that the City offer the residents a lease agreement so that the residents might eliminate the source of their complaints until the City needs the land to utilize for street purposes. OWNERS & REPORT BACK TO COUNCIL IF APPROVED FOR IMPLEMENTATION 00- Acting City Manager Sexton referred to Councilman Aguilar's report on youth problems in the City and said progress had been made in analyzing it but that it would require additional study by the Staff. The County Department of Urban Affairs and related agencies are conducting investigations into possible financial and social resources that might be applied to community problems. Staff recommendations will follow upon completion of the review and investigations. Rev. Paul Malone, Chairman of the Youth Advisory Commission, said the Commission had recommended that 7 young people be appointed to the Youth Advisory Commission and read a list of suggestions made by the Commission and the Ad Hoc Committee of the City Council of steps that might be taken. He said the Youth Advisory Commission had defined youth" as teenagers from 13 up to 18 years old with anyone from 18 to 25 years old as a young adult. He explained that there are presently 6 adults on the Commission and that if 7 teenagers were appointed, 2 positions would be left open for 2 young adults to be appointed at a later date for the best input of what the Commission is hoping to accomplish. He listed consultants other than regular appointed members who have been involved in the Youth Advisory Commission meetings and invited A1 Benzor to attend the meetings and provide further input. He said that according to the Municipal Code, any Commissioner missing more than three meetings should be removed. Rev. Mat one referred to Mr. Nechak and gave valid reasons why he had not attended unfit the last meeting. He asked that he not be removed and said that the Youth Advisory Commission presently has no specific adopted by-laws but that in the future anyone missing more than three consecutive meetings would probably be replaced without a valid reason. Malone for the Youth Advisory Commission report and suggested that all citizens and City Council support the organization. Mayor Waldo asked Rev. Malone if he thought the City was ready to spend large amounts of money for the youth. Rev. Malone was in favor of the hiring of additional Outreach Workers and urged the implementation of Councilman Aguilar's proposal for a Program Director, particularly in the area of Job Development. He stated there would be approximately $1,200,000 dispersed in the 6-City area through the Mid-Valley Manpower Consortium for job training and that there win be more coming to Baldwin Park during the next year than ever before. He suggested that Staff make a study of what services are now available. Councilman Aguitar referred to the memo of additions and changes to his Ad Hoc Committee Report and listed his recommendations to form an Executive Board to supervise the Youth Program and act as an Advisory Board to the proposed Director of Human Resources. He stated that when the County budgeted taxes, they cut the service organizations. He asked if the City wants to ask them for money right now? Roll Ca11. Ayes: AGUILAR/WALDO. Councilman Blewett requested that Acting City Manager Sexton be directed to have the Staff conduct a survey on all services rendered by the public agencies in the community. The Council concurred. Letter in official files) Irving Stein, 4913 Azusa Canyon Road, Baldwin Park, said the Society was not looking for any grants of money from Baldwin Park. He said the purpose was to bring money and industry into Baldwin Park. He referred to the 52% Mexican/American population and said many of them were severely underprivileged. He said the Society may be able to supply Frank Zarate's Parents and Youth group with funds. He stated the Society hopes to get the business of the private sector of all communities to subscribe to the program, because they feel that the Government is making being on relief so attractive that people are robbed of motivation. He said if 2% of unemployment could be diminished in California, the Government could save $30 Billion a year. He said the business sector is the one that can produce productive jobs. He explained that a one-half hour document- ary of Baldwin Park would be produced in color with the aid of Hollywood actors, showing the City as it is and as it should be to th^ rest of the country to show that one community can band themselves together and that everybody can declare war on poverty. He said he wanted an oppor- tunity to show that this can be done. Councilman Hamilton said he thought this program would work very well with the young adults who are unemployed and can receive vocational training in the program. She said she hoped the citizens will get behind them and move something forward. He referred to the tape recordings and said he would tike to review any dossier on himself, under the Public Information Act. He disagreed with firing the former City Manager, City Attorney and Assistant City Manager without first giving them a hearing on the things they were accused of doing. He said he believed Mr. Sexton knew of the taptngs before the election, as he had said at that time that he did not trust anyone. He accused Mr. Ritchie of being callous toward the public and some Councilmen and told him that he was a public servant of the people. He said the Councilmen were also public servants and did not have the right to argue in front of the public and to degrade the City with their actions. He urged that they attend all meetings that they are paying dues to in order to make intelligent decisions on issues they should be concerned about. 00- Gloria Zook, 4817 North La Rica, said she felt that the League of California Cities was a valuable tool and that she had researched and found that Councilman Kitchel had not attended Thursday niqht meetinas in his capacity as a Councilman. She said counselling there has shown her that they really care for individuals and their children and work with them. He stated the youth need support from the Council and a place for recreation. 00- Sandra Neal, 3818 Athot Street, offered help anytime it might be needed for the youth and stated the $50,000 requested could better be used as proposed by Councilman Aguilar and the committees than for a new City Hall. She said she thought the youth were ready to reciprocate if given a chance, as there had not been the violence during the last 3 months of meetings that had been suffered previously. She was opposed to keeping an individual on the Youth Advisory Commission that cou1dn*t make 5 meetings and was in favor of placing A1 Benzor on the Commission. 00- Tom Carpenter, 4346 Jerry, Chairman of the League to Preserve Constitutional and Civil Rights, said his organization was opposed to the upholding of storing personal, non-criminal information accumulated in the computer system. He contrasted it to the operation of the Gestapo and tactics used in other countries to subdue the citizenry. He read from Public Law 9383, Section 524» paragraph b, relative to the accumulation and storage of this information, and stated that collecting private information was not lawful and that it should have been purged years ago. Mayor Waldo said Acting City Attorney Ritchie had informed him that this was a Federal Act. Mr. Carpenter read further that any individual who believed that criminal history information concerning him contained in an automated system was inaccurate, incomplete or maintained in violation shall be en- titled to review and obtain a copy of such information, and that anyone violating the rules of Section 524 of Public Law 9383 may be fined not to exceed $10,000. He repeated that he was opposed to the acceptance of the Draft Environmental Impact Report for the construct- ion of the proposed City Hall and stated his reason as given before. He said the funds to be used would have added from 20 to 30 police with partial or complete equipment to the force for the last 4 years. At 10:30 p.m. Acting City Attorney Ritchie left the Council Chambers 00- Juan Jimenez, 3337 1/2 Del Mar, Rosemead, said gangs are expanding aft over southern California and that Baldwin Park faces the same problems as most other cities. He stated he had expertise on barrio problems and felt sensitive to the cry for help from the people. He said if alt the Mexican/Americans in southern California were organized, everyone present at the Council Meeting would be in trouble and that they were lucky to have the manipulation and control of them now. He stated that the Federal monies received by each city are geared by percentages for gang problems, city improvements and various things but that most people do not know the laws and are being manipulated. He said the people here were the crime organizers and not the gangs, if they do not recognize the proposal submitted to them by community people and implement the crisis.
