Melvin J. Bell, Sr., Hays Tabernacle Christian Methodist Episcopal Church, Los Angeles, California. Councilman Blewett led the salute to the flag. There were no objections. 00- City Clerk Balkus stated that an Employee's Safety Award had been presented to the employees of the City of Baldwin Park by the League of California Cities. It was a second place award for the period of July 1, 1975 to June 30, 1976. She presented it to Mayor pro tern Kitchel, who accepted it on their behalf. 00- Acting City Attorney Ritchie stated that the Public'Hearing had been conducted, testimony had been heard and alt exhibits had been received regarding the adoption of the Redevelop- ment Plan and the Environmental Impact Report for the proposed San Gabriel River Redevelopment Project. He recommended that action be taken on a Resolution and two Ordinances. One was an Urgency Ordinance which was substantially the same as the other ordinance except for the paragraph pro- viding it shall take effect immediately under Section 36937 of the Government Code. Director of Planning Kilgour said this was a continued Public Hearing from November 3, and since then the staffs from Commercial Industrial Development and the Planning Department have met with Mr. Donald Sodara of Sixpence Inns and advised him of the need to revise his plans and meet other requirements for owner participation. The Sixpence Inns plans are being revised to accommodate a better land use plan and improve traffic circulation and access. The property owner was In the process of preparing an environmental impact report as required in the Redevelopment Plan. Staff had recommended that the Public Hearing be continued until February 17, 1976, at which time a draft environmental impact report and revised development plan should be available to aid in the City Council's decision on this matter. Director of Planning Kilgour referred to his Staff report, including environmental notice data, case history, inform- ation about land use and zoning, analysis of the request, effect of the zone changes regarding the number of units which could be developed on the individual lots, a land use and zoning map and map identifying the lots. Fifty four multiple family dwellings could be constructed on this land. He said the Planning Commission had recommended approval of the zone change. Tom Cotwick, 3706 North Puente Avenue, the applicant, spoke in favor of the zone change. He said he hoped to develop with different zoning and that the present zoning was prohibitive through taxes. NO. 747 INTRODUCED It was the time and place fixed for a Public Hearing on SP-30. A Specific Plan to establish setbacks and standards for all new construction and landscaping requirements for properties on Badillo Street, Ramona Boulevard and Puente Avenue Ramona-Badillo- Puente Industrial Neighborhood). Initiated by: Planning Commission. Publications and postings had been accomplished. There were no written protests. Director of Planning Kilgour referred to his Planning Report and the information contained therein. He said this Plan would formalize building setbacks and establish setbacks and landscaping requirements for industrial areas where inconsistencies exist. SP-30 covered the triangular, industrial area between Ramona Boulevard, Baditio Street and Puente Avenue, presently zoned M-1. He said that traditionally developers have set their buildings back 5 ft., where there is no setback required, and left this space for landscaping. There had been concern that since this was optional, someone could construct closer to the street and block the view where there was a setback. SP-30 would also require landscaping in areas which had been set back but had not been landscaped. The minimum setback will be 5 feet on Ramona and Puente Avenue, and 10 feet on Badillo Street with distance measured from the center line of the street. He distributed an aerial photograph with a red line indicating the frontages of the properties involved among the Council, in addition to maps included within his report. He confirmed that he had discussed this with current industrial developers. who are the ones who had set this pattern of set back arrangement. As there was no testimony in behalf or opposition to SP-30, Mayor pro tern Kitchel declared the Public Hearing closed. Proper postings and mailings had been accomplished. Director of Public Works Lathrop said a letter had been received that afternoon from the owner of the property. Reverend Melvin Bell, protesting the cost of the abatement. He distributed copies of the letter among the Council. He said a hearing had been held before the City Manager on August 3, 1976, which Reverend Bell had been unable to attend. Reverend Bell had not set up an alternate date for the Hearing, so the meeting had been held on that date in his absence. It was determined that a public nuisance did exist because of trash, debris, broken tree limbs, deteriorated chicken coops and weeds on the property, and 3 weeks had been a]lowed for abatement on the nuisance. Reverend Bell had been sent this information, but at the end of the abatement period no substantial work. had been done. Staff had taken bids for abatement of the nuisance and the work had begun on November 1, 1976. Contract cost was $647; administrative cost to abate the nuisance was $97.05 for a total bill of $744.05 for the work. Councilman Hamilton referred to Reverend Bell's letter which stated that 90% of the work had been compieted. Mr. Lathrop said that according to the Staff and pictures which had been taken on the property, very little work had been performed when the contractor moved his equipment in to abate the nuisance. There was no evidence that the owner was proceeding with any diligence to abate the nuisance. The owner had not contacted the departr ment that he was abating the nuisance or that he had Intentions of doing so. Melvin J. Bell, Sr., 12885 Salisbury, said he had appeared in Mr. Cunningham's office the day before the first Hearing and explained that he had a funeral on the following day and that unknown persons were dumping trash and debris on his property. He said he had dismantled lead pipes and other material such as cement blocks and stacked it, but it had been removed during the abatement, as well as a shed that served as a fence. He said he had asked that it might remain standing until he had finished the work, but now that it was torn down, the property was left wide open for anyone to do whatever they wanted to do. He stated some of the debris was still there following the abatement. He said he felt that his cost would be nearly $1000, due to the loss in lead pipe, lumber and cement blocks, and asked for special consideration Tom Carpenter, 4346 Jerry, Chairman of the League to Preserve Constitutional and CiyiJ Rights, stated he had protested the procedure for public nuisances at the time it was written into the Municipal Code and several times since. continued) December 2, 1976 Page 5 PUB. He stated he did not think the City had the right to go on an individual's property and that he protested Reverend Bell's case, and would protest every one of the public nuisances. As there was no further testimony in behalf or oppos- ition to Public Nuisance 76-N-17, Mayor pro tern Kitchel declared the Public Hearing dosed. Reverend Bell said that only about two-thirds of the debris had been removed from the property. He had been in the process of doing his garage, because it had been bashed in, and several thousand feet of lead pipe and other materials had been removed. He said that now that he had finished his garage with new lumber, it had been bashed in again. Acting City Attorney Ritchie asked what the estimated cost for the abatement was based upon. Mr. Lathrop said it was based upon a lump sum bid to do the work. This work had been performed by a firm from Montebello. He stated that they try to get at least 3 bids and that if they failed to get more than one in this case it was because contractors had failed to respond. Mayor pro tern Kitchel asked whether Staff went back to see if this was abated. Mr. Lathrop stated they have the before" and after" pictures in the file. He circulated the pictures among the Council. Mr. Ritchie asked whether a format appeal had been taken from the determination of the City Manager. Mr. Lathrop said an official notification of the decision reached at the Hearing had been sent to Reverend Bell and he had been advised of his right to take an appeal. When the appeal period ran out, they had proceeded with the abatement and this was the resultant cost. He said a certified mail delivery receipt of the letter advising Reverend Bell had been returned dated August 7, 1976. Reverend Bell said if the pictures were made since August 27, they wouldn't show what had been done. But if they were made prior to that, they would show everything. He said around the 27th of August the lead pipes had been taken down and other work done. He said he would like for someone to go with him to inspect what had been left. He said he had been told the pictures were made prior to August 27, 1976. Councilman Aguilar stated these pictures were dated November 1, 1976. He said this had been correlated with the Youth Activities Advisory Commission and the intent was to analyze the report and hopefully come up with a program of action that will have benefits to the youth. If the report is completed earlier, it will be presented at the first Council Meeting in January; if not, a status report will be given on progress to that point. 00- Director of Public Works Lathrop referred to a request by petition for a school crossing guard at the inter- section of Tracy Street and Frazier Street to serve the Tracy School. The City Council had referred the petition to the Staff and the Traffic Committee for review and a report. There were two warrants that had to be satisfied if a crossing guard was to be placed at such a location: was the intersection within 600 ft. of a controlled crossing and does the traffic volume exceed 350 vehicles per hour during each of any two hours during which 40 or more school children are crossing the street? He said this intersection wasin excess of 600 ft. of a controlled crossing, and the answer to the second warranty was yes," so the two basic warrants have been satisfied. There was excessive speeding on the street and Frazier Street, at this location, was 60 ft. wide between curbs and youngsters crossing the street have a longer period of exposure to traffic accidents due to the street width. Based upon all factors considered and examination of other locations throughout the cowunlty tfhere crossing guards existed, it was the unanimous reco-Bendation of the Traffic Committee that a crossing guard be hired and placed at this location. City Council toniqht had approved a request fot bbulevard stop signs at the Intersections of Tracy Street and Frazier, Street and the relocation of the crosswalk on Frazier Street from the southerly Tracy Street to the more appropriate north1y location had been ordered. Mr. Haltoway said this fiscal assistance was Title II of the Public Works Employment Act of 1976. The-money must be expended within 6 months of receival and wi'11 be used to continue on-going programs or services. For example, if faced with a layoff of personnel the money could be used to retain personnel as long as possible. He said they want a Council that will take care of the people in the community rather than special interests. 00- James Garrow, 1011 North Baldwin Park Blvd., spoke in favor of the movement for progress and pointed out the achievements of Mr. Sexton in former positions. He defended members of the Council and stated that workers are not encouraged by accusations and being berated continually. He referred to many new businesses in Baldwin Park with more coming in, and said it was because of guidance that there was all sorts of progress. 00- Tom Carpenter, 4346 Jerry, said the power of the City Council could be extended to every private property owner, but that instead they had drawn a line around the property they had designated for redevelopment and cited an urgency to adopt the Ordinance. He stated the property owners may bring the City to court to try to stop the redevelopment, because the property was not blighted. He said that with proper guidance he hoped this could be done and that every Council member would be ousted. He stated that individuals opposed to CRA had received 42% of the votes two years ago. 00- Jeannie Martins, 14621 Channing, apologized for the inuendos and remarks that had been made to members of the Council and said she appreciated what they were doing and hoped they would stick." 00- Councilman Aguitar responded to Mr. Zayas"s comments regarding recall and to Mr. Carpenter regarding the power the Council can extend. He stated that if he had the power there would be no unemployment in the City and the citizens would have shopping contacts. He said Mr. Carpenter had the power and asked that he show the Council that they were wrong with redevelopment. He said if he had a better plan he would join him and fight for it. See Page 10A for amendment) 00- Councilman Hamilton expressed concern over the dissention and lack of unity between member of the Council and the citizens. He extended an invitation to meet with any individual at their convenience for discussion and their recommendations for im- provements. He said he had tried to make decisions that were beneficial to the City, and that it was costing him money to sit on the City Council. It had been a privilege to serve the City and he had served because he thought a11 Americans should do what they can to help their City, county and nation.
