She said Warrant No. 6448 should be corrected to read $72.99 rather than $75.99 and be adopted as amended. Councilman Blewett requested that Items 6 and 8 be removed from the Consent Calendar for discussion. Councilman Blewett referred to Item 6 of the Consent Calendar and s?id he was opposed to raising the fees, as he had been negatively affected by charges for public records in the past and would not want to see citizens treated shabbily. Acting City Attorney Ritchie explained that the cost of one sheet would be raised to 75<t, with each additional sheet 10(. He said this was about the structure before the State Law was changed last year so that 0i per sheet was the maximum that could be charged to duplicate documents. The legislature has changed the law again to allow the City to fix a reason- able fee, based upon the City's cost for duplication. He said he had asked the City Clerk to analyze what the costs were. and that she had prepared a lengthy analysis of the time involved in research, making the copy, writing the receipt nd getting back to whatever they were doing. He said a lot of time and City money is expended and the City has a duty to the taxpayers who don't come in often and ask for documents. The cost should be borne by those who have the need and is not out of tine with what law firms, business firms and others are charging for the time of their personnel. City Clerk Balkus said that a11 of the copies reprinted do not come through her office; other departments are involved. She explained the time and difficulty in researching a document before it is reprinted and said that they tried to reach an average. Mr. Ritchie said that there is no cost for looking at a document at the counter. He did not think a judgement could be n^ade on how much trouble it had been to reproduce individual documents and that a fixed fee had to be set. continued) December 16, 1976 Page 2 APP. Councilman Blewett referred to Item 8 on the Consent Calendar and said he did not understand why the City would want to purchase the property for a park, other than that the price was right on the tax delinquent land. Council discussion followed, with the consensus that the property would be better used for other purposes than a recreational use. NO. 6-102 ADOPTED ITEM 8 OF CONSENT CALENDAR REMOVE ITEM 8 FROM CONSENT CALENDAR & DO NOT PURCHASE PROPERTY Director of Public Works Lathrop advised the City Council that if the City does not purchase the property and if it is not recovered by payment of back taxes and penalties by the former fee owners, it win be auctioned off and someone else wilt be acquiring it. He said he and Mr. Philip Sexton and Mr. Lucas had agreed that the house on the property would make an ideal facility for some of the human resources programs presently being developed by the City. It could be used for senior citizen housing or programs. Councilman Aguilar said that for $5000, the City has the ppportunity of buying a building the youth could use or that could be used as a day care center. Councilman-Hamilton said that his understanding had been that it was to be used for a park. and that he would withdraw his motion in light of the other suggestions. Councilman Blewett said he would withdraw his second. Mr. Lathrop said the deadline for making an offer to purchase the property was January 8th or 10th. Councilman Blewett said he had many questions he wanted answered: who, how, whether the building is up to the standards of the Field Act if it is to be used for public purposes, whether the lot can be split and whether other residences can be put on the property. He would like to see a report on this before voting. Mr. Ritchie suggested that Mr. Lathrop calculate what the revenue might be to the City if the property goes continued) C. There wiere^o objections. 00- ttty Clerk Bat^us administered the Oath to those in the audience desiring to be heard during the meeting. t: 00- It was the time and place fixed for a Public Hearing to consider the cost of abating the public nuisance at 4655 Maine Avenue, Case No. 76-N-33. Proper postings and mailings had been accomplished Director of Public Works Lathrop said a hearing had been held on October 4, 1976 before the City Manager, and the property had been declared a public nuisanpe due to buildings which needed repair and to an accumu- lation of trash. The property owner had been notified of the hearing, but had failed to appear. He had also been notified that an abatement had been ordered but had failed to comply or contact the City. The City had contracted to have the buildings demolished and the property cleared. The total cost, including administrative charges, had been $1276.50. As there was yio testimony in behalf of or in opposition to Pyblic Nuisance 76-N-33, Mayor pro tern Kitchel declared the public hearing closed. City Clerk Balkus read by title: RESOLUTION NO. 76-103. There were no objections. 00- Cfty Clerk Balkus stated that a written communication had been received from the Mid-Valley Community Mental Health Council. Dr. Saif Ullah, Executive Director, gave a presentation on behalf of Mid-Valley Community Mental Health Council. He explained their operation in the community, with the aid of grants received under general revenue sharing from the County, the Office of Criminal Justice Planning, the State, the Dept. of Health Education, the Dept. of Health and from the cities as matched monies for grants. The $237.500 grant given by the Office of Criminal Justice Planning for a period of three years will end January 31, 1977. He had been working closely with the legislator;? of the community to develop legislation at the state level to replace the present monies received that would have helped to continue the program. continued) December 16, 1976 Page 4 D.P.W. The monies for social service programs for the county had been eliminated by the Board of Supervisors, but Mid-Valley's contract had been extender through March 8, 1976. He said the Agency y<i11 be forced to shut down or be severely curtailed unless money can be raised to continue the program. Proposals had been submitted to 34 foundations a and the United Way A.I.D. campaign, efforts and contributions from citizens had been donated. He listed the services that are provided to Baldwin Park through Mid-Valley, and said money was needed to sustain the Agency for about one year. He said that would give them a chance to maintain one-half the level of operation if the County revenue sharing is discontinued past March 8, and at the fu11 level if the revenue sharing is continued, and if the six cities who participate with the Mid-Valley program contribute $1 per capita on a one-time-only basis toward their operation during the coming year. Mayor pro tern Kitchet stated he would like to direct COUNCIL DISCUSSION the Staff to study other organizations who are also in need of money and come back with a report at the next Council meeting. Councilman Aguilar spoke in favor of contributing the funds requested by Mid-Valley Mental Health Council. See Amendment on Page 5A and 5B) Councilman Hamilton stated that he did not want to see M1d-Va11ey Mental Health Council discontinued, but was in favor of donating $1 per capita only if a11 the participating cities contribute the same. He did not object to having the Staff prepare a report on what the priorities were. Dr. Ultah said 8 counsellors and about 10 hot line personnel had been laid off, and if the Office of Criminal Justice Planning funding ends January 31, 1977, the Agency will be shut down by half on that day. The other half will be closed down if the County has not acted by March 8, 1977. They must prepare now to start closing half the Agency by January 31, 1977, if they do not receive the assurance frpm the cities of the continuation of their money. Councilman Btewett, President and one of the co- founders of Mid-Valley Community Mental Health Council, spoke in favor of their quality oriented organization and the way they service the needs of their people. He s?iid their organization was the envy of the nation, state and county, and the reason they were so success- ful was because of their superior staff, who wi11 be looking for ways to support their families soon if funds aren't forthcoming. He stated that Mid-Valley was a quality program that was an exception to most social service agencies and was in favor of acting on the request that evening. Councilman Blewett suggested that a tetter should be sent to Mr* NtcholS^ complimenting him on his landscaping efforts 00- Actlng City Manner Sexton referred to the 1977/78 Community Development Block Grant Cooperation Agreement with Los An§eT«s County. He said authorization was needed to execute this preliminary agreement in order to be eligible for $706,000 to $760.000 funding for the following fiscal year. DEVELOPMENT BLOCK GRANT COOP. AGMT. WITH L.A. COUNTY Mr. Sexton explained this was the third year of funding. An HCD review panel had convened and discussed and made recommendations relative to these funds. With author- ization of this agreement, the next step was refining how the money is to be allocated. One of the recommend- ations of the Review Panel was that a major portion of the money be devoted to funding rehabilitation of houses within the comnunity. He said that the City will be receiving another $3,000 from CHFA, another state program, if requirements are met and documents are executed. The City wilt have about $1 Million to be used in housing community development next year. Director of Planning Kitgour said the Housing and Community Development Review Panel had made a recommend- ation that the purchase of the remaining Pacific Electric Railroad right-of-way be considered with a maximum limit of $100,000. So we have a lot of programs from youth, but mental health is something that has to be coped with, Mr. Mayor." It seems now that there should be a law against Thanksgiving and Christmas. Go down to Mid-Valley and talk to those lonely people down there who are having Christmas come and really don't know where they are going one way or another. Thank God for the motivation of Mid-Valley that when those lonely people start talking to themselves about suicide they have somebody to call. It is sad, because for the people that have it is a beautiful day. For people that have nothing or are lonely, it is a sad day and that is one good thing about Mid-Valley that they are there to help people. And money, money, money if that is the problem, gentlemen, we are never going to get anyplace with this. You said yourself, Mr. Mayor, that to make money, you have to spend money, but to help people, that is more important than spending money. If you remember last year in our Christmas, when we played Santa Claus last year for the Jaycees, giving toys away for the under-privileged kids, it was sad to walk into a house and see the kids with nothing. But just remember this, too, that people when it's Christmas are lonely. They don't have nobody else to talk to. That is a lonely feeling. You can be in a room when it's crowded and still be alone. And I have talked to Saif a lot. I know most of the people down there at Mid-Valley. It is a good organization and helps a lot of people. With Christmas coming, now that Thanksgiving is gone, you have got to have somebody for people to talk to. A lot of people say that they have their church to go to. A lot of people don't go to church so who else have they got to talk to? Thank God for the Hot Line." So you say to study it. Next Council Meeting, after Christmas, that is a long way to wait to see if Mid- Valley is going to exist or not. Because here in Baldwin Park, you go down to Mid-Valley at our Center here it's packed. It's never empty. So I can't see what the wait is. Mr. Hamilton is always talking about spending money, spending money, not here to spend the taxpayer's money and that we are going to end up like New York. Well, you've got to remember one thing New York had their own hospitals and their own welfare. We don't. True, this money we are spending is the people's money. It's not my money. It's the people's money. So, gentlemen, they are asking for money but mostly for help. Not just cash money but job positions CETA positions or don't care what it is. The Hot Line" we could hire temporary help. There is a lot of ways to help this organization that helps a lot of people. The sad thing about it a lot of people think mental health is no disease, but it is the biggest disease we have now, cause with all the pressures that society has put among people, it is a lot of pressure." There were no objections. 00- Acting City Attorney Ritchie reported on progress made on Mayor Waldo's request regarding what could be done about pornographic material being sold that could be harmful to minors. He said there was a Penal Code section that made it a crime to sell or offer to sell to minors material harmful to minors. Some cities had adopted Ordinances that required that somebody be stationed at newsracks in order to assure that material harmful to minors wouldn't b^ sold to them or the newsracks would have to be taken off the street if not attended. That had been tested in court and failed. The courts had held that that was an unreasonable burden upon free speech. If the material was pornographic, it can be seized and the operator of the store and the publisher prosecuted for selling pornography. The Supreme Court had such a vague and useless test for pornography that it was almost impossible to get a conviction except for the grossest and hardest core pornography imaginable. It was necessary to buy the material and turn it over to the District Attorney's office, and they sent it back saying they couldn't get a conviction under the present law. They object to putting a teenage victim through the rigors of a trial and cross examination. He referred to 250 vans that were going to be turned back to the County senior citizens unit when the mobile attorney service is closed down at the first of the year due to lack of funds. He had been informed that the vans could be put into operation by the cities, and asked if the Council could investigate providing this service.
