Approval of Final Acceptance of Project No. 139 West Ramona Boulevard Improvement Councilman Aguitar requested that Warrant No. 6710, Claims and Demands, be pulled from the Consent Calendar until report regarding Mrs. Duncan's case and investigation of wire tapping has been completed. Assistant Acting City Attorney McEwen stated that her file had been received and a report should be ready by next Council meeting. Councilman Blewett asked that Warrant No. 6745, Claims and Demands, be held for discussion, inasmuch as the Treasure Chest publication of Christmas wishes had been unauthorized and was politically motivated to solicit support from the Treasure Chest. Mr. Sexton asked that a Warrant No. be added to the Claims and Demands Resolution for $5000 to the Chamber of Commerce, consistent with the terms of the offer made at the last Council Meeting, with the understanding that in 60 days a contract wilt be negotiated which will extend further agreements with the Chamber. Councilman Aguilar stated to Mr. Mooney, President of the Baldwin Park Chamber of Commerce, that it was not the Intent of the Council to tear the Chamber apart nor to keep money from them. He clarified that the Chamber had been told at their meetings to hire a top-notch" manager so that the Chamber would be run the way the Chamber should and that $38,000 had been offered by the City at a meeting at Howard Johnson's. His job was to get membership and bring industry into the City. Mr. Mooney said they had hired Manager, Mr. Clay ton, whose qualifications were exemplary. His impressions from the previous meetings were that the Council would help to obtain a Manager, an Assistant Manager, a girl In the office and another assistant but they had not received approval yet, although they had submitted a reasonable budget. They will be unable to renovate the office or hire an assistant or an extra girl on the $2500 they will be receiving. They had intended for the Directors to go to seminars or to have someone come in to instruct them in what would be good for Baldwin Park, but they have to have r^oney first. Councilman Hamilton suggested the Chamber and the Staff get together on questions regarding the budget and be prepared with a contract; in 60 days, Mayor Waldo stated the Chamber and the Council are not that far apart but must sit down and iron out the bugs" in order to have a viable Chamber. ADD WARRANT NO. FOR $5000 PAYMENT TO CHAMBER OF COMMERCE M/S/C: AGUILAR/BLEWETT. Roll Call. There were no objections. The motion carried. Councilman Blewett referred to Warrant No. 6745 for $400 for advertising Christmas greetings in the Treasure Chest. He stated it was an unwarranted use of the City's money to place advertising in a newspaper, other than that required by law, and this was the third ad at $400 each time. Greetings had already been extended by the Mayor in the City Newsletter. Councilman Kitchel stated that he thought it was appropriate to wish the citizens of Baldwin Park holiday greetings. They had been asked by the Acting City Manager through the weekly Newsletter what mode of greetings they would tike. For $400 they could wish alt the citizens a holiday greeting, as opposed to sending Christmas cards to selected political favorites. Councilman Hamilton said in 1975 it had cost the City $112.32 to send 400 Christmas cards. In 1976, it would have cost $117.30 with the increase in postage. Out of 400 cards, 165 cards had been mailed with 235 cards put in the employee's envelopes. He said many of the employees live outside Baldwin Park and he felt it was a good gesture for the employee to receive a personal Christmas card from the Council. The Christmas cards that were mailed were mailed to represent- atives of the state and federal government, Board of Supervisors and Presidents of service dubs in town. He had responded that he was in favor of mailinci Christmas cards but had not been totd anything about putting a greeting in the paper. He said he objected to this. The extra cost to the City of about $252 could have been spent more wisely. Acting City Manager Sexton stated that Staff had made a report that the cost for mailing the 4'00 Christmas.cards. Cost benefit was greater to circulate the news ad to 14,000 residents of Baldwin Park through the Treasure Chest, which newspaper auditing indicates has the widest coverage in Baldwin Park. Councilman Hamilton said there was no way it could come up to $300» as figuring five hours for address- ing the amount of mail going out at $7.00 per hour would cost only $35.00, and he had the cost in 1975 and what it would be in 1976 with the increase in postage and the estimated time it would take to address 165 envelopes with the balance of 235 employees having only their name put on them and inserted in their pay envelopes. CLAIMS AND DEMANDS 00- City Clerk Balkus read a written communication from the City of Livingstone regarding illegal entry of a-Tiens into this country and referred to the attached Resolution. APPROVE-A SIMILAR RESOLUTION FOR THE CITY OF BALDWIN PARK. M/S: BLEWETT/HAMILTON. a! Mayor Waldo requested that the Acting City Manager contact the City of Livingston as we11 as the County for further information before initiating *a Resolution. Councilman Hamilton spoke in favor of supporting legislation as outlined in the proposed Resolution. Councilman Aguilar said he wanted more information on Congressman Sisk's bill regarding identification of illegal aliens so that their rights were not abused. Councitmen Blewett and Hamilton withdrew their motions. Councilman Btewett requested that a report with further information be given at the next Council Meeting. 00- City Clerk Balkus referred to a letter th^t had been received regarding additions to the previous Minutes and asked if the Council wanted to discuss this. The revisions will incorporate the requirements of the Federal government and allow for expansion He recomnended that the architect Grimsgaard) be authorized to finalize the plans, specifica- tions and related building documents for advertis ing by February 3, 1977, the fee not to exceed $28.625. Discussion followed regarding the changes to be made before contractors can bid on constructing the facility, and whether money would be needed in addition to the grant. He said the Staff suggested consideration of the median opening appropriate if the owners would cooperate with dedication of the necessary right-of-way in order to construct the street improvement. The City's previous policy of constructing curb, gutter and other related street improvements with dedication may be appropriate in this instance. He said the last time the property owners were contacted, it had been presented to them that they would have to dedicate and pay for the improvements, under the 1911 Act, but now with the additional consideration of the curb, gutter and street improvement program used in the past, the City could consider re-initiating that program and apply it to Rhodes Lane. There would be no cost to the property owner other than dedicating the necessary right-of-way for the street. Acting City Manager Sexton clarified that i"t was a separate issue whether the Council wanted to establish a policy for areas of extreme public interest or areas that have some unique aspect. Discussion followed regarding programs in the past and whether everyone who had dedicated land had had their curbs and gutters and pave-out paid for by the City. Mr. Lathrop stated there was $7500 in this year's budget with which to complete prior years commitments under this program, but that was the extent of this program. He said the program for HCD funds had already been firmed up" but could be further examined; Gas Tax funds could not be recommended as they are committed to complete major street projects and the matching money would be lost or other programs would have to be cut back, so it may have to be an appropriation from the unappropriated general fund. The street was already lighted and sewered, and could be a fully im- proved street with only curbs and gutters and concrete driveway approaches. Concrete sidewalks would not be included. The cost would be approximately $25,000 for the Improved street, with another $3000 to construct the median for a total of about $30,000. Council discussion followed. The consensus was that the Staff should contact the residents to find out if they will dedicate the street if the City wi11 pay for Improving it; what the cost wi11 be what funds might be used and research the policy of subsidizing property owners to convert their private streets into public streets and come back with a recommendation to the Council. RESCIND PREVIOUS ACTION ON RAMONA BLVD. MEDIAN OPENING AT RHODES LANE WITH STIPULATION THAT COUNCIL AND STAFF RESEARCH POSSIBILITIES OF FINANCING OR SUBSIDIZING AND FINDING AVAILABLE FUNDS TO BE USED WITH DEDICATION OF THIS STREET. The property owners and Staff concur that the land should revert back to the property owner to be put back on the tax rolls. Mayor Waldo requested action on the Resolution. RESOLUTION NO. 77-8, DECLARING ITS INTENTION TO VACATE A PORTION OF BALLENTINE PLACE 77-V-1) RESOLUTION NO. 77-8 ADOPTED AND FURTHER READING WAIVED AND PUBLIC HEARING SET FOR FEBRUARY 17, 1977. The motion carried. 00- The report on Youth Problems by the Chairman of the Youth Advisory Commission was held over until the next City Council Meeting. 00- Councllman Hamilton requested that the updated Zoning Code be brought before the Council for study and adoption. Acting City Manager Sexton explained that the Zoning Code had been updated and circulated and the Staff had decided to develop a new one to reflect growth trends and development possibilities of the community. The new Zoning Code was delayed when the expertise of the Planning Department was utilized during the Re- development Project Plan and the EDA Grants, but is being typed now. Director of Planning Kilgour said the two major sections being reworked In draft form should be circulated in two or three weeks to the Staff and to the public in two or three months. Zoning was being approached from a different standpoint; the pattern of the past had been thrown away and there should be some new thoughts to help in the future. 00- Councilman Aguilar requested that Warrant No. 6752, another bi1T relative to Mrs. Thelma Duncan that had been overlooked, be pulled from the Claims and Demands. Assistant Acting City Attorney McEwen said this may be a payment to the attorneys who represented the City for the Workman's Compensation Appeals Board. This bill win be included in their report. One of his neighbors will consider dedicating his property if he is given permission to move his house back, and others will if the City will construct curbs and gutters. He urged the Council to expend funds to improve the street and to contact the property owners. She said she resented being called a gadfly" in the Treasure Chest by Councilman Kitchet as a word chosen to describe the public who come before him with questions into the role he plays as a City official. 00- Tom Carpenter, 4346 Jerry, stated that Councilman Aguilar had had his statements quoted verbatim in the City Council Minutes and that he wanted the letter he had sent to the Council in the Minutes as follows: The Minutes of January 6. 1977, covering the Council Meeting did not reflect rny complete statement. I request you show that I stated as follows: I questioned who owned the tape recorder that Mr. Aguilar bought a battery pack for $32.00 on his trip to Washington by way of Baltimore. Did the battery pack belong to the City? I questioned the $30.00 charge from Baltimore to Washington. D.C., which I had been advised by the Baltimore Airport costs $4.00 by airport bus. I questioned the $30.00 from Washington, D.C. to Dulles Airport, which I have been advised by Dulles Airport to cost $4.75 by airport bus. I stated that Mr. Aguilar had no expense explan- ation on his expense account for these and other items, and you can reference the recording of your Council Meeting which I have taped." He stated he had no intention of arguing in a private room about expense reports, as the answers should be itemized on the public document itself. He listed expenses of the West Covina Chamber of Commerce. He said the Baldwin Park Bulletin had ripped off" the City for years with the City adver- tising, but published issue after issue without one item about Baldwin Park. 00- Councilman Blewett requested that Director of Public Works Lathrop present each Council member with a list of the private streets in the community so that they might a11 look at them. 00- Councilman Aguilar stated he had arranged to meet Mr. Carpenter at 5 o'clock the day after the Council Meeting to discuss expense reports but that Mr. Carpenter did not come. He said he pitied him if he needed an audience to bring out his points. 00- Mayor Waldo responded to Mrs. Neat's reference to the County meeting which he had attended, He explained that mayors representing districts of the County Sanitation Board attend and that his total time there was about 20 minutes, spent representing Baldwin Park's two districts, and was not a long, gruel ing thing and quite different than a Council Meeting. 00- Councitman Kitchel stated that if Mrs. Neal resented the term gadfly," she should go back and revise her vocabulary used in the charges leveled against him in the recall effort.
