The motion carried. 00- City Clerk Balkus administered the Oath to those in the audience desiring to be heard during the meeting. 00- It was the time and place fixed for a public hearing on Z-403 An Application for a Zone Change from Zone C-1 to R-1 on property located at 14345, 14347 and 14349 Be11brook Street. Applicant: Karl Bryant and Larry Koopmans Publications, postings and mailings had been accomplished. There were no written protests. Director of Planning Kilgour presented a brief resume of the surrounding zoning and land uses, location of property and analysis of the applicant's request. An assessment for environmental impact had been prepared, posted and filed. He said the applicant was develop- ing a parcel map consisting of three parcels involved in the zone change. The General Plan indicates the area for R-1 development and a Specific Plan indicates the completion of the cut-de-sac on Bellbrook Streets which Is all part of the parcel map. If the zone change is completed, that would be further implement- ation of long-range plans for residential development on the end of the cul-de-sac. The recommendation from the Planning Commission was that the City Council approve the zone change and certify the Negative Declaration of Environmental Impact. Copy in official files) Betty Hawkins, 3811 Tory, stated that the Assoc- iation's goal was to organize Baldwin Park into neighborhood watches to protect their homes and personal property. They want to have their meetings in their own homes and not at the Park. They would tike literature and attendance of an officer now and then. There are five more neighborhoods that want to organize. James Hampton, Treasurer, restated that the reason the meetings should be in their homes was'that they did not want criminals attending the meetings if they were held in the Park. Barbara Engle, 3812 Tory, Secretary, said it was safer to keep meetings in small areas where everyone knew everyone else, as their neighborhoods were not being watched while they were having a meeting in the Park. She clarified that the over-all organizing of the Watch would be under one management, with individual chairmen on the blocks. Mayor Waldo stated there were over 220 individuals involved, with other neighbor- hoods criss crossing the community wishing to start. Council discussion followed regarding how many coin operated and open pool tables there were in the City and why there was a difference in the fees on two different types of pool tables. Director of Finance Hattoway distributed two sections of the Code which cover the licenses involving pool tables. He said he could only speculate why Council had set the different fees but the distinction in the Code is that one table is hourly and the other is a coin operated machine. Mrs. Garcia said she could not tower the fee charged on the coin operated table as the price is set by the amusement company which installed them, but sfte could lower the prices on food. Assistant Actinq City Attorney McCwen said the problem was a matter of uniform classification. If the Code was going to be revised to permit a machine in this type of business to be operated with a lower business license tax, the whole business license code would need to be revised. That portion of the business license tax provision is to permit a different classification of machines. He recomnended that the necessary recommendations be made to change the classification after being taken under advisement. Mayor Waldo requested that the Assistant Acting City Attorney and the Staff make an investigation into the matter and report back to the Council as soon as possible. 00- Acting City Manager Sexton stated that the City now has possession of the LDS church property and that It will temporarily be used in conjunction with the Dept. of Recreation and Park's operation. Negotiations have been under way to select an architect to rehabili- tate the Community Center and to hire a planning/ architectural design firm to deal with the impact upon the area with the pending construction of the Public Services Building. He said that after the proposals and input from the negotiations, they had concluded to combine the work under one work agreement to provide the services necessary for the Community Center, the Public Services and Civic Center Site study and work necessary for movement of the maintenance yard. Utilizing the services of a single firm as the City's architect to coordinate the variety of assignments will resolve the responsibility of accomplishing the needed work done in a timely and efficient manner and be less costly to the City. He said they are recommending the firm of Pull lam, Matthews and Associates be awarded the contract for a total amount of $34,000. Councilman Blewett said it seemed that the City had been using the same consultants over and over. He asked if the original architect, Maurice Fteishman and Associates, had been considered for this contract. continued) ASST. His precise role is as an architect while PuTh'am and Matthews and others considered had specialized skills in land planning, architectural and design review and rehabilitation services. Councilman Blewett said he didn't understand Part 3 of the study and felt most of this could be done in-house. Part could be done by an architect and part by a study group. Mr. Sexton stated there would be impacts that needed to be measured and that the work on the City Maintenance Yard requires architectural design and assessment of space needs, all of which is beyond the expertise of the City staff. He listed other firms who had been considered for the contract. Councilman Kitchel said that all aspects should be analyzed in tight of the anticipated economic boom that is expected. The City Yard, the City Halt and Community Center a11 need to be studied to see how they are going to fit in the conmunity and down town area. Councilman Hamilton was in favor of having the study on the maintenance yard done in-house rather than by an outside firm, and concentrate tonight only on the Community Center and new City Hall. Councilman Aguilar said he wanted to plan for tomorrow and that a study would show the impact of the new City Hall and Community Center on the downtown shopping area and whether it would bring the neighborhood up. Mayor Waldo said he would like to have some planning by the experts and to know what the impact will be on the down town area. Councilman Blewett stated there had been several impact studies in the past on the downtown area and that it was a waste of money. He said the study made by Cal Poly students had probably been as compre- hensive as the one to be done by Pulliam & Matthews. Mr. Sexton stated the problems involved with the site of the new City Halt as circulation problems, street widths and congestion problems in the downtown area. Spending five or six million dollars on facilities will have a ripple effect," stimulating other enter- prise that wants to build around them. The intent was to provide the Council with the facts so that they can make decisions. He said there had never been an economic impact analysis made, or study by the present architect on better access to the down town area, as the area given to them was constricted to a narrow site presently owned by the City. Council discussion followed regarding studies and analyses that had been made relative to other sites. The decision had been that the cost was prohibitive and that the City would build on the land owned by the City. Councilman Hamilton said an impact study and traffic flow analysis had been made by the former architect and the Staff. The motion carried. 00- Acting City Manager Sexton stated that the timetable for the new Public Services Building was to advertise for bids on construction February 10, 1977, receive proposal March 10, 1977, and award the contract March 17 with construction to start April 1. 1977. The motion carried. 00- Director of Public Works Lathrop referred to a Code amendment affecting two items under the Public Works Department, one under Finance and one under the Police Department. The Police Chief recommended a Code amend- ment regarding truck parking which would limit truck parking on streets designated as truck routes to two hours, with the exception of overnight street parking which is allowed on Baldwin Park Blvd. between Bess Ave. and Dalewood Street. One Code amendment section re- lating to the Public Works Department concerned moving buildings in or out of the City, which the present Code prohibits. A Code amendment had been written to permit good houses and commercial investment buildings to be moved into the community to provide housing and businesses that could not be constructed for a comparable dollar. The Code amendment requires insurance, performance bond and pro-inspection of the property before it is moved. The second Code amendment related to sidewalk construct- ion pursuant to the issuance of a Building Permit. The amendment would eliminate decision making by the City Council relative to sidewalk waiver requests pursuant to issuance of a building permit, and would delegate decisions to Staff with an appeal to City Council, if necessary. There would be a standard $50 filing fee to appeal to the City Council. Councilman Btewett said he would concur with the amendment if the filing fee was removed on the appeal. MC EWEN AND WAIVE FEE CHARGE. M/S/C: BLEWETT/HAMILTON. There were no objections. INTRODUCE ORDINANCE NO. 749 WITH CHANGES AS SUGGESTED BY MR. MC EWEN AND WAIVE FEE CHARGE. M/S/C: BkEWETT/HAMILTON. Roll Call. There were no objections. 00- Acting City Manager Sexton referred to the last Council Meeting when the status of illegal aliens and some legislation proposed by Congressman Sisk had been discussed. A Resolution had been passed by the City of Livingston and the support of Baldwin Park had been requested. The City Council had directed that a legislative task force be formed in-house to study the legislation relative to illegal aliens. He said the matter had been extensively researched and referred to a report on illegal aliens which had been prepared. The research had indicated that the alien problem concerns matters of immigration handled by the federal government and that the federal laws are confusing and conflict with state law. He cited some of the laws and said the legislation by Congressman Sisk had many shortcomings and could result in violation of legal aliens' rights and civil liberties as well as those of American citizens. He referred to legislation sponsored by Congressman Rodino as having similar shortcomings. His Bill was never enacted. He said the Bills and Resolution proposed by the City of Livingston have definite weaknesses and could result in the infringement of the civil rights and liberties. He said the Staff recommended that the Council take no action for support of the Resolution of the City of Livingston. CITY COUNCIL NOT SUPPORT THE RESOLUTION OF THE CITY OF LIVINGSTON. M: AGUILAR. The motion died for lack of a second. Councilman Hamilton said this was a very serious problem, because of the cost to the taxpayers and illegal aliens taking jobs from citizens. Mayor Waldo suggested that the Council vote not to support this legislation until the federal and state government come up with something better. Councilman Aguilar referred to employers who hire illegal aliens to get cheap labor and then allow their businesses to be raided just before pay day. Councilman Hamilton stated that he had been mis- quoted by two newspapers in Baldwin Park as proposing to pass a City Ordinance against illegal aliens. He said this was untrue and that he would investigate any more untrue statements coming out of City Hail attributed to him. A very serious mistake had been made. He requested a copy of the Bill and further information Councilman Kitchel said this was a federal matter and that Staff had wasted a lot of time investigating the report already, without asking for more research. He wanted to support a federal law. Councilman Blewett said he would like to have a copy of the law.and that he had questions he wanted to invest- igate. He felt that the Council had an obligation to ask the federal government to take a stand. He said it was wrong for illegal aliens to take jobs away from citizens and for them to be exploited by employers. He suggested presenting it to their Congressman for action. Mayor Waldo requested that the Acting City Manager's office contact their Congressman and State Senator and ask for all legislation that is in the hopper" on illegal aliens so that it can be compiled and studied. 00- Reverend Paul Malone, Chairman of the Youth Activities Advisory Commission, stated that their report contained recommendations to the City as a combination of their concerns and studies as well as those made by the Staff and the City: 1. Develop the Community Center for use of community educational activities. 2. Urge City Council to work with the school district regarding development of alternative ways of providing education for young people such as a technical school or other curriculum and 3. Establish more Outreach Worker positions. He suggested that funds which had been held in reserve by the City for building a new City Hall be considered for the acquisition of a facility along with the Civic Center complex for use of the youth and the community. He said it was their recommendation that the City establish a Department of Human Relations no later than July 1978. with a staffing capability to research and write proposals for the funding to existing state and federal legislation. He stated that a facility such as a gymnasium was sorely needed for more physical activity. Reverend Malone was thanked by the Council members for his report and fine work. Copy in official files) William Adrians, 4339 Alderson, asked that the Council give their official sanction before he started prepar- ing with the V<F.W. for a memorial at Morgan Park. He requested that the City prepare a plaque in his memory to be installed in the new Civic Center. Councilman Kitchel stated that Dan Zabalski had not only devoted his life to veterans but had attempted to establish BRAVO Brotherhood Rally of American Veterans Organization) in Baldwin Park, and had represented the City on several local television stations. The organization had fought diligently for the rights of all veterans, with particular emphasis on the Viet Nam veteran. He had passed away on January 12, 1977. Mr. Adrians said Major Zabalski had also been active with CRA and had been a Director of the Chamber of Commerce and alt facets of the community. SUPPORT MR. He said this action was being taken as a result of a request from the attorneys representing the two individuals who have disciplinary action pending against them and that it was their recommendation also. Andrew Patterson, attorney representing Lt. Del A1drich» requested that the City Council allow his client to subpoena witnesses to appear at the hearing before the Acting City Manager. He stated that they had listened to the tapes and had asked for a11 written material regard- ing the investigation by the Police Department on the March 17 incident. He said the state and county had given him statistics showing him there was only a 2% critical error made by the Welfare Department on clients and 1% fraud. She stated that she was Indian and hadn't heard anybody say anything about how her ancestors were treated. They were nations of people and stayed in their own nation and if they did not, they warred. She said there should be a percentage of all nationalities living here, but when people come In Illegally they are Infringing upon the rights of their own people who are living here legally* as well as everyone else. She stated that the Welfare Office will give assistance to illegal aliens who are registered to vote without having to show citizenship papers or a birth certificate. She referred to a new organization called HOP, Handicapped on Wheels), which hopes to give personalized services to all handicapped persons of any creed, nationality or color, and said she would be asking for help with this organization. 00- Sandra Neal, 3818 Athol Street, referred to those taking a stand on the alien problem and said that everyone's ancestors were important to them, but that their past treatment was history. He referred to the danger of truck parking on Los Angeles Street and near Bekins at night. He suggested limiting truck parking to the daytime hours in order to save lives, rather than to allow 2-hour parking. He was opposed to the approval for the Baldwin Park medians when so many people were not in favor. 00- Gloria Zook. 4817 North La Rica, stated that the only reason the federal grant had been received on the new City Hall was because they had already had an environmental impact study. She said that Councilman Kitchet should know the difference between a Resolution and an Ordinance. She stated that she hoped Acting City Attorney Ritchie would be back soon as she felt that perhaps we were being represented by less than the man that had been hired. 00- Councilman Hamilton stated he thought it was encumbent upon elected officials and citizens to support good legislation or oppose bad legislation. He referred to the legislation proposed at the last Council meeting on the identification of illegal aliens and said that he had stated without abusing Individual rights." He said he blamed the employer that hired an Illegal alien and took jobs away from our own people. He felt the law should be strengthened. He quoted statistics from a tetter from County Supervisor Schabarum on the expense of providing services to illegal aliens as follows: The County spends $47 million and the City of L.A. $37 million annually," and said it was not true that they could not get assistance or welfare. He thougtit the law should state that a person should not be employed unless he had the green card, and a fine should be levied against the employer otherwise. He said he was supporting federal laws to help alleviate the situation and wanted to clarify this for the record. He said he had made it plain in his statement in the beginning that he would not condone legislation that would abuse individual rights that is human rights. He had not read the bill referred to but assumed the information was correct. He was trying to help his own people, not another nation. Councilman Kitchel referred to having Spanish translation and said that 53% of the school population- and better than one-third of the population was Mexican, with a high percentage of individuals speaking Spanish. He stated he would like to eventually see the City provide head phones and have an interp^te.r sit with the Council and, interpret everything discussed for the Mexican/ Americans in the community. Councilman Aguilar referred to the expense of illegal aliens as expressed by Supervisor Schabarum. He said if the County Supervisors would cut down their high staff expenses, people would not pay such high taxes. Assistant Acting City Attorney McEwen said that he, too. wanted to see the report, but that it was an open question whether it was a discovery right. He outlined the proceedings that were going to take place. There would be an informal hearing before the City Manager and his decision would be final unless the employee chooses to appeal to the Personnel Commission. The employee would have the right to subpoena witnesses at this du nova hearing and be allowed to cross examine witnesses. The City Council can decide whether to uphold the Personnel Commission or not. If the City Council's decision is adverse to the employee he has other steps open to him. He said it would be premature to permit subpoena power before the hearing before the Personnel Commission. Attorney Patterson said that he had received only paper clippings and needed the subpoena power to present his defense. He said he would tike to question Mr. Hale, Mr. Flandrick, Chief Chellino and the widow of former Chief Adams and to take depositions from the executive officers of the City to find out what reports exist. He said he felt all this was relative information. Councilman Btewett said if it would help to find out the truth, then he would like to have the attorney be able to subpoena witnesses. He recounted the history of his people since they had emigrated to this country to establish a democracy and asked If discrimination of color, race or creed was taken into consideration when they lost their lives during the wars and who was to blame for the problem that exists. He stated that the Baldwin Park City Council should not try to deal with problems outside their juris- diction and should stay out of federal problems.
