Five earphones were available by presenting driver's licenses at the desk of the City Clerk. An invocation was given by Councilman Hamilton. Councilman Aguilar led the salute to the flag. CHIEF OF POLICE CHELLINO, CITY TREASURER MONTENEGRO AND CITY CLERK BALKUS 00- Mayor Waldo presented a plaque of appreciation from the City to Alfred Wittig, who had resigned from the Planning Commission on March 1. He said he had served since 1970 and that his hard work, research on the problems he had to deal with and just conclusions would be missed by all. 00- City Clerk Balkus proceeded with the reorganization of the City Council. She stated that at this time all of the Council members were on an equal basis to nominate and elect, and that voting could be done by roll call or secret ballot, as the Council desired. It was agreed that the reorganization would be accomplished by voice vote. City Clerk Balkus stated that nominations were open for Mayor. COUNCILMAN AGUILAR NOMINATED COUNCILMAN WALDO FOR MAYOR. Approve Request for Endorsement of Mid-Valley Manpower Consortium to Seek Prime Sponsorship Directly With Department of Labor Mr. Sexton recommended changes on Items 2 and 4 of the Consent Calendar. He recommended that a Warrant Number be added to the Claims and Demands, authorizing $4000 increase in the City*s Revolving Fund to meet miscellaneous expenses for travel, meetings and other fees. On Item 4, an expenditure of $2,680 should also be authorized to be transferred from the Unappropriated Reserve. Councilman Blewett asked if the Revolving Fund hadn't recently been increased. Mr. Sexton said the increase from $500 to $1000 had not been sufficient to cover the costs before being reimbursed for expenses. Because of the anticipated burden which will be placed upon this account, it would simplify matters if the amount were increased. Councilman Blewett said that his objection was that the Revolving Account is used for travel advances. He would rather see expenses reimbursed on return or have the request come before Council for prior approval so that it is known who is traveling. RESERVE) Councilman Hamilton requested that discussion on the $4000 be held over until the next Council Meeting until more information was obtained on how much money had been spent the past year on travel. Councilman Blewett clarified that he had no objection on Item 4, as it was for the good of the City. Ma^yor Waldo asked Sergio Cabinillas, Executive Director of Mid-Valley Manpower Consortium, if there was ar^y assurance that the other cities involved would give the same amount. Mr. Cabinillas said that there was no assurance of this, but it would enhance the chances of the Consortium being designated as a prime sponsor. He said that a complete accounting of how the money was spent would be forthcoming, if approved. He stated he would make a recommendation to their Board that any money be returned that is not spent. He said they have only the City of Rosemead to go to on this cycle of requests. Four other cities have approved. Roll Call. Ayes: AGUILAR/KITCHEL/HAMILTON/WALDO. Noes: BLEWETT. The motion carried. 00- City Clerk Balkus administered the Oath to those in the audience desiring to be heard during the meeting. 00- Director of Planning Kllgour referred to an encroachment permit to allow San Gabriel Investments, Ltd. to develop the public street right-of-way at the southwest corner of Ramona Boulevard and Baldwin Park Boulevard for a Burger King restaurant drive-through business and parking lot. The Planning Comnlsslon had recommended approval of the encroach- ment permit to allow the development, similar to the existing portions of Ramona Boulevard. Everyone present had indicated willingness to dedicate their property if the City will improve the street and open the median. He stated three possible sources of unappropriated funding that were available: Gas Tax Funds, the General Fund and Public Works Employment Act Countercyclical funds. It would be a practical approach to include the cost of this project in the next fiscal budget. He said if the Council approved the street improvement, there will be surveys and title searches made on a11 the parcels before the property owners are approached for dedication The estimated cost to the City was $36.000. There were no objections. 00- Acting City Manager Sexton said that accord had been reached with the Chamber of Commerce on terms of a new contract that is being processed and will be presented at the March 17 Council Meeting. He recommended that $5000 interim funding be expended to accelerate the operations of the Chamber of Commerce white details were being finalized. AUTHORIZE CHAMBER OF COMMERCE $5000 ADDITIONAL INTERIM FUNDING. M/S/C: KITCHEL/HAMILTON. Councilman Aguilar directed Mr. Sexton to ask the Chamber to just answer yes" or no" when the new contract is presented to the Chamber and whether Mr. Clayton plans to stay on as Manager. Mayor Waldo suggested that Mr. Sexton ask the Chamber Board to have the Chamber Manager attend all City Council Meetings. Roll Call. There were no objections. 00- Acting City Attorney Ritchie reported on the case of Mrs. Stoskus vs. Baldwin Park. Mrs. Stoskus had contended that her property was unreasonably assessed and filed a federal court action after losing her case in the California Supreme Court, She had filed under the Federal Civil Rights Act and was also attacking the constitutionality of the Improvement District Act.. Several months ago her counsel filed a motion for summary judgement. The court considered both motions and ruled in favor of the City and all the individual defendents and her case had been dismissed. Mr. Ritchie referred to personnel hearings on March 21 and March 24 on Roger Tremblay and Del Aldrlch. who win each be represent- ed by their own attorneys. He said he had been a participant in the confidential conversations involved in the alleged tapings and had a cause of action for invasion of privacy if he wished to consider pursuing it. He said he had taken a partisan role in the proceedings to date on behalf of the City. but felt he could not objectively advise the Personnel Board in all fairness to the officers involved because of his personal interest in it. He stated the Personnel Board must have independent counsel to advise them what their rights and duties are in conducting these two hearings. This will involve preliminary matters regarding the issuance of subpoenas, appearance at the hearings, advice on the admissability of evidence, testimony and other legal points. He recommended the services of Mr. James Markman, Whittier, who serves with his partner as the City Attorneys for the City of Brea. He listed his qualifications and said he was available in this capacity at the rate of $75.00 per hour for advising the Personnel Board. He clarified that his only exposure to Mr. Markman was that he had handled two matters in the City of Brea for private clients where Mr. Markman had represented the City very skillfully. He had ruled out all attorneys that he had been involved with in the past as he wouldn't want any questions on that to arise. The Board itself sits as the judge and will be making the rulings. He stated they should be provided with legal counsel to assist them in making those kinds of decisions. Councilman Blewett asked, since the officers would have the right to appeal their case to the City Council if they are not successful before the Personnel Board, should the City Council feel free to attend the Personnel Board Hearing if they may eventually be hearing the case? Mr. Ritchie said it would be best not to attend the hearings, with the possibility that the Council may later have to rule on them, but he would give a definite opinion later on. 00- AT 8:20 P.M.
