Mayor Waldo said Councilman Blewett had announced he would be leaving the City. Councilman Blewett said he was not planning to leave for some time. He had server as President of Mid-Valley Mental Health and always attended his meetings. He stated that white'he was here he was entitled, as an elected official, tn serve on some boards and felt that he was being punished because he helped circulate a recall petition. He said if he published the attendance records of the Councilmen to these.committees, the people would know who represented them in this past year. Councilman Hamilton stated that three of the most important meetings the Council must attend are on Council Meeting nights, including the League of California Cities He recommended that the Council consider changing the Council Meeting night back to Wednesday or to Tuesday. He stated each Councilman should be consulted by the Mayor about whether they would tike to serve on the committees and plan to attend the meetings if appointed; otherwise they should not accept. continued) RES. Councilman Kitchel stated that when Councilman Blewett announced he would be resigning, he had no intention of resigning but cleared himself from being recalled. He suggested that Councilman Blewett forget participating or taking any active role in any of the organizations. Councilman Aguilar said he would tike to bow off" as representative to the RTD Board and give the position to Councilman Blewett, as he did not believe in the RTD and would not want to vote. Councilman Blewett said he would be happy to serve on that committee as well as on Mid-Valley Mental Health and Mid-Valley Manpower Consortium. M/S/C: BLEWETT/ HAMILTON. There were no objections. AWARD CONTRACT FOR SLURRY SEALING STREETS AND ALLEYS TO FLEX-PAVING & ENGINEERING, INC., TUSTIN LOW BID OF $27.574,41. M/S/C: HAMILTON/BLEWETT. There were no objections. Director of Public Works Lathrop referred to award of the contract for Project P-141, Baldwin Park Blvd. street and median improvement. He stated if the Council awarded the contract as recommended, it should be made subject to approval by the Federal Highway Administration, who is funding Q0% of the cost of the project. He referred to a discrepancy in the bid of the tow bidder and said the award of this bid was being contested by the next tow bidder, Griffith Co. The opinion of the Acting City Attorney, regarding the award, was that the discrepancy was of a minor nature and the contract can be awarded. AWARD CONTRACT FOR PROJ. P-141, BALDWIN PARK BLVD. STREET AND MEDIAN IMPROVEMENT TO VERNON PAVING CO., CERRITOS LOW BID OF $221.222. M/S/C: HAMILTON/AGUILAR. Ro11 Call. Ayes: HAMILTON/AGUILAR/KITCHEL/WALDO. Noes: BLEWETT. The motion carried. Maurice Fteishman, architect for the Baldwin Park Public Services Building, read a letter he and his associate, J. Robert Grimsgaard, had directed to Mr. Sexton. They had estimated a total cost of $4,477.117 for construction and the low bid was 8% lower than estimated. The contractor's reputation was excellent and he recommended the contract be awarded to the low bidder, Morley Construction Co., Los Angeles. AWARD CONTRACT FOR BALDWIN PARK PUBLIC SERVICES BLDG. There were no objections. Mr. Sexton clarified this was subject to EDA approval and funding. 00- Acting City Manager Sexton referred to the Chamber of Commerce Agreement. He said the agreement had been reviewed and approved by the Acting City Attorney's office but had not been distributed to the Chamber of Commerce. He requested that the Agreement be accepted for review and recommended that the Council adjourn to a meeting on Tuesday to act upon it. March 17, 1977 Page 5 ADJOURN TO TUESDAY, MCH. 22, 1977, 7:30 P.M. TO REVIEW CHAMBER OF COMMERCE AGREEMENT 00- Councitman Blewett referred to a dinner held in West Covina by the True Leadership Committee and money expended for filming of the movie shown. He said he considered the banquet to be of a political nature and requested the Acting City Attorney to submit a written opinion to the Council whether the City or CRA can legally spend money to do the filming. 00- Councitman Hamilton reported on a SCAG general assembly meeting which he had attended on March 11. He said that most of the speakers felt the Clean Air Act was being violated in Los Angeles County with traffic being a contributing factor. It had been recommended that no more freeways be built and that bills being introduced in Congress should be supported by the cities and that they work with SCAG, state and federal to bring about more public transportation. Also they discussed $4 billion approved by the Senate under the Public Works Act to be distributed throughout the United States and that cities such as Baldwin Park with under 50,000 population might not be benefited. He urged that alt representatives attend their committee meetings or ask their alternates to attend. 00- Mayor Waldo reported on his trip to Washington, D.C. He said he had the opportunity to meet the President. They were told the lion's share of projects for putting people to work would be given to California and New York this year. 00- Acting City Manager Sexton requested that the Council consider authorizing the execution of the City/Redevel- opment Agency Cooperation Agreement in a capacity as the Council on behalf of the City. He said this had already been accomplished as the Redevelopment Agency on behalf of the Redevelopment Agency. She said she would remember the incidents of the pre-planned firings of March 17, 1976 which will be judged in court; trips and meats at the expense of the City; and the bugging" incidents. She referred to the State of the City Address" and dinner given by the True Leadership Committee and stated it would probably results in lawsuits. She charged the Council majority and True Leader- ship Committee of violating the Elections Code} illegally using City funds to present certificates and make movies for political use at a political banquet and stated an attorney had been consulted. She referred to the next edition of the City Newsletter and said the Elections Code is explicit about mass mailings by cities and their officials. This afternoon the Political Action Committee had presented to the City Clerk the required signatures to cause a recall election for Mayor Waldo and Councilman Kitchel. She said the people will judge their year of firsts and progress." 00- Robert Chancy, 14974 E. Pacific Avenue, referred to Alpha Beta's new check cashing application and stated that the unusual requests of the bank would require an individual to give up their rights regarding the invasion of privacy, personal inform- ation being misused, character being defamed or collection, maintenance, use and dissemination of personal information. He stated the Privacy Act of 1974 had been meant to provide certain safeguards, but can not help if people wittingly sign these applications without realizing the harm that can come to them. 00- Sandra Neat, 3818 Athot, expressed opposition to the abuse given to Councilman Btewett and said she had helped petition to eliminate dictatorship of the people, the City Council, Chamber of Commerce and local organizations. She referred to the State of the City Address" and asked if the banquet was given as a means to collect money to fight the recall and why the committee who sponsored it didn't pay for the ad in the Treasure Chest or the movie. She stated that only one person in 35 had declined to sign the recall petition and that some had been afraid to sign. He commended the Police Department's performance. He said that if there was a recall election he hoped the people would continue to vote for progress. 00- Santos Hernandez, 3517 Feather Ave., read charges against Councilman Kitchel as listed on recall petition and said that to his knowledge he had not been proven guilty on three of the charges and the majority rules" regarding the fourth. He also read the charges as listed on the recall petition of Mayor Waldo and said he had not been found guilty of four of the accusations and that the majority rules" on the fifth charge. He said the petition was persecution" and not prosecution and suggested the City get on with progress. 00- Acting City Manager Sexton responded to Mr. Dargus that the HCD committee stilt exists and had not been dissolved. The Housing Advisory Commission was a separate organization with different functions than the HCD committee, which had been established to deal with special revenue sharing funds. 00- Councitman Aguilar responded to Mrs. Zook that when she had called him a radical," he was glad to be a man who wanted change, as that was the definition of a radical. 00- Councilman Blewett responded to Mr. Chaney regarding the check cashing application of Alpha Beta Markets. He suggested he call the La Habra offices to find out who the president was and send the application to their executive management for a response. He agreed that recalls were bad for a city but was glad that Hiram Johnson and the political reform administration had provided a way to take care of bad legislation and bad elected officials in the early days of California. They had formed initiative, referendum and recall. He quoted political philosopher Edmund Burke, the only thing necessary for the triumph of evil is for good men to do nothing," and said he was thankful for the good people in Baldwin Park who didn't do nothing, but decided to do something. 00- AT 8:33 P.M.
