Approve Agreement Between the City of Baldwin Park and the County of Los Angeles for the Baldwin Park Police Department to Participate in the Los Angeles County Sheriff's Justice Data Interface Controller System Director of Finance Halloway requested that the Claims and Demands Resolution be amended to add $25>000 on Warrant No. 7537, payable to Maurice Fleishman, architect on the Public Services Building, and $290,000 on Warrant No. 7546, payable to the Community Redevelopment Agency, as approved by Resolution on May 2, 1977. Acting Ci^y Manager Sexton said the $25.000 was a partial payment on a bin of $99,000, based upon certain provisions being negotiated. It had been questioned whether an Environmental Impact Report should be written or whether it should be a Negative Declaration, but it was the Staff's opinion that there was no need for an E.I.R. There were three issues: the multi-family zoning as a buffer, traffic as hazards on Ramona Blvd., and the impact of breaking in the cul-de-sac. He said these items were not detrimental to the neighborhood if the General Plan is changed as recommended by the Planning Commission. He reviewed these recomnenda- tions for Parcel A, B and C and for certifi- cation of the Negative Declaration of Environmental Impact. Mayor pro tern Kitchel opened the public hearing and asked for testimony. Larry Adams• 15323 Adams Drive, spoke in favor of R-2 zoning in the area recommended in AGP-36. rather than light industrial. Kelty Bixby. 9209 Sunset Blvd.. Los Angeles. renewed his opposition to AGP-36 on Parcel A. He said there was need of a full-scale environ- mental impact report. Linda Anderson. 4210 Laurel Avenue, wanted to continue the public hearing until they could meet with Mayor Waldo. As there was no further testimony in behalf or in opposition to AGP-36. Mayor pro tern Kitchel dosed the public hearing. Councilman Aguilar suggested continuing the public hearing until Mayor Waldo could meet with residents. Council discussion followed with the consensus that testimony had been received and that the majority of property owners and Council members were in favor of zoning as recomnended by the Planning Commission. FROM R-1 TO R-3 AT 3125 & 3135 PUENTE AVE APPLIC.: PAUL R. WHEELER PUBLICATIONS.POST- INGS ft MAILINGS NO WRITTEN PROTESTS Director of Planning Kilgour reviewed his Staff report. He said there was a relationship between this zone case and the Puente-Merced project and that the Redevelopment Agency had not had time to review the matter. He recommended that testimony be taken during the public hearing and that the public hearing be continued until a report had been received by the City Council from the Agency. Mayor pro tern Kitchel opened the public hearing and asked for testimony. Paul Wheeler» 21220 Mesarica Road, Covina, the applicant, stated that they feet they have submitted plans and drawings to offer a package that will be an asset to Baldwin Park. Jack Schluneger, 3143 Puente Avenue, property owner adjoining the proposed development, asked for clarification of what would be developed. Mr. Kilgour said that only a change of zone was involved. A change from R-1 to R-3 would allow multi-family development and the builder could build a two-story development, but they were not tying down what configuration the land use would take on the property. The applicant's tentative plan had indicated a one story development with garage units on the common property. Discussion followed regarding whether a fence would be built. Mr. Kilgour stated that a 6 ft. minimum height fence was required. He informed Mr. Schluneger that the General Plan indicated a multiple family designation on his property and others on Puente Avenue, and that this designation would have to be requested in order for Mr. Schluneger to have a change of zone on his property. As there was no further testimony in behalf or in opposition to AGP-36. Mayor pro tern Kitchel closed the public hearing. COMMENDING JOHN S- LATHROP FOR HIS OUTSTANDING SERVICE TO THE CITY OF BALDWIN PARK WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 77-32- M/S/C: BLEWETT/HAMILTON. There were no objections. 00- Acting City Manager Sexton said negotiations had been completed for the interior design of the PiAlic Services Building. He said five finalists had been involved in the process and that the lowest acceptable bid had been submitted by the firm of Ford/Wilson. He recomnended they be awarded the contract. He explained that they do not manifacture furniture or act as a dealer or representa- tive of a manufacturer. Bids and specifica- tions will be written for the furniture that is agreed on as a result of their research, but they will not be engaged in the process of buying furniture. All dealers and manufacturers will have an opportunity to submit bids, and awards wi11 be based on the lowest acceptable bid. HIRE FIRM OF FORD/WILSON AS INTERIOR DESIGNER FOR PUBLIC SERVICES BUILDING. M/S/C: BLEWETT/AGUILAR. There were no objections. 00- Acting City Manager Sexton referred to the recruitment of a Public Works Director to replace Mr. Lathrop. He said that in light of the Anderson report the Council may wish to defer recruitment* or they may wish to start recruitment. He said the Staff felt that it might be meaningless to advertise unless the job descriptions were altered to reflect the recomr.endations of the Andersen report. Council discussion followed regarding whether to defer recruitment until they can act upon the Anderson report, which calls for restructuring that department and filling the position with a person of different qualifications, or whether to go ahead and fi11 the position. Councilman Blewett said he thought it was premature for the Council to not fill the Director of Public Work's position when the position had not yet been filled for the City Manager's position. He proposed advertising for a new City Manager. He said their attorney had advised not to advertise, however, while they wen* in litigation with Mr. Mitchell. but he would not want an Acting City Manager to have the power of appointing Department Heads. They are starting classes to teach English to those who speak Spanish and expect to have a physical education program for the youth. He said that they had invested only their own money and that of private individuals. None had been received from city, state or federal organizations. They would like to work without government funds and felt that the private sector must make the meaningful jobs. They were asking the City Council for $25.000. and hoped to receive future funds from the private sector, i Councilman Aguilar referred to letters which had been distributed among the Council from Danny Miranda and A1ex Carrera. he said Danny Miranda had stated he had not received training at his facility. Mr. Stein related his experiences with Mr. Miranda and Mr. Carrera during the five months they worked with them. Councilman Blewett stated that the administrative costs on the budget that was submitted amounted to over 33%, and that he was sure private enter- prise would not grant money on this type of budget, Mr. Stein said that four CETA employees they had been promised were part of the the budget. He stated that the cost of the U.S. government providing one job was $100,000. Councilman Blewett said the cost was not that high for Mid-Valley Manpower Consortium to provide one job. Mr. Stein said they are paying $1.50 per hour to an employer to take an untrained man and train him for a six-month period. He related an instance where training a man had cost $1500. He stated that $78,000 of the budget goes to the employer, which means that it goes back into the community. He said this was a sample budget. He said that part of the $25.000 may be used to employ two employees if they don't get the CETA employees, with the rest going for paying such bills as the telephone bills. He explained the function of the office manager they would like to hire. He said they would approach such foundations at the Ford Foundation for private money» as they are interested in the private sector. They wished to avoid getting federal money as it comes from the taxpayer. Councilman Blewett suggested that their group research the Foundations Library at UCLA through the federal tax returns of the various foundations. He said some foundations are self serving, while others put money into the areas of medicine or education. Mr. Stein said they could secure r'unds from the Bank of America or United California Bank after they have been around for a year- They need the $25,000 now to get started. Councilman Aguilar said John Rousselot was shown as one of their representatives. Mr. Stein said Jack McLean represented Congressman Rousselot and that Mr. McLean was concerned about their getting seed money. Councilman Blewett said Mr. McLean had told him he was interested in seeing that they receive CETA positions, but that he did not feel that the City should get into the Manpower business. Dwalne Glass, Glasstein Auto Parts, told of the formulation of their corporation and said they are already a publicly supported foundation with a tax exemption clear through 1980. They felt that business men would be more qualified to train people In businesses than people who are hired by the government to train them. They had devoted time as well as money and had been asked for help by many people. If the City is unable to extend money, they will have to find other alternatives to raise the money. Councilman Blewett said Manpower Consortium demanded that a11 their providers submit budgets with 10-13t administrative costs. This budget was three times that high. Mr. Glass said the budget provides for wages for four CETA employees to be trained by good Job administrators and thct they hoped that by the time the CETA employees were up the funding from the private sector would achieve the level they would need for their year long budget. They could eliminate the four CETA employees and employ only an office manager and someone to answer the phone, but they would not be helping to train people under CETA. After six months, these unemployable people would be trained to do something other than mowing lawns, sweeping streets and repainting graffiti. Councilman AguHar asked what the criteria would be for hiring the CETA employees. He stated that Manpower Consortium w111 not hire anyone under these manpower programs if his father made more than $10,000. Mr. Glass said they had no restrictions like that. They would appreciate the City's help and the City would benefit from it. Rev. Walter, member of the Advisory Council, said he was in favor of the stated aims of the Inter-Comunity Improvement Society. He had not been aware of the change in policy to petition for public money for start up. He suggested that perhaps there should be a postponement of this action until the Board of Directors could ask the advice of Advisory Council members. Assistant Acting City Attorney McEwen stated they would attempt to have a legal opinion by the next meeting on whether the Council has any legal basis to make this kind of a grant. It would be wise to Insure that money was being spent in the best places possible. He said there would be no require- ment to advertise for public bids, but they should explore what other avenues are available for accomplishing the same type of purpose that this organization is accomplishing. as well as considering the City's budget limitations. Councilman Hamilton expressed approval of a program where the employer would pay half the wages until the employee was trained. He said he thought the objectives were good and it was a non profit organization. There was a need for service people in many fields. Mr. Sexton said the Staff had not completed their analysis of the organization and did not know If the City had the resources to fund them. The Staff would be concerned whether the organization had adequate funding to attain their goats within a reasonable time. Underfunding could affect their success as well as overfunding. There was the question of what other funding agencies are engaged in manpower programs or parallel what this organization Is proposing to do for this City. It had not been determined what kind of priorities would be necessary regarding resources once they were identified. He said some kind of percentage matching arrangement had been suggested whereby an attempt could be made to leverage the organization's possibilities with the federal, state and county agencies that have these programs underway. When they have enough facts to make a recommendation, they will try to parallel that with the legal opinion that is expected. He said Baldwin Park didn't have a normal situation and that It was not true that the police department didn't need to be expanded. He stated the gangs had taken over the City and said the Council should be realistic and put money where it was needed to get more police and help the people. 00- Sandra Neal, 3818 Athot. asked what had been done about the tax situation of the owner of the Happy Days Malt Shop. She said she could sympathize because of her own experiences with crime since she had come to Baldwin Park and that she thought that It required more police officers because of the great number of crimes for a City of this size. She said she understood that the six new officers that had been hired were desk men and not patrol officers. She referred to the $400,000 owed by CRA to the City and said this was money 111 spent. She said they should maintain the people first and give them what they want, and what they wanted was not hotels. He said if there was money, it should be used to help the people instead of doing nothing. 00- Mayor pro tern Kitchet responded to statements about indifferent politicians who spend money on redevelopment and don't care about the citizens. He stated that last June an Individ- ual had been killed in front of his house in a gang related incident with a sawed off shotgun He said that only he and one other person on the block testified and identified the suspect. who is now serving time. He stated that spending money on community redevelopment will strengthen the economy so that services can be provided that the people are demanding. He requested that Chief Chellino launch a full investigation into the shootings and get together with Wayne Lukart and accept phone numbers from others who are involved. Councilman Hamilton stated that the Council merely passes City Ordinances and that the people should go to their state and federal representatives to get the laws changed so that individuals will be punished commensurate with the crime they committed. Councilman Aguitar stressed the importance of witnesses to testify after seeing a crime. Council discussion followed regarding citizen involvement and participation to see that suspects are convicted. The consensus was that putting a police officer on every corner would not solve the problems. Problems were caused by unemployment and lack of recreation for youth. He said he was in favor of social programs for the youth, but remembered that when he grew up in Baldwin Park, they did not commit crimes simply because they weren't rich.- He stated that he supported the police, but thought it was a cop out" to excuse themselves by saying the courts do not do their job- He said crimes should not be excused and that though the Council was not responsible for the Courts they were responsible for protection of the citizens. There was a strong feeling in the community of wanting increased police protection and he considered this a high priority. He stated he had requested a report from Chief Chellino two meetings ago on police complement. One Captain had been budgeted, but they have two Captains and a lot of chiefs" but no Indians." He said he thought Chief Chellino should be responsible to see that every prosecutable crime is brought to the attention of the District Attorney. If he doesn't do his job, then call the Los Angeles District Attorney and try to get him to do his job. Councilman Hamilton said he would have Hked to take some of the money that had been wasted to add patrolmen, but that the probation de- partment needed overhauling and that it should be mandatory for judges to hand out a minimum sentence for crimes committed. It should start in Sacramento. Mayor pro tern Kitchel said it starts on all fronts. Educational and judicial reform and citizen participation was necessary. Family values had greatly diminished and they do not discipline children the way they used to. He said it was an extremely complicated situation and it was unrealistic to suggest that Council should put a cop on every corner to solve the problems overnight. He stated that it was the first time in mar^y years that the police department had a fu11 complement.
