Councilman Hamilton stated he would like to have a legal opinion on whether the Staff and the Mayor could legally order this expenditure without prior approval of the City Council. Assistant Acting City Attorney McEwen said he would look into that, if directed by the Council. DIRECT ACTING CITY ATTORNEY TO LOOK INTO LEGALITY OF PUTTING ADS IN THE PAPER IN GENERAL AND THIS AD IN PARTICULAR. M/S: BLEWETT/HAMILTON. Mayor Waldo said this did not have to be in the form of a motion. The motion and second were withdrawn, with the understanding that the Acting City Attorney be directed to come back to the Council with a report. Acting City Manager Sexton confirmed that one bill was a budgeted item for the ground breaking of the new City Ha11; the second item was for the meeting where the Mayor had delivered the state of the City" address, sponsored by the True Leadership Committee. Councilman Blewett asked if the City attorney hadn't ruled before that the advertisement regarding the True Leadership Committee was not legal. Mr. McEwen said he had rendered no such opinion. Mr. Sexton said this item was back on the warrants because it had failed to pass at the last meeting. Councilman Aguilar said that $5000 had been allocated for the City Hail ground breaking. Councilman Hamilton said that that expenditure had been exceeded. Mayor Waldo said that the City Attorney had said he would like the direction in the form of a motion. TO COME BACK WITH LEGAL OPINION ON PUTTING ADS IN NEWSPAPER & THIS AD IN PARTICULAR Councilman Hamilton questioned whether it was necessary to have a motion when a Councilman asked for a legal opinion and asked for a legal opinion from Mr. McEwen on this question Mr. McEwen said that the best way to get clear direction from the Council was in the form of a motion, as his understanding was that it was more than a legal opinion; it was a direction to investigate this particular expenditure to see if it was proper Councilman Hamilton seconded the motion. PUBLICATIONS & POSTINGS NO WRITTEN PROTESTS Director of Planning Kilgour stated that proposed Specific Plan 31 was to develop a residential neighborhood plan at the intersection of Frazier and Fairgrove Streets. The Planning Commission had recommended approval of the Plan subject to conditions. It provided for 24 single family homes and a small park in an area of transition between single family homes and multi-family. He gave a brief resume of his report and said that the only condition of the eight conditions really in question concerned a 3,200 square foot tot lot to be dedicated to the City as a park. The estimated cost to maintain the park ranged from $1000 to $2000 per year. He said the Council should consider whether the benefit to sixteen lots was worthy of this type of expenditure. Twenty-four other homes would be benefitted in a more remote way. The developer would not consent to the adjacent property being a part of the park with maintenance by the property owners. Councilman Hamilton was not in favor of the City taking the responsibility and cost of a park for that number of homes. Councilman Kitchel said that the advantage of having a park would be that it would beautify the neighborhood and might be an incentive for property owners to help maintain it, with some assistance from the City. Mr. Kilgour explained the estimates on the cost of maintenance of the park. Mayor Waldo stated that Baldwin Park already had too many mini-parks and that the City should not undertake the expense for another park. Acting City Attorney McEwen stated that no decision has been registered as yet. The judge only denied kthe injunction. The case is still pending and is stilt active. Councilman Aguilar said the question of constitutional rights has not been resolved. Mayor Waldo said he had talked to his attorney and there is a possibility that their rights have been violated. It is before the courts and his attorney would like a few more days for preparation. He asked for the full 14 days time before making a decision. In answer to Councilman Hamilton, Mr. McEwen explained that Judge Philtips ruled that he could not issue a Preliminary Injunction as it was his feeling, though he had serious reservations, that the Statute was not unconstitutional. He did not have the precise question of constitutionality before him. only whether there was sufficient showing to grant a Preliminary Injunction. He did not grant the Preliminary Injunction. He lifted the Temporary Restraining Order which allowed Mrs. Balkus to certify to the results of the petitions and the case on its merits is still pending in Court. It has not been set for trial. Councilman Blewett felt the Acting City Attorney was representing the Council rather than the people of the City and he did not agree with Mr. McEwen's portrayal of Judge Phil tips* decision. Mr. McEwen said there was no written decision and although the Judge had serious reservations he did not feel that the Statute was unconstitu- tional and therefore he did not grant an injunction. Councilman Blewett asked why the City could not pick up their own animals and store them at the County shelter. Mrs. Betty Denny Smith, Director, Department of Animal Control explained the County had been operating for five days without a contract and an agreement had been made between the League and the County for this year. The contract was written around 27 cities for animal control service. Any change in housing should have been negotiated months ago. This can be negotiated for next year. No action was required. 00- Appointments to commissions were continued pending a complete analysis and staff report. 00- Unfinished Business, Item 4 was handled earlier on the Agenda. 00- Regarding the question of Mid-Valley Mental Health and Intercommunity Improvement Society, Councilman Aguitar said we had made a commitment to Mid-Valley Mental Health of $48,000, $1.00 per capita. Other cities have done their share and now it is up to us. Intercommunity Improvement Society has come up with a proposal for job training for Baldwin Park citizens. Councilman Aguilar said he had talked to Jack McCtain last Friday to verify that Herb Stein said that wherever you got a job with the Feds the pay is $10,000 a year. The cost to the Federal Government is $100,000. This infor- mation is from a book which John Rousselot wrote. With this in mind Councilman Aguilar proposed that the City take $96,000 from the General Fund set aside for City Hall to give Mid-Valley Mental Health $48,000 and to give Intercommunity Improve- ment Society the remaining $48,000 to start a job training for the people of Baldwin Park. Councilman Hamilton suggested handling the items separately as a commitment has been made to Mid- Valtey Mental Health. Discussion followed. Mr. Saif Uttah, Executive Director of Mid-Valley Community Mental Health Council, said that Section 3120 says that prevention is the problem of the local community. He said the law specified that any activities pertaining to health and welfare, delinquency prevention or crime control the City may participate. In answer to a question by Councilman Hamilton, Mr. Ultah said the other cities did not require a contract because all cities receive a monthly progress report indicating that sufficient services are being provided to the residents. About three weeks ago the Acting City Manager had asked for a letter from him in the form of a proposal which could be changed into a contract. This was done. The items included: 1. That since this program should have been funded as of January 1,1977 through December, 1977, we would see at least 100 youth and families referred by the Police Department or school districts, etc. 2. That we wilt provide all staff necessary as required by the Police Department, School District or the City in accomplishment of goals dealing with children and youth. 3. Continue to undertake any efforts necessary to seek other funding such as County, State and Federal for the on-going continuance of Mid-Valley Community Mental Health Council. He spoke to Mr. Ritchie about three weeks ago asking if there were any questions regarding expediting the contract. He had not heard anything further and he anticipated the contract would be uniform. He had also indicated to the Acting City Manager that a paragraph could be added. Mr. Utiah said he spoke to the Acting City Attorney about the legality of using General Funds. He explained that they were proving that juvenile delinquency services, which comes under delinquency prevention, could be considered equivalent to providing law enforcement. This was discussed four or five years ago and all cities had researched He suggested that the animal control allocation from antirecessionary funds be appropriated to Mid-Valley and fund animal control from the General Fund. Mr. James Sexton, Acting City Manager, said that there had been some misunderstanding legally about the program and the use of public money and a contract. Other cities' use of public funds is their concern. The'Acting City Attorney has said that legally we need a contract with anybody that we are going to authorize expenditure of public funds. The contract is being prepared. An understanding should be reached as to the commitments of Mental Health and of the City. Councilman Hamilton felt that after six months action should be taken and that the legality had not been such a problem previously. Councilman Kitchet said the three page tetter had vaguely outlined what the organization was going to do and he felt the contract should be specific on the use of $48,000. He suggested that the staff be directed to expedite and report back as soon as possible. Mr. McEwen clarified that the contract had just come up in the last month. Councilman Blewett suggested the the Chief of Police testify as to the value of the juvenile program. In answer to Mayor Waldo, Mr. Ullah explained that they had received $48,000 for three months from the County. Until State funds are available they cannot make application. He enumerated the members of the Mid-Valley Staff. Councilman Aguilar said he was elected to the Board last year and spent a great deal of time with Mid-Valley; they provide an essential service and he questioned What price do you put on a human life?" Also, the same services are provided by the Manpower Consortium and other agencies. Councilman Aguilar said the same program was not available to all youth because of family income. Councilman Hamilton expressed concern as to the justifiable spending of $3000 for attorney fees. Acting City Attorney McEwen stated that the Government Code provides that the City Council is the judge of the qualifications of its members and that any councilman who ceases to be a resident or an elector of the City ceases to be a councilman. Although there is no procedure provided in the Government Code, such cases require what the declarations are when a vacancy exists that a councilman is not qualified. They guarantee to that councilman the basic due process of due Notice of Public Hearing and to hold a Public Hearing on the question of whether a council member is now a resident of the City of Baldwin Park.
