Roll Call: Present: COUNCILMAN AGUILAR, BLEWETT. HAMILTON, KITCHEL AND MAYOR WALDO ACTING CITY MANAGER SEXTON, ACTING DIRECTOR OF PUBLIC WORKS SEXTON, DIRECTOR OF PLANNING KILGOUR. CHIEF OF POLICE CHELLINO AND CITY CLERK BALKUS Also Present: Absent: ACTING ASSISTANT CITY ATTORNEY MC EWEN AND CITY TREASURER MONTENEGRO 00- Mayor Waldo announced that the adjourned regular meeting was for the purpose of considering the 1977-78 Budget. At the dose of the study there would be input from the citizens. Acting City Manager Sexton explained that an executive session to consider meet and confer items would be necessary before final action on the budget. Finance Director Halloway reviewed the Special Funds in the proposed budget. Page 77 Public Services Building $880.000; this is separate from the General Fund this year. $45,000 has been spent for furnishings and other equipment. This is for items not covered in the EDA Grant. Page 79 City Maintenance Yard $750,000 for land acquisition, site improvements and equipment in the new facility. Page 81 Federal Aid to Urban Highways $689,000. Page 82 CETA VI $438.600. Page 83 Housing and Community Development $172,000. Pages 84 89 There are six or eight projects. One is the continuation of the low interest loan program $497,000. This year we had only $100,000. Some of the other projects include rehabilitation of the Community Center and senior citizen activities; $44,000 administration of tow interest loan program and agency programs; $60,000 handball courts, etc. $76,000 is expected from HCD. Low interest home loan program. We have spent about $70.000 of the $100,000 so far this year. The process for obtaining a loan is: the applicant files form and staff helps secure bids for contracturat work; the homeowner is permitted to do some of the work. The applicant requests a certain dollar amount, a credit check is made through a credit agency, and the application and the qualifications of the applicant are reviewed by a loan committee. The bids are checked as to reasonableness, etc., and contractors must be City licensed. A permit is required and all protections are afforded. Page 90 Gas Tax 2106 $155,000. Last year this was $217,000 We had an agreement with Manhattan Beach whereby we bought their FAU funds with our gas tax funds; that is why it is less this year. Page 91 SB821 Pedestrian, bicycle trails, lanes, signs, etc. $10.000. Page 92 Sewer Connection $15,000, no change. Page 93 Curb & Gutter $10,000. Page 94 Morgan Park. This was State Proposition 1 money; we may get Proposition 2 money. Page 95 EDA Grant for street work $195,000. Page 96 EDA. We expect to receive $3-1/2 Million. We have already received about $1-1/2 Million; this page wilt be updated. Page 97 Street Lighting $215,000 for operations. Mayor Waldo opened the Public Hearing on the 1977-78 proposed Budget. As there was no testimony. Mayor Waldo declared the Public Hearing closed. Councilman Blewett asked that Mr. Sexton go through the budget in general in relation to the recent Court decision regarding the CRA project and explain how this wilt affect the budget and the 11st of projects. It was also asked how this will affect the five cent reduction on the property tax. Acting City Manager Sexton said it was stilt uncertain as to the outcome of the recent holding by the appellate court. This was a preliminary holding and has not been made final. Other cities throughout the state are interested in that holding. They feet it is very inaccurate, that the judges misunderstand the tax increments, the role of the taxpayer and his obtications under it. Many cities are coming in as amicus curaie, we are advised, as it is a Dad decision. Efforts wi11 be made on our part along with the friends of the Court to try to educate the judges as to what the redevelopment law is a11 about. If that is unsuccessful and the Court does not alter its opinion, it will be appealed as Council has already authorized. Continued) PAGE 90. GASTTAX 2106 PAGE 91. There is a brief by the Attorneys that this opinion will be overturned. In the meantime reliance on the tax increments to assist us in the project to enable us to undertake other social efforts from those economic measures that we receive certainly puts some of it in some kind of a questionable area. He said it was probably premature for his office to recommend any changes in the budget relative to it, merely because it is uncertain, primarily because of newspaper articles. This City hasn't really been contacted by any- body from the Court threatening to stop the funds or in any way affect current tax increments we presently are receiving from the project. He supposed the quarter million dollars could be related to the quarter million dollars approximately that we are spending for social services in this community if they are ever done $110,000 for the department of human resources, the added policemen that would be put on board to deal with juvenile delinquency and crime prevention amounts up to another, perhaps, $100,000; plus other efforts are being made to spend money on mental health and perhaps other manpower programs. These all add up to quite a sizable sum of money that the City Is going to spend in these areas and it is likely that those could be jeopardized. If we are unable to float bonds on any of our projects, or in the event that we get an adverse ruling against the City on the Puente/Merced project, then we will have to adopt a redevelopment plan for the area a11 over again. He said that probably at this stage it is premature to have answers to these kinds of questions. Councilman Hamilton asked if the funds are cut off, then would our alternative be to revise the budget. Mr. Sexton said that likely could happen and the understanding was that we were going to come back to Council with a program budget in three or four months as opposed to the line item budget. At that time we'd probably have more of a basis for making a final judgment on that. Councilman Blewett asked if the attachments A" on the proposed program budget items were not part of the budget unless they were placed in the budget. Mr. Sexton said no he thought they indicate how funding will be undertaken at a later time and most of the Items are in the budget. Councilman Btewett asked for a review of which items were in the budget. Mr. Hatloway said the only items not in the budget are public services building $100.000 for maintenance and operation and the Human Services Department. The tax reduction has not been calculated into revenues. Revenues for taxes are calculated at the present rate. The $100,000 for the public services building is an annual estimate and budget is balanced. The revenue sharing money would be set aside for human resources, etc. The income is in the next budget but the expenditure 1s not. Mr. Philip Sexton explained that under appropriated surplus there is $210,000 for public resources and the public services building. Also under surplus is unappropriated surplus that is money uncommitted toward anything. If Council approves the list of projects, including the Human Services department and $100,000 for the Public Services center, then that's appropriated. The Tax relief has not been accounted for. If the tax relief is approved, it would reduce the unappropriated surplus by $40,000 roughly. Councilman Aguilar said that four or five months ago when we decided to create a Human Resources department we did approve it and he asked shouldn't this be in the budget? Mr. Haltoway said that Council direction at that time was for the staff to study this and find where the money was going to come from. He said they were suggesting that if we're going to do it, the money should come from revenue sharing to effectuate that goal of the Council. Further discussion regarding the use of revenue sharing funds followed and Mr. Halloway said the budget would be balanced. Because the unappropriated surplus is $471,000 and revenue sharing is $480,000, this would leave about $9,000 unappropriated surplus. Blewett asked what happens to the City if we spend all this money and the County comes and wants a11 the CRA money back? Mr. Halloway explained that this was the Agency's responsibility and not the City's. It's like if the Agency floated bonds and the Agency went belly- up, couldn't pay the bonds, the bond holders could not come to the City for redemption. It's a totally separate entity. The only thing we'd be out would be the money we've loaned the Agency thus far, about $285,000. Councilman Blewett said we could have a $280,000 liability and what happens if the City is called upon to pay the County back those funds? What does the City do? Mr. James Sexton explained that there's a cosigner to these bonds and there is an underwriter on the rewrite. The Agency stands independently on any debt that it owes anybody. Councilman Blewett asked what is Council's individual responsibility? Mrs. James Sexton said a lot of people misunderstand the whole concept of agencies and what agencies are all about. It's separate. Mr. Haltoway said we've used those funds to repay services and salaries, etc. and it wouldn't mean that we would have to dip into our present budget any. Those monies to alt intents and purposes have been expended and when they come back it's just like revenue. Mayor Waldo said let's assume that for some reason the Agency was cut off and pays the City back and at some future date, if we had to redefine future boundaries and we did so when that plan gets under way, could they pay back the City? Mr. Sexton replied that the Agency wi11 always be in a debtor status until the bonds are paid. The bottom tine would be if the plan had to be readopted, then we would just adopt another plan and the tax increments would float into the new development which the City has created through its Agency and we would be required to pay off any debts it has incurred. Mayor Waldo asked if the public services building and human resources were to be included in the budget. Mr. Hatloway said this year the department heads were told not to incorporate into their budget a11 the things they would tike to have. They were totd to do the budget with no increases except for the normal salary increases a five or six per cent inflationary factor. They were asked to submit under separate cover a11 new programs they would tike to get into, such as youth services, etc. Programs were evaluated and these were the ones we feet are most amenable and could be funded by Council and that's the reason this is separate. Mr. Sexton said the intent is to indicate to Council the future processes for program budgeting. This will not be tine item matters; the concern will be with the total program and what wi11 be accomplished by spending a certain amount of dollars. The basis would be to see what a program costs and if under- taken, monitor it to its accomplishment and the result would be whatever Council set forth as an objective to achieve. Mr. Sexton said that in tight of the uncertainty about the CRA suit on the Puente/Merced project and the objectives already stated as to social programs, we found the monies and recommend that they be allocated as such. We'd also recommend the tax deduction be undertaken. In the future if we get a program budget and have a different took at it, we may recommend a tax increase and maybe a reduction in some of the programs we want to undertake. He did not think Council should wait for that because it could take a long time in coming as far as a judicial decision is concerned. There are a few other things we have not talked about which have cropped up since the budget was prepared which we would recommend adding in, but those are only minor dollar amounts. These major expenditures and tax reduction we would recommend. Councilman Blewett had two things he wished to bring up. 1) He felt the City Manager's office has too many employees and he would like to see two of the staff cut out of that office. 2) He would like to see a check made of the City Attorney's office and would like to get a letter from the City Attorney with what we are supposed to be getting for our retainer. He requested this as it seems that the amount of legal fees being charged City Hail departments is far in excess of anything it's been in the past for the results obtained. Other cities appear to pay less. Acting City Manager Sexton explained that the retainer is for undertaking the normal operational legal questions that daily come from a City and its departments and on a day to day basis he handles those questions whether it is a Planning question or an engineering question, a tax question, or a finance question. Anytime he goes to court those are extra charges; that is standard operating procedure. If his fees for those kinds of appearances seem extreme, it must be put in the proper perspective that there has been a lot of court action required on his part. Councilman Blewett said that is accurate, but the thing that disturbed him was the seemingly incredible advisement on the two personnel hearings. He could understand one, but when you don't win one, it was kind of foolish to go for two and it was sure a lot of money spent that could have been another couple pennies off the tax rate. Acting City Manager Sexton said that the charges and the background on those charges and the information that was compiled was the basis under which it was recommended that further legal expenses be incurred in trying to bring that to a just decision. Councilman Blewett said there had been a previous case on the police force and the attorney had said the police chief did not have a case. This had probably been better and saved money. Acting City Manager Sexton said that anyway you want to try to measure the City's legal fees and costs this year, you would have to look at the settlement record of the previous legal counsel who very seldom went to court? but there were heavy costs for just settlement purposes. That would be a vindicating factor. Councilman Blewett agreed but he would like to see a comparison made and see a11 the cases. He referred to the Stoskus case. He thanked the Data Processing Department for the report and hoped that everything they point out in the report comes to fruition so that we do well as far as Data Processing is concerned. He said he would like to have the Public Relations office completely eradicated and the reason being he thought the last.issue of the Newsletter was indicative and he was thinking of personally filing a taxpayer's suit against the City based on those things because every issue has had an attack on somebody politically that is not in with the majority. It is against the State Code plus the fact that the public relations man does not represent the City as a whole, he represents the majority members of the Council. Because of that>and there was a promise by this whole Council, they decided that each Councilman could not write a column and it was decided that the Mayor would write one and that it would be fair and that it would be a non-political instrument. He asked for comments. Mayor Waldo said that he tried to point out the progress that has been made and that forces are trying to hold us back. He was proud of the progress we've made. Councilman Blewett questioned whether it is riaht to use taxpayer's money to push a message that is self-serving? Councilman Hamilton said that regarding the expenditure for legal fees, he personally did not feel that we have had the proper legal advice. In the past cases had been settled out of court and sometimes costly but the legal fees this year were about $68,000 and he thought some of this could have been prevented and other cities are not spending this much. This cost was in addition to CRA legal fees. He also requested a cost analysis for legal fees. Regarding the Public Relations office, he thought a newsletter was good but it should not be so costly, about $30,000 of taxpayer's money. He thought we could get along without it. The Newsletter has been political and it should not be. He said development is happening alt over the Country, not just in Baldwin Park and he did not think we should take credit for that as development would have ocurred regardless of who was in the Council seat. Mayor Waldo said he. Councilman Hamilton and other people had worked hard for it and they were going to take credit for it. Councilman Hamilton said he would tike the Public Relations officer expenditure cut out of the budget because he thought it was a waste of the taxpayer's money and he wanted that on the record.
