Letter in official files) Betty Hawkins stated they needed an answer on their request tonight so they could get the new neighborhoods started. She said that Chief Davis of Santa Ana had stated on television that after four months of the same program, crime had gone down 25% in their City. There was also a small white card that warned that their articles had been identified with their driver's license. They would be needing the loan of an etching tool so that each neighborhood might use if for five days before sending it on for use by the next neighborhood. Councilman Aguilar said the Staff should be directed to help as requested. AUTHORIZE AND DIRECT STAFF TO ASSIST NEIGHBORHOOD WATCH ORGANIZATION IN THE PREPARATION AND DIS- SEMINATION OF INFORMATION AS REQUESTED. M/S: WALDO/AGUILAR. Councilman Hamilton stated he would prefer to receive a copy of written communications in advance so that he could study it ahead of time. He requested that City Clerk Balkus re-read the written communication. Mrs. Hawkins stated their neighborhood was the first Neighborhood Watch, started about a year ago. MOTION CARRIED 00- Councilman Btewett stated that Public Hearings were normally first on the agenda, and requested that his Hearing be held at this point, rather than under Unfinished Business at the end of the meeting. He said it would more economical for the City to conduct the Hearing in its proper order so that the Court Reporter did not have to sit through the entire meeting. He asked for an opinion from the City Attorney. Assistant Acting City Attorney McEwen stated that the Public Hearing had been closed at last Thursday's meeting, and that the only item of business remaining was the delibera- tion on the question. It could properly be brought up under Unfinished Business. Councilman Blewett said that he wanted to question their motives and requested that the Court Reporter record it on tape. He stated that Public Hearings and their summation had always come at this point on the agenda. He requested that the Council be polled on the matter. The majority of the Council voted to hold the deliberations on the Public Hearing after the City business had been completed. Mr. McEwen said the public hearing had been closed and opened for deliberations and the deliberations had been continued. Councilman Blewett stated that the motion in the Minutes of the last meeting had been to continue the meeting. He asked Mr. McEwen to read the motion and said Mayor Waldo had made his remarks at this point. Mr. McEwen stated that Council had the authority to take anything out of order that it wished. The motion carried. 00' City Clerk Balkus read in full a letter received from Glenn Robinson, requesting a lot split at 4708 Walnut Street. Letter in official file.) She said a tetter from the Planning Director had been mailed in response to this letter. Director of Planning Kilgour said verbal arrangements had been made with Mr. Robinson and then the letter had been sent to him with clear instructions on the procedure for making parcel map application in order to apply for a lot split. He stated that there was nothing the Council could take action on until after Mr. Robinson had made his application to prepare a parcel map. He stated he would contact Mr. Robinson again and follow up on his letter. 00- Acting City Manager Sexton stated that a contract had been prepared and had been negotiated with the officers of the Inter- community Improvement Society. He outlined the terms of the contract. The objective was for job training of 26 under-employed residents of Baldwin Park with the cooperation of the employer to subsidize the jobs. The term was for six months at a cost of $44,000. The concept had occurred because federal programs had not been successful and county and state funding had not been effective. The focus was for use of the moderate and middle income families rather than low income families with the requirements of the other programs. Irving Stein, 14345 E. Garvey Ave., executive director of Intercommunity Improvement Society, stated that certain objections had been made when they had requested funding at a former meeting but that they had successfully moved to overcome those objections. The concept of their program had already been endorsed by the Council. Letters in official file) He said Mr. Otting, the Chairman of the Advisory Committee, had endorsed the contract today and had said that if administrative costs were under 14^ he felt that Councilman Blewett would also be interested in their program. Mr. Stein gave an account of three individuals to whom the Society had admin- istered help with employment or in other ways. He said that while they are promising to make 26 subsidized jobs, they felt they could duplicate an equal number of non-subsidized jobs. Mid- Valley Manpower Consortium will be providing them with four CETA employees. Councilman Blewett said that he had reviewed the contract and appreciated that some of the objections he had raised had been met. He stated he would consider funding the program if a couple of addendums could be added. One would be that no member of the executive board of the Intercommunity Improvement Society or any company that they are associated with would be eligible to use any of the employees; that no member of City Council or elected official or companies that they are associated with be allowed to have US employees placed with them; and that the Director of Finance conduct an audit of the program the second month into the contract, to make sure that it was functioning correctly. Councilman Aguilar said that the City of Baldwin Park received $481,000 for 41 jobs for one year from Mid-Valley Manpower Consortium. After one year no more money would be available. US would train people to go into private enterprise and this would fight unemployment and welfare, because the government creates welfare. Abs tai n: Mayor Waldo. Mayor Waldo stated that he had abstained because he had been employed by a firm that had helped set this organization up. He was no longer employed by this firm. Councilman Hamilton stated that the Council and Staff had spent a lot of time obtaining grants and money for operation of the City and hoped they could spend it wisely. He expressed concern that other organizations would be requesting money for similar programs as there is not that kind of money available. He expressed approval of the pilot program of Intercommunity Improvement Society. Mayor Waldo stated that statistics show that it costs the Federal government $100,000 per job provided. Councilman Kitchet stated that he favored the City becoming involved with this experimental program to provide manpower assistance. The motion carried. 00- Director of Planning Kilgour stated they had received proposals from four different planning firms for the preparation of the Neighborhood Facilities Plan. This document would combine the General Plan, the Zoning Code, the Capital Improvements Program and an E.I.R. This would be funded under Housing and Community Development funds. He said that the firm of Wallace, McHarg, Roberts and Todd appeared to be the most qualified to develop the plan and their proposal in the amount.of $70,000 was within the budget for this project. There were no objections. 00" Acting Director of Public Works Sexton stated that the Council had requested information concerning handicapped pro- vions for the new Public Services Building and the Community Center and new buildings. He said provisions in the Public Services Building would include access to all floors. rest room facilities, telephones, drinking fountains and access ramps and special vehicle parking. The same provisions had been included in the rehabilitation of the Community Center, with the exception of access to the basement. He said that present codes require that all new build- ings used by the public provide facilities for the handicapped, with the exception of office buildings of less than 10,000 square feet, any residential structure and supermarkets. He said that this City, by administrative direction, also requires developers to provide these facilities for major remodeling of general purpose buildings. The State Architect was presently having public hearings for new regulations on this issue. He said there would be no exceptions whatsoever under the new regulations. 00- Director of Recreation and Parks Lucas asked that the Council consider the purchase of the Ledford School Site, offered to the City by the Baldwin Park Unified School District. He stated that the present Recreation and Parks Commission and those in the past had endorsed this action. continued) AUTH. He said this may be a strong enticement for incorporation, as they would be adopting a City tax and a park would be something the City could provide them. Mr, Lucas said that his report indicated that the intention of the Commission, upon the staff's recommendation, was to acquire the land for future development rather than present development. There were no.objections. 00- Acting City Manager Sexton said the Staff had contacted the Commissions relative to alternate meeting dates to be considered by Council for study sessions. This in- formation was included in their packets. The Council approved the following schedule for study sessions between the Council and the Commissions: Housing Advisory Commission October 3 Job Opportunities Advisory Commission September 22 Senior Citizens Advisory Commission October 11 Youth Activity Advisory Commission November 21 Community Redevelopment Advisory Commissi.on October 17 Planning Commission September 12 Recreation and Parks Commission November 7 Mr. Sexton stated that a master list setting forth the recommended dates would be se.nt to the Council plus periodic notices of when the meetings would take place, 00- Acting City Manager Sexton referred to changes made in the State legislature pertaining to Bingo, permitting organizations erroneously omitted from the previous statute to participate. It could also be introduced as a regular Ordinance to be sure that it would become effective if the Urgency Ordinance was challenged. Councilman Blewett said he was wilting to go along with the State law but not to adopt it as an Urgency Ordinance. Mr. McEwen said the new law expands the number of organizations that come within permissable organizations to conduct Bingo games, including fraternal and educational organizations as well as charitable. Private schools could fall within this definition. Councilman Hamilton stated that with the change in the law to liberalize gambling, he was not in favor of the Ordinance at all. City Clerk Balkus stated that November 22 was the earliest date the election could be held and January 4, 1978 the latest date. Mayor Waldo said he preferred December 15 as he may be out of town working on industrial shows for his company for about twenty days in November. Councilman Kitchet stated that he would like the earliest possible date of November 22 for his election. SET RECALL ELECTION FOR DECEMBER 15, 1977. M/S: WALDO/AGUILAR. City Clerk Balkus stated there would be a conflict with the March election if the election were held on this date as nomination papers would be out. Assistant Acting City Attorney McEwen said there could be a conflict but it wouldn't be insurmountable. The election must be set between November 20 and January 4. There was no way it could be put off. City Clerk Balkus stated that people would be filing for the March election and there might be a problem. Roll Call. Ayes: WALDO/AGUILAR. There were no objections. 00- Chuck West, Chamber of Commerce Director and owner of West Coast Carpet, informed the Council that the Chamber of Commerce was planning a promotion for the last quarter of the year. They plan to issue bumper stickers with their motto, Fun to Shop in Baldwin Park," and are offering a prize of $25 each week to spent with any given merchant. A picture will be taken of the winning bumper sticker and winners wilt be posted each week in the participating store windows and in newspapers. He asked the winners to come to the Chamber office at 14327 East Ramona Blvd. within seven days to receive their $25 gift certi- ificate. The new telephone number at the Chamber of Commerce office is 960-4848. He stated that the Chamber had made arrange- ments to provide book covers for a11 the schools in Baldwin Park and the book covers would also be available at all the partici- pating stores. He distributed the bumper stickers to the Council and said that hopefully they could be put on City vehicles. He referred to a memo that had been provided the Council on August 18 and again tonight to be used as a test to follow in making their determination. Discussion followed relative to taking a brief recess. The consensus was that the issue was before them and should be resolved now. Councilman Hamilton stated he had reviewed all the material and the Minutes from the Court Reporter. He said the only evidence given was that Councilman Blewett had utilities and his property in his name at 2305 Redding Way and that his daughter rented that property. He had said in January he would be moving but no date was given. He said that when Council man Blewett signed papers for a primary residence in Upland, no date was mentioned. Councilman Blewett had moved furniture to Upland for his daughter's use. Neighbors who should know had stated that Councilman Blewett never lived at 2305 Redding Way and Mr. and Mrs. Blewett also had said they had not lived there. On June 9, Councilman Blewett had registered to vote at his new address, 3529 Baldwin Park Blvd. Councilman Hamilton referred to the August 25 meeting transcript, pages 138, 139 and 140, and said Mayor Waldo had made pre-judging remarks. He had said, if Mr. Blewett didn't resign, turmoil would continue if the Council lets Mr. Blewett continue as a Councilman.11 He said this sounded prejudiced and asked Mayor Waldo how he could vote fairly after he had made these recorded remarks. Mr. McEwen clarified that if the City Council found that Mr. Blewett was a resident of the City of Baldwin Park the motion would be that THIS COUNCIL FINDS AND DETERMINES THAT MR. BLEWETT HAS NOT MOVED FROM THE CITY OF BALDWIN PARK AND IS PRESENTLY RESIDING WITHIN THE CITY OF BALDWIN PARK. He said if their decision was otherwise, the motion would be that THIS CITY COUNCIL HEREBY FINDS AND DE- TERMINES THAT MR. BLEWETT HAS MOVED HIS RESIDENCE FROM THE CITY OF BALDWIN PARK AND AT SUCH TIME CEASES TO BE A COUNCILMAN OF THE CITY OF BALDWIN PARK PURSUANT TO GOVERNMENT CODE SECTION 36502. Councilman Kitchet said this was one of the most disastrous issues that had ever come before the political body of Baldwin Park. He referred to the extreme political differences and attitudes on social programs and community redevelopment and the contro- versy that had been caused. He stated he had looked into the Blewett qualifications matter very seriously and weighed out both sides. He said the point had been brought out that there must be shown joint harmony between intent and action. He recounted the evidence of Mr. Ble'wett selling his home, selling both his properties and buying an expensive home in Upland and moving his business; the remarks he had made during the Council meetings and in the newspaper article printed by Judy Hammond showed every intention of moving to Upland. He had stated that the only reason he wanted to stay on the Council was to see that Mayor Waldo and Councilman Kitchel were recalled and that he owed that to the people of Baldwin Park. He stated that he felt there was a preponderance of evidence indicating every intention of leaving Baldwin Park but that he could not vote to remove him from the Council without more evidence showing that he had physically moved to Upland. He stated that the public hearing had been acted upon too quickly and that if enough time had elapsed he would have been given enough rope to be hanged" and there would have been enough evidence to indicate that he was living in Upland. He said that Mr. Blewett was not fulfilling the obligation of a Councilman in good faith. He said Mr. Blewett was sitting on the City Council, knowing well in his heart that after the recall he would be leaving Baldwin Park, because there was a house and a business waiting for him. He said he hoped there would be enthusiasm to take action against Councilman Blewett through the recall process, as it was the only procedure to remove what Councilman Blewett called immoral, contemptuous and corrupt politicians and he felt that he fit into that category and should be subjected to that process. Councilman Aguitar stated that he had totd Councilman Blewett here that he didn't like him as a man that was supposed to be close to God in his religion or as a politician, but that he was going to give him a fair hearing. He said that in going through the evidence he had found that the intent was there but that they could not prove the body was there. He said he had heard rumors that Councilman Blewett was going to run for the Upland Council and said that he believed that in January he wouldn't be around. He stated that his heart was not with the people, because he had stated he wanted to get rid of Mayor Waldo but when Mayor Waldo had offered him the chance for both of them to resign he had not taken it. He said it was hate and jealousy because Mr. Waldo had ran a recall against him, but if he were to oust Mr. Blewett on the evidence presented, he would be using the same hate that he had for Mayor Waldo and he couldn't do that. Councilman Blewett stated that Baldwin Park needed a housedeaning, as represented by over 6,000 signatures gathered against Mayor Waldo and Councilman Kitchet. He said he would welcome a recall of the people of the community put in on the ballot, because he felt the people should make the decision and not the Council. He said the Council would be making the right decision tonight because there had been no evidence. He said at one time it was his intent to leave Baldwin Park but that now he planned to stay for an indefinite period of time. He had changed his intent because he felt he was one of the few people that could stand up to Mayor Waldo and the power of City Hall that he had exerted against the people. He stated that on November 22 Mayor Waldo would find out how the people felt, because they were going to deliver a new City Council and a new day for the City. Mayor Waldo stated that he was proud of the record that the City had made in the past two years and that he wouldn't have missed it for anything in the world. He said the City had made progress that it had never made before, although it had been frustrated by Councilmen Blewett and Hamilton and others that had tried to stop progress, and that he would stand on his record. She said the City had given the Intercommunity Improvement Society money and asked the City Attorney a question about the Conflict of Interest law. She said she understood that no City Commissioner could enter into a contract with the City, and that Dwaine Glass was a CRA Commissioner and had entered into a contract with the City. She also questioned why Councilman Aguilar was doing electrical work at Glasstein Auto Parts as that would also be a conflict of interest. She said she did not feel that they deserved the money and that they were playing games with the Council and their political cronies. He said that he must have a financial interest in a contract with a non-profit corporation in order to have a violation of Government Code Section 1090. Mr. Glass was not a Director and would have only a remote interest that would not violate Section 1090. Councilman Hamilton said he wanted to correct the statement made by Mayor Waldo that he had opposed development.
