CITY HALL COUNCIL CHAMBERS) 14403 East Pacific Avenue The City Council of the City of Baldwin Park and the Baldwin Park Planning Commission met in joint study session at the above place at 7:30 p.m. Planning Commissioner Etko led the salute to the flag. FLAG SALUTE Ro11 Ca11: Present: COUNCILMEN AGUILAR, ROLL CALL BLEWETT arrived at 7:34 p.m.) HAMILTON, KITCHEL AND MAYOR WALDO Present: CHAIRMAN WHITLEY, VICE CHAIRMAN MORENO arrived at 7:33 p.m.), COMMISSIONERS BURNETT, ELKO, LARSON arrived at 7:32 p.m.), SMITH AND WIEST Also Present: ACTING DIRECTOR OF PUBLIC WORKS SEXTON, DIRECTOR OF PLANNING KILGOUR, CITY CLERK BALKUS AND BUILDING SUPERINTENDENT CUNNINGHAM 00- Director of Planning Kilgour detailed the Neighborhood Facilities Plan, which he said included the General Plan, Zoning Ordinance and Capital Improvement Plan in one document. The General Plan wi11 be consistent with and enhance the Zoning Ordinance. Under the Capital Improve- ment Plan, a list of capital improvement project locations would be prepared and a funding program established to accomplish these projects- He referred to Housing and Community Development programs and their status in the current year and the fourth year. He said over one-half million dollars was earmarked for housing rehabilitation loans and $25,000 for a graffiti removal program. $50,000 was budgeted for park site improvements in Morgan and Barnes Park. Further programs included the Neighborhood Facilities Plan, Community Center rehabilitation and the purchase of land east of the Community Center for con- struction of a Senior Citizens Center Building. A budget wi11 be prepared soon for the fourth year of Housing and Community Development funds and public hearings wi11 be scheduled. He stated at least as much as received this year, $750,000, is expected for 1978/79. The Staff was considering improving some of the private streets as public streets and would tike to see the continuation of the home im- 1provement loans and an on-going graffiti program with these funds. Richard Cunningham, Building Superintendent, detailed the housing programs subsidizing senior citizens, the handicapped and those with tow income. Two applications had been submitted on Section 8 housing one for 100 units and the second for 198 new construction units. He explained the procedure for rentals subsidized by HUD, with the renter paying only 25% of his income. Baldwin Park wi11 receive the money for the 198 units because Baldwin Park had scored 9 out of a possible 10 points of rating by SCAG, the highest in southern California. He stated that by moving citizens into this housing, owners will be forced to repair or tear down structures which need updating. The greatest strides were being made in the financing of Section VIII housing, the refinancing of individual homes, at a low 7% interest rate. Input had not been received back from referrals sent to their participat- ing banks, but the City was participating in their program because more help may be received later on. He quoted statistics on public nuisances abated and inspections made on that program and said that 46 HCDA loans had been made this year for $74,517, including $560.48 received back in interest and $2,525 in principal. $24,000 remained to be loaned out from the first $100,000 received. There had been no de- faults and only two late payments on the loans. He stated that the graffiti removal program would be started shortly. He had received requests from citizens for a housing inspection program similar to the one used in Pasadena and related how the Pasadena program worked. He stated that Baldwin Park landlords were probably not wilting to pay the $20 inspection fee and that it may have to be done free for awhile. He said the landlord may be glad to have the inspection as evidence when he has to go to court to evict a tenant and that the program should include an arbitration board so that the parties could settle their problems among themselves. This was only a housing program now; commercial was covered when a license was issued and the Building Department checked the property to bring it up to Code. He stated a penalty should be built into the Ordinance so that the City would be able to police the violation if the owner does not notify the City to inspect. Cooperation from real estate and escrow offices could be requested. He said four units or more require a business license. There should be an advertising campaign and absentee owners should be notified by letter including a copy of the Ordinance. Discussion followed on conditions found in dwellings and how the violations were found and what the penalties were. Vice Chairman Moreno stated that the same situations that had existed eighteen months ago when the Council and the Planning Commission had held their joint meeting still existed relative to a lack of enforcement of nuisances. He said he took issue with the Council on the way the enforcement was functioning to only put a bandaid" on the cancer that was out there when a scalpel was what was needed. The deterioriation had been allowed to continue and there had been tremendous improvement in only 5% of the cases. He stated he would prefer having the enforcement office fell them to abate the nuisance and take them to court within six weeks if they don't, or contract to have the work done and send the owner the bin. He referred to homes on Los Angeles Street and in the Americana tract that are constantly deteriorating. He suggested offering $100 reward for turning offenders in and making penalties tough on the kids and their parents. Councilman Hamilton stated there will be a seminar at Mt. Sac by the East San Gabriel Valley Association of Cities relative to graffiti and that he will get information and date so that all may have an oppor- tunity to attend in October. He said that two years ago 21 persons had been picked up by an unmarked police car for painting graffiti, but that the juveniles were all released the next day by lenient judges. About three years ago, several police chiefs had tried to meet with judges to convince them to hand out sentences commensurate with the crime of destroying property but that also hadn't worked out. He said he was in favor of an Ordinance and a little pressure on the judges from the Council and talking to the City Attorney about it. He recommended that the City have a full time abatement officer covering a11 properties, street by street. Discussion followed regarding how many nuisances had been called in and how many the enforcement office had picked up and what he could accomplish alone. Councilman Hamilton stated that one employee and a secretary should be able to handle enforcement. Commissioner Moreno suggested using the City newsletter to inform the citizens that inspections wilt be made and alerting them that the City planned to crack down and that an initial tetter he sent to individual homeowners regarding their nuisance. Chairman hittey stated that if they forced the inspection, landlords would have to upgrade their property and raise the rent. He was in favor of the inspections and said it would also help correct the graffiti problem. Councilman Hamilton said rental property should be inspected when it became empty. A person could drive around and observe without having to go into their back yard. Discussion followed relative to having the utility companies notify the City of properties being rented so that they could issue an occupancy permit. He said if the graffiti program included paying the same kids to paint over what they did at night, he considered that blackmail. He stated they should go on record with a get tough" attitude with the Police Department. He said he felt that the people who created the nuisances should be the ones to pay the bill and was in favor of the $20 fee charged by Pasadena, as the owner would also benefit from the improvement. He referred to weeds at Los Angeles and Center, Merced and Baldwin Park Blvd. and the Southern Pacific Railroad right-of-way and said this should not be tolerated. Mr. Cunningham stated that they now have a nuisance case against the Southern Pacific Railroad because of the weeds on the right-of-way. They had always received cooperation before, but the City may have to cut the weeds for them if they aren't cut. Commissioner Larson stated that he was not in favor of the taxpayers paying for the inspection for an occupancy permit for the owner. He stated the judicial system was responsible for letting the graffiti defenders loose with a slap on the wrist. He agreed with Commissioner Moreno that they were not attacking the job right and stated that Pasadena had had results with their program. Mr. Cunningham stated that rather than use boys on the graffiti program, they plan to use grown men on the CETA Title VI program to sandblast and clean it off. He said the graffiti must be removed in order to bring business into the City. Mayor Waldo said he would tike to see a $500 fine for anyone graffiti ing and their parents should be fined if they were minors. He stated that if they or their parents had to come out and work for hours removing graffiti, parents would see that their children were not on the street. He asked if an Ordinance could be adopted to levy a fine or place a jail sentence upon offenders and maybe offer a $50 reward for information leading to their arrest. Mr. Cunningham said a City Ordinance could be written, but only the courts could enforce it. Commissioner Moreno stated that E1 Monte had made tremendous strides in the removal and retaining of the removal of graffiti. He suggested that someone be directed to contact the City of E1 Monte to see what type of program had been implemented. He said he had never heard of a City Council sending a Resolution to a judge, requesting him to sit hard on violators that come before him, but he didn't think there was a judge on the bench that would ignore the City Council. He said there was a desire on the part of those painting graffiti to be part of the scene and they were proud of their logos. M: HAMILTON. Councilman Btewett requested that the Acting City Manager furnish a report on how CETA employees were used, because this may take a higher priority than in which CETA employees were used. It would be to their advantage if a CETA employee would be used. Councilman Hamilton said it would be up to Staff to get the man from wherever they can. Councilman Blewett seconded the motion. There were no objections. Mr. Cunningham presented statistics regarding how many abatements had been made and buildings brought up to Code in the past eighteen months, and how many had been brought up to Code as the result of enforcement. Commissioner Moreno asked how these figures compared to those of 1974 and 1975. He stated that what Mr. Cunningham had been doing was commendable. Commissioner Burnett referred to the house Councilman Hamilton said he had turned in a couple of times as a nuisance as being on Baldwin Park Blvd. before Francisquito, coming from the San Bernardino Freeway. He stated this nuisance would be a good one to start with. Councilman Aguilar suggested that the Council instruct the Staff to contact the Acting City Attorney to ask him if there was a legal way to charge $500 fine for painting graffiti. Commissioner Moreno said that if it was legal and an Ordinance was enacted, it would be good advertising to notify each judge on the Citrus judicial bench and each judge sitting on a Superior Court bench of our jurisdiction of the law enacted, so they would prosecute with sentences commensurate with the crime. He stated they should know we are watching them and the voters are watching them. Mayor Waldo said a shut-in friend had suggested that the City invite a Citrus Court judge to ride along with a Baldwin Park policeman one night a week for a month so that they can see what was happening when they were so lenient. It could be sent as an invitation after the study has been made. Mayor Waldo suggested sending the Ordinance to the state legislators, too. Councilman Btewett said he would like to set up a meeting with Judge Smith, the presiding juvenile court judge of Los Angeles County, to ask him what he thinks could be done about the graffiti problem in this area. He said it was difficult for a Pasadena judge to relate to Baldwin Park. He stated he had received a call from someone in the HUD office who had told him that the inventory of FHA houses was going to increase over the next three to five years. There had been a shortage of houses but they are taking houses in Pomona back now. He said the problem wi11 magnify when they start having vacant houses in Baldwin Park. He referred to Mr. Cunningham's remark that $74,000 had been spent out of $100,000 HCD funds and asked if it was difficult finding citizens to borrow the money. He suggested leveraging HCD funds with the banks to increase the use of the money. The City could guarantee the loan if payment was not paid. Mr. Cunningham explained that many people did not qualify and why it couldn't oe done through the banks. There was plenty of money available for loans. $21,950 had been loaned to senior citizens and handicapped, $19,800 to small families and $32,767 to larger families. They were all making regular payments. Councilman Hamilton asked if HCD funds could be used for curbs and gutter. Mr. Cunningham said these funds could be used for different projects and could be used if programmed that way. Councilman Hamilton suggested that curbs and gutters be put in where necessary if the money was available and the loan be repaid in the same way as a home loan. Under the 1911 Act the property owner repaid it on his tax bi11. Discussion followed on curbs, gutters and sidewalks. Some citizens had not been witting to dedicate their property. It was estimated that more than 90% of the City was curbed and guttered but more than that did not have sidewalks. Citizens in the past had had to pay for curbs and gutters and might be upset if others didn't. Councilmen Blewett and Hamilton were in favor of using HCD funds for sidewalks, curbs and gutters, as the money was available for this type of program. Mr. Cunningham said $500,000 was available for the third-year program. Mayor Waldo stated that the money would be used too rapidly on curbs and gutters and not enough would be left for home loans. Mr. Cunm'ngham said that about four loans per month were being issued, where the average had been six or seven per month before. Tom Carpenter, 4346 Jerry, stated that CALTRANS money had been spent on installing the Baldwin Park Blvd. medians rather than on installing sidewalks. He said citizens would not resent spending HCD funds for sidewalks, because they were needed for their safety and welfare. He stated that the money should be used for the people and requested that sidewalks be installed. Discussion followed on the minimum size of apartment units and senior citizens units in Baldwin Park. Director of Planning Kitgour stated that the minimum size on a bachelor unit was 450 sQuare feet and 650 square feet on a one bedroom unit. A variance had been granted on the Clark Terrace senior citizens units. He said that a11 the standards and figures would be reviewed with the Ordinance on the Neighborhood Facilities Plan. Commissioner Moreno commended the Council for putting their differences behind them and taking action in an affirmative manner. He said he anticipated a hard fight on the vacancy inspection bill. Councilman Kitchet stated that the Council must also remain vigilant on the nuisances and assist the Staff by reporting them. Councilman Aguilar agreed that the Council should work closely with the staff and for the people and keep personalities out of City business. Jeanne Martens, 14621 Channing Street, stated citizens would be glad to have sidewalks completed as it would improve property values a11 along the street, if the owners were witting to dedicate their property. She suggested that the Council and Planning Commission should meet and exchange input more than once every eighteen months. Councilman Hamilton stated that the Staff had been very cooperative with the nuisances he had turned in, with the exception of the one on Baldwin Park Blvd. and he understood there was a reason for that. It will create a massive problem and will take a gutty" Council to make sure that the City doesn't have rent control Commissioner Wiest questioned the City policy of charging $1.10 per square foot for a bond to allow citizens to put in their own sidewalks. Acting Director of Public Works Sexton stated that citizens had not been allowed to put in their own sidewalks in the past, because they were not a11 qualified craftsmen, The procedure had been changed to allow those who could not afford a contractor to post the amount of money that would be required to remove the improvements if not satisfactory and have a contractor replace them. Some of the work had been totally inadequate. A11 of the deposit was returned except for the inspection fee of $5.00. This insured the City from having to put up public funds for someone's mistake and the cost was not unreasonable. Commissioner Burnett stated that recently he had posted his bond, received his permit for a driveway approach and driveway, put down his money and after the cement was poured it was inspected by the City and less than a month later he had received his money back. Mr. Sexton said it didn't set well with citizens to ask them to put up a big deposit to improve their property, but that when the property owners hired a contractor, they never got their money back. Mayor watdo stated that he had received a request to have a traffic study done at the corner of Foster and Athot due to speeding and accidents. Children were walking to Sierra Vista High School along here and they wanted to know if a stop sign should be placed there. Mayor Hamilton stated that this study had been made three years ago and the Traffic Committee had recommended against a stop sign, saying it would cause more accidents. Councilman Kitchet said he had received complaints of traffic hazards on the corner of dark and Maine by Atphy's and on the corner of Syracuse and Ramona Blvd. where there was a stop sign on Syracuse and no traffic light on Ramona Blvd. He said he was concerned with the traffic having to make left turns onto Ramona Blvd. Councilman Btewett said a No Left Turn" could be posted at Syracuse and signalize Barnes Avenue to turn left there. continued) September 12, 1977 Page 8 BIB] 37657-U01 1977-U02 09-U02 12-U02 CC-U02 MIN-U02 LI1-U03 FO9591-U03 FO9724-U03 DO9728-U03 C4-U03 MINUTES1-U03 2/4/2003-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 1977 09 12 CC MIN(ÌìË Special Meeting of the Baldwin Park City Council September 12, 1977 Page 9 Councilman Hamilton said he had received complaints on speeding traffic on the curve at Merced Avenue and Frazier Street. The Traffic Committee had studied it and recommended no stop sign Merced Avenue. Commissioner Moreno asked whether putting a six-foot width band of dots in the street or speed bumps which tires would hit and a big number 25 on the street would help to stow traffic. Mr. Sexton stated that speeding was a police problem. Innumerable signs could be put there to make the travelling public aware that a situation was coming up, but after awhile they tend to ignore warnings and stop signs. Commissioner Smith said he wanted to call attention to a dangerous situation at the intersection of Ohio and Landis Streets, where the stop signs are not in favor of the children coming up Landis Street. He suggested a study for a four-way stop may be warranted or that the stop signs should be changed around. Chairman Wiest stated that it had been brought to his attention that there was no fence around the emergency equipment at Johnstone Peak. He said the kids get in there and assault the doors and that it would be cheaper to put a fence there. Mr. Sexton said they would look into that. TRAFFIC COMMITTEE STUDY INTERSECTION AT OHIO & LANDIS STS, CITY ENGINEERS CHECK FENCE AT JOHNSTONE PEAK Commissioner Moreno requested that the City Engineers check the corner of Center and Olive Streets where traffic is coming through the back of the lot of the 605 Freeway and the gully is getting deeper. He asked if stop signs could be embedded in concrete to prevent traffic there as it was not a street and presented a dangerous situation. Mayor Waldo asked the Staff what had happened with work that was to be done in the area of Olive Street, as there had been talk of deleting Olive Street and putting another street alt the way through. Mr. Sexton said the extension of Olive Street had been deleted and as part of the San Gabriel River Redevelopment Project, a proposed road parallelling the Department of Water and Power right-of-way was under design. Mayor Waldo stated that the joint meeting had been very effective and requested that Staff make a note that Council and Planning Commission would like to have a joint meeting every six months.
