Mayor Waldo read the Resolution in full and personally thanked Frank Fitzgerald, Frank Juchters, Lee Lucas and family and the Chamber of Commerce for their continued contribution to community exhibits resulting in winning of award of first prize consistently at the Los Angeles County Fair. The matter had, by action and inaction of various property owners, taken on greater proportions than just the siting of a Fotomat facility. He said the Planning Department requested a continuance of the Public Hearing until November 17, 1977. Mayor Waldo asked if there was anyone present that could not be in attendance at the public hearing on November 17th that would tike to testify tonight. There was no testimony in behalf or opposition to CP-250. CONTINUE PUBLIC HEARING ON APPEAL CP-250 UNTIL NOVEMBER 17, 1977. 00- City Clerk Batkus read in full a written communication from Wanda Lee Wit son, 3706 North Willow, requesting three stop signs at Willow Avenue and Howeltnurst Drive. Letter in official file) She wrote that this corner had a bad curve in the street which had resulted in accidents tearing up her yard and trees and causing fear of further dangerous accidents. Councilman Aguitar suggested that the request be given to the Traffic Committee to install stop signs if there is a hazard, without returning the matter to the Council. Deputy Acting City Attorney McEwen said he would research the Code to see if action can be delegated to the Traffic Committee on the need for stop signs, curbs to be painted red, etc. without coming back to the City Council for approval. AUTHORIZE STOP SIGNS SUBJECT TO THE APPROVAL OF TRAFFIC COMMITTEE. M/S/C: AGUILAR/HAMILTON. There were no objections. Mr. McEwen was directed to review the Code to see what could be done to amend or change the present Code to permit staff to take action they deem necessary. Councilman Hamilton said that some of these conditions could be hazardous to the safety of the people and that this could save time by not having to delay approval until it could be brought before the Council. Mayor Waldo informed interested citizens in the audience that the Traffic Committee would study the situation and make a report. Citizens would be able to talk under Oral Communications later in tonight's meeting, or if the staff comes back with a negative recommendation there wilt be opportunity to talk further in a Council Meeting. Acting Director of Public Works Sexton said that Staff had tried to interpret the Code liberally and had brought only the things before the Council that the Code said must come before the Council, such as the Resolution approving a stop sign at Rockenbach Street and Maine Avenue that had been adopted tonight and decisions on no parking. Mayor Waldo asked that Council be given a report on each request given to Staff so that Council is aware of how the problem was solved. Mr. Sexton stated that they respond to everyone for whom they receive a request and that a packet was being put together to answer every question that had been asked during the joint study session with the Planning Commission, including traffic and public nuisance requests. He said he thought this situation at Willow and Howetl- hurst had been investigated before but that he would notify those involved of the results of their decision. 00- Acting City Manager Sexton referred to the award of a contract for capital improvements to be made at Francisquito Avenue and Athot Street. The City Clerk had certified to bids received and the bid tabulation and a written report were included in the the packets. AWARD CONTRACT FOR PROJECT NO. 164 TO LOWEST BIDDER, CORNISH CONSTRUCTION CO., FOR $270,000. M/S/C: AGUILAR/HAMILTON. There were no objections. 00- Acting City Manager Sexton referred to a request from the Council for Staff to investigate the Baldwin Park Welfare Rights Organization in order to assist them with their operation within the community. Director of Recreation and Parks Lucas had headed up a task force of City Staff and prepared a report requesting deferrment of action until further questions were resolved concerning the organization. He said that the Staff understood that they had limited resources and were attempting to deal with the funding question and supported the principle. Councilman Aguilar asked James Gregg, President of Baldwin Park Welfare Rights Organization, if he was financially able to keep their office open another month without help. Mr. Gregg said he had received communication that would allow him to continue further. He said his attorney would explain. Ray de Espinosa, attorney for El Monte Legal Aid, said that temporary assistance was being rendered to the organization and requested that the matter be continued to the next Council Meeting in November. He stated that Baldwin Park's rates were among the lowest and would remain so even if Webster's were granted the modest increase they were requesting. He requested that the rate increase be granted as it had been over three years since they had received a rate increase and only a minimum amount of complaints had been received. He said the residential rate was being increased from $2.50 per month to $3.00 per month with the multiple family rate per unit increasing from $1.50 to $1.80 per month, representing a 2Q% increase. NO. 77-87, SETTING RATES FOR REFUSE COLLECTION RES. NO. 77-87 ADOPTED 8:08 P.M. RECESS At 8:24 p.m. the meeting reconvened. Roll Call was the same as before. 8:24 P.M. MEETING RECONVED 00- Acting City Manager Sexton referred to the recent joint study session conducted with the Housing Advisory Commission at which Staff was directed to prepare a Resolution appointing members of the Housing Advisory Commission to the Housing Authority. The Resolution stated that the City Council will no longer function as the Housing Authority and wilt appoint five persons to act as Commissioners of the Housing Authority. He said that Thomas Klein, Chairman, George Lowe, Vice Chairman, LeMarr Mosley, Dr. Robert Lane and Josephina Medrano were presently serving on the Housing Advisory Commission. City Clerk Balkus read by title: RESOLUTION NO. 77-88, CITY COUNCIL CEASING TO FUNCTION AS A COMMISSION OF THE HOUSING AUTHORITY AND APPOINTING CERTAIN PERSONS TO SERVE AS COMMISSIONERS OF SAID HOUSING AUTHORITY Mr. Sexton stated that the terms were staggered for continuity in the authority and that two offices should be considered for four years, one office for three years, one office for two years and one for one year HOUSING AUTHORITY RESOLUTION RES. Councilman Hamilton said he was not objecting to the people who had served on the Commission. He asked if all the Commissioners had been contacted and had indicated they were wilting to serve. Mayor Waldo said they had all been contacted. Councilman Aguilar said he wanted to move adoption of the Resolution naming Thomas Klein as Chairman for a four-year term, George Lowe for a four- year term, LeMarr Mosety for a three-year term, Robert Lane for a two-year term and Joseph!na Medrano for a one-year term. ADOPT RESOLUTION NO. 77-88 AND WAIVE FURTHER READING. M/S/C: AGUILAR/KITCHEL. There were no objections. Acting City Manager Sexton stated that there were further steps to be taken for which information would be provided for decision making perhaps at the next meeting. There will be changes in the Municipal Code, changes in the salary resolutions, and establishing an admin- istrative arm of the City to service the Housing Authority, including staff and secretarial assistance so that the Authority can function. There are several million dollars worth of programs that are either currently underway or have been promised after the appointment of the Commissioners and the execution of the contracts with HUD has been completed. Councilman Hamilton stated that he did not want to receive information at meeting time to be acted on that night and asked that this practice be dis- continued. He said the Commissioners had evidently all done a good job, but he would have preferred to receive this information in a packet so he could have contacted them before appointing them. The Council had been responsible before but now it was being taken completely out of the Council's hands and being given to a group which he would have liked to have talked to. He stated this was a wrong way of doing City business. Councilman Aguilar stated that he had requested a recess in order to get his question answered, because he had received his packet at the same time as Councilman Hamilton. He said the Resolution had been prepared as an administrative duty in carrying out the direction of the Council. Councilman Hamilton stated that he had not understood that the Housing Authority would be completely taken out of the hands of the Council. Mayor Waldo said it had been discussed and to read the Minutes of the joint study session. Councilman Hamilton said he did not think it was in the Minutes and that he did not want to receive a Resolution or anything pertaining to the business of the City five minutes before meeting time. He said if it happened again, he would request the legality of it. Councilman Kitchet said that it was his understanding when the Housing Authority was created that that the citizens would be handling it. He stated that he was the delegate to NAHRO, which deals with housing and redevelopment officials, and that it was the practice for citizens to be involved and that that was the whole purpose of the joint study session. He agreed that the Resolution had been brought before the Council on the spur of the moment rather than being in their packets, but said that the structuring of the Housing Authority Commission had been approached ethically. Councilman Hamilton stated that he was not objecting to any of the Commissioners, who had served well, but that he would like to have studied it and contacted each of the Commissioners and had not had the opportunity. Councilman Aguitar referred to Page 5 of the Minutes of October 3 relative to the the role of the Housing Authority. Councilman Hamilton said this did not speak of the authority they would have and that it would be taken completely out of the hands of the City Council. Acting City Manager Sexton clarified the relationship between the Housing Authority and the Council. He said that an Agreement between the Housing Authority and the Council must be accomplished and that concerns about the control of the Housing operation can be further stipulated on the forthcoming Agreement. He stated that the Council had the power to appoint and to remove Commissioners, so this was not an absolute arrangement. Mayor Waldo requested that City Clerk Balkus read the Resolution. City Clerk Balkus read Resolution No. 77-88 in its entirety. Mayor Waldo stated that the same individuals whose title had been Housing Advisory Commissioners and who had taken the program from its inception and brought it to the present state where the City was to receive millions of dollars had been discussed at the joint meeting. He said that it was decided that they should be the ones to be transferred from the Housing Advisory Commission to positions on the Housing Authority. Councilman Hamilton said that it was not true that they had discussed transferring any individual to serve on this permanent Commission. He said he was not complaining about the document but about the way it was handled. 00- George Scott, 3522 Baldwin Park Blvd., referred to the new Baldwin Park Blvd. median. He said he had become used to the rocks, but objected to the street lighting, as the amber lights resulted in total darkness between houses and looked tike a brown-out." He referred to the request by the Baldwin Park Welfare Rights Organization for $200 per month for upkeep on their building. He said the County Welfare program took care of their clients and had a union. He said that Mr. Moran was the legal aid attorney in El Monte and handled patrons here. He asked who worried about the property owner who pays the taxes, 00- Tom Carpenter, 4346 Jerry, stated that he had testified that the Welfare Rights Organization should be given anything they asked for, providing that they were checked out. He said that on driving by their office that night they had seen a big sign inside, Vote No on the Recall for Waldo." He stated that this was a political thing and that he had taken pictures and distributed them all over town. He referred to amounts charged for community redevelopment on individual property tax statements and tax increments coming back from the County to the City. He said that the City was being ripped off" and that he objected to extending $50,000 of the City's money to study a project which had been declared invalid. Someone had asked a volunteer in his office to put the sign there. JAMES GREGG, PRESIDENT, B.P. WELFARE RIGHTS ORGANIZATION RE POLITICAL SIGN & LEGAL AID ATTORNEY Mayor Waldo stated that he had asked him to take the sign down. Mr. Gregg said he was not aware that it was there until he had totd him the night that he asked for funding. He said that he could not possibly keep the sign because his bylaws win not permit him to be involved in politics and because he is a deputy registrar. He told Mr. Scott that Mr. Ray de Espinosa was the Legal Aid directing attorney for the Legal Aid office in El Monte and not Mr. Moran. He said he knew everyone connected with the Legal Aid office and there was no one there named Moran and he wanted Mr. Scott to be aware of this. 00- Thomas Klein, 12800 Salisbury, stated that Jim Garrow had always left the Council Meeting with an up-beat attitude and statement. He said that now Mr. Garrow was quite i11. He referred to the progress being made on new buildings in the City and receiving good press from the San Gabriel Valley Tribune and said on behalf of Mr. Garrow he wanted to leave the meeting with the feeling that the City was coming ahead.
