Pacific Avenue SPECIAL MEETING OF THE BALDWIN PARK CITY COUNCIL The City Council of the City of Baldwin Park met in adjourned regular and special session at the above place at 4:45 P.M. At 6:10 P.M. the meeting convened. DECEMBER 2, 1977 4:45 P.M. 5:00 P.M. 6:10 P.M. MEETING CONVENED Councilman Btewett apologized for the delay and said they had just returned from an emergency meeting with Congressman Rousselot at which all Councitmen were present. He stated that the meeting was being conducted in accordance with Government Code Section 36810; that two was a majority of a quorum and that there were some items which they could not handle. He said the first item would be a reorganization of the Council and asked the City Clerk to preside. Councilman Hamilton led the salute to the flag. Roll Ca11: Present: COUNCILMEN BLEWETT AND HAMILTON Absent: COUNCILMAN AGUILAR Also Present: ACTING CITY MANAGER SEXTON, ACTING DIRECTOR OF PUBLIC WORKS SEXTON, DIRECTOR OF PLANNING KILGOUR, DIRECTOR OF FINANCE HALLOWAY, CHIEF OF POLICE CHELLINO, ACTING CITY ATTORNEY FLANDRICK AND CITY CLERK BALKUS Also Absent: CITY TREASURER MONTENEGRO Mrs. Balkus stated that Mrs. Montenegro would not be able to be present. 00- City Clerk Balkus stated that nominations were open for Mayor. RUSSELL BLEWETT NOMINATED AS MAYOR. M/S/C: HAMILTON/ BLEWETT. The nominations for Mayor were declared dosed Councilman Btewett was now Mayor and assumed the chair. Nominations wore now opened for Mayor pro torn. VIRGIL HAMILTON NOMINATED AS MAYOR PRO TEM. M/S/C: BLEWETT/HAMILTON. The nominations for Mayor pro tern were declared dosed. Councilman Virgil Hamilton was elected Mayor pro tern. 00- Mayor Btewett explained that Ordinances, payment of bills and public hearings required three votes and could not be handled. There were no objections. 00- Mayor Btewett stated that alt Public Hearings were continued to December 15, 1977. 00- Ptanmng Director Kitgour explained that in order to comply with federal HUD) guidelines and to obtain funds, it was necessary to adopt a Citizen Participation Plan. This is how we have operated in the past on our HCD programs. ADOPT THE CITIZEN PARTICIPATION PLAN AS PRESENTED. M/S/C: BLEWETT/HAMILTON. There were no objections 00- Ptanning Director Kitgour explained that a HUD requirement for grant applications would be public hearings before an appointed Review Panel. She referred to the fact that Councilman Aguilar was not present at the meeting and stated that she felt Acting City Manager Sexton had engineered all this. 00- Raul Zayas, 12815 Finchtey, requested that agenda packets be made available 1n the library for citizen use. He suggested Council meetings be reorganized so that citizens could make comments before Oral Communication and also be given opportunity for rebuttal and not have to wait until the last for an answer. 00- Gtenn Robinson, 4708 Walnut Street, teferred to efforts to obtain a building permit through the Planning Department. He said he had paid $100 and asked the Council for an answer. He said that he was being asked for another $50.00 to speak before the Council. Planning Director Kitgour said that Mr. Robinson had made an application for a division of land by a parcel map process. The decision of the subdivision committee had been contrary to Mr. Robinson's request and Mr. Robinson must pay an additional $50.00 to appeal that decision. However, the time period to appeal had lapsed, although the procedure had been made very clear to him. He offered to explain the process again to Mr. Robinson. Mr. Robinson stated that he had answered Mr. Kilgour's correspondence a day before the time lapse that had been indicated. Mayor Blewett explained that $50.00 was the fee for filing an appeal. Mr. Robinson stated that he had understood he would be given a hearing before the Planning Commission and the City Council Mayor Blewett directed Mr. Kilgour to meet with Mr. Robinson on Monday morning. Mr. Robinson and Mr. Kilgour agreed to a meeting Monday morning at 8 o'clock. 00- Joseph Angelo, 3123 Baldwin Park Blvd., stated that his client was involved in an Ordinance change and asked for a projection of what might happen if the same situation existed on December 15 or at the following Council meeting. Mayor Blewett said he would promise that it would not continue on his part or that of Councilman Hamilton. Acting City Attorney Handrick reiterated that the problem was that adoption of the Ordinance would require three affirmative votes regardless of what kind of meeting. Council discussion followed regarding the calling of a special meeting to handle a11 public hearings, with concurrence to try to handle them on December 15, 1977, as announced earlier in the meeting to a11 involved individuals. 00- Tom Carpenter, 4346 Jerry, stated that there were many procedures which needed correcting. He congratulated Mayor Btewett and Council- man Hamilton for the way they were handling a difficult situation despite obstacles put in their way. He objected to citizens having to wait until the end of the meeting to speak and getting an answer at the pleasure of the Council. He referred to citizens payment of a $50 appeal fee to enable them to talk to the Acting City Manager or his designated person and stated that it should not be necessary to have to pay $50 to talk to the people who govern their city, as the First Amend- ment of the Constitution gave them that right. He said that the Municipal Code had been changed to take awav the power of the people. He also objected to the militant atmosphere at the November 29 Council Meeting attended by several policemen and called upon the Mayor to help right these wrongs including limiting Oral Communications-to five minutes. 00- Mayor Blewett closed Oral Communications. 00- Councilman Hamilton asked City Clerk Balkus if the agenda packets in the City Library for observation by the citizens had been discontinued. City Clerk Balkus stated that the two library packets were still available and that the last packets sent to the Library were for December 1. 00- Mayor Blewett reopened Oral Communications. Gloria Torres, 3854 Athol, asked Council who to contact regarding a house at the corner of Athot and Foster, owned by Mr. Stockton. Mrs. Torres said that she had been totd that it was. She referred to rubbish visible to the street and said neighbors had been cited for lesser nuisances. She asked why Mr. Stockton had not been cited. Councilman Blewett said that some leeway was usually given when a site was under construction. He referred the matter to Mr. Phil Sexton and asked her to discuss it with him. Mrs. Torres stated that Mayor Waldo had been fu11y aware of the nuisance and hadn't done anything about it. It could be a dangerous area since the property was not fenced in or guarded. 00- Mayor Blewett stated that he would like for the citizens to write in their suggestions for improvements to make Baldwin Park a better city so that the Council could be more responsive.
