Councilman Aguitar referred to Minutes of December 2 and December 5 and stated that November 29 he had asked for a copy of the meeting on Neighborhood Watch. City Clerk Balkus clarified that Councilman Aguitar had requested verbatim Minutes of November 3. Forty five pages of verbatim had been completed this date so were not yet listed for approval. M/S/C: BLEWETT/HAMILTON. Ro11 Call. Ayes: BLEWETT/HAMILTON. Noes: AGUILAR. The Motion Carried. Councilman Aguitar referred to Item 5, the award of bid on the interior planting for the Baldwin Park Public Services Building and the recommendation of Staff that it be held over. Mayor Blewett stated that the award of bid would be held over until the next meeting. Councilman Aguitar referred to Item 6 of the Consent Calendar, City Clerk Position, and stated that he had asked for a Staff report to have the City Clerk's position with increase in salary to be put before the vote of the people and not to have the City Council increase it. The report was to be relative to whether the City Clerk's position should be an elected position or an appointed position with a salary of $15,000, not an elected position at $15,000. Acting City Manager Sexton said that his understanding was that Councilman Aguitar wished to have the question of whether the position was to be elective or appointive placed on the next election. He stated that Mrs. Batkus was working a full-time job and that it was difficult to justify her $4200 salary. The question of conflict of interest had arisen between the appointive Admin- istrative Aide position and the elected City Clerk position when the City Clerk held both positions. He said this would be City Clerk, elected, and the issue could be put to the voters at the next election. Councilman Aguilar asked if increasing her salary to $15,400 would help her retirement. Mr. Sexton said that her retirement was based upon her highest twelve months of service and that this salary was about the same as the combined two positions had been. Councilman Aguilar stated that he preferred that it go to the vote of the people before increasing the City Clerk's salary. He said that his fear was that if she retired with the salary that high, everyone would run for that position, and that it was not right that she receive $15,000 and then return it to the regular salary when she retired. If it was going to remain at $15,000, he would rather resign and run for City Clerk. Mr. Sexton said that this item required three affirmative votes by the Council. Councilman Hamilton stated that he had asked Staff to compare the City Clerk's salary with other city's fu11 time City Clerks and that this salary had proved to be in tine with other cities of this size. Councilman Aguilar stated that he would tike to see this made an appointive position at $15,000 in order to get a qualified person after her term ends. Councilman Aguilar said that if the vote of the people was that the position should be made appoint- ive, then her salary should start at $15,000 and continue until she retired or her term ran out. The position would then become an appointive position Councilman Hamilton asked Councilman Aguilar if he wanted the City Clerk to go for two more years on the salary she was receiving now. Councilman Aguilar stated that this issue could go to the vote of the people in June 1978. Mayor Blewett stated that most cities were appointing their City Clerks, but here the person had been receiving a full-time salary and stilt had a full-time position but had had her salary cut to a part-time salary. Mr. Flandrick stated they would check the time required to place the issue on the March ballot. Mayor Blewett said it could be considered on the March or the June ballot where more people may have the opportunity to vote and this issue would not cost any more money. Mayor Blewett said he agreed with Councilman Aguilar that the City Clerk's salary was not fair to her and also that it should be appointive. He asked him if they could consider the two points separately, as by the end of her term they could find out how the voters felt. He stated that Mrs. Batkus was qualified, but other cities had not been so lucky with the vote and had had to make it a staff position. Councilman Aguilar reiterated that he would rather have it go to the vote of the people before raising anyone's salary. Mayor Blewett said if Councilman Aguilar was firm on this, then they could not handle the budget amendment necessary to increase the salary. Councilman Aguilar said that he was firm and there was nothing personal about it. Mayor Blewett said that Mr. Sexton had suggested that the City Clerk could be reinstituted as an Administrative Aide until the issue could be voted on. He said it was unjust that she was not receiving money for doing a full time job. Councilman Aguilar stated that certain employees must resign their jobs for the City if they want an elected position so this would not be right either. Councilman Hamilton said that the salary of the City Clerk had been set many years ago and was ridiculously low. He was concerned that she must serve at this salary until the next election. Acting City Attorney Flandrick said that the appointment could be made, but that the Code required three affirmative votes for an budgetary amendment and would require the concurrence of all three councilmen. It could be submitted as a ballot measure and become effective at the expiration of Mrs. Balkus's term. Councilman Aguilar stated that he would like to have the issue put on the June ballot, whether the City Clerk's position should be elected or appointed and if appointed, whether the salary should be $15,000, yes or no. Mayor Blewett requested that Acting City Attorney Flandrick draw up the appropriate ballot measure. There were no written protests. Director of Planning Kitgour referred to information contained in his staff report and stated that the Planning Commission recommended approval of the zone change and certification of the negative declaration of environmental impact. Mayor Btewett declared the Public Hearing open. Jay Angeto, 3123 Baldwin Park Blvd., stated that commercial buildings were lacking in the City and that prominent commercial areas should be developed since the freeways gave access to Baldwin Park and such buildings as the driving school would beautify the freeway. Much of their revenue would be spent in the City and their banking would be done here. A building such as this may bring in other builders and more freeway beauty may invite people into Baldwin Park. He referred to a packet that had been prepared and distributed, showing the economic benefits to the community. Mr. Muggeri would register all of his 50 units in Baldwin Park, although he would be using them in a five county area. He stated that this location had been on the market for eight years now. He explained how the school would operate and said they were multi-languaged. It would be a beautiful structure and be good for Baldwin Park to show that a big company had come to town. William Nona, 805 S. Fremont Ave., Athambra, architect for Mr. Muggeri, stated that the building would be a Spanish/Mediterranean structure and that this design would be carried out also in the sign and other aspects of the project. Landscaping and other amenities astheticatly pleasing to the project would be added. He stated that present uses under C-1 would allow construction of lesser quality and bring less revenue to the City. Tom Ktein, 12800 Salisbury, spoke in favor of Z-412 as it would bring revenue into the City and help beautify the freeway along the southern end. Bob Izetl, 3812 Athol Street, stated that as land values go up, people may purchase this property and land bank it or there could be uses on the existing zone of less value than that proposed. He said it would be ideal to have a big sales tax base there, but it would be a start. Dwaine Glass, 14345 East Garvey, stated that he objected to Z-412 because he was aware of a CRA study being made of the freeway frontage in that area. $50,000 had been budgeted. He suggested cancelling the $50,000 study or putting a moratorium on anything done along that area of freeway until a consultant gives input on what to do with it. He noted that Garvey Avenue was 30 feet wide and stated that the lot behind Dial Driving School would be used to train semi truck drivers. He said both he and Mr. Stockton had testified against this at the Planning Commission but the Planning Commission had approved it anyway, not knowing about the study. He said he was not in favor of a semi truck driving school on Garvey Avenue until extensive improvements had been made. He stated that the area along the freeway should have the highest and best use. As there was no further testimony in behalf or in opposition to Z-412, Mayor Btewett declared the Public Hearing closed. Councilman Aguitar asked Mr. Kitgour about the Class A vehicles to be used at the Dial Driving School and stated that Garvey Avenue was too small to drive a Class A vehicle on. continued) WM. Mayor Blewett reopened the Public Hearing. PUBLIC HEARING REOPENED Mr. Angelo stated that a small vehicle with a small trailer would be used, rather than a Class A vehicle. Councilman Aguilar said that if one small rig is allowed, in time larger vehicles may be using Garvey Avenue which was not equipped for Class A vehicles, which were not necessarily semi trucks. Mayor Blewett stated that Class A vehicles travel Garvey Avenue to get to local businesses. He said the City was considering using the old Highway Patrol location for the City Yard, which would mean that the City would be driving heavy vehicles down Garvey Avenue. He stated that his company had proceeded anyway with an investment of $160,000 in preparatory construction work. They had asked for a two-year extension in 1975 but had since come to the conclusion that they could not build a system under the existing criteria and were asking the Council to withdraw the franchise. Theta Cable Television would abandon the construction and bear the toss. Mayor Blewett asked whether Theta Cable TV was finding it uneconomical to construct systems in the lowland" areas. They were not asking for a beer license but for a conditional use permit to serve beer and wine where the main purpose was to sell food and to operate only in daylight hours. He stated that he did not feel they had caused an increase in crime there but that they were victims of it. He clarified that they did not have a bar and food was served cafeteria style. Lynnda Ross, 15401 East Olive, stated that she managed the property west of the proposed restaurant. She stated that the owner, Phil Gray, had attended three Council Meetings at which Council had not met and was unable to attend this meeting. She said that many people buy liquor rather than food at the mini-market, drink it in front of their building, leave their trash and empty themselves in their alley. She referred to a petition signed by 42 residents in the area, opposing the zone change and liquor being sold there. Richard Cunningham, Building Department Supervisor, said that on August 18 Council had authorized them to use local craftsmen and tradesmen to work on the Community Center, not to exceed $68,000. The first phase, including the second year HCDA funding, had been completed and portions of the second phase for a total expenditure of $67,166. Approximately $26,000 was needed to complete the second phase along with the authority to use local craftsmen and tradesmen. There was approximately $8000 left in the second year fund and approval was expected any day on the third year funding. Mayor Btewett stated that he had looked at the rehabilitation of the Community Center today and did not care for some of the changes being made. James Gregg, President of Baldwin Park Welfare Rights, stated that Councilman Hamilton had wanted to review the proposal they had turned in. He said they had helped over 12,000 people over the years and could not be covered within the proposal but the majority of things they did was included in the proposal breakdown. He said calls were received from all parts of California as he was active in many committees which he listed. He had worked a lot with veterans and senior citizens were his top priority, with their many problems on housing and with their low income. He stated that he was attempting to obtain funding from GLACCA but they would not fund them until July, 1978. He stated he intended to keep the office open but City funding would help him with rent and utilities, which he had been paying out of his own pocket for three years. He stated they were assisting with the 250 families that would be moving out of the trailer court. Mayor Blewett stated that Mr. Gregg had made a request for the funds and that Council had requested that Mr. Gregg present what he was going to provide for the City in return for the funds in written form. Mr. Gregg said he had turned in a complete breakdown of a11 the work he had done in the City in the last three years and would continue to provide. Services would probably be better if they were funded. Councilman Hamilton said he had requested that Staff study this proposal and come back with a recommendation or a proposal. Councilman Aguilar said it had been tabled while Mr. Gregg was in Sacramento. Councilman Hamilton stated that Director of Parks and Recreation Lucas was to present a report to Council on the organization. He said he was going to recommend that a budget be set up at the next budget meeting for these things with only a certain amount allotted. He said his office was the only office f in the Valley to have direct communica- tions and to be able to help people immediately without long waits. He said many people are told the computer made a mistake although clerical errors had caused many people to go hungry and without. Councilman Hamilton said that Baldwin Park organizations such as the American Legion and Veterans of Foreign Wars have counsellors to help veterans and that there were welfare offices in other cities. He stated that Mr. Gregg had done a good job but that these services were available elsewhere. Mr. Gregg stated it was difficult to get an answer from these offices. He said they had helped a lot of people in the City and were now asking for $1200 temporary funding so that he could continue with operation of the organization without paying expenses himself as he had done for three years. He said if the taxpayers in the City could not see that what he had done had been an asset and kept the poor people off as a burden to other taxpayers, then he must be wrong. Jane Lucas, 13979 E. Garvey, stated that she was a volunteer service to the community. She said it had taken from 1975 until October 1977 to get her S.I.D. straightened out after she became disabled, and Mr. Gregg had helped her to get it. She said they work for every- body in the community and hoped that the Council would make the decision so that they could keep their doors open to help people in alt areas of need. Mayor Blewett said that Councilman Aguilar had suggested that a complete referral service of the many services in the City be made avail- able at City Hall and that that was probably the answer. He said that in his opinion most of the community based organizations did not provide good service. He did not feel that City government should become involved in the welfare problem as welfare may be removed from the county and handled by the state or federal government. He stated it would seem foolish for the City to become the advocate of welfare and that he saw city government as an instrument of management to make things happen in the community, not as a social service agency. Councilman Hamilton said that when he had applied for Social Security he had received all the information necessary from their counsellors. He stated that many people have received disability and social security assistance from the West Covina office with no problems and he was not in favor of providing City funds for services available through another office. Councilman Hamilton said he understood that the Chamber had not realized that policing the Carnival would cost so much. Chief of Police Chellino clarified that in the past the Chamber of Commerce had paid for the officers who were providing security. He said that no less than two officers should patrol the carnival and that it might be necessary to put two pair there, depending upon the people there and the activities. Mayor Btewett asked about the possibility of placing two regular officers and two reserve officers at the carnival. Chief Chetlino stated that they were hoping to use mostly reserve officers and confirmed that cadets could also assist. Councilman Aguilar said to keep an eye on the vendors because they would short change. Joe Angelo, Chamber of Commerce President, stated that two months ago the Chamber Board had decided not to have a carnival. They had had a meeting with the Chief of Police and the City Manager and the interpretation was that the Chamber should put on such events as a Carnival, etc. etc., as though it was a suggested item. He said the City Manager had clarified that they did not have to have a carnival. Mayor Blewett stated that the prior City Manager had claimed some executive privilege as the present Council members did not interpret it that way. The Chamber Board should have come to the Council for direction before they deleted the carnival. He stated that the carnival would not be feasible if the Chamber must bear the cost of the security personnel, but if the City wished to provide that and give the Police Department a greater budget to cover it, it might be feasible. Councilman Aguilar stated that the Chamber had received $52,000 and that the City should not have to pick up this cost. Mayor Blewett said that maybe the City could pick up the deficit, if there was one for the carnival, as far as police protection was concerned. It would be better for City officers to provide the security. Mr. Angelo stated that it was not their intent to breach the contract and that if it was the Council's interpretation that they must put on a carnival, they would do so. Council concurred that this had been their intent and that the beauty pageant, the parade and the carnival were the highlights in the City every year. Mayor Blewett said that Mr. Sexton would have to determine something on the first question and that it may not be resolvable until after the March election. Mr. Sexton had been directed to took into it. He polled the Council as to their preference for Council Meeting nights. Following discussion. Council decided to hold this item over until the next meeting so that Councilman Aguilar could consider it. 00- Dwaine Glass, 14345 E, Garvey, said that before the change, Wednesday night was a major meeting night in the City, whether it was a Council or Planning Commission meeting and everything else could be set aside so that Wednesday night was a City night. Ohio Street, asked if the City Engineer position would be advertised for or if a consulting firm would be used and if so, if they would be picked by advertising. Mayor Btewett stated that the Acting City Manager would contact firms who do municipal work and probably bring an experienced consultant before the Council for their consideration and approval. He said many cities do this on a short-term basis. He said the Andersen Report was being reviewed and some changes would be made, but the City would still be a full service City with its own employees, Mr. Smith commended the Council for extending their hands to each other and having an easy, flowing Council meeting tonight. Councilman Hamilton stated that when the Andersen Report is implemented, it win improve the previous services in the City. He said Council was still investigating it and when it was implemented. City Halt would be run more like a business and with a lot of red tape eliminated. 00- Linda Parilla, 5046 N. Meeker, asked what was happening with the Youth Advisory Commission. Councilman Aguilar said he had just called for a meeting and that Mr. Sexton would determine whether they could have one on December 27. LINDA PARILLA RE YOUTH ADVISORY COMMISSION 00- Haltie Slater, 4814 Stancroft, stated that a few years ago Mrs. Balkus had acted as City Manager as well as City Clerk and did a tremendous job. * She stated that Mrs. Balkus knew more about the City than most and had been City Clerk for many years. She suggested that she be appointed Assistant City Manager ** and also that Council consider allowing citizens to speak under Oral Communications before all agenda items are settled. Mayor Blewett said the Council would consider her suggestions but that it couldn't be settled tonight. 00- Jeanne Martens, 14621 Channing, stated that she and many others have church obligations on Wednesday night and would not be able to attend Wednesday night Council meetings. 00- Councit concurred that the joint meeting with the Youth Advisory Commission would be called as a soecial meeting. 00- AT 11:15 P.M. He referred to the unusual circum- stances and the hardship this requirement would create. Leo King, 3830 Grace Avenue, referred to the density factor that had created the 6000 sq. ft. lot requirement and said that times and the money situation had changed. He stated that the homes looked as though they would be a credit to Baldwin Park and that the depth was sufficient and side yards did not have that much effect. Robert Wyatt, 15214 Kenoak Drive, stated that his home had only a 50 ft. frontage that was satisfactory. He referred to the subject property as an eyesore" and a weed abatement problem and said he was speaking also for neighbors who weren't present that wanted it developed. As there was no further testimony in behalf or opposition to ZV-349, Mayor Blewett declared the Public Hearing closed. Councilman Hamilton suggested that since the people in favor of ZV-349 had been asked to stand, those in opposition should also be asked to stand. Mayor Blewett concurred and those in opposition stood in the audience. Councilman Hamilton asked if there were other alternatives to cutting down the number of lots and asked Mr. Kitgour to elaborate on the conditions to be imposed. Mr. Kilgour stated that the only alteration would be to reduce a lot from each row across the width of the property. Three lots would be lost in the process of making the lots 60 feet wide. He read the seven conditions Staff and the Planning Commission had recommended. Council discussion followed regarding lot width, the possible trend back to 50 ft. width, and that quality construction of homes by the R. G. Garland Corporation would alleviate the problem the City had had with this property.
