JANUARY 5, 1978 7:38 P.M. She requested that Warrant No. 9548, $70,000 to the Baldwin Park Water District, be added to Claims and Demands Resolution No. 78-3, amending the total to $400,001.79. The $70,000 was to be appropriated to the Public Works Department from the unappro- priated surplus. Mayor Blewett and Council concurred that the intent of Council was that the City Clerk handle the Btewett recall and that only the City Clerk recall be handled by another entity. He said another Warrant Number would be added to the Consent Calendar for the City Council to appropriate $70,000 to the Public Works Department for the construction of a water line in the Northwest CRA area. An invocation was given by Reverend Ruben Martinez, Iglesia Bautista. Councilman Aguilar led the salute to the flag. He confirmed that normally payment of bills required three votes; nowever, they had operated under the Rule of Necessity on December 7. Councilman Aguilar stated that he hated to bother Councilman Hamilton after his operation. Mayor Btewett said that Councilman Hamilton had been assured they would only stay five minutes, although Councilman Hamilton was feeling much stronger. Councilman Aguilar asked if there was any way it could be done by phone. Acting City Attorney Flandrick said there wasn't. He stated that the Council had set the precedent of acting on the bills and could again, but there' wos no real necessity on the Ordinance. He confirmed that public hearings and appeals did not require any particular number of votes. Councilman Aguitar asked if three was considered a quorum to act on public hearings and payment of bills. Mr. Flandrick said he didn't think that was necessarily true although the number of a quorum was not dear with these circumstances. 00- AT 7:45 P.M. Mr, Flandrick stated that only three Council seats were tilted on this Council and that on prior occasions the Council had taken the position that a majority of a quorum was two of the three present members. He said this was not free from legal doubt, but the precedent had been set and the Council could proceed with the public hearings on that basis if they wished. Councilman Aguilar said that he was concerned that the Council's decision might be tried in court because they didn't have a full quorum to consider the appeal. Mr. Flandrick stated that the Council may want to withhold SP-34 until the next regular meeting, which Councilman Hamilton planned to attend. Council consulted the applicant, Mr. Perance, regarding whether he wished to proceed with two councilmen or to continue the hearing until Councilman Hamilton was present. Mr. Perance stated that he would be willing to take the chance that Council's decision might be challenged. Councilman Aguilar stated he had merely wanted to protect the applicant and the Council. Mayor Blewett said Council would proceed with the public hearing. Director of Planning Kilgour said the request to permit the construction of the planned unit development complex. Specific Plan 34, had been considered, along with alternatives, by the Planning Commission and had been denied. They had preferred that the development have 6000 ft. + lots in a conventional pattern. He referred to information contained in his staff report and said that Staff had recommended approval of the applicant's proposal, subject to conditions and certification of the negative declaration of environmental impact. He said additional details could be added to the nine conditions if Council wished to approve the request. Draft Resolutions of approval and denial were included in his report. Mayor Blewett declared the public hearing open. C. Les Perance, 3750 Puente Avenue, the applicant, stated that he and staff members had completed about six month's research on the project. They had examined single family developments in areas surrounding the city. He had reviewed a number of projects developed in this manner. They had explored the different alternatives that each developer had used and eliminated some of the less desirable projects, attempt- ing to take the most desirable aspects from different projects for their proposed project on Puente Avenue. He stated that a lot of work had been put into the Staff recommendation. He described the planned unit development and physical structures of single family homes and how they would be maintained in detail. He said the landscaping was included in the project in a manner that would blend together. The project had been designed with privacy in mind, with the asphalt areas minimized by putting it at the garage areas at the rear of the property, serving eight units, and the green area maximized by putting everyone's landscaping in one area on front of their homes. He stated that the sales price would range between $45,000 for a two-bedroom home to $65,000 for a three- bedroom home and that an income of about $17,000 per year would be necessary to qualify for purchase. They were trying to attract people who could afford to live in this development and make monthly payments of $450-$500 per month. The type of housing that there was a strong demand for had been taken into consideration for the proposed project. Jeanne Martens, 14621 Channing, stated that she and her neighbors were enthusiastic about the project and were pleased that something was being done with the property. Opal Pierce, 3337 North Puente Avenue, stated her opposition to SP-34. She stated that she lived adjacent to the property and was opposed to 24 houses with families in each home living there, as she said there wasn't space enough for play area for a11 the children. She stated that there was not enough parking area and that Puente Avenue would probably have cars parked on both sides. She stated that she and her neighbors had 91' lots rather than the proposed 60' lots. She said their privacy would be minimized by the back yards of these homes facing into their own back yards and that there were no other two story houses in the neighborhood. As there was no further testimony either in favor of or in opposition to SP-34, Mayor Btewett declared the public hearing dosed. Councilman Aguitar stated that 24 new homes at an average of more than $45,000 apiece should bring a better class of people into the city rather than to create a ghetto." Mayor Blewett stated that he thought the project should be an excellent addition to the City and that there was a tendency for families buying in planned unit developments to have fewer children. He stated that block walls should be required everywhere but across the front. Councilman Aguilar inquired about a graffiti- proof paint for walls. Mayor Blewett suggested the requirement that a11 walls within 50 feet of the street be painted with vandal guard graffiti retardant. With the concurrence of Council, Mayor Blewett declared the public hearing reopened. Mr. Perance stated that the project included perimeter block wall fencing and cross fencing of redwood and beams that would be more attractive He said they were trying to use redwood or wrought iron fencing or used brick that would be resistant to graffiti. Mayor Blewett said that anything in front must be graffiti proof and agreed with the proposed cross fencing and block wall perimeter. Mayor Blewett assured Mrs. Pierce that the project would be a credit to the neighborhood and that 6 ft.' block walls would be provided. Acting City Manager Sexton stated that a framed plaque could be made for the entire team with a scroll for each individ- ual player with their name on it. Council concurred. Mayor Blewett explained to the audience that the Resolutions of Commendation had been prepared for the Baldwin Park Braves and Coach Pagone, commending them for the first undefeated football season in the history of Baldwin Park High School. He said he felt the whole town should honor them. 00- Tom Klein, 12800 Salisbury, stated that there was a need for information on home improvement and City programs, recreation, etc. through the City Newsletter as the local newspapers do not print this. He was in favor of starting the City News- letter again. Councilman Aguitar said that the Council had voted not to publish the Newsletter two months prior to an election. There had been an election in November and the next election was in March. Mr. Ktein said that at the rate Baldwin Park was going it might be another year or two before another Newsletter was published and that the Council should keep politics out of it. Mayor Blewett stated that Councilman Aguitar had also agreed to this policy at the time the motion had been made and that it was a policy that was correct and should stand because it would generate publicity for an in- cumbent and was not a proper use of money. He said he assumed the next News- letter would come out in May or June and and would contain information on summer recreation programs. There would be an election and a change in March and if the majority of the Council wished to publish one soon after, they could do so. Councilman Aguilar said that Council had requested that Staff find out how much it would cost for a newspaper article on events in Baldwin Park. Mr. Ktein suggested a small ad in the Tribune once a week or on Sundays, listing activities and meetinos for the following week. Mayor Blewett said these were already in the Sunday Tribune every week, with the exception of Park activities. Mayor Blewett stated that he objected to spending taxpayer's money on buying advertising in newspapers and that this would involve making a choice of which newspaper to buy it from. 00- Jeanne Martens, 14621 Channing, suggested disseminating information on services provided by the City and schedules on Recreation and Park Department's activities in pamphlet form. Mayor Blewett asked Mr. Sexton to direct the Public Information Officer to prepare a report for Council outlining how informa- tion is disseminated to the public. He asked Director of Recreation and Parks Lucas how and when the information on the sports scheduling should be put out. Mr. Lucas said that the summer program information comes out in June and that prior to the City Newsletter, this was distributed with a house-to-house mailing. Mrs. Martens stated that she does ca11 Parks and Recreation for information and that she had been asked to help disseminate schedule information. Mrs. Martens said she understood that this city was to be host to the Independent Cities of Los Angeles County and that it was for the dissem- 1 nation of public information and if we were not disseminating our own information it looked tike it didn't work. Mayor Blewett stated that the Public Information Office was charged with this responsibility, but this didn't necessarily mean publishing a Newsletter. He said his objection had been to the prostituting of the Newsletter in the past.
