There were no objections. 00- It was the time and place fixed for a public hearing on an Appeal on the conditions of approval of Parcel Map No. 950 for property located at 4619 North Laurens Avenue Appellant: Dorothy M. Iford Proper publications and mailings had been accomplished. There were no written protests. Mayor Btewett declared the public hearing open. City Clerk Batkus stated that a copy of the agenda, with this item checked, had been sent to Mrs. Iford as notice of the hearing. Mrs. Iford was present but did not testify. Mayor Btewett requested that the public hearing be continued to the next Council Meeting as a matter of courtesy and because of the confusion about the date of the Council Meeting. Proper postings and mailings had been accomplished There were no written protests. As there was no one present to give testimony on Case 76-N-44, Mayor Blewett directed that the public hearing be continued to the next regular Council Meeting to allow the case to be presented. 00- Acting Director of Public Works Sexton stated that the City operated under the various Building Codes which were adopted in the Municipal Code. He recommended that Council adopt the updated 1978 edition of the National Electric Code as mandated by the State of California. There were no objections. 00- Mayor Btewett referred to prepared Resolutions calling for the direct election of the Mayor and four Councilmen and allowing the electorate to decide the term of office of the Mayor and whether the office of the City Clerk should be appointive in the June election. Councilman Aguilar asked if the City Clerk's salary would be included on the measure. Acting City Attorney Flandrick stated that the Government Code provides that the City Council shall set the salary even for elected positions. He said it would be difficult to put the salary on the ballot but that the Council could take a straw vote" on the salary if they wanted to. Councilman Aguitar asked if the law had changed so that the Mayor could be elected even if Baldwin Park was a charter city. He said this would be a great advantage to the City. Mayor Blewett stated that this had been put before the voters a few years ago and it had been defeated about 6-1 because the people were afraid of government. He said that many general law cities were starting to elect the Mayor direct. This hopefully might solve some of the problems that the City gets into. He said he had definite ideas about whether the term for Mayor should be two years or four years, as he didn't feel that the Mayor should be weaker than the Councilmen who serve with him. Councilman Aguilar said that with an elected Mayor Council could oust a dictator under a two year or a four year term. Mayor Blewett said that a Mayor had just been recalled by the people and that they wouldn't be precluded from doing this with an elected Mayor. They would be given a chance to vote on whether they wanted an elected Mayor or not. Councilman Hamilton stated that he thought that had been a lack of understanding by the people when the issue of charter city had been placed on the ballot before and defeated badly. He said he was not ready to make a decision and vote on the Resolutions as they had just been handed to him tonight. He wanted to give the people a chance to express their feelings on it and would like to make a survey himself of other cities. Mayor Blewett said the Council was only deciding to let the people vote on this and they would ultimately be making the decision of whether they wanted that form of government or not. Councilman Hamilton said it would be necessary to set up a campaign to inform the people and that it was important to discuss what information was to go out to the people. He confirmed that he was in favor of voting the City Clerk issue in but not of voting on the other at this time. Mayor Blewett said that this discussion could be continued to the public hearing on March 9 or the next regular meeting on March 15. He invited comments from people in the audience. Carl Sharpe, 5018 Wimmer, stated that he felt this subject should be tabled until a full 5-person Council had been seated and could deal with it. Bob Izett, 3812 Athol Street, asked if the three best men in town were to run for Mayor, would the two who were not elected be excluded from the Council? This way the City would not receive their services. Mayor Blewett said this would be the men's choice of what they wanted to run for. He stated that the Resolution had never failed in any City it had been proposed in. The people had always approved it because they wanted the right to select their elected Mayor. Councilman Aguilar suggested that the Resolutions be voted on at the March 9 meeting and said that everything the 3-man Council had done couldn't have waited until March for a fu11 Council. Councilman Hamilton stated that he wanted to talk to other Councils who had made this change and would have all the information he needed by March 9 in order to enact the Resolution. He said the office of the City Clerk had been discussed before but that he was definitely in favor of a 4-year term for an elected Mayor. Councilman Aguilar asked when this would take effect.
