Councilman White led the salute to the flag. He stated it was a waste of taxpayer's money. Acting City Manager Sexton stated that there was a legal problem with accomplishing what they wanted to do with Item 6 and that he and Mr. Flandrick and Mr. Cunningham were going to go and try to remedy that during the public hearings and present it later during the meeting. 00- It was the time and place fixed for a Public Hearing to confirm the cost of abating the public nuisance at 3152, 3154 Baldwin Park Blvd., Case No. 77-W-210. Proper postings and mailings had been accomplished. There were no written protests. Acting Building Superintendent Dawson said that the property, owned by Rene Mirazo, and been inspected and was found to be a nuisance. Th? weeds had been abated by the City at a cost of $230.00. There had been a second bid for $275.00. Mayor Blewett declared the public hearing open. Jay Angelo, 3123 Baldwin Park Blvd., said there had been a lack of communication from the owner to him on the contract to abate. The last weed abatement by Mr. Gamble had been only $35.00. He said the front of the house had not been disced and that the part of the back that had not been disced was more of a fire hazard than what had been done. He distributed photographs among the Council and stated that he was objecting to the amount of work that was done for that amount of money. Mr. Dawson said that the owners and Mr. Angelo, as agent for the owners, had been notified in timely fashion over the last year and had been given every opportunity to dean up the property. The abatement had been done February 16, with hand cutting and a considerable amount of debris removed from the property, in addition to the discing that had been done. He presented photographs showing the property before cleanup, with the man doing the handwork on February 16, and said that the inspector's report had stated that the contractor had cleaned satisfactorily as directed. He stated that nothing had been disced that was not over- grown and hazardous and that weeds had grown rapidly because of the rain. Council concurred that the property had been a disgrace for a long time and looked much better since the abatement, although the weeds had grown since then. Councilman McNe111 stated that he had been shown the property and did not think the property should have gotten in the condition that it was in today since February, and that more discing should have been done. He said there should be more restriction on the contractor and inspection after the job was completed. There was no quarrel with the owner over paying the fee, but the question was, whether the job could have been done better. Councilman White stated that he would encourage the owners to obtain their own contractors to clean up their property, as the City could not be responsible for providing a controlled service. Councilman Aguilar stated that abatements should be brought before the Council sooner, rather than a month and a half later. Richard Gamble, 4129 Jerry Street, stated that his brother and his son have contracted this type of work for twenty-five years. He said he had piled trash from the premises at 3152 and 3154 Baldwin Park Blvd. because he thought they were working there rather than down the street. He said he did not know if couches had been removed before that day, but that he could have removed the debris he piled in one pickup load and that discing had not been done next to the house where it could become a fire hazard. He had looked at the property the day after the job was done. The rear of the lot had been disced but not within 30' of the house, and no handwork had been done. Acting Building Superintendent Dawson stated that the property, owned by Manuel Mendoza, had been inspected and found to be a nuisance by the City. It had been abated by the City at a cost of S235.00 for the cleanup of debris and removal of a stab. He said that Mr. Salinas had been the contractor and there were before" and after" pictures, the City was responsible for taking the pictures. There had been two bids. Acting City Attorney Flandrick confirmed that this was an update into the existing National Electric Code, 1978 Edition. Mr. Lee inquired whether rewiring would be required on older buildings. Proper publications had been accomplished. There were no written protests. Director of Planning Kilgour referred to information contained in his staff report relative to the eligi- bility of the City for an Urban Development Action Grant from HUD. At a public hearing held on MarQh 23, 1978 the chairmen of the Advisory Commissions, Housing Authority and Planning Commission, acting as a review panel, had recommended that the Puente-Merced Redevelop- ment site and proposed development be considered as the UDAG application emphasis. The public hearing tonight was to receive testimony from the audience, after which the City Council should select a project. He referred to a listing of possibilities eligible as a project for UDAG funding and of the factors in support of the recommendation that the Puente-Merced be selected. He stated that the action tonight of selecting a project for the UDAG grant application would be followed by another public hearing two weeks from tonight to present to the Council to direct a specific action for applica- tion. He referred to the Minutes of the Community Development Citizens Committee, which included their recommendation that the Puente-Merced project be selected, and said it was attached to his staff report. Mayor Blewett declared the public hearing open. As there was no testimony 1n behalf or in opposition to the Urban Development Action Grant, Mayor Blewett declared the public hearing dosed. Councilman White inquired whether the community redevelopment site was to be funded from sales tax anticipated from sales after the operation is built. Mr. Kilgour stated that economic studies indicate that the probable way to finance the site was through sales tax from the proposed project. The grant wilt impact the funding by cutting down the length of time required for the pay back of sales tax from the site. The UDAG grant would be a down payment or seed money on the project. He stated that the amount of the grant would depend economically on how they fit in the project, but confirmed that it looked as though they wi11 have a successful application, as HUD requires a project that will benefit the City by providing jobs and have good leverage of public and private funds. There is also a signed commitment from a developer ready to go and the auto agencies wi11 provide permanent jobs within the City. Spin-off" businesses should result from the project. There were no objections. 00- Administrative Assistant for Redevelopment Raphiel stated that after the Redevelopment Agency's action on March 6 to adopt the Preliminary Redevelopment Plan, the law required that a Project Area Committee be formed when a substantial amount of residential individuals will be relocated. He referred to his staff report, including a listing of individuals who had expressed willingness to serve on the Committee and said it was required that a series of no more than four Committee meetings be held to discuss background and progress, owner partici- pation rules, and to review the Redevelopment Plan and make recommendations to the Agency if there are changes. He explained that a majority of property owners on the list were absentee owners and confirmed that relocation benefits must be provided to tenants, businessmen and homeowners in the area. His prepared listing was representative of the property owners in that area and were the owners who had expressed interest in serving on the committee. Councilman White stated that he had been concerned that a11 pros" might be on the committee and that perhaps all things that should be considered might not be, but felt more comfortable knowing how they had been selected. Mr. Raphiel stated that there had been no members from the Property Owners Association on a formal committee when the first Puente-Merced Redevelopment Plan was adopted, as there were on this proposed committee. He confirmed that the Animal Control budget was approximately $50,000 and that the contract with the county was paid from General Fund monies. Some of the antirecessionary funds had been used in the past to help pay Animal Control fees and providing basic services to the City was a proper and authorized use for these funds. He stated that the City could not pay for any new services that had not already been provided in the past fiscal year from these funds. He confirmed that five quarterly payments of antirecessionary funds had been received and that they would probably continue for another couple of years, based upon inflation and unemployment trends in the United States. The intent for receiving these funds was probably to cover impending layoffs, if the City was ever faced with that. A citizen's review process was necessary to satisfy federal and state requirements for citizen participation, particulary with the housing element of the General Plan. The Committee will function as a study and review board on goals and objectives on General Plan and land use matters, recommend- ing action and directing Minutes of their meetings to the City Council. He said that the committee should be composed of a cross section of the community and had been divided into six neighbor- hoods, boundaries which had been set at the time of application for Housing Community Development funds. Representation should be based in pro- portion to the population of each neighborhood and had been considered in the compilation of the membership listing for the Neighborhood Facilities Plan Citizen Advisory Commission. He said that home owners were the ones who usually tried to get by on a low budget, with the houses not coming up to standard. Mayor Blewett said that move-ins served a need, and that he had sympathy for the first-time home buyer as it was hard to be able to qualify financially; however, they should be developed to a satisfactory standard. He said that virtually a completed neighborhood had been moved into the City of Irwindale and they were very attractive. Councilman Aguilar inquired whether houses being moved in must be brought up to Code. Mr. Kilgour said that basic improvements of plumbing and electrical must be made, but that insulation was not required. The inspector must decide whether the house is basically sound and had been built to Code. Mayor Blewett stated that only six permits had been issued in a year and two months. Councilman Izell inquired how many had been completed. He said they were alt still 1n process Mayor Blewett stated that permits had not been issued until six months ago, so this was not unreasonable. Mayor Blewett said that this had been before the Council three times and it had been tried both ways. The Building Department seemed to be tightening down in order to make the move-ins into quality developments. Mr. Kilgour suggested tightening restrictions by requiring that development be accomplished by licensed contractors only or people who specialize in moving structures and relocating them. This would make it necessary for owner/ buyers to know they needed enough money to hire a contractor to carry out the project to completion in a diligent manner. Councilman White inquired whether Council would be exceeding their discretion by passing a law that move-ins were disallowed. Acting City Attorney Flandrick stated that he was not aware of any such cases, but that there might be some court that might upset this decision. Councilman White asked whether an Ordinance could be passed indicating that a licensed contractor must do the work. Mr. Flandrick said that this requirement would not be unreasonable and could be sustained; however, requirements of this type might be set up without specifically requiring that a licensed contractor do the work. Garvey, stated that someone at the Planning Commission Meeting had been held off on a lot split on relocating a house. He asked how the Council's decision to ask for more study on ideas to tighten up the house moving standards would affect several people who are in the process of moving houses. He asked if they would be stopped or exempt. Mayor Blewett stated that if they had a permit, they would have a right to finish what they were granted. Councilman White explained that the Council had left everything as it was and had not changed anything tonight. Mr. Glass stated that the Planning Commission did not like move-in houses and given any reason not to act on a piece of property that was about to accommodate a move-in house, would forestall any action until the Council had given their opinion. She stated that there were funds available to aid in the restoration of historic sites, and this building had been designated as such by the State of California. She suggested modification of the building and listed the possibilities for its use, including a museum with display of local arts and craft and possibly the loan of large collections from the Los Angeles County Museum of Natural History. These programs could be correlated with programs of the Baldwin Park School District. One central building should house a permanent collection of antiques and memoribitia representing the City of Baldwin Park so that everyone may share in looking at them. She established her credibility and explained that her interest and awareness of the concern of citizens had happened after being requested by the Editor of the Pomona Valley Historical Quarterly to do research on the history of Baldwin Park and to write and article for the Quarterly. She said she had incorporated two independent studies, an oral history and geographic history of Baldwin Park, into her schoolwork as a student at Pitzer College in Ctaremont, hopefully laying the foundation for a history book on Baldwin Park, She stated that she had been totd by a Board Member relative to the California Preservation Act that the Environmental Impact Report was questionable regarding the historical significance of the building; therefore the EDA and California Historic Preservation Commission had re- considered that portion. She stated that she had no political affiliation and did not belong to any groups in the City of Baldwin Park and wished to take exception to a remark made to her by an employee of City Hall at a City Hall Meeting and witnessed by a number of people, suggesting that there was a conspiracy on the part of those wanting to save City Ha11. She stated that she would be forced to take action if Mr. Cunningham again cast aspersions on her integrity as her activities had been well documented. She had received applause from students at De Anza School for her presentation on the history of Baldwin Park and said she believed this was the most constructive method in helping young people to appreciate their environment and that the adults in Baldwin Park could team appreciation of the history of their community from these youngsters. She stated that she had given a copy of the map to Robert Weiss Carr, associate planner of Wallace, McCarg, Roberts and Todd, who had been hired by the City of Baldwin Park, to aid him in his work and benefit Baldwin Park. She asked the consideration of the Council in restoring this fine building to its rightful place. 00- James Gregg, President of Baldwin Park Welfare Rights Organization, asked how many senior citizens owned homes in Baldwin Park and what their average incomes were. He stated that most were incapable of making the required payments on current home improvement programs and asked the City Council to approve a free home improvement plan for senior citizens in the City. He quoted statistics from the 1970 Census relative to poverty levels in the City and listed his affiliations from which he said he gleaned his information. He referred to the Jarvis-Sann Amendment and the effect it would have upon cities and legal offices, if passed. He said that legal services were not being provided even now, before passage of the amendment and s^atsd that one issue dealt with cutting off 26,000 people from Medicaid for those in convalescent homes. He said that President Carter intended to use the CETA program to help with his welfare reform package but that with the cutbacks it wouldn't help much. He recounted an incident where a person not receiving Social Security had received an overpayment for $15,000 through clerical errors in the Social Security Department. He said the Baldwin Park Welfare Rights helped with those kinds of problems and that he was well equipped through his affiliations. He gave senior citizens fact sheets to Council. 00- Tom Ktein, 12800 Salisbury, stated that the tow interest home improvement loan program was a fine program, as the repaid money would be used over and over again and provisions have been made that those who are unable to pay their loan may have their payment defrayed until their property is sold. He said that he knew of ten or fifteen move-ins over the years and that they all appeared as if the house had originally existed there. He stated that a house was inspected to see that the foundation, sewer tine, gas and water lines and everything required are up to Code before the house is lowered. Judith, stated that she had inquired about a low interest improvement loan for a client of hers and had been told that they were handled through the county. Mayor Blewett stated that Mr. Cunningham would help her with information. He explained that there were low interest loans, but if people couldn't make their payments the City did not foreclose on their homes but received their money back when the house was sold. Councilman Izetl stated that he had been in the office when Mrs. Azquith was there, and said that she had been told about $600 free money that did not have to be paid back and given a telephone number to call. She said their names and phone numbers had been taken and they were told that someone would contact them. Her client wanted money that she would pay back. She said senior citizens had been independent a11 their lives and don't want their independence taken away from them. 00- Mary Gathron, 3148 Syracuse, said that Ginnie's Trailer Court around the corner from her was an eyesore and asked what would be done about it. Mayor Btewett stated that a public hearing had been held and that her Conditional Use Permit had been revoked and the County of Los Angeles was in the process of taking criminal action against her for health violations. Mrs. Gathron referred to luncheons prepared for senior citizens and asked if bus service could be provided for them, Mayor Blewett stated that the City was in the process of obtaining a couple of vans to be used for a senior citizen dial-a-ride system. City Manager Sexton stated that an information package on the dial-a-ride system should be ready within two weeks. 00- Jamie Clark, assistant editor for the Glendora Press-Azusa Herald, stated that he had been designated to cover the Baldwin Park area and listed his credentials. He volunteered assistance and exposure for organizations, projects or fund raising clubs and said he would do all he could to help with his paper and other editors and publishers throughout the southern California area. Mayor Blewett requested thdt Mr. dark print the application for City Commissions as a news article, with a request that the appli- cations be mailed back to the City. He said he was also requesting that Judy Hammond print the same article in the San Gabriel Valley Tribune. Mrs. Asquith stated that the Baldwin Park Herald-Press publishes the advertising for the City but that the paper had not been delivered south of the freeway for two months. Mr. Clark stated that he planned to increase to 15,000 circulation but that it would take about 30 days. Circulation up to 100,000 was planned by mid-summer and if response was received from the public. Council and merchants of Baldwin Park the paper may go into bi-weekly publication. Mayor Blewett stated that Councilman McNeill had made pamphlets available of available services to senior citizens so that anyone interested might take a copy. 00- AT 9:55 P.M. Mayor Blewett stated that Little Leagues had always borne the burden of being self-supporting and that the City may be facing the loss of revenues as high as $800,000. He said that he personally preferred to provide in-kind services to the Little League rather than cash, and hoped that Councilman Izett would guide them in this direction. Councilman White said that he had found in his involvement with Little League groups that most of them pride themselves on the fact that they are completely self-supporting. The schools gave them sites to play on and the Recreation and Parks Commission conducted training programs for umpires and coaches. Councilman Izett said he had attended the East San Gabriel Planning Commission dinner and the El Monte City Council meeting. He referred to notes made during the Council Meeting Mayor Blewett stated that the Council would compare notes after they had a11 attended their various Council Meetings to see how the City Council Meetings could be improved. Councilman Izett stated that a new City Manager had been appointed and that now he would tike to pursue getting the staff up to date and taking care of the problems the Council had been elected to take care of. Mayor Btewett said he was not in favor of moratoriums and asked Mr. Kilgour what the problems were with move-ins. Mr. Kilgour stated that Staff had implemented a procedure and was carrying it out well. He said there were no problems with buildings re- located on the same site, as the concerned property owner did a professional job, but as with the frame school house, sometimes with an owner/builder they have to foreclose on the bond or declare it a nuisance. Councilman White inquired whether standards could be set and insured on move-in properties. Mr. Kilgour said that some cities have de- clared certain standards on age of structure and architectural theme, with a special permit required and review by a Planning Commission or City Council or architectural committee, based upon a pictorial presentation before the Board. Sometimes it was still necessary to foreclose because the owner/builder had under-capitalized. He confirmed that standards could be established and maintained by the City. It would probably increase the cost because of the qualifications that must be met but could be done by surety bonds. Mayor Blewett suggested changing the surety bond to a cash bond, as this might spur them on to faster completion. Mr. Kitgour said he could check to see if this would have an effect. He confirmed that presently the City is operating under general construction ordinances, with a building inspector checking to see if the structure is sound, writing up corrections and then inspecting it again after it has been moved for additional corrections. It is re-inspected as the work progresses after being relocated on its foundation, but there were no limitations or standards otherwise. Councilman White stated that he would be inclined to support a moratorium also, although he did not like moratoriums. Councilman Ize11 inquired how long move-ins had been allowed in the City. Mr. Kilgour said, since February 1977. Councilman Ize11 referred to the MacDonatd house and stated that he would not like to see it or any other 50-year old house moved, as they would not be as good as a new house.
