Proper postings and mailings had been accomplished. There were no written protests. Acting Building Superintendent Dawson stated that the nuisance of hazardous weeds and overgrowth had been abated by the City at a cost of $92.00, which was the tow bid. There had been two bids. Mayor Blewett declared the public hearing open. As there was no testimony in behalf or in opposition to Public Nuisance 77-W-230, Mayor Blewett declared the public hearing closed. Duane Glass, 14345 E. Garvey, stated that he had expressed his approval at the Planning Commission meeting, as this proposed zoning would be far better for land near the freeway as the noise gradient would not be suitable for residential zoning. He referred to a map included in an environmental impact report made during the last CRA studies and said he would like for the Council to see it. Councilman Izelt stated that Mrs. Long had been his campaign treasurer and inquired whether he should vote on the Ordinance. Acting City Attorney stated that there was no disqualification unless Councilman Izetl felt he should disqualify himself because of his personal relationship with the family. Proper publications and postings had been accomplished. There were no written protests. Director of Planning Kilgour stated that HUD regulations require that Council conduct a public hearing to hear public comment in order to authorize a project appli- cation submittal. The Puente/Merced redevelopment site had been selected as the project for the UDAG application at the last Council Meeting. He stated that the pre-application had been submitted to HUD and notices had been sent to SCAG and the State clearing house and that the Staff recommended that Council authorize the submission of the UDAG appli- cation involving the Puente/Merced Redevelopment site. Mayor Blewett declared the public hearing open. As there was no testimony in behalf or in opposition to Urban Development Action Grant Project Submission, Mayor Blewett declared the public hearing closed. AUTHORIZE SUBMISSION OF UDAG APPLICATION: PUE:1TE/MERCED REDEVELOPMENT SITE. U/S/C: MC NEILL/IZELL. There were no objections. 00- City Manager Sexton referred to the Agreement between the City and the Baldwin Park Redevelop- ment Agency and said that it stated that the City has and will continue to provide certain personnel services, utilities, etc. for the operation of the Agency. M/S/C: AGUILAR/WHITE. There were no objections. 00- City Manager Sexton referred to the City's application for a Transportation Development Act Claim to the county. He stated that a transportation system was being considered and that money was available. A Resolution adopted by the Council was a nacessary requirement, although this would not guarantee the money or incur debt. City Manager Sexton read by title: RESOLUTION NO. 78-46, AUTHORIZING A TRANSPORTATION DEVELOPMENT ACT CLAIM WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 78-46. M/S/C: AGUILAR/IZELL. There were no objections. 00- Director of Finance Haltoway referred to a request that the County Assessor's office provide the City with early estimates of the City's assessed valuation for the npxt fiscal period. REQUEST THAT THE COUNTY ASSESSOR FURNISH THE CITY OF BALDWIN PARK WITH AN ESTIMATE OF ASSESSED VALUATION OF THE CITY NO LATER THAN MAY 15, 1978, AS PROVIDED IN THE SECTION 27421 OF THE GOVERNMENT CODE, AND THAT THE CITY CLERK BE INSTRUCTED TO NOTIFY THE COUNTY ASSESSOR OF THIS REPORT. There were no objections. 00- Director of Housing Cunningham stated that after two years the California Housing Financing Agency had their program assembled and had requested that the City's application be submitted, along with a required Resolution stating that the City desired to participate in their concentrated rehabilitation assistance program, TWO tracts had been designated as target areas for the first six months of the program. Rehabilitation financing will be provided and refinancing of homes at 7h% interest, The restrictions of HUD relative to income limits and residency requirements are relieved by this program and it becomes a complement to the other loan programs. There is a tandem designation for the rest of the City which win provide refinancing of properties and also rehabilitation with refinancing at 2% interest up to a maximum of $65,000 for the properties. The City's responsibilities will be to provide inspections of the rehabilitation and monitoring of the program. There have been difficulties in the past with lenders providing loans in Baldwin Park. There will be 6-month's trial period for lenders working in this area and if they do not perform and provide loans, CHFA will replace them with lenders who are willing to make loans. He said he strongly recommended participating in the CHFA program as it will assist citizens with moderate and upper level income, which the low interest loan program was prohibited from doing. Councilman Izetl asked how refinancing would help the City and individuals. Mr. Cunningham stated that refinancing would help the individuals while the rehabilitation and refinancing will upgrade housing and allow individuals to consolidate their'debts and payments and proceed with loans at a lower rate of interest. Councilman White said he agreed that Proposition 13 was a faulty piece of legislation and that it would bring lawsuits and other troubles, while Proposition 8 would be a wiser solution. He said that the people, however, had shown that they wanted to decide on Proposition 13 themselves and that he was not in favor of the Council attempt- ing to assert its will on the people, even if the Council could be in full agreement enough to take a position on it. Councilman Izetl stated that he was personalty voting for Proposition 13 but did not feet the Council should take a position on it. Councilman Aguitar said that people were tired of taxpayer's money being wasted and the mis- management of money by the County officials. There was talk of cutting services but not of Supervisors cutting employees or their big expense accounts. He said he was endorsing Proposition 13 as a City Councilman. Councilman McNeill said that all Councilmen should state whether or not they are in favor of Proposition 13 and attempt to help the people in their decision, as they do not a11 have the time to attend seminars and read information on both initiatives. He stated they would be shirking their duties as City Councilmen if they did not try to inform the people. Mayor Btewett stated that he had a split opinion on the two bills and was still studying them. He stated that the Jarvis-Gann initiative motivation was high principled but was attacking local government rather than state and federal government where most of the waste occurred. He proposed that Council defer taking a stand on the matter for 30 days, after which he would have made up his mind. There was a split vote at present among the Council. I think she is an extraordinary person that has done an extraordinary job for the City and there were some people that felt strongly that they wanted to punish Mrs. Balkus I think for some of her political beliefs in the past. And this is kind of an old wound and they had that opportunity when they had power in the City and they did that. But I think the people in this community spoke and a lot of us spoke because they respect and admire this person for the work that she has done and the dedication that she has provided to the people of this community. He stated they were request- ing cooperation and support as well as approval that the City provide for four police officers to supervise the activities. 00- Jesse Sanchez, President of M.E.CH.A. at the High School, stated that they had asked other organizations to help them as this was their first Cinco de Mayo celebration. He said their budget was low and help was needed with security. Mayor Blewett inquired whether there would be a charge to attend the dances. Mr. Velasquez stated there would be a charge to cover the expense of the band and any money left over would be applied toward a scholarship for the High School as they were a non-profit organization. The dances wilt be held at the Morgan Park Community Building. He stated that they had met with the Chamber of Commerce relative to their Cinco de Mayo celebration. The Chamber was more business oriented and would have preferred to hold it in front of businesses rather than at Morgan Park. Councilman Aguitar stated that Morgan Park closes at 10 P.M. and inquired whether they had asked for a later hour. Chief Chellino stated there would be an overtime charge for regular police officers for Friday and Saturday, a time when they were usually fully committed. Director of Finance Halloway stated that the cost for four officers per hour would be $60.00. Councilman McNeill inquired about the use of cadets and reserve officers. Chief Chellino stated that the Police Department does have cadets and reserve officers, but a reserve officer along with a regular officer would probably be paired for security use. Mr. Velazquez stated that they were in the process of asking for volunteer officers and that Officer Martinez had already said that he would volunteer. They were asking that security be provided in case they were not able to get four volunteers. He stated that the requirements of the Recreation & Parks Department were that one dance will be for teens and one dance for adults, which meant that security would only be required for four hours on Friday. City Manager Sexton stated that the City would incur a certain liability by officers volunteering services to the City. Acting City Attorney Handrick agreed. Councilman Izell inquired whether the Police Department automatically furnished security when there was a dance. Mayor Blewett answered in the negative. Councilman Izell stated that if something went wrong, the Police Department would surely be called. Chief Chetlino said they would respond. Director of Finance Halloway stated that there were Ordinances which require that some kind of security be provided at dances, although it was not stipulated they must be police officers. Director of Recreation & Parks Lucas stated that the applications for dance permits had been brought in only this afternoon and the permits had not yet been seen by the police officers who issue the permits. He said his office only makes the building available. Councilman McNeHI stated that he had met with M.E.CH.A. and found the young people involved and enthused over the celebration of Cinco de Mayo. He said he believed the Council would be doing a good service by approving funding for protection of the citizens by the police. Councilman Aguilar stated that since the City would be liable for donated police services, they should honor the request for police protection and waive the permit fees. Mayor Blewett asked how they could differentiate between this group and, for example, the band group at Baldwin Park High School which was attempting to raise funds and have something at Morgan Park to raise funds. Mr. Lucas stated that if there were no funds» there was no gift of public funds and that the band group was not asking for co-sponsorship because they would be taking a financial benefit from the program. Mayor Blewett asked if the group in question planned to take away zero" money. Mr. Lucas said that he had stated that this was a possible solution. Councilman White stated that that particular solution would also facilitate deploying on-duty police officers. Councilman Izell stated that he was of the opinion that if the Chief of Police issued a dance permit, that he was obligated to protect the dance. Councilman White stated that the Chief was obligated to protect the entire City at all times, but that he would not normally assign policemen at locations to do that for private affairs. He said large dances are the kind of affairs that are known for having caused trouble and that the purpose was preventative patrols. Part of regulation was insuring that the agency sponsoring the dance has adequate security to prpvent this kind of activity as opposed to having the police come to repress it after it happens. This was the purpose of the regulation and the pre-police deployment. Mayor Blewett stated that the Code normally required that the function supply security. Chief Chellino stated that there were restrictions, before the permit was issued, that security be provided. Councilman Aguilar asked City Manager Sexton if Council had not waived permit fees when the Youth Activities Advisory Commission had requested it when they held their car wash. She stated that she had been told, no, when she had asked Mr. Lucas for a waiver of fees, because although no money will change hands there, the students are taking pledges for per hour of playing. She said there were all cultures in the band and that if the City wants to waive fees for this one group, she felt the $68 fee must be waived that the band must pay Friday night. Mr. Flandrick stated that he had been referring to fees for dances, Councilman McNeill asked why the fee for a band marathon was so high. Mrs. Zook said that the charge was for Park personnel and for the permit to use the building and that she was not complaining because the Parks staff and Police Department had a11 done everything they could. Councilman McNeill asked if this was the same fee as for the dance. Mr. Lucas said that the same basic fees apply for the building rental and overtime for personnel. The Cinco de Mayo group had just filed their application this afternoon and their permit had not been processed yet for the dance. They have not asked for a waiver of the rental fees and will pay it themselves. Mr. Velasquez stated that the only cost they could not cover was for police protection. Mr. Flandrick said that the matter at issue was police protection and that this was committed to the discretion of the City Manager unless Council decided to make it a City-sponsored event and have the City bear the cost. Councilmen McNeill and Aguilar were in favor of making it a City-sponsored event and providing police protection. Mr. Velasquez inquired whether the City wished to co-sponsor the whole event or the two dances. He stated that they were just asking for police protection for one particular event. They would be unable to make money for the scholarship fund if the City co-sponsored it, because they would not be allowed to charge. Mr. Velasquez proposed that the City Council consider establishing a policy that police be sent to any type of activity done by agencies of the City that would benefit the community and that were non-profit organizations. He said that when non-profit groups must pay fees in order to put something on, they don't do it. Councilman White stated that philosophically this thinking merited approval but that it would be impossible for the Police Department to deploy to all the non-profit organizations which include churches, Womens' Clubs, Little Leagues, football leagues, etc. Mr. Velasquez said that the policy should be established for the agencies who specifically come and ask that the service be provided. Some agencies may not require or seek it. Mayor Blewett stated that he would not want to make a general policy like this, but that the Council could make special exceptions. He stated that the schools pay for security at their football games, even though it was a worthy endeavor. Acting City Attorney Flandrick clarified that if the two applications, one for teenagers dance and one for adult public dance, are made by the organizations, the Code provides that there will be no filing and processing fee involved because they are exempt from the City Business License provisions. He stated that the City Manager had the authority under the Code to waive the police protection if he finds that good cause exists. This could be done if there were sufficient officers volunteering. The alternative would be, if the City wished to sponsor either or both dances, for it to be a City activity with no fees other than the Council may direct. James Gregg, President of Baldwin Park Welfare Rights, stated that he wholeheartedly favored the request made by the organizations and that he thought money from block grants might be used toward it. Cinco de Mayo celebration would help to bring people together and give a better understanding of the various cultures of the Latin race. He said the Welfare Department had spent $84,000 last year on cultural awareness. Councilman Aguitar asked for further clarification on what was meant by a City-sponsored event and whether it meant there would be no admission fee. Acting City Attorney Flandrick said that if the City wished to sponsor either or both dances, they would become Recreation & Parks Department functions and be conducted without charge to the organizations involved. If it was a co- sponsoring situation such as Mr. Lucas had suggested, and a charge was made at the door for the cost a that /ould be fine. Regarding the last item on the Agenda I'd tike to know if this position was open and if it had been advertised as being an open position or was it just re-created? If the job was just created, it seems that it is also a part-time position since the City Clerk already has a position. I am sure that if it had been advertised that you needed an Administrative Aide with the proper qualifi- cations, that you could have hired a part-time worker for $15,827 a year. Isn't this also a conflict of interest, where someone has to wear t"/o hats in the City? Are they serving the public or serving the City? Who is paying the higher salary? It is interesting that this term is going to terminate on February 28, 1970 1980). Isn't this just a week before the election of the City Clerk? Of course that is an elected position by the electorate of Baldwin Park and we ex- panded that position. What was your second question? Mayor Btewett Because it is our feeling, and I think that's a majority feeling of the Council, that we have an extraordinary person and an extraordinary situation, and that person intends to not seek reetection and at that time we are not we are going to at that time the ordinance the position will revert back to what it has been, a part-time position. The Clerk's duties will be diminished as well as the salary. Mrs. Waldo So then you won't have someone doing these extra duties at $15,827 a year, is that correct? Mayor Btewett That's correct. Mrs. Waldo Then it was just created for one person? Mayor Blewett Unless the Council at that time so decides to do that. Mrs. Waldo I also understood that it was on the ballot in June. Mayor Blewett That is correct. Mrs. Waldo Why couldn't this just have been done through that month and then let the people take care of it from that point on? Mayor Blewett Well, the people certainly are going to have an option in making the position appointive or making it elective at that time. And the Council felt that they didn't want to wait. If the people so decide to make the position appointive, that change would not be made until the 1980 election. Mrs. Waldo I think you have answered my question. Probably there are as many ways of handling it as there are cities and we are selecting one method that is ysed in other cities, too, where they have a full-time elected City Clerk who receives a rather, you know, appropriate salary. The duties well, I know that I know none of us, as you well know, would perform the duties that the Clerk is required to perform and the time that she is required to put in for that amount of money. It is, you know it's a very ironic thing that she has people that work for her that make two-and-a-half and three times as much money as she does. Okay, Mrs. Zook Gloria Zook, 4817 N. La Rica About a year ago, I had the opportunity of walking the streets of Baldwin Park, and I believe I was asked at about every other house about why we couldn't do some- thing for our Clerk, Our Clerk was making a low salary $300 a month not commensurate with her duties at all. I think you have done a wonderful action. But I would like to remind people that this is not the first time jobs have been created. We have a Public Relations Officer that was created that position was also created and favorites were played. I do not believe that job was advertised. That is your own statement, Mr. White. Listen to the will of the people. You said that about twenty minutes ago. And with that, Madame Clerk, roll call. please. Councilman White Rebuttal, Mr. Mayor, please. Mayor Blewett Mr. White, Councilman White Mr. Aguilar, I think that basically and I understand clearly what you are saying and I acknowledge saying, listen to the will of the people. I believe clearly here that I am listening to the will of the people of Baldwin Park. I think certainly that the measure can be decided by the people in June and I agree that it should be. I don't endorse that particular change in our process, but I do agree that it is up to the people to decide. However, I don't think that we should ask a person that has been loyal to this City for many. many years to be deprived of a fair wage while that issue is being decided and for that reason I made this motion tonight. I don't think we are doing I don't think we are giving anyone anything. I don't think we are being unfair with anyone. I think we are applying a special solution to a very unique and special problem and I acknowledge that it is not the soundest administration. However, this is a motion with a terminal date on it, which is February 22nd, 1980. It is acknowledging that a situation has existed in the City for a long time and I again reiterate my motion. Councilman Aguilar I agree with you, sir, that this situation has been going on in the City for a long time and the main reason it is still going is because of favoritism for a certain person. I agree that Mrs. Balkus has done a lot for the City. I can see where there has been a lot of good people in the City that have done just as good as Mrs. Balkus. Then why don't we give them money and make it a fair issue? The issue of $15,000 is not it. It is just that it shows favoritism and like you say yourself that the $15,000 wage is going to finish in March of 1980 February of 1980 and after that if somebody else decides to run for City Clerk they won't have the opportunity to make the $15,000 a year. That's not right. You don*t care which way you think or to make I don't care which way you turn to make it legal or to sound legal, it is 100 percent favoritism and you are still telling the people, we don't care what you decide June 6, we are going to do this now and that's it. Take it or leave it. Take it or leave it that's what you are telling the people of Baldwin Park. Mayor Blewett I just have one brief comment. Yes, I think it probably is showing a degree of favoritism.
