Roll Call: Present: COUNCILMEN AGUILAR, IZELL, MC NEILL, WHITE AND MAYOR BLEWETT CITY MANAGER SEXTON, DIRECTOR OF FINANCE HALLOWAY, DIRECTOR HOUSING CUNNINGHAM, ACTING CITY ATTORNEY FLANDRICK, DIRECTOR OF PLANNING KILGOUR, CHIEF OF POLICE CHELLINO, RECREATION & PARKS DIRECTOR LUCAS, AND CITY CLERK BALKUS Atso Present: 00- Absent: CITY TREASURER MONTENEGRO 00- It was the time and place fixed for a Public Hearing on an APPEAL CP-264, appealing the decision of the Planning Commission on an application for a Conditional Use Permit to maintain a non-drinkers lounge with dancing in C-2 property at 14426 Ramona Blvd. Applicant: Jesse E. Fristoe Proper publications, postings and mailings had been accomplished. There were no written protests. Planning Director Kitgour reviewed the agenda packet report. Mayor Blewett declared the Public Hearing opened, Mr. Jesse E. Fristoe, 14426 Ramona Blvd., asked that Council ignore statements which appeared in the Herald-Press as they are not his statements. He proposed a non-drinkers lounge with dancing and had submitted a petiti 1 to the Planning Commission expressing no objection" to his application from McMahan's Furniture, Speers Florist and Baldwin Park Lumber Company. This is a new concept. There are 20 non- drinker lounges with dancing in the United States and a11 are doing well. He will advertise and plans to bring people and business to Baldwin Park. Mayor Blewett said the petition should have been in the agenda packet. In answer to Councilman Aguitar, Mr. Fristoe said there would be live music weekm'ghts from 8 p.m. to midnight and weekends from 9 p.m. to 1 or 2 p.m. He will surrender his liquor license. In answer to Councilman McNeitI, Mr. Fristoe said he would refuse entry to anyone who had been drinking outside and it would be clearly understood that there will be no drinking and no dope. He will be his own bouncer." Mayor Blewett inquired as to police protection and clarified that Municipal Code Section 4203 stipulates police protection is required for all public dances; 0 to 50 persons requires one officer; 50 to 100, two officers or licensed uniformed private patrol. Mr. Fristoe said a $5.00 cover charge wilt discourage drifters and he will have a mature clientele. In answer to Mr. White, Mr. Kilgour said the specific parking plan applies to the entire city; some cities allow use of public right-of-way but our code does not. There are some legal non-conforming businesses using public parking, but their requests to expand were denied because there were no parking facilities. Councilman Aguilar and Councilman Unite agreed that restrictive night parking might inhibit growth of business, but the Council was obliged to conform with the code. Mr. Fristoe said he could meet the conditions, includ- ing a large exit" sign, but expenditure of five or six thousand dollars for handicap rest rooms would be impossible and asked that this requirement be modified. In answer to Councilman White, Mr. Kitgour said there could be no variance to the A-3 occupancy Building Code requirements and Mr. Cunningham said handicapped require- ments are mandated by State law and there is no appeal section. Mr. Fristoe withdrew his application as remodeling costs would be prohibitive. As there were no further testimony either in favor of PUBLIC HEARING or in opposition to CP-264, Mayor Blewett declared the CLOSED Public Hearing closed. Mayor Blewett said police and handicapped requirements should have been resolved by the Planning Department or the Planning Commission before present tion to Council. REFUND $50.00 APPEAL FEE FOR CP-264 TO MR. FRISTOE. M/S/C: BLEWETT/AGUILAR. Roll call. There were no objections. Mr. Kilgour clarified that A-3 requirements for handi- capped was included in staff reports but that the fact that there was no option under State law may not have been stressed. He said police review on alt applications is standard procedure. Councilmen White and McNeill requested that in the future the police report become part of the report to Council. Mr. Flandrick explained that legal publications must be in an adjudicated newspaper of general circulation. Both bidders are adjuicated by State law. June 15, 1978 Page 3 LEGAL PUBLICATIONS Councilman White asked if award half to each of the said the award must go to bidder. it would be equitable to two papers and Mr. Flandrick the lowest responsible Councilman White asked if it would be possible to negotiate with the newspaper to be of more general circulation as delivery was not made south of the freeway. Mr. Flandrick explained that no requirements can be made of a qualified paper. Notices can be shortened to cut costs. Requests for bids can be readvertised with new conditions added. Council concurred that wider circulation would benefit the people. REFER BIDS ON LEGAL ADVERTISING TO THE CITY MANAGER to discuss with the Herald-Press, suggesting that 50 copies be available at both the library and at City Hail, stipulating the smaller 6 point type to cut costs. REFER BIDS ON LEGAL PUBLICATIONS TO CITY MANAGER 00- The NEIGHBORHOOD FACILITIES PLAN CITIZEN ADVISORY COMMISSION appointments were continued to June 21, 1978. Council was requested to submit names for consideration. 00- APPROVE EMPLOYMENT MANAGEMENT AGREEMENT WITH CITY MANAGER. M/S/C: WHITE/MC NEILL. Roll Ca11. There were no objections. 00- Mr. Philip Sexton said he and Mr. Hattoway's review of revenues indicated the General Fund would be short $757,000 and Street Lighting $170,000. The General Fund cannot be reduced by $757,000, so attempts were made to find other sources of revenue. Mr. Halloway reviewed possible sources of revenue and discussion followed. The City Manager was instructed to prepare a list by June 21, 1978, of possible revenue sources for Council to adopt or reject. 00- The Mayor with the ratification of Council made appoint- ments to commissions. COMMENDATIONS BE PREPARED FOR PRESENTATION TO THOSE WHO HAVE SERVED ON COMMISSIONS. M/S/C: MC NEILL/AGUILAR. There were no objections. Councilman White thanked those who have served on commissions. He said that if a person was not reappointed this was not an indication that they were not a satisfactory commissioner. There wilt be some changes in government as there have been on Council. Mayor Blewett requested more applications for further appointments, stating that the same people serving continuously is similar to having the same people on City Council; and the voters do from time to time change councilmen. 00- ADOPT RES. NO. 78-62 COMMENDATIONS FOR COMMISSIONERS ORAL COMMUNICATIONS Mr. James Gregg, President, Baldwin Park Welfare Rights said Mr. Lawrence Evans, Counselor for Los Angeles Center for Veterans Rights, had contacted him today. As the Center is non-profit and they will help Baldwin Park veterans, Mr. Gregg proposed that they apply for a fireworks permit under Welfare Rights Organization. Mr. Evans said that when incorporated they would be based in Baldwin Park and because of this, other cities had denied them permits. He proposed using the American Legion site for fireworks sales. Council concurred that on June 7th the application time had been extended for Mr. Evans. If the organization contacted the City Manager and if they qualified under the Municipal Code, an applica- tion would be accepted. The Council meeting was hot the proper place to appear on this matter at this time. 00- Mr. Dwaine Glass, 14345 East Gravey, said he was a cancelled commissioner Community Redevelopment Advisory Commission). He had served and at the last few meetings he was the only one present. He will continue to help the City. Mr. Glass said as an agent he had appeared before the Planning Commission ZV-356) on June 14, 1978, requesting an interior lot. He felt he was mis- treated based on a threat made some weeks ago on a Planned Unit Development when rejected by the Planning Commission and appealed to Council. The threat was that next time something similar occurred, an EIR would be requested. On ZV-356 an EIR to be paid for by the client was requested and the matter was continued to November, 1978, He had expected an acceptance or a denial. He questioned whether he could appeal this action. Mr. Glass said he felt the Planning Director, in handling this variance, had misused the fiduciary.
