In the Resolutions distributed to Council, he suggested that the first word do" be replaced by the word shall" in the measure set out in the Resolution. Thp City Council stipulated that the Council as a body file written arguments for the measure. In answer to Mayor pro tern Unite, Mr. Cunningham explained that in order to acquire funds for tow-rent housing projects from the California Housing Finance Agency it is necessary to have voter approval. For Baldwin Park this consists of about three minion dollars in construction funds, plus approximately $240,000 a year to the landlords who rent facilities. He recommenod approval of the Resolutions. Councilman Me Neill stated this would not be a cost to the taxpayer and their approving vote wilt make the Federal funds available to the City. Discussion followed IhoL Council would ho responsible for druumonts in favor of the measure. The cost for the attorney's analysis, etc. was discussed. Mr. Alien said preparation would require two or three' hours to draft at the regular legal fee. DIRECT CITY ATTORNEY TO PREPARE IMPARTIAL ANALYSIS OF THE MEASURE AND PROVIDE COUNCIL WITH DRAFT OF ARGUMENTS IN FAVOR OF THE MEASURE. M/S/C: IZELL/ MC NEILL. There were no objections. 00- At Councilman IzeTl's request, Mr. At ten explained the reason for adopting the tax raLe resolutions. Mr. Alien said the Legislature provided for revisions of 1' of the sales tax receipts. In addition they provided for distribution of certain funds from the State treasury. If the Jarvis-Gann initiative is held valid the Council action adopting the Resolutions wi11 be ineffective. However, the law provides a time limit in which to levy taxes and this was the last date Council could comply. There are pending, throughout the State certain challenges of the Jarvis- Gann and to the validity of State Legislature action taken to distribute state surplus. The City adopted the Resolution in order that if someone is successful in over-turning the Jarvis-Gann or the State bait-out provt sions, the Ci ty wi11 have a revenue post tion to fal1 back on. If Jarvis-Gann fails, the State ba11 out proposition has to fall. As a consequence the CiLy as a matter of cautious planning has adopted a plan so if the court, should strike down Jarvis-Gann, the City will have done that which the law requires them to do. the City is not involved in litigation but this would protect the City's financial situation. Councilman Uhite said placing this on the ballot will let the voters decide. Many people have a low income and he does not think low cost housing is equivalent to slums. Councilman McNein said 8500 homes were repossessed last year by F.H.A. Then you have nothing but slums and that's where you run into a problem. He was not for or against the measure, but there are many people in the City who cannot afford to pay the rent and tow income housing can be extended to any City. This housing wilt not be slums, but built up to standards and be good places to live in. 00- Council directed that Ordinance No. 776 be placed on the September 6, 1978 Agenda for second reading. 00- AT 8:15 P.M.
