AND REISSUE WARRANTS. M/S/C: AGUILAR/WHITE. There were no objections. 00- Mayor Blewett presented a proclamation proclaiming October 8, 1978 as Bike Ride Against Diabetes Day 00- It was the time and place fixed for a public hearing on ZV-359, an appeal on the decision of the Planning Commission on a request for a variance from 9552.3a of the Zoning Code; Section 2, Condition B, requiring construction of sidewalk around corner lot, at 15102 Swanee Lane; applicant: William Ghent. Proper publications, postings and mailings had been accomplished. There were no written protests. Mr. Kitgour gave a brief resume of the Agenda Packet report and stated that the code requires sidewalk and installation of two trees when building construc- tion exceeds $5,000. A variance was granted by the Planning Commission to allow reduction of the front yard setback. Mayor Btewett declared the public hearing open. William Ghent,15102 Swanee Lane, requested waiver of sidewalks as he is retired and cannot afford them. In answer to Councilman Aguitar, Mr. Ghent explained references in his appeal tetter as follows: The contractor received a permit and then removed the front of his house. The City stopped construction as there was a misunderstanding regarding the lot tine. In answer to Councitmen White and Izett, Mr. Kitgour explained that printed on building permit applications is a statement that improvements in excess of $5,000 valuation require sidewalks" and the applicant is made aware of this. He said the applicant prepares and presents a plot plan to the Building Deaprtment and the permit is approved. However, in this case when the inspector went to the site he found the location of the property line was not as shown on the plot plan. The City checks the plot plan against City maps based on the information furnished by the applicant. City maps show the right-of-way but not where a11 sidewalks are installed. Even if the lot tine was not in question, sidewalks are still required. Mr. French explained that the City does not have plot plans for structures constructed prior to incorporation so the City relies on the plan presented by the contractor. In this case the contractor believed the property line was back of the curb because there was no sidewalk and he measured from there. The plot plan was approved based on the information furnished. The inspector field checked and caught the error. Councilman Izelt said when the inspector found the setback was less than 20 feet from the street, a variance was required. The Planning Commission approved a setback variance requiring a sidewalk. However, on any improvement over $5,000 sidewalks are required. Mr. Ghent said the room was not completed. Only the front of the building had been removed. Mr. Kilgour said this is a corner lot with no sidewalk on this side of the street and none across the street. Councilman McNeill said he sympathized but he knew of an instance where a room was added; that sidewalks were required and even had to be replaced due to faulty installation. Merrill Whitley, 15116 Howetlhurst Drive, said he had made two additions prior to incorporation when sidewalks were not required. People in the area had made few additions because of the sidewalk requirement and they would not get the value out of the house. Neighborhood traffic is light, there are few children and he favored the zone variance and and sidewalk deletion of the area bounded by Arditla. Chetney, Willow and Howellhurst. In answer to Councilman White, Mr. Sexton said Municipal Code Section 7004, requiring sidewalks, was adopted in December 1974 and subsequent to that time the code was changed from $1,000 to $5.000. Mrs. Bertha Regus, 5013 Cutler Avenue, favored the variance and deletion of sidewalk in the area; that cill sidewalks be put in at one time. She referred to an instance where curb, gutter and sidewalk had been waived as the builder could not afford the cost and she could not see discriminating 1n this Instance. Dwaine Glass, 14345 East Garvey. concurred with Mrs. Regus and Mr. Whitley. Due to Increased building costs, maybe the $5,000 requirement should be raised. As there was no further testimony 1n favor of or in opposition to ZV-359, Mayor Blewett declared the Public Hearing closed. Mr. Flandrick said the code requires Improvements but requirements can be waived upon finding of the following conditions: 1. That because of the location of the property concerned, the terrain or condition of the property that the construction of curbs or gutters or sidewalks or driveway approaches would be Impracticable or unnecessary; or 2. That because of the lack of adequate data in regard to street grade, plans or surveys, that the construction of any of the said Improvements above described render impracticable or unnecessary the construction thereof; or 3. That the construction of any one or more of the above described Improvements, Is included in a budgeted City project, or an existing or proposed assessment district; or Conditions one could apply or Muncipal Code Section 7706 could be changed. GRANT VARIANCE AND WAIVE SIDEWALK REQUIREMENTS. M/S: AGUILAR/BLEWETT Discussion followed. Mr. Sexton said that there maybe deposits for sidewalks. Mr. Kilgour knew of no plans to construct side- walks in the area. Councilman McNeill said everyone should be treated the same; possibly the Ordinance should be revised; investigate possibility of sidewalks on the entire street at one time. Councilman Izelt said sidewalk or a bond is required and waiver can't be granted without a study. Mayor Blewett said this is a secondary street but streets should be sidewalked. Mr. Flandrick suggested granting the Variance with conditions and if study indicates sidewalks are not necessary, then modify the ordinance or Lhe conditions of approval. Discussion favored a review of the ordinance possibly using a percentage of the value of improvements; that sidewalks should be required on all streets. The Director of Public Works was directed to study the issue and present a report with alternatives. Regarding deterioration of the Virginia and Puente areas, Mr. Kilgour said dwellings are built to code. The Planning Commission is udy-ing development standards including setbacks for commercial and industrial buildings in industrial zones. This is part of the General Plan. 00- Chlef of Police CheTlIno reviewed the agenda packet report on overnight parking. Municipal Code Section 3217. He suggested repeal of Section 3217, increase permit fees or continue program at a financial loss. The repeal to be effective January 1, 1979. Enforcement will be continued to that date. Councilman Aguilar suggested posting day of street sweeping so streets will be swept. 00- Councilman Izell asked if the City's Bingo Ordinance is strong enough to prevent abuse by professionals. Mr. Flandrick said he and Chief Chetlino would revelw the ordinance. 00- In answer to Councilman Izell, Chief Chetlino said the party control matter is being studied and a report will be made and that he would research the skateboard matter. The City was successful in obtaining a judgment which had the effect of upholding the Council's revocation of the two Conditional Use Permits on her trailer park. In the same proceedings we filed a cross-complaint asking an injunction to prevent continuing operation by renting trailers and removing existing trailers on the premises. The judgment enjoined her from renting properties to additional individuals and required termination of existing tenancies and removal of trailers. The site has been observed and apparently the same violations continue. He proposed filing proceedings again next week in the same lawsuit asking alternatives for a contempt citation and asking that a conservator be appointed by the Couv't to operate the two properties, terminate tenancies and remove trailers and requesting a hearing within a week or ten days. 00- Councitman I'hite asked guidance of Council in voting on 49 resolutions befor' the League of California Cities in Anaheim. ORAL COMMUNICATIONS Alma Garcia, 15143 Navitia Place, said her concern was the Puente, Root, Central and Chetney intersection. As a committee member from Central School, on January 11, 1978 she had received a tetter from Mr. French that there would be a crossing guard and a storm drain would be put in this summer. Drains have not been installed and there is no school crossing guard. The yield sign on Puente was removed and this is a dangerous intersection. She requested that this matter be taken care of. She is concerned about the children. Mayor Btewett asked if Mrs. Garcia would be a guard or help the City find a guard. Mrs. Garcia said she worked full time and had tried to find someone. Mayor Blewett said the problems of flood control, crossing guard and traffic pattern were being handled by the City Engineer who will submit options to Council. He directed that the Chief of Police place a patrolman at the location if a crossing guard cannot be found. There were no objections. 00- Dwaine Glass, 14345 East Garvey, said there were no sidewalks on Puente and there should be. He asked that the next intersection near the school on Puente be included in the study. 00- Mrs. Bertha Regus» 5013 Cutter, said she would like to see cars that have been parking on lawns for months removed and the ordinance prohibiting parking of cars on front lawns enforced. 00- Councllman McNeill asked that the Mayor proclaim October 6 and 7 White Cane Day."
