There were three areas: San Gabriel River Parkway north of Los Angeles Street in the redevelopment area; two street easements are no longer required as the street pattern has been revised these were a part of LS198, now included in Tract No. 35421); and a 50 x 87 foot parcel dedicated on Tract No. 26197 for Falconer Street. The street is no longer needed). Mayor Blewett declared the public hearing open. As there was no testimony either in favor of or in opposition to 78-V-2, Mayor Blewett declared the public hearing closed, City Clerk Batkus read by title: RESOLUTION NO. 78-101 ORDERING THE VACATION OF CERTAIN STREET EASEMENTS 78-V-2) PUBLIC HEARING OPENED NO TESTIMONY RES. M/S/C: MC NEILL/WHITE. There were no objections. Lewis Farkas was reappointed to office No. 2 and Annie Montgomery to Office No. 3. Gary McMurtrey, student from Baldwin Park High School was appointed to Office No. 6. 00- Mayor Blewett introduced his wife and his daughter Judy Ann Ms. Sherill Testia from his office; also Mrs. McNei11's brother-in-law and wife, Mr. and Mrs. Henry Scarlett. 00- The number of fireworks stands allowed each year in the City was discussed. The Municipal Code allows 14 local organizations to participate if application is made before May 1st and the organization had a permit the previous year. It was the concensus of Council that the number of allowable permits 14) remain the same. 00-- Mr. Flandrick summarized a memo concerning the disciplinary action regarding John Morehead which he had read this date to Mr. Shaeffer. The actions available to Council are as follows: 1) To accept the position taken by Sgt. Morehead's attorney and order the charges dismissed. 2) To set the matter before itself and hear the matter in either of the following ways: a) To set a new de novo hearing and hear the case by presentation of evidence; or b) To review the case based on the transcript of proceedings before the Commission and then permit management and the attorney for Sgt. Morehead to present oral arguments in support of their respective positions; or 3) To refer the matter back to the Personnel Commission with instructions to either rehear the case de novo or to instruct each of the five members of the Commission to review the transcript and resolve the case based on that review of the hearing, and to permit management and the attorney for Morehead to present oral arguments, if they so desire. He and Mr. Sexton recommended alternative 2 a). He cautioned Council not to get into any of the facts of the case at this time. Mr. Shaeffer, Attorney for Mr. Morehead, said they preferred to accept the position that the 2 to 2 vote indicated that the City had not made its burden of proof and in effect sustained Mr. Morehead's position. Alternatively, they would prefer that Council review the matter based on record giving the parties the opportunity to argue the merits of the facts. This would be subject to their contention that only the employee has the right to appeal to Council based on the Personnel rules and regulations. If other alternatives were selected he requested that the date be set far enough in advance for the Superior Court to determine the effect of the October 4, 1978 Page 3 RES. There has been no disposition of the case. The Personnel Commission had not been able to agree on a decision as a member was missing. Councilman White did not favor judging the matter from a transcript or the record. ADOPT RECOMMENDATION 2(A) AND HEAR THIS MATTER BEFORE THIS BODY. M/S/C: WHITE/IZELL. In answer to Councilman McNeill, Mr. Ftandrick said the hearing would be public at the option of the employee. Councilman Me Net 11 questioned the duties of the Personnel Commission and the fact that five members could not get three votes one way or another and make a recommendation and had they been polled as to whether they would rehear the case. Mr. Flandrick said that was precisely what ocurred at the last meeting September 27, 1978, there were four of the Personnel Commission in attendance. One of those who was missing was one of the members who was there during the hearing of the case. The fifth man, who was not present at that time was present at that meeting. He thought it was reasonable to say that a11 of them agreed in the state- ment made that apparently they could not reach a determination- whether they would rehear it or whether they would consider it based on the transcript. Mayor Btewett said there is a motion and a second. As there were no objections the motion was so ordered. He suggested the hearing be Wednesday, October 11, 1978 after the CRA meeting. Discussion followed. Mr. Shaeffer requested a transcript of the hearing and the subsequent proceedings before the Personnel Commission and time for a Superior Court decision on a 2 to 2 vote. Discussion followed on the possibility of holding the hearing at a later date. Council concurred that the hearing on the Morehead matter be set for Wednesday, October 11, 1978 at 7:30 p.m. subject to a court order to the contrary. 00- Councilman White reported that at the League of California Cities Conference, September 24, 1978, there were some 30 resolutions. The Key resolution was one requesting legis- lation from the State that the cities be granted an additional 1 cent of the State sales tax, based on a per capita scale rather than point of origin. This would replace funds lost by property tax and wi11 make life more equal between commercial and bedroom cities. Only one person objected at the final vote. The majority of city representatives voted in favor. Councilman McNeill said he had also been present at the voting; that City departmental heads had attended the conference and reflected credit on the City. He felt the conference was very educational. 00- Carl Sharpe, 5018 Wimmer Avenue, asked the City representative on the Mid-Vattey Manpower Consortium, if the rumor that a settlement had been made with Sergio Cabanitlas was true. He asked where the money is coming from. Councilman Aguitar said a settlement had been made to pay, but now there was litigation as to payment. Mayor Blewett directed that Mr. Sexton call the Acting Director of the Consortium, get details and give a written report to Council, costs, etc. and make a copy available to Mr. Sharpe. CITY MANAGER REPORT DETAILS TO COUNCIL ON MID-VALLEY MANPOWER Mr. Sharpe asked if the Consortium was in debt to the City for the copy machine. Mayor Blewett said the City had purchased the copy machine and is leasing the machine to the Consortium. He suggested that Mr. Sharpe go over this with Mr. Haltoway as it was beneficial to both the City and the Consortium. 00- APPOINT CARL SHARPE AS MEMBER OF THE HOUSING AUTHORITY COMMISSION, TERM EFFECTIVE OCTOBER 20, 1978. He and his family were moving and he wished to proceed with his future personal plans. He thanked his fellow councllmen, his wife and family and his parents and his office staff and the entire community for their support.
