Mayor Blewett presented the resolution to Dr. Nance. He and Mayor pro tem White expressed their thanks and gratitude to Dr. Nance for his contribution to the Community. M/S/C: AGUILAR/IZELL. There were no objections. 00- It was the time and place fixed for a public hearing on Public Nusiance Case 78-W-67 Confirming the cost of abatement at 4848 Marion Street. Proper postings and mailings had been accomplished. There were no written protests. Mr. French gave a brief resume of the Agenda Packet report. Mayor Blewett declared the public hearing open. As there was no testimony either in favor of or in opposition to 78-W-67, Mayor Blewett declared the public hearing closed. The letter referred to Tentative Tracts and requested that the City modify condominium or subdivision ordinances to Include Planned Unit Developments. Copy 1n official files) Mr. KHgour explained that a condominium 1s a division of the a1r space where the underlying lot remains as one single lot as a person buys the air space and an Interest in common with that single lot. In a P.U.D. or Planned Unit Development) an Individual would buy In fee title to the land beneath the Individual unit plus an 1nt»?re^t in common areas open space, driveways, etc.) The distinction as far as the City Code is concerned condominiums are allowed within department zones because there is no division of land. The land remains as one lot. If application is made for a Planned Unit development, which involves division of these lots, we would have lots smaller than required by our present code and most of these lots do not have street access which would be a violation of our code and the Subdivision Map Act. The maps in this instance have been lableted for condomin- ium purposes, but the terminology over the phone and in the last letters indicates a P.U.D. We do not have a P.U.D. within the City. Under the condominium ordinance they can build, but they cannot deed the land to the owner. F.H.A. and V.A. require P.U.D. for financing to obtain lower interest rates and lower down payments. They asked for some written assurance from the City, acceptable by F.H.A., that would allow them to start construction now rather than wait for the City to pass a Planned Unit Develop- ment ordinance. Mr. Kilgour said he understood from HUD that if Mr. McGuire were to have? his project approved by HUD as a P.U.D. and he were to present plans and begin construction of an apartment building now, then when the City code is amended the units can be converted to a P.U.D, Mr. McGuire said this was correct but he needed a communication from the City to HUD that their project does and will comply and that the City wilt have the ordinance which will allow them to file their subdivision maps Then HUD would finish their processing and they could begin construction. Discussion followed. Mr. Ftandrick said there was no assurance of passage of an ordinance proposing to take a single R-3 lot and divide it into 10, 20, 30 lots as opposed to units. To do that, depending on the size of the lot, you may have lots, as such, with 800, 900 or a 1,000 sq. ft. There is nothing at this time within the code that prevents the creation of a subdivision map for the purpose of condominiums. This is State law. A statement that we wi11 comply in the future was not advisable. Discussion. Mr. McGuire said he had no objection to condominiums versus Planned Unit Developments, but the problem was obtaining F.H.A. and V.A. financing. If called a condominium it fails within the scope of the Davis Bacon Act which sets minimum wages and requires full records of every employee on the job. This is a nightmare and adds to the cost of the job. Discussion. Councilman Izelt said even if we had a P.U.D. ordinance applications would require public hearings before the Planning Commission and the City Council. Me can't have a P.U.D. we have never seen and we do not have an ordinance to even consider one under. Mr. McGuire said he had discussed the parcels with the City staff and told them his intent prior to purchase of the property and when they filed maps they found out there was a problem. Mr. Kitgour said that bhe Planning Commission public hearings on the code would probably begin in December. Councilman Aguilar asked when the application had been filed and Mr. McGuire said they had visited the City Hall about a year ago. In answer to Mayor Btewett, Mr. French said it might be possible to expedite this application by possibly processing ahead so that when the ordinance becomes effective the application could be approved or through some kind of a variance through the Planning Department. Mr. Randrick said the draft ordinance can be pulled from the proposed zoning code and be set for faster hearings before the Planning Commission and the Council. Mr. McGuire said his attorney, William Ltoyd Hughes, had tried to contact the City Attorney as he felt there was a way to accomplish this but had been unable to reach him. Mr. Flandrick said he had never met or heard of Mr. Hughes and knew of no calls to his office from him. Mayor pro tern White suggested that the staff provide Mr. McGuire with a true state of the facts including the fact that if his plan meets with the proposed new ordinance and the ordinance is adopted, under those conditions then the application plan could be acceptable. Mayor Blewett said it appeared that there was a lack of communication and he suggested that Mr. Kilgour and Mr. French write a letter outlining the alternatives and present it at the next meeting. He asked that a copy of the proposed ordinance be submitted to Council for review. Mr. McGuire said other cities have a P.U.D. ordinance. They had included a11 the F.H.A. suggestions in their design. They would like to move their project and get F.H.A. inspections but are not concerned with filing and recording the map. That can come after the fact when the ordinance is adopted. In answer to Mayor pro tern White, Mr. Kilgour said there was not a uniform P.U.D. ordinance used through- out the State. Mayor Blewett again suggested that the possible alternatives be presented to the Council on the next agenda. 00- Mr. Sexton reviewed his agenda report on the construction and cost of medians on Baldwin Park Blvd. Discussion followed. TO LA RICA AVE. TO VERNON PAVING CO., CERRITOS, CALIF. IN THE AMOUNT OF $338,421 IN ACCORDANCE WITH THEIR LOW BID, SUBJECT TO APPROVAL OF CAL TRANS. M/S/C: IZELL/AGUILAR. There were no objections. 00- Mr. French reviewed the traffic investigation report on the Puente-Root intersection. The report was in response to Mrs. Garcia's request on September 20, 1978 and showed a very tow accident rate over the past three years and 9 months. A storm drain presently budgeted will reduce the water and enforcement may reduce speed. COMPLETELY REPAINT INTERSECTION AT PUENTE-ROOT AFTER STORM DRAIN CONSTRUCTION. M/S/C: IZELL/ WHITE. There were no objections. 00- Mayor Btewett said he and Councilman Aguitjr served on the Mid-Vattey Manpower Consortium on which he would like to continue to serve until April if there were no objections. There we^e no objections. Mayor Blewett said AB 965, Montoya and Lancaster, says lO^ of the State money would go into a pool for a juvenile delinquency prevention program such as Mid-Vattey. Under the bi11 only the counties could decide if they want these funds. An alternative amendment to the bi11 was offered which states that if the counties do not apply for the money then consortiums of cities or cities with a population in excess of 200,000 could apply for the funds for demonstration projects throughout the State. It appears the County wi11 not apply for the money and the Mid-Vafey Manpower Consortium of six cities can quat ify. He asked that this ordinance be set aside. There is no drive approach to garages and it is a deadend alley. Discussion followed that all alley parking is prohibited by ordinance and exceptions cannot be made for certain alleys. It was suggested that application be made for a permit to park on the street overnight. Residents in the area have more vehicles than there are parking spaces and they don't want to park overnight on a busy street. The tickets were the result of a complaint by a resident as a drain in the alley was stopped up. It was suggested that neighborhood differences be resolved. Mr. Rudi Hess. 15347 Badillo, requested that the law be changed to allow parking for people residing in tracts on special days for instance. Councilman Izett suggested limited alley parking or that possibly the City could find some solution.
