Pacific Ave. THURSDAY, OCTOBER 26, 1978, AT 7:30 P.M. AND ADJOURNED REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF BALDWIN PARK The meeting was called to order in the Council Chambers at the above place at 7:30 p.m. An invocation was given by Stair Holman. Merrill Whitley led the salute to the flag. Roll call: Present: COUNCILMEN AGUILAR, IZELL, MC NEILL AND MAYOR PRO TEM WHITE AND COMMISSIONERS BURNETT, LARSON. RICHARD. RUMNEY, SHANE, SMITH AND CHAIRMAN WHITLEY Also Present: CITY MANAGER SEXTON, PLANNING DIRECTOR KILGOUR, AND CITY CLERK BALKUS 00- Mayor pro tern White said the purpose of this joint meeting was to receive the report and recommendation on the General Plan and the goals and recommendations from the Citizens Advisory Committee* He introduced William Kelly, Director of Community Development, previously of San Bruno and Glendora. He also introduced Blair Holman, Chairman, who introduced members of the CitizensAdvlsory Committee as follows: Daniel Erbe, Lewis Farkas, Dwaine Glass, Phy111s Pierce, Doug Stevens and Bertha Regus. Mayor pro tern White thanked the Committee on behalf of the City Council and the Planning Commission for a very pro- fessional job indicative of their outstanding leadership. Mayor pro tern White said he had the following documents before him: The Neighborhood Facilities Program Technical Report; the Citizens Advisory Commission's recommendations and the Andersen Report. These documents are Interrelated. The Andersen report concerns management and the recommendations are being implemented. These documents are Important to the implementation of the Master Plan for the City. Mr. Kitgour said the documents were for review as to the general directions and serviceability of the General Plan. He introduced Bob Takata of the Planning firm of Wallace, McHarg, Roberts and Todd; Jeff S1av1n, Economic Research Associates, Inc., Tom MitcheTI, Barton-Aschman Associates, Inc. Mr. Takata stated that the General Plan Is the key Instrument in local planning, setting out development policies, diagrams, objectives, principles, standards and plan proposals for future character and development of the City. Zoning Is a tool to provide development control necessary to implement the General Plan. A key element of the proposed General Plan Is the Citizens Advisory Committee. Chairman, CitizensAdvisory Committee, said the Committee appreciated the opportunity of working on this process, reviewing the charts in the Technical Report and the report. They had looked at areas of the City they thought needed change. Their recommendations were what they thought were for the best good of the City, develop those areas to begin to build a base to show we're on the move and want to progress. He urged that the recommendations in the agenda packet be considered and be incorporated in the General Plan. In some areas they suggested keeping the recommendations flexible so an area can develop either industrial or commercial for the best use of the land. Mr. Takata reveiwed the recommended goals and objectives and recommendations of the Citizens Advisory Committee. He also recommended flexibility. Mr. Takata presented a commentary and slides of graphs, tables, maps and pictures of key areas based on Technical reports 1 and 2 and the Citizens Advisory Committee study beginning at page 5 of the Advisory report. The slides included land use development in other cities. Mr. Takata said that the fourth phase of this study would now begin to draft the elements of the General Plan, revise the Zoning Code, draw up a capital improvements plan and provide for review by the public. Planning Commission and the City Council. They propose to provide a draft General Plan and EIR by the first of the year. Mayor pro tern White invited comments from the Planning Commission and the City Council. Councilman Aguilar asked if the Committee had considered flag Lots in their study and Mr. Kilgour said flag lots were reviewed and alternatives were a part of the report. Councilman Aguilar asked if the proposal to annex areas to the City was in process and Mr. Kilgour said he had checked with LAFCO and the areas abutting the City are not considered as islands as they abut County territory. Discussion followed that use of flag lot development would only be as a last resort. Councilman McNeill said the intent of the General Plan was to eliminate many of our problems, especially zone variances and that the intent of this joint meeting was so there would be an understanding with the Planning Commission as to Council's intent for the good of Baldwin Park. He hoped the proposed street plan would establish where streets will go and eliminate the flag lot problem. Mr. Kilgour said there would be specific plans as to street circulation and the uses of the land. Councilman McNeilt suggested that restaurants should be centralized rather than small ones scattered in every little commercial area. Mr. Hot man said it was the Committee's hope that as the City moves forward efforts will be made to make it easier for developers and that as the cities image improves especially along the freeway more developers will be attracted to the City. M/S/C: IZELL/AGUILAR. There were no objections. 00- Mayor pro tern White on behalf of the City thanked everyone involved in the preparation of the proposed General Plan. He concurred with Mr. Holman that people come to a City because they feel welcome there. 00- Councilman Izelt said his concern was conditional use permits. They are approved but we do no seem able to revoke them. He referred to various locations. Mr. Rumney said the CUP is the only tool available to assist development in some instances. Discussion followed and Mr. Kitgour said that revocation and administrative procedures in the Zoning Code were being reevaluated. Councilman McNem expressed his appreciation of the Planning Commision's efforts. He felt that if the Planning Commission had denied a request and 1t was appealed to the Council and dented, then if the applicant refiled an application on the same property and the Planning Commission approved the request, then the case should come back to the Council for consideration. He requested that this stipulation be Included 1n the Code and that the City Attorney research this procedure. Mr. Kilgour said this can be Included in the Code as an automatic appeal and the legal ramifications would be researched. Mr. Whitley said Council can appeal the Planning Commlslon's decision. Councilman McNelH agreed but he felt that once a case had been denied by Council It should automatically come back to them. This procedure could save a developer expense 1f Council rescinded the action. Councilman Izell agreed. He also proposed that staff have authority to resolve physical condition of approval requirements which may not be compatible with the development. Mr. Whitley asked, What constitutes the image of a City?" not as we see 1t but as outsiders see It. Is It dependent upon average Income, size of lots, the amount of commercial or retail business 1n the City? How can we change the Image? Mayor pro tern White said to him the image Is the sum total of one's grasp of a name, like Baldwin Park. Before Incorporation this was a rural, friendly neiqhborhood community. Immediately after incorporation there were problems with those 1n office. The freeway bypassed the downtown area; the traffice went one way and the City remained somewhere else. This towered our sales tax. The school district had recalls and the recent discord in City Hall did not help. The City was not progressive and did not plan for the future, but to maintain what we had. Collectively, he felt the City needs to piece by piece reverse all these processes which can be accomplished partly by the Master Plan, by City reorganization, partly by some stability and professional answers to our staff, cooperation with the School District, the Board of Supervisors and all forces that effect people's lives and finally by the people upgrading their own homes. He felt all these things combined will bring about a change. Councilman Izetl said he felt this City has the most cooperative staff in the Valley in assisting developers. Councilman McNei11 said land sells for more in West Covina is because of desirability. From comments heard as much as four hundred miles away, he felt the City reputation is changing and that we are now on the road to progress. We are all sincerely working for the good of Baldwin Park and we will see change. Councilman Aguilar said that as a body the Council can agree or disagree but as long as they refrain from personal likes or personalities the City will progress. 00- Mr. Smith said that under the County a 50' lot was acceptable but our requirement is 60'. He suggested the Code be changed to allow the staff to approve 50' lots where the existing land use is developed with 50' lots. He did not propose lowering our present requirements for subdivisions and newly developed property. In answer to Mayor pro tern White, Mr. Kilgour said there were legal ramifications as to granting a variance without notice; however, he would review the State requirements with the City Attorney. Councilman McNeill favored retaining the 6,000 sq. ft. minimum for new development but he can see no advantage on a 11,000 sq. ft. lot to hold a builder to 6,000 and not let him use the other 5,000 sq. ft. He suggested a change in the Code to fit the situation. This would have nothing to do with new development which should remain 6,000 sq. ft. This would allow development as long as there is not a street designated to go through. Mr. Wittig said the slide presentation had shown two, three hundred foot lots backed up against each other and one answer was to put a street through to allow access from both ends of a 300 foot lot, makinq 150 ft lots out of 300 ft. lots, but developers want to make three lots and that's the problem. What do you do with the center lot when they want to make three lots out of it? If you hold it 150, this makes a nice lot, but this is where the problem ties with flag lots, the middle lot. Mr. Larson felt each case should be handled individually. 00- Councit had received a tetter from Jesse and Helen Montgomery, 14308 dark Street, that Shadylawn be extended to their property. He requested that Mr. Kilgour retain the request.
