Mayor White declared the public hearing open, Mrs. Balkus read a tetter in protest from Gilbert and Yotanda Rodriguez, owner of the property. A memo from Victor Dohm, Sr,, Pasadena Pest Control, was attached. The communication protested the cost of discing as unreasonable; that a storage shed worth approximately $450 was removed along with three rat traps worth $2.85. and two cans of outside paint worth $17.00. The disc broke a water pipe. Copy of letter in official files) Mr. Kelty said a hearing was held before the City Manager on August 3, 1978 at which Mr. Rodriguez was present. He had been notified by certified mail of the hearings. He was given the option of conforming to the City code with the storage shed or removal. He was given sufficient time and he failed to complete these actions. The storage shed was considered unsafe and Mr. Rodriguez was advised at the hearing of the violation and the property was posted with that notice. In answer to Councilman Me Neiti, Mr. Rodriguez said he did have time to correct the deficiencies but no one said that the shed was condemned and to be torn down. They just said to bring it up to par. He is now remodeling the house. Mr. Kelly said the recommendationsof staff were that ten 10) days be allowed to clean up and secure house or twenty 20) days be allowed for decision as to future use; twenty 20) days allowed for rehab and thirty 30) days for demolition. He said the original tetter to Mr. Rodriguez states that permits must be obtained for plumbing and general rehab of the house and storage shed. Mr. Rodriguez, 3339 Mangum, said he felt, $375 was too much for three hours work and there was nothing posted on the shed to be demolished or condemned. It should not have been torn down and if necessary, he would go to Co-'t. Mr. Ketly said competit-:\^ bids had been received and the work awarded to the low bidder. He had set rat traps; when he went to check the shed, it had been removed and he wrote Mr. Rodriguez a note asking him why. An order from Mr. Rodriguez had been placed with him in August. As there was no further testimony either in favor of or in opposition to 78-W-99, Mayor White declared the public hearing closed. Councilman Aguilar requested that this case go back to staff for more information. Councilman McNeiTI said he would go along with Councilman Aguitar, except that the second paragraph of the staff letter said, a hearing was held on August 3, 1978 and that the City abated the nuisance on October 23, 1978. He had viewed the pictures of the property and as there had been time to make corrections, he would favor confirm- ing the assessment. The petition requested a traffic study of the Maine Avenue and dark intersection. They recommended four way stop signs or a signal at the intersection. Ruth requested that the agenda read that this communication is from concerned citizens instead of Ascension Lutheran Church. Mayor White said that anyone wishing to speak could do so under Oral Communications. 00- Mr. Cunningham, Director of Housing and Economic Development,reviewed the Agenda report on the Business Development Corporation and requested approval of an agreement between the Corporation and the City. Council requested more detailed information as to the corporation, who it is, etc. for consideration on the December 6, 1978 agenda. FLANDRICK CITY ATTORNEY ORAL COMMUNICATIONS Mrs. Pat Zupkofska, 14218 Calais, said she had attended a wedding reception and party at the Bait residence. About 10:30 p.m. October 14, 1978 police cars arrived. The officers totd alt to disperse, which they allegedly did. She stated that about 15 people remained who lived there or were waiting for rides. Baldwin Park Police, Industry Sheriffs and a paddy wagon drove up. Mr. and Mrs. Ba11 were arrested. They entered Mrs. Zupkofska"s kitchen door and arrested her husband who supposedly had not attended the party. Tracy Milter was allegedly hit with a flashlight and required ten stitches in his head by unknown persons or officers. Their front and bedroom doors were kicked in. Her two year old daughter was thrown and dropped. Her son and Robert Johnson were arrested. She saw officers allegedly beating John Garcia, Later on charges were dropped on everyone except Mr. Ba11, She said some officers are fine but something has to be done. The ACLU has helped them. She was speaking for Mark Page, Shen'e Beebe, Tracy Mitter, John Zupkofska, Beverty Wyatt and her sons Scott Joiner and David Hardi. She stated she had complained to Chief Chetlino who said he would took into it personalty and a formal written complaint at that time would not be necessary. Arrestees were to appear in Court the morning of October 26 and did not receive tetters saying the charges had been dropped until that afternoon. The list of witnesses should be turned in to the Chief or his representative. The City can and wi11 handle the investigation. It wi11 take time to investigate and responses will come from the City Manager, the Mayor or the Chief. The corrective action taken will depend upon what the investigation determines. He doubted that any specific questions would be answered this evening. John Garcia, 14138 Calais, read a statement which said JOHN GARCIA that he had returned to the party about 8:30 p.m. Then about 10:30 p.m. the police said the party was too noisy. He repeated many of Mrs. Zupkofska's statements. He stated he was hit and kicked. At 11:30 p.m. he was handcuffed and put in a police car. At 1 a.m. when Officer A1 Negron found out he was 17, he took him to the Baldwin Park Hospital where he had shots and xrays. About 3 a.m. Officer Negron called his parents. He left with his parents at 3:30 a.m. on October 15. He stated he gets dizzy and has headaches and that he takes medication for epilepsy. Copy in official files) Eugene Ba11 said he lived at 14212 Calais where the party was held and said he and his wife were arrested and were concerned about leaving their 14 year old diabetic daughter without care. The have lived here 16 years. They had alerted the Police Department, who said they would telephone them if there were complaints. About 10:30 p.m. the Police came. They had him on one count and after he went to see the Chief he had three counts. An attorney wants $2,000 to defend him. The judge advised him to get an attorney but he can't afford it. He has until the 27th to get one or go to jail. He is present here as he is not guilty and did not incite a riot. There is no reason for police brutality. This did not apply to a11 police just 3 or 4. He wi11 stay in jail before he pays a fine to the City. Copy of Mr. Bail's statement in official files) Jim Kilgore, 14420 Fartington Street, representing American Civil Liberties Association, said their interest is that people's constitutional rights be observed and that the police use proper police procedure. As a result of talking to those involved in this case and investigation, the ACLU voted to provide for a possible class action lawsuit against Baldwin Park. Richard McGurie, 13241 Tracy Street, read a tetter he had written to Senator Alan Cranston citing instances when he and his wife had been stopped by police and a search made and his objections to police prejudice and bigotry and disregard for human rights. Copy of statement in official files) Fred Aguilar, 14609 Sanders Street, La Puente, State Chairman of La Raza Uneda Party, said he had been in attendance with many people pertaining to this incident. Other citizens have come forward with similar complaints in regard to violations of civil rights. He suggested that the City Council set up a Human Relations Board and appoint some of these same citizens. He said a City Review Board should be implemented and review advancements and salary increases. He further suggested establishment of a Community Hiring Board. He commended ACLU for stepping forward. He will go before their State Central Commii:-^e asking for funds and resources to help the people in the City to see justice prevail. He had recommended a class action suit which will automatically trigger a Federal Justice Department to come in and investigate the practices and policies of the Police Department. The Council is responsible for the actions of police officers. The Council is elected and the people can run themselves as a slate as concerned citizens against the City Council. Just before she left at 11:15 p.m. an officer shook hands with Mr. Ba11 and they were not asked to break up the party. About 15 or 20 minutes after she left the arrests occurred. Copy of Mrs. McCawtey's statement in official files) Mrs. Norma Ba11, 14212 Calais, said she phoned police regarding the party and was told that if there were complaints they would let her know. She said she was not informed of complaints until about 11 p.m. when there were 7 or 8 police cars out in front and they were told the party would have to disperse due to complaints. The party broke p. They told the kids not to throw anything. The police left. When police returned only she and her husband were in the front yard talking to a neighbor. She was handcuffed. When she was released from the police station four hours later she was asked if she knew why she was arrested. She said no" and was totd it was becau a she did not disperse from the party as you were fold. She said she lived there, but the police had not known that. She had brought her kids up to respect police but now she wondered just over a wedding reception. Copy of statement in official files) Rosa Pimentet, 4639 North Jerry, said she had read the written accounts of the witnesses to the alleged action of the police on October 14, 1978 and was appalled. She abhorred brutality and the alleged actions of certain officers on October 14 cannot be condoned. The grievances have been brought to the attention of Council for a purpose. He questioned why, some years ago, his daughters were stopped by officers when leaving the house with an arm fu11 of newspapers to deliver and why they were asked if they were trying to burglarize the house. This stopped when they saw him. He did not report this to the Police Department. He'd tike to know why they were questioned. Also, his daughter was bit by a dog and when he complained to the Police, they said they could do nothing about it. The dog was frothing at the mouth and they found out later the dog did not have rabies. The dog pound told the owner to chain the dog up or they'd have to take it away. No one knew if the dog was rabid and to this day he does not know. He said police usually say, they can do nothing as it's a civil matter, as was the case when a knife was held against his daughter who at the time was seven years old and he had to knock the man down. TANNER Regular Meeting of the City Council of the City of Baldwin Park Mr. Alien, Attorney, said a formal complaint must be made so there is a record at the Police Department to identify the instance and the time and place. Then an investiga- tion can be made. Once both sides of the issue are available then the City Council can examine it and make a judgment. Mayor White said complaints filed will be investigated. ** SEE NOTE: PAGE 10 00- E. R. Tanner, 4917 Marion, said Marion is a 30 ft. private street. He circulated and filed a petition from the owners for street improvement. The previous Council agreed to accept a 40 ft. street. He questioned the differences in required dedication and said a 35 ft. street is too narrow. Councilman Izetl said he would review and discuss the street with Mr. Tanner. 00- Sam Wiest, 14440 Cavette Place, questioned the method SAM WIEST of establishing electrical permit fees. He felt the charge should be by electrical outlets or by circuit and not by the square foot. He felt it was wrong to charge the same amount for nine outlets or a hundred. Mayor White said this would be investigated and if this varied with the procedure, an adjustment would be made. 00- Councilmen Izelt and McNeill requested that Mr. Ball and those under Oral wait until after the meeting so problems can be discussed. Mayor White declared Oral Communications dosed. He said the Council wilt investigate the complaints of Mr. Ball and others. He understood there will be an ACLU inquiry and a possible class action suit, this would be adjudicated presumably by a Federal Court. Alleged Civil Rights violations can be investigated by the Criminal Justice division. Council cannot make a decision at this time. An investigation wilt be made and if mistakes were made efforts will be made to correct them. Policies and individuals will also be corrected if that be the case. Councilman King concurred with Mayor White and said the elected Council were here to protect the citizens of Baldwin Park. He hoped the investigation would uncover any indiscrepancies. Councilman McNeill thanked those in attendance. He said the Council is trying to build a better City image and is not for police brutality, nor are they for citizens control. The Council represents the peop'-e and Council should be the very first to know of problems. The Council will listen, investigate and settle problems and will try it's best to see if anyone is abusi1-'^ and if so they will not be here any longer. The Council sx»es not believe in disobedience of the law. They will attempt to resolve problems or find somebody who can. He reminded everyone that: This is your town; if you gi\; it bad publicity, it's stilt your town. If you give r good publicity, it's still your town. We can setrle our own problems by all working together. He did not hold with unnecessary police work. He does believe in the police carrying out the law and doing what they have to do. There may be some who are a little overbearing and maybe a tittle bit past what we call correct police procedure. When a party is held the giver controls the party and knows whether it disturbs neighbors. Somebody called the police. If a party gets out of hand and you can't control it, someone else comes up to control it for you. He can't phathom why you can't have a party at your home, peacefully, cut it out at a decent time and get along with your neighbors. He invited those in attendance to attend Council meetings, because attendance is not enought when you wait until something is out of hand and then come to a Council meeting. Come often and see what Council is trying to do. We're trying to make this a better City not a hole" for people to live in. We don't want such a hole". We have to make it a better City. The Council wilt investigate this. If it is found that a person is quilty then we hope the City Council, the Chief of Police, the people we have appointed win do the right thing and that is get rid of a person or see it doesn't happen again, At the same time, the people have to help the Council. Citizens have to cooperate with the police not create problems, but eliminate them. The police do have problems with gangs, etc. He would favor a police review board if people have a fear to register a complaint. However, he asked that citizens phone him if they have a problem, Councilman Aguilar said thai: one month ago there was a Personnel hearing on a police officer and he was suspended five days. This Council is aware of some problems and is here to deal with them. Until Council has all basic facts of both sides of the Ball Party problem, a determination cannot be made. He asked that citizens sign complaints when there are problems. He gave his phone number and invited calls from citizens if they are harassed. Councilman Izett said his phone started ringing Sunday morning after the party and his first impression was that there had been a big party and the police did whatever they had to do. A few weeks ago there were five parties in town, kids were dancing on the roof and the police were going wild trying to take care of the situation on a Friday night. He could under- stand that they might over rea^t, but the people were in a position to do the City a great service helping Council find out the truth. He said Rev. Ruth had come to the City at a time when he can make a good impression on the town and through his leadership be a great help to the City. Mayor White said it can usually be ascertained which officers were where and when. He would like an investiga- tion. There may have been excesses &nd another side to the story. There are so many possibles right now and from the findings it wi11 be possible to go forward with disciplinary programs if necessary. Perhaps redirect both the community and the officers in a spirit of cooperation and hope we can avoid some of these things. He regretted the incident. Many questions are to be answered and Council will give the best answer possible. If there is ever any retaliation by a police officer he and a11 the City Council quested that phone calls be made to them. Councilman King concurred with Mayor White's comments. He welcomed ohone calls from citizens and would continue to assist citizens as he had in the past. Councilman Izelt asked that citizens not hesitate to call him day or night, In answer to Mayor White, Captain Snowden said that from the Police Department's standpoint, this case has been investigated as far as possible without further written documentation from those actually involved. The people had come into the station. The actual people involved were asked to submit a written document of what took place October 14. No complaints were filed.
