Pacific Avenue WEDNESDAY, DECEMBER 6, 1978 AT 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m. 00- An invocation was given by Rev. William Waiter, Living Hope Baptist Church. Councilman Aguitar led the salute to the flag. Lovejoy. Proper publication and mailing had been accomplished. There were no written protests. Mr. Kelly gave a brief resume of the agenda packet report. The Municipal Code allows 10' adjustment by staff. Applicant has requested a 20' adjustment. He has two lots, one 80' and one 60'. Mayor White declared the public hearing open. As there was no testimony either 1n favor of or 1n opposition to appeal, Mayor White declared the public hearing dosed. Funds were set aside in the budget for funding agency operations. A $150,000 loan secured by a promissory at 10% per annum was recommended. They requested a 35 cent Increase on single family use, making that $3.85 per month and 20 cent on multiple use, making that $2.00 per month. Mr. Halloway said this and other proposals could be negotiated. GRANT RATE INCREASE TO WEBSTER'S DISPOSAL; STAFF TO PREPARE THE NECESSARY DOCUMENTS AND MEET WITH WEBSTER'S TO NEGOTIATE THE OTHER REQUESTED CHANGES IN THEIR CONTRACT. M/S/C: KING/IZELL. There were no objections. 00- Mr. Hatloway said that effective January 1, 1979 the State Law regarding the licensing of bicycles will be changed and it was necessary to amend the City Code to conform. City Clerk Batkus read by title: ORDINANCE NO. 788 AMENDING SECTIONS 3301 AND 3306 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO BICYCLE REGULATIONS. INTRODUCE ORDINANCE NO. 788. M/S/C: KING/IZELL There were no objections. 00- Mayor White said the volumnious SCAG planning reports had been received about three weeks ago. The reports contained about 350 regional agency recommendations to be reviewed in this short time and accepted by City Council resolutions. He said Mr. Ketty had reviewed the plans and noted discrepancies. The City should present their recommendations; otherwise they will proceed without City input. He had complained to Mr. Bill Smith, SCAG staff member, that such a limited time did not allow a thorough review of the plans. Mr. Kelty said the Council must take some action. If the region fails to adopt the plan, the government will come in and mandate that appliance and even though we are being pushed, the City's position win be on record. He reviewed the population forecast plans to the year 2000 which indicated a significant decrease in population which is not consistent with the staff projection included in the General Plan. The resolution to be adopted refers the SCAG policy board to adopt the population exhibit attached. The purpose of the Air Quality Maintenance Plan is to: 1. to identify maximum allowable emissions which will permit clean, healthful air 2. to provide for a comprehensive program to attain clean air by 1987 3. to meet the requirements of the California Lewis Air Quality Management Act 4. to meet the requirements of the Federal dean Air Act amended 1977) The costs involved to local government are rather significant about $2.00 per capita). Failure of the City to adopt the plan could cause a cut off of Federal funding to cities includ- ing manpower, development, etc. Attached Exhibit A to the resolution are the City's recommended control strategies. The 208 plan will come back to Council for a second review. The other plans will not come back to Council. Councilman King referred to the last paragraph, page 2 of State Senator Bill Richardson's letter on the Air Quality Management Plan which said, Failure to adopt the measures will result in the possible toss of Federal funds. Perhaps the time has come to re- evaluate. the price which must be paid in the loss of local control, as well as the right of our cities and state to determine their own standards, against the benefits derived from the Federal funds we received Councilman King said SCAG is an overlay of government which we need, but in the beginning they operated differently than they do now. They had time to listen to cities and cities had time to evaluate SCAG proposals. He agreed with a statement of Bill Richardson to the effect that cities had better get together and take stock of their own interests. Discussion followed. There were no objections. 00- Mr. Cunningham said the Baldwin Park Business Development Corp. had proposed an agreement presented at the previous meetinq which was to provide staff and services on a reimbursable basis. The Corporation has advanced with their first project along Maine Street and have been in contact with all the businessmen and they have received what the project entails with enthusiasm and they intend to participate in the SBA loans and to develop the down- town business district along the guidelines proposed by the Development Corporation. There were no objections. 00- Mr. Ketty reviewed the report on a petition requesting a four way stop or signal at Maine Avenue and dark Street. This is also a hazardous intersection and he favored these stop signs. Councilman King questioned if the cross walk had warning signs and Mr. Kelly said there were Cal Tran required standard warnings. Councilman Izell said he had experienced trouble at this intersection; that possibly more study was warranted and that cross walks be on both sides of the intersection with better markings. Mayor White said it was necessary to have an objective analysis of requests for stop signs; otherwise, there would be stop signs all over town which was not practical. Councilman King agreed and did not feel that the installation was warranted at this time. Mayor White said there are three E's on a traffic program: Education, engineering and enforcement and he felt this might be an enforcement problem. He questioned the need for further study. He did sympathize with the petition request but was concerned with creating more problems. TABLE THE MATTER, STAFF VERIFY THAT CROSSING IS CORRECTLY MARKED AND THE CHIEF OF POLICE CHECK AND SEE IF THERE IS AN ENFORCEMENT PROBLEM IN THE AREA. M/S/C: IZELL/AGUILAR. There were no objections. Councilman McNeitI asked for an up-to-date traffic count of this area. There were no objections. Councilman Izetl requested an accident report of the Foster and Maine intersection since installation of the stop sign. There were no objections. 00- Councilman McNeill requested that the Youth Commission be reactivated. Discussion followed regarding a seven member commission; that there be two students from each high school 6) and two members at large from the community; that the ordinance be reviewed and amended for presentation at the next meeting so adoption can take place at the first meeting in January and that applications be available for those interested. Copy in official files) Signers offered to serve on such a commission. 00- Betty Wallace, 14438 California Ave., said she had circulated the petition for the stop sign at Maine and and dark and that she felt very strongly about it. She said many fender bender" accidents occur and police are not called. She asked that Council further consider the request. 00- Bill Adrians, 4339 Alderson Ave., thanked those who attended the Major Zapatski memorial service in Morgan Park. He asked that the Maine/dark stop'sign be given further consideration. He objected to the ideas presented by SCAG. 00- Helen Gibson, 13268 Francisquito, also objected to SCAG proposals and believes in local control. 00- Pat Zupkofska, 14218 Calais, said that in the last 14 years she had witnessed many accidents at the Maine dark intersection. She said it is a bad intersection. Mayor White said the Maine/dark intersection would be policed and checked further. He dosed Oral Communications. 00- In answer to Councilman Aguilar, Mr. French said a signal installation cost is about $70,000, maintenance is about $50.00 a month and average cost for damage to signal is $1,000 00- Councilman Izell extended an invitation to the Chamber of Commerce Mixer December 19, 1978 which he and Mrs. Izell were hosting. 00- Councitman King asked for a cost maintenance report on traffic signal lights by the County versus contract.
