Jerry Ave. regarding responsiblity for keeping complaints on October 14, 1978 party and time retained. Copy in official files). Mrs. Balkus stated the complaints filed with the City Council) are in the vault in the City Clerk's office and will be retained a minimum of 5 years. Council directed that the City Clerk answer Mrs. Pimentel's inquiry by letter. PUBLIC HEARING CLOSED RES. NO. 79-23 CONFIRM CITY MGR REPORT RE COST RES. NO. 79-23 ADOPTED LETTER MRS. PIMENTEL RE COMPLAINTS CITY CLERK WRITE MRS. PIMENTEL 00- City Manager Sexton presented the annual audit for 1977-78, closing 6/30/78, prepared by Me Gladrey Hendricks & Co. of Arcadia. Mr. Vern Moser, C.P.A. briefly reviewed the audit. The audit was received and filed). 00- Mr. Kelly said that 1n accordance with M.C. section 9465.4 the City Council had defined the boundaries and designated the Central Business District a Special Architectural Zone" with a Spanish Mediterranean Design". An Architectural Committee was appointed which ceased to exist. EXECUTIVE DIRECTOR. There were no objections. 00- Chief of Police Chellino Introduced Lieutenant Ronald Lowenberg, Division Commander of the Investigative Services Division of the Police Department. Lt. Lowenberg said at the present time there Is one Sergeant with 9 Investigators assigned to the division. There are 3 sections: Adult, Youth Services and Narcotics & Burglary Suppression team. Each section has a specific investi- gative responsibility but work as a team to investigate and follow-up criminal cases and hopefully suppress crime in the community through criminal intelligence and crime analysis. Adult crime includes adult homicides, assaults, robberies, thefts, frauds, fraudulent documents and embezzlements. They also provide in-house counsel- ling. They maintain a dose relation with the probation officer assigned to the department. This is referred to as The Intercept Program" for youth crimes of a lesser nature. Sex crimes are handled by Youth Services and have a female juvenile officer assigned to the section. A responsibility of Youth Services is to accumulate and coordinate intelligence information for the purposes of preventing the increasing problem of gang violence. The Narcotics & Burglary Suppression team has 4 officers assigned to the NABS team, 3 officers on loan to the Field Services Division. The intent of the team is to provide a flexible and coohesive striking force to suppress the burglary problem with emphasis on narcotic suppression because of the close relationship in the burglary and narcotics problem. They also emphasis the reduction of narcotics availability to youth, Investigative Services investigates about 250 to 300 assigned cases per month. The average clearance rate runs about 30% to 40%, which is above the state average. Councilman Izell said that the storage place for impounded cars closes at 6 p.m. and time paid for is calculated at Midnight. This necessitates paying for another day as there is no way to get the car out of storage. He suggested this be checked out. In answer to Mayor White, Lt. Lowenberg said clearance rate" is when they are able to identify a suspect and a reasonable disposition of the case. Councilman King said that all cities experience similar police problems. 00- Councilman King suggested that in the event a gasoline crisis developes the city should have an alternate plan of operation. Mr. Sexton said that in 1974 the city was on a priority list for gasoline supplies and the same would probably apply again should the need arise. Mayor White said that in the interest of police protection it might be well to develop a plan should such a situation develop. 00- Councilman Aguitar requested that the Sister City Program with Valle de Bravo be reactivated. After discussion Councilman Aguitar said he would pursue the subject. 00- Councilman Aguilar said last year three service organizations received appropriations and questioned if the same procedure would be followed this year. Mayor White explained that the Service Council are a11 volunteers, receiving $2,400. a year from United Way they give $65.00 a year to Welfare Rights for office supplies for their assistance. 00- City Clerk Balkus proceeded with the reorganization of the City Council. She announced that at this time all of the Council Members were on an equal basis to nominate and elect and that voting could be done by roll call or secret ballot, as Council desired. It was agreed that the reorganization would be accomp- lished by voice vote. City Clerk Balkus stated that nominations for Mayor were now open. COUNCILMAN AGUILAR NOMINATED COUNCILMAN WHITE FOR MAYOR. COUNCILMAN KING SECONDED THE MOTION. THE NOMINATIONS WERE CLOSED. There were no objections. City Clerk Balkus stated that Councilman White was reelected Mayor. City Clerk Balkus stated that the nominations for Mayor pro tern were now open. COUNCILMAN IZELL NOMINATED COUNCILMAN AGUILAR FOR MAYOR PRO TEM. MAYOR WHITE SECONDED THE MOTION. COUNCILMAN KING MOVED THAT THE NOMINATIONS BE CLOSED. There were no objections. City Clerk Balkus stated that Councilman Aguilar was elected Mayor pro tern. 00- Councilman King commended the Mayor and Councilmen and expressed his good will toward all and wished Councilman Aguilar well during his term as Mayor pro tern. Councilman Izell commended Mayor pro tern Aguilar and said he found he had enjoyed working with him this past year. Councilman Aguilar expressed his thanks and appreciation. Councilman Me Neill extended his congratulations and asked that appointees to Organizations and Commissions remain the same. This was agreed to except to organizations where the Mayor and Mayor pro tern are the official representatives Mayor White said he was honored to be Mayor of a very dedicated, capable Council and would continue in his endeavors for the city and in representing the Council and the City. 00- Mrs. Pat Zupskofska said she was present on behalf of Jim Kilgore of ACLU, she said her comments were on the Calais St. incident. She said stories were sub- stantiated by witness, yet no misconduct was found to have taken place by officers involved. She said not only did Council accept the police departments findings, the Council itself broke the promise made in a police hand book entitled What About My Complaint", which she said, stated that a complainant would receive a letter from the Chief telling the disposition of the investi- gation. She said no one involved had received such a tetter and according to ranking officials nothing wilt be forthcoming She said that as a result of such actions by the City, the ACLU will join with others in the community to request the L.A. County District Attorneys office to conduct its own investi- gation. She said she had a short personal opinion regarding the Chief of Police and said she found it interesting that our Chief chose to take a vacation at a time,- that his personal attention was most critically needed She said, she felt he passed the buck", and that citizens were not worthy of his personal attention in this matter and that a personal vacation was more important to him than his high office and responsiblity warranted. Mayor White quoted Thomas Jefferson as saying When a person MAYOR WHITE becomes a public servant he becomes public property" and people are entitled to criticize their public servants because they public servants) generally are not allowed to respond 00- Mrs. Rosa Pimentel, 4639 Jerry, said she had been asked to ROSA PIMENTEL read on behalf of October 24. 1978 complainants a statement, She read a statement which expressed dissatisfaction and objection to the investigation, the findings and no written answers. She reiterated statements which were made previously. She gave her personal opinion expressing dissatisfaction with the investigation, the findings and Council action. Mayor White stated that he had directed that the response MAYOR WHITE be made public on Council motion in this issue. Findings were made publicly and publicized in the press.
