There were no objections. CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR 00- It was the time and place fixed for a public hearing on MV-84 an Appeal from the decision of the Planning Division on granting of a Minor Variance granted on February 12, 1979, to keep 6 Adult Show Dogs on property located at 13716 Monterey Avenue. Applicant: Mendleson & Holtgrieve Appellant: Thomas M. & Ina B. Knight Proper publications, posting and mailings had been accomplshed, Mr, Kelly reviewed the Agenda packet report. One letter in favor of the Minor Variance was received from Mrs. Margaret Bruickshank, 13726 Monterey. He explained that a Mirpr Variance means a zone variance relating to R-l, R-2 or R-3 property which proposes in this case an increase in the number of household pets permitted in an R" zone. These dogs are Afghans of Mixed Sex. This was a joint application by the owner and the renter. He said the City is establishing a process for a once a month analysis of this type of use cind if there are violations a permit can be revoked. Mayor White declared the public hearing opened. Mrs. Beverly Mendelson, 830 Monterey Road, So. Pasadena, owner of the property, said they had recently purchased the property from Mr. Mendleson's mother and sister who had owned the property 30 years and been renting it out for the last 5-6 years. Tenants neglected the property and since purchasing they have invested over $7,000. in repairs and clean-up. They have rented the one acre property to their daughter and son-in-law the Holtgrieves) and installed a $1,500. chain link fence to protect their show dogs. She said the property and the dogs are well cared for and without the variance the Holtgrieves would have to move. They do not intend to have a Kennel. She said the property could be made into two lots with a house on one and the garage converted into a house on the other, and with 2 lots they could have 6 dogs. She urged approval of the Minor Variance. Thomas Knight, 13615 Rexwood Ave., said he and neighbors were opposed as attested to by the petition containing 23 names filed at the Planning hearing. Mr. Kelly gave the petition to Council for review). They do not object to dogs but the number involved. He read and presented an additional petition which requested reversal of the variance granted over the objections and concerns of 33 resident signers. Their main concern was that if the variance is upheld, neighboring properties will apply for a variance and that then in a residential area some- one would apply for a major variance and open the door for the operation of a kennel. Also of concern is the M.C. section that allows the variance for 6 months after this use ceases, as presumably someone could come in and pick it up and it would be an on going thing. KNIGHT times. The people on the back side of the property are concerned as during the day time the dogs are in a kennel area near them. She said 4 owners to the the rear of the property protested at the Planning hearing and were still in opposition. She said the dogs were noisy; the yard is well fenced except for the back fencing which the rear abutting property owners had put in and a 4 foot fence abutting Mrs. Bruickshank's property. The dogs try to come over their rear 6 ft. wood fence. She urged concern for the needs of older citizens who have lived there many years and supported the City. Roguelio Pantoja, 13621 Rexwood, said at the Planning hearing he had suggested a chain link rear fence. He had put in a fence 2 years ago, but with his one dog and 6 dogs on the other property the fence is deteriorating and he has to keep fixing it up. ROQUELIO PANTOJA Richard Holtgrieve, 13716 Monterey, said the dogs are IN FAVOR locked up nightly from 8 p.m. to 9 a.m. He did not feel HOLTGRIEVE they were any more disrupting than neighbors dogs. He felt each application for Minor Variance must be considered separately. They request 6 show dogs on the one acre; have been there since October and the dogs are never out of the yard and are not to be feared. He said that they would have all six dogs surgically debarked to further favor of the variance. The yard is cleaned of feces twice daily. He presented pictures of the Afghan hounds and said they do not wish to sell or breed dogs but just keep the six they have. As there was no further testimony either in favor of or in opposition to the Appeal on MV-84, Mayor White declared the public hearing closed. PUBLIC HEARING CLOSED Councilman Izell said he had intended to suggest tableing this case for 6 months to see if any problems developed, but in view of the petition signed by 33 people he could not in good conscience vote to allow this variance. COUNCILMAN IZELL Councilman King concurred with tableing 6 months but he felt this was special. He did not favor variances due to the staff time required for continued review of the usage. COUNCILMAN KING City Attorney Flandrick said tableing for 6 months would allow a use in violation of the zoning ordinance, but the Minor Variance could be approved for a 6 months and then terminate. Prior to the end of the 6 months a public hearing could be held to determine if the variance should be modified or eliminated.' He explained that the action of the Planning Division was vacated by the Appeal but there would be no abatement period pending Council action. CITY ATTORNEY FLANDRICK Councilman Me Neill said variances to allow any more than COUNCILMAN 3 animals on any Residential lot should not be permitted MC NEILL any where in the City. A Minor Variance was recently revoked for show chickens as the usage violated the zoning ordinance and the law should be consistent throughout the city. He said 38,250 sq. ft. does not constitute an acre 43,560 sq. ft. 1 acre). In answer to Councilman King and Mayor White, Mr. Flandrick said that if it was the policy to deny a11 variance, then this provision should be eliminated in the Municipal Code. It was clarified that the property is presently 2 lots and a residence could be on each lot. Mayor White commented that the Variance procedure was in the code to make it possible to handle unusual problems so every- one can enjoy the same equal privileges in the development and use of property. Councilman King concurred, RESOLUTION NO. 79-29 DENYING A ZONE VARIANCE LOCATION: 13716 MONTEREY AVENUE: APPLICANT: MENDLESON & HOLTGRIEVE CASE MV-84) WAIVE FURTHER READING, ADOPT RESOLUTION NO. 79-29. Mayor White stated that the appeal was granted and the Variance was denied and that the Council was endeavoring to conform with the standards set in the Code. He said that reasonable abatement action in this case will be followed. 00- It was the time and place fixed for a public hearing on Public Nuisance Case No. 78-N-42 Confirming the cost of abatement at 3288 Patritti Ave. Proper postings and mailings had been accomplished, There were no written protests. Mr. Kelly gave a brief resume of the Agenda Packet report. Mayor White declared the public hearing open. As there was no testimony either in favor of or in opposition to 78-N-42, Mayor White declared the public hearing closed. There were no objections. 00- In answer to Councilman Me Neill, Mr. Kelty said paving of Merced between the Wash and Big Dalton is being included in the 5 year improvement program in terms of priority. There were no objections. 00- Councifman Me Neill said he had been asked to report to Council on the City Representatives to the Regional Library Council, East County Region. Council should receive reports and there should be community input. Mayor White directed that the City Manager write to the appointees to ascertain if they wish to continue to serve and attend in the future. Council concurred that in general, with the possible exception of the Personnel Commission, that Commission and City Appointees should be residents of the city and that the Code be amended to reflect this where applicable. Mr. Sexton suggested that he report on existing code requirements. Council concurred. 00- Regarding the Mid-Valley Mental Health Center, Councilman Aguilar said funds are low, so the Board must decide whether to consolidate or keep centers open. The proposal is to have the Home Center in El Monte and move the present Baldwin Park Center on Maine Ave. to the Baldwin Park Community Center. This would eliminate a $1,400. a month rental cost. The Center will not close. He said it had been indicated that space may be available on the first floor in the Civic Center. Councilman King had contacted Supervisor Schabarum's office and indications are that space is available on Maine Ave. in the present facility and there might possibly be some emergency funding available. Some repre- sentatives of surrounding cities concur that Baldwin Park is a central location for the service. It may be that cities will be asked to assist with funding. Mayor White said Mr. Ullah was recommending cost cuts by moving to the Community Center and was not proposing to move the service from Baldwin Park- 00- Mr. Doug Shaw, Mid-Valley Manpower Consortium, requested that a staff member from each of the 5 cities be appointed to an evaluation Committee for CETA funded programs. They will train the appointees and there will be about 130 hours for the year, mainly during June, July and August. Duarte and El Monte are considering appointees. Mr. Sexton suggested the appointment of Mr. Lucas and Council concurred. Mr. Shaw referred Council to the updated summary of the Mid-Valley Manpower Consortium report and introduced Joe Blizzard, Chairperson of the Advisory Council. Both thanked Council for their support. 00- Councilman Izell proposed and Council discussed no in-house" granting of minor animal variances by the Zoning Administrator and possible revision of the Code. Mr. Kelly said he would prepare a report including the number of Minor Variance requests received.
