Pacific Avenue, THURSDAY, APRIL 4, 1979 AT 7:00 P.M. AND ADJOURNED REGULAR MEETING OF THE BOARD OF DIRECTORS, BALDWIN PARK REDEVELOPMENT AGENCY. 00- Mayor White said the adjourned regular meeting of the City Council was for the purpose of conducting a joint and concurrent meeting with the Baldwin Park Redevelopment Agency to conduct a Public Hearing to effect the disposition of real property and develop- ment agreement with Kendall-Johnson Company for the Puente/Merced Redevelopment Project. He said at the end of the Puente/Merced Redevelopment Project we will recess the Community Redevelopment Agency and proceed with the regular Council meeting. OF CRA) CITY ATTORNEY FLANDRICK DIRECTOR OF COMMUNITY DEVELOPMENT KELLY DIRECTOR OF HOUSING AND ECONOMIC DEVELOPMENT CUNNINGHAM CITY CLERK BALKUS 00- ROLL CALL Mayor White declared the Public Hearing Open to consider the Disposition and Development Agreement for the Puente/Merced Redevelopment Project. Mr. Cunningham said the Puente/Merced Project was Illustrated on the rendering on the wall on his right. This indicated what they felt will be the best projects for the area and the highest return to the City. This project has been under negotiations for some time with the Kendall-Johnson Company. At the previous Agency meeting the hearing was continued because of certain verbages which needed changing in the DDA. He said Attorneys for the City, the Agency and Kendall-Johnson and he had met and resolved all the minor differences in the DDA, mainly the developers rights to assign his interests in the project to someone else and it was agreed providing that the developer maintains responsibility for the execution and completion of the project. There were a few minor changes In the escrow Instructions and the agency agreed to satisfy any unknown easements which might show on the title search. There was an extensive change to the schedule of performance and this was required because the entire project is subject to the City's authority to obtain a grant from the Federal Government to assist in some of the project performances. There were minor changes in some of the attachments to the agreement and these were solved this afternoon in final negotiations. He said that with approval of the Resolution adopting the Disposition and Develop- ment Agreement, then the City Staff will proceed to work with the tenants and the property owners to assure that they receive equitable consideration for their property and that the relocation process proceeds with little incon- venience and injury to everyone concerned. In answer to questions from the Mayor and Council/Agency, he explained that the time procedure will be finished on the approval of the grant. Project review plans will begin within 30 days after approval of the r-ant. After required approval of plans, specifications and permits are issued then there would be a period of 305 days or construction. It should be substantially completed by next April. Denney's Restaurant will remain intact and be refurbished in accord- ance with the overall theme, lenants will be relocated. There are 7 residence tenants dnd approximately 7 business tenants. The agreement wiU' he developer does specify 305 days. As there was no testimony sit-her in favor of or in opposition to the DDA for the Puen'-.o/M^rced Project, Mayor White declared the Public Hearing Closed, Mr. Kelly said the C^ty t<jit id reviewed three documents: the E.I.R., the Agen',.. Plan rmd the Proposal by Kendall- Johnson Company. Thes0 w iew^l with Dwight French, Agency Engineer and bill RdpMel, Agency Administrative Assistant. He said IL w^s the Staffs opinion that no further environmental analysis is required due to the fact that no changes are proposed to he project: which will require any revisions in the E.I.R. w' no riGv information of substantial importance to the project has become available. He said they therefore recommended that the Agency continue with the pro- ceedings without need for further environmental analysis. Iteyor White said that Councilman Aguilar and Izell were on the ad hoc committee that worked with the developer and the staff on this project. Councilman Aguilar said he had met with Mr. Cunningham and reviewed the proposal. He felt this would be a successful project if we get the grant and that this was a fair contract between the City and the developers. Councilman Izell said the entire project will depend upon the size of the grant. He concurred with Councilman Aguilar. Mr. Sexton said all legal advertisements and notice require- ments had been complied with and were on file for review in the Redevelopment Agency office and in the office of the City Clerk. He said alt projects documents are on file and available for public review. NO. 79-25. M/S/C: AGUILAR/MC NEILL. There were no objections. CHAIRMAN OF THE COMMUNITY REDEVELOPMENT AGENCY BE AUTHORIZED TO EXECUTE THE AGREEMENT ON BEHALF OF THE AGENCY. M/S/C: KING/AGUILAR. There were no objections. 00- Mayor White thanked the Ad hoc Committee, the staff and the developer for their cooperation and help on this project.
