DENY CLAIM AGAINST THE CITY BETTY CAMPBELL, SALLY BLOCK & PATRICK EUGENE FLYNN F:933 CONSENT CALENDAR AMENDING SECTION 2411 OF THE BALDWIN PARK MUNICIPAL CODE. RELATING TO THE 4. CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR 00- It was the time and place fixed for a Public Hearing on the intent to acquire certain real property by eminent domain at 14418 Ramona Blvd. Ramona Parking Lot). As required by law a certified mailing was made to Mrs. John Salcido as owner in the capacity as administratrix of the estate of Walter V. Heidt. Mr. Cunningham said negotiations with the owner have been successful, but when the property was placed in escrow March 8, 1979, the Title Report indicated a difficulty of clearing title on half of lot 14. A half interest to Mr. O'Meyer has not been cleared. There is also a $3,000 indebtedness which has never been reconveyed and all parties and heirs are now deceased or unknown. Mr. Flandrick said Mrs. Salcido claims ownership by way of adverse possession dating back to 1934. She had been notified and was aware of this hearing. He suggested filing a condemnation action and have Mrs. Salcido file her answers citing all the facts necessary to obtain title. He felt this would be acceptable by the Court, Mayor White declared the Public Hearing open, As there were no testimony either in favor of or in opposition to the proposed condemnation action. Mayor White declared the Public Hearing closed. Discussion followed. Mayor White said this matter will be continued to June 6, 1979 at which time a Planning Commission report and resolution wi11 be presented. There were no objections. 00- Mr. Sexton said a letter had been received from the Chamber of Commerce requesting Council support of Assembly Bill 1693. The bill will go to Coinnittee May 23, 1979. Mr. Sexton said the Bill is titled Parking and Improvement Districts. Assessments." Assemblyman Mello. He said, AB 1693 is of interest to all cities which have or wish to create parking and business improvement areas under present law. As a result of Proposition 13, Legislative Counsel indicated that these charges on local businesses may be special taxes subject to a 2/3 vote. If this is a correct position, it is unlikely that new districts can be created nor will existing districts be modified. AB 1693 would solve this by creating a system of benefit assessments and charges as an alternative to the existing law. He said the Chamber of Connerce is using the present law as a business improvement district and passage of this bill would create a benefit assessment district and therefore the majority votes. DIRECT CITY MANAGER TO WRITE A LETTER IN SUPPORT OF AB 1693. M/S/C: IZELL/AGUILAR. There were no objections. PUBLIC HEARING OPEN PUBLIC HEARING CLOSED CONTINUED TO 6/6/79 CHAMBER/COMMERCE AB 1693 PARK/IMPROVE DIST. ASSESSMENTS CITY MANAGER WRITE LETTER SUPPORTING AB 1693 00- Regarding acquisition of real Property by eminent domain at 14306 Palm Avenue, Public Hearing held 5/2/79), Mr. Cunningham said the property had been appraised to be used as a Senior Citizens center and it was determined this was the most suitable property for this project. On May 2, 1979 agreement with the owner had not been reached as to the price of the property. Late on May 2nd a tax bill was presented to the City which was interpreted that it reflected the assessed value. However, the bill reflected the market value. Mr. Flandrick said he had had discussion with Mr. Abrahams, attorney for Mr. Hannah, which was indicative that a settle- ment is not likely. The evaluation referred to on the tax bill is $14,600. as fair market value, which is the 1975 evaluation as a result of the Jarvis amendment. If there is a possibility of settlement on the cost, he asked if Council wished to authorize staff to proceed with negotiations. Discussion followed and it was ascertained that neither Mr. Hannah or his attorney were present, however they were present of May 2, 1979 and were aware that action had been continued to this date. Mr. Kelly said that in accordance with Government Code section 65,402, the Planning Conmission found that the acquisition of this property would be consistent with the land use designated by the General Plan, City Clerk Balkus read by title: RESOLUTION NO. 79-49 14306 Palm Avenue, Proposed Senior Citizen Center) FINDING AND DETERMINING THAT THE PUBLIC INTEREST. There were no objections. 00- Councitman Me Neill said the Street Medians are full of weeds and a disgrace to the City. He asked that this be corrected. Mr. Ketly said the staff was aware of and embarrassed by the problem; that being short ten maintenance men the department was reorganized and the Medians are now being weeded. This should be corrected within the next 3 weeks. Ceta personnel have been transferred to full time positions and Ceta personnel cannot be replaced. Present personnel has been reassigned. 00- Councilman Aguilar said the Municipal Code allows the filing of applications for 14 Fireworks permits each year. Due to various reasons some organizations were not aware of the May 1st filing requirement. Eleven were timely filed. He requested that three late applications be processed. Discussion followed. AUTHORIZE FILING OF FIREWORKS APPLICATIONS BY SILHOUETTE BATON & DRUM CORP, BALDWIN PARK NATIONAL LITTLE LEAGUE AND BALDWIN PARK KIWANIS CLUB ON THE GROUNDS THAT THEY HAVE COMPLIED WITH M.C. SECTION 3050 ETC. SEC. M/S/C: MC NEILL/AGUILAR. There were no objections. 00- Helen Gibson, 13268 Francisquito, asked if anything had been done about the business license tax assessed to persons engaged in the business of rental of commercial or manufacturing buildings) or the Pin Bait Alley on Ramona. Mayor White said the fee set January 1, 1979 had been reduced drastically on March 7, 1979, but there had been RES. If further adjustment is needed this will be considered. Mayor White said the Pin Ball Alley is a lawfully operated business and Mr. Kelly explained that the operation was under a Use Permit consistent with all the City Ordinances. The activity will be monitored monthly. If there are problems it will go to the Planning Commission for revocation. Mrs. Gibson asked if all places of business, especially this type of business, were required to have restrooms. She also questioned the hours of operation as they operate until 1 a.m, Councilman Izell said he believed all the buildings are under one ownership and sound proofing of walls is the responsibility of the owner who rents the shops. Mr, Kelly said he would review the use conditions and conformity and report to the Council. In answer to Councilman King, Mr. Kelly said the noise level was not addressed specifically in this case. Discussion followed regarding noise levels and control. Los Angeles County has an excellent ordinance. Mr. Flandrick said the City code contains two sections relative to noise. Section 3609 was reviewed by the District Attorney. It is adequate and not preempted by section 415 of the Penal Code. Councilman Me Neill requested a report at the next meeting as to whether the code covers what type of building and business has to furnish restrooms also the hours of operation for recreation and related activities including a Pin Ball operation. 00- Ann Pinedo, 14025 Benbow thanked Council on behalf of the Baldwin Park Little League for allowing the acceptance of their fireworks application. 00- Bess Jenkins, 13056 Amar Road, was concerned about weeds in the medians at Baldwin Park Blvd. and Ramona and on Frazier. On Frazier, south of the Freeway, cars parked on both sides of the street could cause a problem in an emergency situation. She said that the curve on Datewood going toward Baldwin Park Blvd. is narrow and dangerous as cars are parked there. She asked what activity was taking place on Amar south of the Wash & Councilman IzeU said a building was being built there. Mrs. Jenkins asked that minutes of meetings be mailed to her and agreed to furnish stamped, addressed envelopes. She said Amar, a dead end street, is a place where children play as there is no place for them in that area, and there are no facilities at De Anga school. She said the yellow street lights on Baldwin Park Blvd cut visibility and made driving difficult. Mayor White said the sodium lights saved on electrical power and Councilman Me NeiU said that the power company is now in the process of putting in a11 sodium lights in order to save electrical power. He said the Ledford school site Walnut Creek) was being developed as a park for recreation in that area. They have an Outreach Program in the San Gabriel Valley. They provide interpreting services for doctors, legal problems, etc. The service includes Counsel- ling and job placement where they experience discrimination. GLAD is composed of over 40 organizations and individuals whose services are related to deafness. Many of their staff are deaf. She introduced Jerry Me Carthy. Jerry Me Carthy, using sign language, interpreted by Nancy Pitek, expressed his appreciation of an interpreter to relay his message to Council. He said approximately 10% of the U.S. population is hearing impaired, with about 2,000,000 in California. Deafness is specifically a communication disability and invisible and therefore there are many frustrations. TV and Radio is not accessable to them as there are no captions and not always some- one to interpret. In emergencies fire) they have no access. 6.5% of the 10% hearing impaired use sign language and even fill- ing out a job application is difficult without interpreted infor- mation. There is one academic college for the deaf in Washington D.C. and one Technical Vocational College in Rochester, N.Y. There are few school programs available and variety of education is limited. Employment is limited as Communication is important to business. Their income is low. He exhibited a teletype TTY) a communication device adaptable to the telephone. The cost of a TTY ranges from $400 to $1,000 and some are portable. With this machine the paramedics, police and fire department can be contacted. He said they are tax payers but do not get their even share. He distributed packets containing information on GLAD. Mayor White said all County-City Police and County Fire Depart- ments are equipt with the TTY and in emergencies do pass the information on. 00- Bertha Regus, 5013 Cutler, was concerned with dry weeds especially with fireworks. She suggested that the noise generated by car and fender repairs from early morning until late at night in residential areas be stopped. 00- Helen Kelley, 14616 Baldwin Avenue, said she lives on a private, undedicated Street. She had a crowing rooster 4 years ago which she disposed of but despite phone calls 3 or 4 families on the street still live in garages. In answer to Mayor White, Mr. Kelly said if not legally habitable the buildings would have to be converted back to garages and violations would be forwarded to the District Attorney. Helen Kelley asked that the crosswalk on Baldwin Park Boulevard between Morgan Park and the bowling alley have a yellow sign or flashing light or the cross walk be repainted. Mayor White asked that this be investigated and corrected if possible. Helen Kelley asked if the Community Center could be used one night a week for Youth dances or entertainment and Councilman Me Neill suggested that Mrs. Kelley attend the Youth Activity Advisory Commission meeting May 21, 1979 and present her suggestion. Mrs. Kelley asked that something be done to prevent small business from exploiting illegal aliens and Mayor White said these people can go to the labor department or the police department and report such action. 00- AT 9:08 P.M.
