NO. 792 Z-427 ADOPTED 00- It was the time and place fixed for a public hearing on CP-281 An appeal on a Conditional Use Permit to operate an educational institution as required by Section 9472.12 of the Baldwin Park Zoning Code on property located at 13232 Ramona Boulevard. Applicant: Dr. G.S. Bevli Appealed by: City Council Proper publications, postings and mailings had been accomplished There were no written protests. Mr. Kelly gave a brief resume of the Agenda Packet report. Mayor White declared the Public Hearing open. As there was no testimony either in favor of or in opposition to CP-281, Mayor White declared the Public Hearing closed. Councilman Izell said the reason he had questioned this case was the move-in house on the property had sat there for 18 months unfinished. The house completion had been a condition of approval and had been in violation about a year and he could see no reason why there would be compliance with Conditional Use Permit conditions now. Councilman King and Me Neill concurred. Mayor White said Council had appealed this case within the required time. He asked the City Attorney for clarification of possible council action. Mr. Flandrick said the Conditional Use Permit could be conditionally approved or denied. There was no evidence presented by the applicant. If approved, and there is failure to comply with conditions the permit can be revoked. If no action is taken by Council, then the Conditional Use Permit will not be issued. He said the move-in was a separate permit. Councilman Izell said he was not against the Conditional Use Permit provided the City Attorney came up with restrictions that would guarantee completion in two months or be automatically revoked. As the Applicant was present. Mayor White reopened the Public Hearing. He requested 2 or 3 months to complete as contractors do not always conform. He will show the City the signed contract and guarantee of completion money deposited. He said he could comply with the conditions by September or October. As there was no further testimony. Mayor White declared the Public Hearing closed. Discussion followed as to the time necessary for completion of the Move-in; that a bond had been posted and staff had met with the applicant to determine the time needed. Mr. Kelly said 2 months should be adequate to finish the project and Council concurred. Mr. Kelly explained that the Montessori Method was a system of teaching children 3 to 6 years of age). Mr. Flandrick said he had modified the conditions of approval included in the Planning Commission Resolution to include: The applicant shall complete the work of renovation as described in the Relocation Permit for a move-in building within a period of 2) two months from the date of adoption of this resolution, and if the said work is not completed within that period of time, the said building shall be forthwith demolished or removed from the subject property." He said the applicant would be given a copy of the Resolution and requested to sign an affidavit that he had read and agreed with the conditions. There were no objections. 00- The Public Hearing on the 1979/80 Preliminary Budget and the Use of Federal Revenue Sharing Funds was continued to later in the meeting when Councilman Aguilar would be present. 00- The six Resolutions under City Manager concerning Personnel Rules, etc. were continued to the next meeting. 00- Mr. Kelly reviewed the Agenda Packet Report on house moving. He said this problem was due to lack of completion of recent move-ins. The code provides necessary enforcement with the exceptions that house moving should only be within the City limits and work should be performed by licensed contractors, Also funds should be deposited in lieu of bonds with more restrictive time of completion constraints. Councilman King objected to the in-City limitation as many times outside move-ins would up-grade the City more, or not allow move-ins at all. AT 8:05 P.M. COUNCILMAN AGUILAR ARRIVED. Councilman King concurred, but favored outside move-ins with adequate controls. Councilman Me Neill concurred with Councilman Izell and King, but said requirements should be more stringent so the City will have better homes and up grade the City. In answer to Councilman Aguilar, Mr. Ketly said all move-ins have been from outside and they have been a problem. He said standards can be more strict and if necessary Council could initiate further modifications. Councilman King suggested a moratorium on move-ins until problems are resolved. In answer to Mayor White, Mr. Cunningham said that regardless of whether there were move-ins or not, the vacant land in the City will be developed. He said he felt that strict enforcement of the present code would resolve the problems. He further stated that he knew of no houses that have ever been moved out of the City. Councilman Me Neill said that in the interest of up grading the City he would favor no move-ins. City Attorney Flandrick asked that he have an opportunity to research the law as there had been a Bill introduced prohibiting an outright prohibition. DECLARE A MORATORIUM ON MOVE-INS. MOTION BY COUNCILMAN KING. The motion died for lack of a second. Mayor White said he could see the advantages of some house- moving with adequate controls. This could resolve some of our deep lot problems. He concurred with the staff recommen- dations. In answer to Councilman Me Neilt, Mr. Kelly said the City has the right to reject any structure from moving into the City after the staff makes a finding as to the condition of the structure. IN ACCORDANCE WITH THEIR LOW BID OF $11,788. M/S/C: AGUILAR/IZELL. There were no objections. 00- It was the time and place fixed for a Public Hearing on the Preliminary Budget for the Fiscal Year 1979/80 and the Use of Federal Revenue Sharing Funds to be received by the City Proper publications had been accomplished. Mayor White stated that Council had received copies of the Preliminary budget and that applications for Grants from general agencies for funding had been received. Mr. Halloway said the joint Public Hearing was to consider the 79/80 proposed City Budget and the use of $552,894. in Revenue Sharing funds to be divided among services, the Police Department and Community Development. The hearing is for the purpose of conforming with Revenue Sharing and City code requirements. Mayor White declared the Public Hearing open. Bill Adrians, 4349 Alderson, said he had submitted an application for Senior Citizens. In order for him to do a more effective job they need transportation, personnel, office equipment, a typewriter and a copy machine. Joe Pierce, 3722 N. Willow, President of Service Council, had submitted an application requesting funding in order to continue operation. Councilman King said a Community based consortium had been discussed which might help Community organizations which could be funded from the Consortium. Mr. Sexton explained the City has been working to establish a Community based agency. Money now is handled by Los Angeles County. The Cities concerned would be the same as the Mid-Valley Manpower Consortium. He understood that funding of about 1/3 million dollars is available. That would be the basis of funding for the Bassett Bario Program. A Joint Powers Agreement has been submitted to the Federal Government to assume that responsibility under the Joint Powers Agreement with the 5 cities. It appears this will be ready in August for reatification by the City Councils. Councilman King said this would relieve funding from the General Fund each year. The Consortium would allocate funds on request. Mayor White clarified that regardless of whether the City funds the Service Council or not, there are Federal funds available. If the organization is not funded by the City there may be a chance of Federal funds; or if the City does fund the organization these funds may be available. James Gregg, President of Welfare Rights spoke for Welfare Rights and the Service Council. This helps in the interium before Welfare takes over. He said Welfare Rights works with the Service Council and they check that there is not a duplication of services. They counsel family units, help juveniles and help ex offenders obtain jobs. They work with Senior Citizens, Welfare and the Health Department They try to put people to work. They are trying to set up a meeting with all employers working on a program that will give the employer a tax break and supply jobs for people and are trying to save tax dollars. He requested employment of a Secretary and a Bookkeeper and funding of both organizations. Councilman Aguilar suggested that Mr. Gregg contact Mid-Valley Manpower Consortium in September when they will be handling the CETA program and discuss the secretary and bookkeeper problem. Discussion followed regarding Federal or block grants avail- able for Service Organizations and Mr. Gregg said he would forward information he has to the City on funds available. Bess Jenkins, 13056 Amar Road, urged consideration of the Service Councils request. Ana Montenegro, City Treasurer, said possibly cities can apply for a Title IV Grant, a Cultural exchange educational type of grant. This could be beneficial to the City. Mayor White asked that Mr. Sexton research this possibility. As there was no further testimony Mayo White declared the Budget-Revenue Sharing, Public Hearing closed. DISCUSSION GRANTS & CONSORTIUM BESS JENKINGS SERVICE COUNCIL ANA MONTENEGRO POSSIBLE TITLE IV GRANT RESEARCH PUBLIC HEARING CLOSED BUDGET REV SHARE Council discussion followed that all applicants are all deserving organizations and although City funds are limited, Council is sympathetic and will consider the requests. Establishment of where the most need lies, is difficult to access. Funds are limited and Police Services, Street Maintenance, etc. must also be considered as this is the Tax Payers money. 00- AT 9:12 P.M. COUNCILMAN MC NEILL LEFT THE COUNCIL CHAMBERS. AT 9:15 P.M. COMMISSION APPOINTMENTS REVIVE SISTER CITY PROGRAM 00- James Gregg, President of Welfare Rights, said he had attended a meeting with the handicapped and was told that City Halt facilities are not easily accessible for use with a wheelchair. Mr. Kelly said funds were being made available thru HCDA to make the building more accessable to the handicapped. 00- Bill Adrian, extended an invitation to Council and all present to attend. She appreciated the removal of the truck parked on Dalewood, however she would like to see the hole at the end of Frazier St. filled in.
