The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m. 00- An invocation was given by Councilman Izelt. INVOCATION Councilman King led the salute to the flag. APPROVE MINUTES OF JULY 2, 1979 AND JULY 5, 1979 2. WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 79-74 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 3. WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 79-75 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 4. WAIVE FURTHER READING AND ADOPT ORDINANCE NO. 794 AMENDING SECTIONS 2255 Second Reading AND 2256 OF THE BALDWIN PARK MUNICIPAL CODE, RELATING TO CONDITIONS OF EMPLOYMENT CONCUR WITH RECOMMENDATIONS ON THE CONSENT CALENDAR. M/S/C: CONCUR WITH AGUILAR/KING. There were no objections. RECOMMENDATIONS ON CONSENT CALENDAR 00- A letter was received from Robert Gair, President of the Baldwin Park School District regarding SB71 amending the Penal Code and adding to the Welfare & Institutions Code, relating to vandalism, effective January 1, 1980. The School Board requests that the Police Department investi- gate and apprehend those responsible for burning Baldwin Park High School. NO. 795 WAIVE FURTHER READING AND INTRODUCE ORD. NO. 795. M/S/C: AGUILAR/MC NEILL. There were no objections. 00 Mayor White requested that the City Manager prepare an Ordinance for the next regular meeting regarding appoint- ments to the Personnel Commission by the City Council. 00- Mr. Halloway reviewed the Agenda packet report regarding changes in the agreement with Webster's Refuse Disposal. Discussion followed. APPROVE AGREEMENT WITH WEBSTER'S REFUSE DISPOSAL AND AUTHORIZE SIGNING BY MAYOR AND CITY CLERK. M/S/C: KING/MC NEILL. There were no objections. City Clerk Balkus read by title: ORDINANCE NO. 796- AMENDING THE PROVISIONS OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO REFUSE COLLECTION ORD. NO. 795 INTRODUCED PREPARE ORD. RE PERSONNEL COM. APPOINTMENTS WEBSTER'S REFUSE DISPOSAL AGREEMENT APPROVED ORD. NO. 796 REFUSE COLLECTION WAIVE FURTHER READING AND INTRODUCE ORD. NO. 796. M/S/C: IZELL/KING. There were no objections. 00- Appointment to the Senior Citizens Advisory Commission was continued to a later date pending submission of applications from Citizens interested in serving. ORD. NO. 796 INTRODUCED 00- Mayor White proposed that MRS. HELEN TAYLOR BE APPOINTED TO THE PLANNING COMMISSION. M/S: IZELL/MC NEILL. Councilman King said he had spoken to Mrs. Taylor and she understands that his vote does not reflect on her character, ability or integrity, as he felt that there could be, inadvertently, some influence regarding a person in Real Estate serving on the Planning Commission. Discussion followed concerning Conflict of Interest and Mr. Flandrick said that there was no conflict of interest and that anyone, on any commission would disclose their interest and abstain from participation, including lobbying. The State makes no qualification for Planning Commissioners and the City would set a precedent excluding a profession and there could be litigation. Further discussion followed that the Council is responsible for Commission appointments and cognizant of Commissioners performance and this is a safety factor. Continued MRS. RESOLUTION NO. 79-76 APPOINTING A MEMBER TO THE PLANNING COMMISSION TO THE CITY OF BALDWIN PARK HELEN TAYLOR OFFICE H) WAIVE FURTHER READING AND ADOPT RES. NO. 79-76. M/S/C: IZELL/MC NEILL. There were no objections. 00- Councilman Aguilar commended the Baldwin Park American Little League for winning the City League Championship as he felt they should be recognized. RES. NO. 79-76 APPOINTMENT PLANNING COMMISSION HELEN TAYLOR RES. NO. 79-76 ADOPTED P.B. AMERICAN LITTLE LEAGUE CITY CHAMPIONSHIP 00- Councilman Izell said it would be handy for residents if an impound vehicle storage yard was situated in the City. Discussion. Mayor White requested that Chief Chell-ino investigate the feasibility of this proposal and make a report, 00- Dwaine Glass, 4708 Walnut, requested a waiver of Fire Department hydrant requirements for property being developed by Mr. Filer at the S/E corner of Puente at Ramona, adjacent to Big Dalton Wash. He objected to this cost being the responsibility of one developer. As they were not aware of this requirement he asked if they could be granted Temporary Occupancy while this problem is being resolved. Discussion followed and Council referred Mr. Glass to Mr. Kelly, Director of Community Development. 00- Glen Robinson, 4708 Walnut, said he had a Lot Split at this location which he had started processing in 1977. He has 3 lots and requested waiver of the sewer lateral on the middle lot. At the time he began development a lateral for each house was not a requirement. Since then, unknown to him, the code has changed and as this is very costly he asked permission to put 2 houses on one lateral. Discussion followed and it was established that a code requirement cannot be waived. Therefore the request for waiver was not granted. 00- Councilman Izetl said that Miss Baldwin Park will be his guest at Kiwanis next week and he jokingly asked that Chief Chellino and Officer Emon be directed to attend and protect her. 00- Mayor White said he had attended the League of Mayor's Conference. He reviewed the program and said the information is available for Council perusal.
