The City Council/Redevelopment Agency of the City of Baldwin Park met in adjourned regular session in the 3rd floor meeting room with Supervisor Schabarum and County Representatives. KELLY, DIRECTOR OF HUMAN SERVICES LUCAS AND CITY CLERK BALKUS 00- The City Council/Agency met with Supervisor Schabarum and staff members to discuss the proposed settlement of the Puente/Merced/ South Baldwin Park Boulevard Redevelopment Project. Supervisor Schabarum and Mr. Holston had assumed that an agreement had been reached as a result of a discussion held in 1978. At that time Supervisor Schabarum said proposals were made that the County would pay back $219,000. and the City pay $200,000. in ten years, not less than $15,000. a year on the unpaid balance. The auditor would retain $14,000. Mr. Sexton said he had recorded the discussion and that was not his understanding. A letter dated September 6, 1978 outlining the results of the discussion was referred to and discussion followed. The following steps were discussed and agreed upon for inclusion in an agreement between the County of Los Angeles and the City/ Agency: 1. The County to return money held by the Auditor/Controller to the City $219,068.34 from the City property tax allocation, and to the Agency $14,834. tax increments on the San Gabriel River project $233,903.34 no interest. 2. $170,000. will be acknowledged by contract as an obligation of the Agency. 3. The acknowledgement of $170,000 to be payable over a ten year period at not less than $17,000 per year, payable in two semi-annual payments in December and May, at no interest. 4. Acknowledge $234,000. to be considered as indebtedness to the Puente/Merced project. Of that amount we received $233,000. tax increments; $233,000. which the county now has. He suggested that the County acknowledge $170,000. plus the difference between the indebtedness incurred $283,000 and the tax increment money received $219,000. Mr. Flandrick said he would draft a contract this date for Mr. Sexton's review and send it to Supervisor Schabarum by messenger on Friday or Monday. Mr. Flandrick said this was a valid settlement agreement as to form. He recommended acceptance of the agreement, but said that the dollar amount was up to the Council/Agency. Mayor White asked for a informal indication from Council/Agency as to whether or not they agreed with the terms suggested subject to a formal contract. Roll Call: Yes: Izell, King, McNeill, white. No: Aguilar. Supervisor Schabarum said he would recommend that the Board approve the contract. Council/Agency expressed their thanks to Supervisor Schabarum and his staff for being in attendance and for their cooperation. AT 9:30 A.M. INVOCATION FLAG SALUTE ROLL CALL Mayor White called for proceedings to commence concerning adoption of a Redevelopment Plan for the West Ramona Boulevard Redevelopment Project. City Clerk Balkus said that pursuant to the appropriate sections of California Community Redevelopment Law, Notice was duly given that the City Council of the City of Baldwin Park and the Baldwin Park Redevelopment Agency have authorized a Joint Public Hearing to consider the approval and adoption of the Redevelopment Plan for the West Ramona Boulevard Redevelopment Project. Said Notice was published by the City Clerk in the Herald Press, a newspaper of general circulation on August 8, August 15, August 22, and August 29, 1979. The Executive Director of the Baldwin Park Redevelopment Agency, for the City Clerk, mailed by certified mail. Notice of said public hearing to the last known assessee of each parcel of land in the proposed Project. Mayor White said that this was the time and place set for the Joint Public Hearing of the City Council of the City of Baldwin Park and the Baldwin Park Redevelopment Agency on the Negative Declaration and the Redevelopment Plan for the West Ramona Boulevard Redevelopment Project. At this hearing, all persons who wished to speak for or against the Negative Declaration or the Redevelopment Plan could have an opportunity to speak. As Mayor and Agency Chairman, he declared the City Council and the Agency Public Hearing Open. Mayor White said that the record contains the following documents: Continued WEST RAMONA BLVD. The Negative Declaration on the proposed project. b. The Redevelopment Plan for the West Ramona Boulevard Redevelopment Project; c. The Planning Commission Report; d. Report to the City Council on the Redevelopment Plan; e. Owner Participation Rules At the request of Mayor White, Mr. Sexton introduced Agency Counsel Reginald Woolfolk who would give a report on the Redevelopment Plan and Staff Members William Kelly, who would present a staff report on the Environmental Documents and Bill Raphiel who would present items relating to the Planning Commission. City Clerk Balkus administered the oath to the above named individuals. DOCUMENTS ON FILE INTRODUCTION OF STAFF OATH Mr. Kelly said the Agency staff had reviewed the required MR. KELLY Environmental assessment according to the California ENVIRONMENTAL REPORT Environmental Quality Act. At that time, the Staff prepared an initial study which was to determine any significant adverse Environmental Impacts which may result from the implementation of this proposed project. The Environmental assessment and the initial study are a part of the document which the Council/Agency had received. In the report the initial study, beginning on page 7, lists the majority of the catagories as having no significant adverse environmental impact. However, several of the catagories listed possible Environmental Impacts. #(l.e) Change in water runoff resulting from the project: we found this would not have significant impact based upon the fact that present City codes wilt control this problem. #(2.a) Possible deterioration of the Air Quality: required a study as outlined in the report. 8) A change in land use: this was found not not to be significant as the project will be consistent with the General Plan as well as the existing zoning. #(3.a,f) Increase in vehicular movement and potential for traffic accidents: these required further study. 16) Increase in Utilities Usage: further study indicated this would not be of significant adverse impact as all the utilities necessary for this project area are available. The only areas needing further study as mentioned were Air Quality and Circulation, #2a and 13a,f. At that time the Agency Staff commissioned the detailed circulation studies to be performed by M.S.I. Envicom performed the Air Quality analysis. Following staff review of both studies it was determined that the Air Quality Impact and the Traffic Impact would not be significant adverse impact providing the mitigated measures as proposed in the plan are accepted and implemented by the Agency/Council. Mr. Kelly stated that the project is consistent with the General Plan Land use classification, of high density residential with a small area for commercial. There is presently no Specific Plan adopted for this area and the Project Development will be consistent with all applicable City Zoning Codes and Ordinances. Mr. Kelty said the staff recommended adoption of the Resolutions which certifies to the Negative Declaration and adoption of the mitigated measures in the Agency Plan. 00- Mr. Raphiel said that pursuant to the instructions given by the Agency Board the Staff prepared the preliminary Redevelopment Plan. On August 8, 1979 the Planning Commission adopted Resolution PC 79-27, adopting the Plan and making findings that the Redevelopment Plan conforms to the General Plan and recommending that the Plan be adopted. MR. RAPHIEL PLANNING REPORT 00- Mr. Woolfolk said the Redevelopment Agency had received a MR. WOOLFOLK directive from the City Council. They then went through REDEVELOPMENT a process to determine exactly where Redevelopment activity PLAN REPORT was about to take place within the City. The Baldwin Park Redevelopment Agency was created to improve, upgrade and revitalize areas of the City that in fact have become blighted through deterioration, disuse or non productive uses. As part of this effort the West Ramona Boulevard Redevelopment Project was selected specifically to: 1) Eliminate and prevent the spread of blight by promoting the immediate development of the vacant and unimproved land around the Railroad Right of Way. 2) To encourage new high quality Residential Development and Commercial Development in the City. 3) To promote efforts intended to increase the economic and social viability of the City. The project area is a large block of vacant, undeveloped land formerly abandoned as Railroad Right of Way in 1972. The land is unused and generally negative as a influence on surrounding property. It contains no natural grassy areas, no tree cover. This condition reinforces the negative and depressing esthetic aspects on surrounding residential areas. As detailed in the report to Council the area shows symptoms of btiqht as defined by Section 33,032 of the Health and Safety Code by: 1) Circulation and disuse because of faulty planning 2) Irregular form, shape and size, of property prevents the proper usefulness of development 3) The area typifies impaired investment and social and economic maladjustment. He said that the Redevelopment Agency is the only agency that will be able to place the complete plan in an economically, viable physically standard condition to effectuate the Redevelopment Project. A better environment is our major concern, and adoption of the Redevelopment Plan will assure that all development within the project area will conform to the Citys General Plan and equal or exceed all applicable codes and ordinances. And finally, based upon the discussion with Los Angeles County Administrative Office the adoption and carrying out of the development plan is economically sound and feasible and that the project area will not have a detrimental effect or financial burden on any of the taxing agencies located in the Project area. They have had communication with the railroad and they have concurred in the report and recommendation and have voiced no objections. He said they felt that adoption of the Redevelopment Plan is to the benefit of Baldwin Park. 00- Mayor White asked that the City Clerk read any written communications received in favor of or in opposition to the Negative Declaration and the Redevelopment Plan. WRITTEN COMMUNICATION IN FAVOR BALDWIN PARK CHAMBER OF COMMERCE City Clerk Balkus read in full a letter in favor addressed to the City Council dated September 4, 1979 from the Baldwin Park Chamber of Commerce as follows: This is to advise you and the members of the City Council that at a Board of Directors meeting held on August 29, 1979 the Baldwin Park Chamber of Commerce went on record to Support the concept of the West Ramona Redevelopment Project.'
