Documents for the fiivlronmontal Quality Act were submitted by applicant. Staff recommended this usage be allowed in Industrial & Commprcid1/Mdnufacturinq zones subject to a Conditional Use Permit, as in other cities. The usage is not compat ble to residential use. ATKINSON PUBLICATIONS NO WRITTEN PROTEST RESUME PUBLIC HEARING OPENED Lynn Atkinson, Applicant, 8306 Rush St., Rosemead, read his letter of application, copy in official files) which referred to a prior request for self storage units at the end of Dart Street near Garvey, This request had been denied. He thought, this usage was the best usage for their parcel as it is a quiet use, a sound barrier for residential and a tax benefit. He requested approval of AZC-77. TESTIMONY IN FAVOR LYNN ATKINSON Joe Angelo, 3123 Baldwin Park Blvd AZC-77. requested approval of JOE ANGELO Jay Angelo, Realtor, 3123 Baldwin Park Blvd., said he felt this would improve the Garvey area and he requested approval. As there was no further testimony either in favor of or in onoosition to AZC-77, Mayor White declared the Public Hearing closed. JAY ANGELO PUBLIC HEARING CLOSED In response to Mayor White, Mr. Flandrick said the question had DISCUSSION been asked, Would this request be proper and consistent with the State Planning Law for a city to allow a temporary particular use and know that shortly the law would be repealed by the ne',7 zoning code)?" If that were to occur, the question would be, 1/hat was the intenc of the time of the adoption of the Ordinance?" If this were to occur, in his opinion, this would constitute a subterfuoe under the State Law. Under state law, when an ordinance is adopted, the intent is that the regulations be permanent in nature. In answer to Councilman Aguilar, Mr. Kelly said the land use classification for this property end of Dart St.) in the General Plan is to be retained as single family Residential. In answer to Councilman Ize11, Mr. Kelly said the Citizens Advisory Committee recommended that the Freeway Corridor provide for heavier manufacturing usage but they did not want the Commercial/Manufacturing to intrude into established residential areas and this proposal would intrude into residential and therefore staff is recommending Residential for this area in the new General Plan. In answer to Councilman McNeill, Mr. Kelly said that Battaglia and Associates have tenative approval of a 12 lot subdivision for this area. Councilman McNeil! said ihe proposed General Plan indicates residential and ho did not believe in deviating unless absolutely necessary a', this creates spot zoning. HP also thanked Mr. Keltv for his assistance with a citizens problem. 00- Mr. Kelly said the proposed final General Plan will be presented to the City Council and Planning Commission on October 25, 1979. At that time it will lie explained where we're at with the General Plan; the issues that were studied, such as deep lots; zoninp, changes from the old General Plan; to detail what will he hanpem'ng at the public hearings and answering questions. Th^ public hearings will take place in December so this will allow time for document review.
