DELETE WARRANT NO. 14606 CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR 00- It was the time and place fixed for a Public Hearing on CP-268 an Appeal on the decision of the Baldwin Park Planning Commission on the Revocation of Conditional Use Pernit 268 that permits the operation of a group home located in an R-l Zone at 3562 Vineland Avenue. There were no written protests. mai1 ings had been PUBLICATION, POST/MAIL NO WRITTEN PROTESTS Mr. Kelly stated that this matter was before Council based upon the fact that the applicant violated two sections of Section 9483 of the Zoning Code, and Section 2.H. of the Planning Commission Resolution; specifically that the perr'it is being exercised contrary to the terms and conditions of the approval; that the use for which the approvil was granted is being exercised so as to be detrimental to the Public Health or Safety, or as to constitute a public nuisance. Councilman Aguilar said he would abstain from voting on this item as prior to October 25, 1979 he had met with Mr. Randall and expressed his views; also his residence is two or three houses from this property. Mr. K^lly reviewed the Agenda Packet report and the Staff and Planning Commission recommendation to revoke Conditional Use Permit 268, based upon the findings. He said the City diJ no^. desire being placed in a position of being uncon- cerned about the residents of Hampshire House. The City's only objection deals with the lack of supervision people are receiving and the kinds of problems they are causing to the Police Department and the residents in the area relative to this lack of supervision. The City's concern in this matter is a land use issue, that the use permit co.h'itions relative to adequate supervision are not being honored, and not the kind of care residents are receiving. He said Council had received from Mr. Kerckhoff a copy of a petition signed by 56 people within approximately 1000 feet of the subject property. In answer to Councilman Kina, Mr. Kelly said public hearing notice was given to within 300 feet of the property. The nurl'er of residents who signed the petition and living within 30^ feet is about 30'. of the total number of properties. This 30' was also true of up to 600 to 1000 feet of the property. Councilman Izell said this Public Hearing is for the people of Baldwin park who are concerned. With Council concurrence, Gregg Wood, 4238 Pasadena Street, teacher at Hampshire House said he would interpret the proceedings for the benefit of Residents who are deaf. Steve Foundoulis, 509 Julian Drive, Pasadena stated he is a STEVE FOUNDOULIS Psychiatric Social corker. Program Consultant with Hampshire PSYCHIATRIC SOCIAL House for 13 months. He described the procedure to receive WORKER/PROGRAM residents and the process that takes place in the development, CONSULTANT WITH education; programming and supervision. Residents are HAMPSHIRE HOUSE referred by the State of California Department of Development and Disabilities. After referral, parents decide whether a candidate will be comfortable in Hampshire House. A screening procedure is begun. They do not accept addicts or people known to have violent behavior. There is a 30 day probation period for indepth screening to develop a program for the person and determine their needs. With the assessment a treatment plan is developed. The program is implemented by 7 program Counselors. They do staff training on a weekly basis. They have 2 special education teachers from the School District. Sign language is also used. They are developing a work shop where sometime in the future residents can participate. Mayor White explained that Councils concern is Supervision of the residents and their effect on the neighborhood. Future plans, etc. are not that significant to the issue before Council, He asked that testimony be confined to what is germain to the issue. Steve Foundoulis said that in the past 15 months to reduce problems screening has been more intensive. They have discussed this with the State and they are being more selective. They have 7 additional staff to work with residents. This is an open facility, as mandated by Title II of the Social Security Act, with the emphasis toward normalization. The people are free to come and go as they please. Those whose behavior is in conflict with the Community are removed. Those with a potential problem are chaperoned when away from the facility. He understands that most problems have been at the Baldwin Park Bowling Alley, so they now take residents to establishments in Covina. They have 22 employees, housekeepers, cooks, attending staff, counselors, supervisors and manager. They maintain 3 residents to 1 staff member. In answer to Councilman King's questions, Mr. Foundoulis said the State refers residents in keeping with the guide lines for their particuidr kind of facility, however the facility has more detailed screening and is more discriminating in their acceptance. From the 1st to 30 days at Hampshire House residents are evaluated. He said he had no evidence of a problem with a dog or they would have acted immediately. The people are not violent or armed. Councilman King said a signer of the petition in close proximity to Hampshire House said things had seemed to imorove and that's the reason they had signed the petition. However, they did relate previous quite serious happenings to him. Councilman Izell said the question is, has Hampshire House complied with the Conditional Use Permit or not and did they violate the permit any time in the past 4 or 5 years. In answer to Councilman Izell, Mr. Foundoulis said the state useu certain referral guide lines, however Hampshire House does not necessarily have to accept the referrals, but if there is no conflict they do accept them. They have hired 7 more people and have a more stringent screening process. Councilman Aguilar asked why the staff was not increased before the City took action and said had there been adequate supervision this issue would not be before Council. Mr. Foundoulis said the entire process of referrals and hiring and trainee Counselors was in an on going process of change for 13 months and the State requires a 3 to 1 ratio. Albert Randall, Palm Springs, Calif., owner of Hampshire House, 3546 Vineland, said the responsibility was his and in accordance with State requirements they have a ratio of 3 to 1. The number has varied. If they did not comply with State requirements their license would be taken away. He could not believe a resident would choke a dog. He said he never received any letters, maybe one, about revocation of the Dermit and then he discussed this with the Manager and the Staff and to take care of those who go out they hired 3 or 9. They have 23 employees and 45 residents, that's 2 to 1. About 80\ can go out and do not need Counselors to go out. They shop and 90 to work. 98 of the 80.''- of the police comolaints were from the bowling alley, not the street. The Bowling Alley or the Hamburger place call the police and they are brought back to Hampshire House. They now take them to Covina where they are accepted. He will employ more people if necessary. He has expanded the school as there is a need to help these people. There is no other home 1ik" this. The 3 or 4 who were causinc; problems have been replaced. He has reolacpd staff members and there will he no trouble. He asked that they remain and that Hampshire House be checked every 60 days. They have 2\ acres, fhere have been thefts fro'n outsiders but they have not called the police. A bullet hole is in their window from the lot next door. The residents receive medical and dent.il care. Ho te1t that the majority of neighbors do not object to Hampshire House. On October 18 the State presented thorn with a Commendation. He asked that compassion bo shown. In answer to Councilman King, Mr. Kelly said that t^e first Public Notice on Revocation was sent to an incorrect address. The meeting was continued, and another notice sent. Mr. Randall said he had received the Notice and the Manager said that possibly she should have told him that twice residents were picked up at the bowling alley. In answer to Councilman King, Mr. Randall said that the first 2 vears he spent 4 or five days a week at Hampshire House, but lately his wife has not been there so now he's there about 4 or 5 times a week. He does not believe they create problems now and would like to see Hampshire House continue. He felt the owner had had ample time to correct the situation. Under the direct duress of revocation he has made substantial gains. One employee stated he worked part tine, 5 hours a week, and Mayor White wondered if other employees are part time and how that would affect the total management. Mayor White said Councils concern was conduct and super- vision and the City Attorney advises on the legal aspects. Mr. Brody said that since Mr. Randall learned of the problems he had hired additional people. He suggested closer coopera- tion in the future with the Planning Department and the facility by tighter management with scheduled supervision by the City; that each shift report problems immediately to him; initiate a supervised tram service for the residents. He said Mr. Randall had started the Buddy System. Mr. Brody suggested a canteen at the facility. He felt something should be worked out and that 30 or 60 days would allow them to resolve problems. The problem can be controlled. He suggested that Hampshire House use a staff member to police the residents throughout town. Robert H. Benbow, Covina from the Baldwin Park School District, ROBERT H. BENBOM said that within the last month he hdd seen constant super- BALDWIN PARK SCHOOL vision by the young Counselors when he was in the arpd from DISTRICT 3:30 p.m. to 10:30 p.m. He said the situation had improved. Mr. Kerckhoff in summary, said he felt that perhaps the MR. KERCKHOFF report of police calls had been telescoped over a period of SUMMARY 4 years. He referred to an April 10, 1979 interdepartmental communication from Chief Chellino to William Kelly which indicated the situation had ipiDroved, from Officer Lermon to Captain Mertens regarding a resident who read the news- paper, folded it and put it on Mr. Bob Talbot's porch at 3536 Vineland. Ron Wall, 3594 Vineland, said he had never had any problems with residents. He said this City and all cities are exposed to related or worse problems and Hampshire House is providing a valued and necessary community function. He said Council would have to find suf^'ciont facts upon which to base a conclusion that there is a nuisance of sufficient maonitude to warrant the revocation of a valuable program. He said there is a difference between inconvenience and nuisance. Businesses are subject to rudeness from all types of clients and he would prefer Hampshire House residents to many of them. Ho suggested that Council visit Hampshire House. Sometimes a situation has to become serious before changes and corrections are made. There have been improve- ments lately. Under a Conditional Use Pernit the City has control. The residents are no different than anyone else and they are screened and have a right to a niace in society. He suggested concrete supervisory directives from the City and denial of the revocation.
