Proper publications had been accomplished. Mr. Ke11y gave a brief resume of the Agenda Packet summary of the General Plan changes which covered the purpose of the General Plan and background; the General Plan structure is divided into the following documents: PUBLIC HEARING AGP-48 AND CERTIFICATION OF E.I.R. PUBLICATIONS RESUME Technical Report 1 Technical Report 2 Technical Report 3 Technical Report 4 General Plan and Map Physical inventory of the city Physical inventory of the city Social, physical data for Tech. 4 Draft Environmental Impact Report Copies of these documents were made available at the City Hall, the Public Library and were available for purchase. The documents were sent to the State of California, Southern California Association of Governments, the Cities of l-Jest Covina, Covina, El Monte, La Puente and Irwindale, the County of Los Angeles, the Chamber of Commerce, the School District and other affected or interested agencies or parties. Mr. Kelly said the General Plan is a policy making document which sets forth the general direction of development the Community desires to move towards. The General Plan is separate from the zoning code. The zoning code implements the quality of the community. Mr. Ke11y said Council had appointed a Citizen Advisory Committee to assist the staff to establish and set forth the general goats and objectives for the community. Their recommendations are included in the plan. Mr. Kelly said the General Plan changes are not substantial in nature. The changes that do occur are the results of what the staff feels are comprehensive planning in an attempt to make the plans more developable and provide better controls. He said that following the adoption of the General Plan it is subject to consideration for change as the City changes. We are allowed to change the General Plan three times during the calendar year. The Agenda Packet included a letter from C. Les Perance, Fiesta Financial Corporation, Baldwin Park, which requested consideration of a change of land use designation which differs from the proposed plan low density to medium density) for property between Puente & Van Vig Ave., South of Channing. Mr. Perance had received approval of this project in 1978 under a specific plan request. Mr. Kelly said the staff report provided the surrounding land uses. He said the specific issues basically are, it is Mr. Perances desire to construct an attached single owner complex. The reason he is requesting a change to the General Plan land use category is that the density he desires requires a multiple family, or medium density land use classification and not the type of housing proposed. His request equals more than 7 units per acre which would require a higher density. He was advised that the City Council could not review a specific project design, but must consider the best land use designation. The Planning Commission reviewed this request and voted to leave the General Plan in this instance as it is single family residential. LETTER C. The first step in this direction is adoption of a functional General Plan which wilt be operable on a day to day basis. The second step will be the resultant zone changes to make the General Plan and the land zoning consistent. Adoption of certain changes to the zoning code will facilitate better projects. The last step will be to rewrite the zoning ordinance to guarantee that alt the goats and objectives can be accomplished. Following the public hearing he recommended adoption of a Resolution. Mayor White declared the Public Hearing open. Royce Witson, 3704 Kenmore, said he assumed the object of the General Plan was to provide for orderly growth and development within the city and a guide to the development. He said a concern of zoning should be the separation of different types of areas. He suggested ways this could be accomplished and said that it was necessary that the plans be aware of where spot zoning exists and provide for the necessary buffer zone for continual up grading of the areas. He listed the following questionable areas: 1. Frazier Ave., between Fairgrove & Waco, 2 pieces of property zoned Multiple family in the middle of single family property. 2. No side of Baldwin Park Blvd., east of Francisquito shows multiple family and in the middle has R-l. 3. Area on Baldwin Park Blvd. just east of Merced single family in the middle of multiple family. 4. Area on south side of Baldwin Park B^vd., shown as R-T, Garden apartments, used to separate multiple and single family. This he said, was a good use. The problem is the area is already saturated with multiple family usage. 5. The area south of the San Bernardino Freeway at Athol overpass was zoned R-3 and now is shown as R-l. The area has deep lots and one major multiple family development and would make an ideal R-T area rather than R-l. 6. Area at Merced & Los Angeles is a chopped up multiple family area with no R-T separating multiple from single family. 7. Area south of Arrow Highway is shown as manufacturing with no attempt to provide a buffer zone for R-l. 8. Maine St., west of City Ha11, now has a lot 75' x 200* with a sign stating they will build 3 houses on it and its zoned R-l. He said somebody has come in, in the last three months and got special zoning for three houses. He said it appeared the General Plan was special interest zoning or a poor job of General planning; there appears to have been no attempt to buffer various zones or to consider the existing spot zoning. Existing R-3s have been down graded to R-l and this cannot physically happen without a great loss to present owners. He asked that the City Council table the plan until it is studied in detail. He said economics and cost and interest must be considered, and they have built good projects in the City. He said his request may sound unusual in that they are asking for an apart- ment zone but they build single family houses and sometimes to make the land use proper they have to duster them together. He requested Council's con- sideration of this matter. In answer to Mayor White, Mr. Kelly commented on Mr. Wilson's statements. He said the staff had reviewed every street and area and the present usage and tried to establish the highest and best use for the city in the future. Buffer zoning can be achieved through implemenatation of the zoning ordinance. The zoning code wilt isolate and protect the different uses from each other. Appropriate zoning criteria will provide buffers for areas in conflict. Many projects now on the ground will become legal nonconforming and their usage will probably expire before the General Plan reaches its full implementation. He said the City has to look at what will happen in 20 years and some changes may take 20 years to occur in order to build a community of the future. He said alt vacant lots in town were analyzed in terms of their potential development. The portion of the Community on Frazier Street has a major problem dealing with lot line differentiation and inadequate street frontages in some cases. This area has been R-l since the City started and has not developed and it was staffs opinion that R-l w111 not foster development. The zoning ordinance will facilitate R-3 in an R-l area. In answer to Councilman Izell, Mr. Kelty said the General Plan study, with Citizen imput, began about 2 years ago. Councilman McNeil'1 said it was his belief that spot zoning was not good and this City was spot zoned long before this Council was here. He had believed that the General Plan would eliminate some of the unnecessary spot zoning that is a problem in the City. Possibly the R-3 on deep lots will allow development and there- fore he would go along with some spot zoning where necessary. He said that unless it was a rushing situation he would appreciate more time to study the General Plan. Mr. Ketly said the staff was not in favor of spot zoning. The General Plan provides for the removal of 9/lOs of the existing spot zone problems. The new plan has a few isolated instances of where we call spot zoning. But, in fact, we feel that is not negative. It's a positive process to develop that part of the community in an acceptable manner. The staff does not favor spot zoning if not done properly. The zoning code can provide a mechanism to protect these areas. The majority of them have been removed. Councilman McNeill said he felt the area near Van W-ig and Millbury should be held to R-l zoning. Councilman Izell said that out of 47,688 people in the City there was one objection to the General Plan. He said he wished Mr. Wilson had come forward 2 years ago when citizens input was first started as he would have been a great help. He did not favor tabling the matter. Mayor White said he appreciated Mr. Wilson's comments. Mr. Wilson brought up some of the very points Council had discussed at work sessions when slides were pre- sented. A Citizen Committee had been appointed and they atonq with staff and professional consultants had considered these problems. Large lots were considered and workable solutions were proposed. The so called spot zoning was considered and discussed along with what other cities have done to correct the problems. It appears there is no good reason to separate R-2 from R-3 uses, with the use of adequate set backs, with step ups, single story frontages, to multiple family developments. This can be controlled with the zoning ordinance. This was Council direction given to Mr. Ke11y and a11 those involved. He con- curred with Councilman Izett's statements and with all the studies and hearings that have proceeded this hearing he would not favor tabling this matter now. He asked that Mr. Witson let Council know if he ever finds any incidence of preferential treatment in the City. As there was no further testimony either in favor of or in opposition to AGP-48, Mayor White declared the Public Hearing dosed. Councilman King said he felt the non conforming uses would be resolved with the General Plan. He did not favor R-l & R-3 mixes. He said he liked the General Plan which is an exceptionally fine plan for the future development of the City and will correct many problems. He commended a11 who worked on it. He hoped the Planning Commission as well as the Council would agree that the plan can be bettered and that everyone would strive to make it better as the need arises. Councilman Aguilar said that since 1976 there have been problems interpreting the General Plan. He felt this is a good General Plan; that it is a guideline and can be changed as the need arises. He thanked a11 who participated in the General Plan preparation. Councilman McNeilt said that he would like a 2 weeks continuance on the General Plan, however since this would be detrimental to procedures and necessary changes can be made in January he would not ask for the delay. His main concern was the proposed locations for apartment houses. Mr. Ketly, in answer to Mayor White and Councilman McNei'n, said the only way to resolve Mr. Perance's problem is to send the request to the Planning Commission for a report. Approval of the General Plan would not approve Mr. Perance's request. He expressed regret that Mr. Perance's request had not been approved as his projects have been outstanding and a credit to the community. He thanked all who had worked on the General Plan. 00- City Clerk Balkus read a letter from Mrs. Guyneth Crites submitting her resignation from the Senior Citizens Advisory Committee because of distance and being out of town. 00- TERMINATE ANY ACTION AT THIS TIME ON CONDITIONAL USE PERMIT CP-243 BREAKTHROUGH INTERDENOMINATIONAL CHURCH, 13212 FRANCISQUITO AVENUE AND ALLOW THE APPLICANT TO WORK WITH STAFF TO RESOLVE ANY PROBLEMS. M/S/C: AGUILAR/IZELL. There were no objections. 00- Councilman Izell said he had gone to Mrs. Jenkins house and found the noise was louder than he thought. RESIGNATION FRC SR. CITIZENS COMMITTEE TERMINATE ACTION CP-^43-BREAKTHROUGH INTERDENOMINATIONAL CHURCH-STAFF TO RESOLVE PROBLEMS NOISE ABATEMENT INDUSTRY Mr. Kelly said some change in for an up date the City of Industry said they would make the noise generated. He will contact them on the progress and make a report. 00- Mayor White requested that Mr. Lucas propose names at the next meeting for appointment to the vacancy on the Senior Citizen Committee. SR. CITIZEN APPOINTMENT 00- Councilman Aguilar welcomed Chief Chellino and said there was a Boy Scout Troop in attendance. Mayor White asked that the Scout Master come forward and Mr. Bill Hayes introduced himself and 4 members of Troop 679 who were welcomed. BOY SCOUT TROOP 679 00- Councilman McNeill suggested that acknowledgement be made of the Baldwin Park High School Champions. Councilman Aguilar suggested that all Championship teams receive some acknowledgement. Mayor White said that this could be coordinated by the Recreation & Parks Commission as Councilman Aguilar suggested. Councilman Aguitar said it was worth noting Donkey Basket- ball game was played between to Police Department and the Baldwin Park Seniors. 00- Mayor White called for Oral Communications: Ernest Tanner, 4917 Marion Ave., thanked Council, on behalf of residents, for the improvement of Marion Ave. He hoped that in the future they would have sidewalks. The noise is down some but it is irritating. Councilman King said some of Mrs. Jenkins neighbors had also complained to him and Mr. Kelty suggested that it would be helpful if the neighbors would contact Industry. Council had received a letter from Industry assuring their coopera- tion. Mr. Kelly will again contact Industry. Bess Jenkins, regarding the Genera"! Plan said they like their large lot but the 4 apartment units built back of them causes a continual problem because of children putting things in their pool.
