Pacific Avenue WEDNESDAY, DECEMBER 19, 1979 AT 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m. 00- An invocation was given by Rev. Jack Showers, First Baptist Church. City Clerk Batkus led the salute to the flag. COUNCILMAN AGUILAR, IZELL, KING, MCNEILL AND MAYOR WHITE Roll Call: Present: INVOCATION FLAG SALUTE ROLL CALL Also Present: CITY MANAGER SEXTON, CITY ATTORNEY FLANDRICK, DIRECTOR OF ADM. SERVICES HALLOWAY, DIRECTOR OF COMMUNITY DEVELOP. KELLY, CHIEF OF POLICE CHELLINO, CAPTAIN SNOWDEN, DIRECTOR OF HUMAN SERVICES LUCAS, CITY TREASURER MONTENEGRO AND CITY CLERK BALKUS 00- Mayor White spoke of a disastrous fire in the 14500 block on Ramona Blvd. in which County Fireman-Paramedic James Michelli tost his life. He directed that the City flag be flown at half-mast until sunset on the day of Mr. Michelti's funeral. 00- Councit Members and staff introduced their spouses who were present at the meeting. 00- City Clerk Balkus presented the Consent Calendar: 1. WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 79-126 CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 8, 1980, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES 6. M/S/C: KING/MCNEILL. There were no objections. CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR 00- Mr. Kelty reviewed his report on the Implementation of Business & Parking Improvement Area I. He recommended execution of an agreement with the Chamber of Commerce and that an Advisory Committee be appointed including the Mayor and a Council Member. M/S/C: KING/MCNEILL. There were no objections. COUNCILMAN IZELL APPOINTED TO ADVISORY COMMITTEE AUTHORIZE EXECUTION AGMT WITH CHAMBER OF COMMERCE 00- Mr. Kelty said an Ordinance had been prepared regulating Patio, Garage & Yard Sales. A no fee permit was proposed. Two sales per calendar year of personal property only will be allowed. Signs will be regulated and placed on the subjects property only. Duration of and hours of sate are stipulated. City Clerk Batkus read by title: ORDINANCE NO. 804 AMENDING AND ADDING CERTAIN SECTIONS TO THE BALDWIN PARK MUNICIPAL CODE RELATING TO PATIO, GARAGE AND YARD SALES ORD. NO. 804 WAIVE FURTHER READING AND INTRODUCE ORDINANCE NO. 804. M/S/C: IZELL/KING. There were no objections. 00- Mr. Kelty proposed repeal of Municipal Code Sections 4030 x) and 4032 relating to Rental of Commercial or Manufacturing buildings. He said the fee 1s not cost effective. In answer to Councilman McNeill, Mr. Kelly said there will be no fee in the future. Court action will be pursued with those who have not conformed with the present Ordinance. M/S/C: KING/IZELL. There were no objections. 00- Mr. Kelly reported on Smoke Detectors, saying that the Uniform Building Code has been changed requiring smoke detectors in every new room addition over $1,000 and every new residential structure. This is also required on all apartments and h-ighrise structures. He had contacted Covina. In the past they had furnished them to Senior Citizens at no cost. They used HCDA money, which is no longer eligible for this use. This City would have to use general fund money. The staff is proposing that the County Fire Department, Chamber of Commerce and merchants collectively have a program to purchase and make Smoke Detectors available to residents to encourage protection. California Edison provides service to all street lights except Ramona Blvd., which are city facilities. It has taken time to resolve the blame for the problem between Edison and the City contractor. Edison has corrected their part of the problem, but the city contractor had to go back east for the parts. We have asked the contractor to push the completion schedule up. Councilman Izell said he estimated about 200 to 250 street lights that are out. Councilman McNeill said he had had calls from business people in the area who had break-ins because of darkness on Ramona. He said he had checked for at least 2 months. He favored a strict policy that the police report all inoperative lights immediately so they can be repaired as soon as possible. If the contractor cannot do the job he would suggest getting another contractor. He did not believe there should be any further lapse of time until lights are operative. They should be taken care of now. Councilman Aguilar said the problem is that Edison is the only service provider and the General Contractor has to resolve difficulties with them. Mr. Kelly said Edison is under the Public Utilities Commission and he was checking as to why our contractor did not have the necessary parts stocked. The parts were ordered last Thursday. Councilman King felt a letter from the Mayor would resolve the situation. Discussion followed and it was resolved that this problem win be corrected as soon as possible. 00- Mr. Sexton read by title: STREET LIGHTS RESOLUTION NO. 79-131 A RESOLUTION OF THE CITY OF BALDWIN PARK COMMENDING THE SAN GABRIEL VALLEY DAILY TRIBUNE FOR 25 YEARS OF SERVICE TO THE COMMUNITY WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 79-131. There were no objections. 00- In response to Councilman Izell, Mr. Flandrick explained the election procedure as it relates to.^should an incumbent member of Council run for the office of Mayor and be successfully elected^' The question is, is there a way to avoid a special election to tilt the Council vacancy? An appointment could be made for someone to serve until the special election is held. In answer to Mayor White, Mrs. Balkus said an election would cost approximately $7,000.00. This amount includes County service costs, election supplier, precinct workers, polls, rental of booths, etc. 00- Councilman Izetl asked for an opinion and Councilman McNeill asked that the opinion be made by the next CRA meeting on whether CRA property can be sold for a church parking lot. They referred to the Church of God at Ramona and Merced. Staff will prepare a report in anticipation of such a request being made. 00- AT 8:13 P.M.
