Pacific Avenue WEDNESDAY, JANUARY 16, 1980 AT 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m. 00- An invocation was given by Rev. Roger Sawyer, First United Methodist Church. Councilman King led the salute to the flag. M/S/C: KING/AGUILAR. There were no objections. Mayor White presented the Resolution and Trophy to Coach Ty Pagone, who expressed thanks on behalf of the Braves. Mr. Pagone introduced Captains Ray Jansen and Danny Trijo. Council individually expressed appreciation of the Braves accomplishments and said they anticipated like accomplishments by the Sierra Vista Dons. RES. NO. 80-5 COMMEND BALDWIN PARK BRAVES RES. WAIVE FURTHER READING AND ADOPT January 16, 1980 Page 2 RESOLUTION NO. 80-4 Grant: Central Business District; Parking lot; Maine Ave. from Ramona to dark; building at 14435 Ramona) AUTHORIZING SUBMISSION OF AN APPLICATION TO THE U.S. DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT AGENCY FOR FUNDING ASSISTANCE UNDER TITLE I, OF THE PUBLIC WORKS AND ECONOMIC DEVELOPMENT ACT OF 1965, AS AMENDED CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR. M/S/C: AGUILAR/MCNEILL. There were no objections. CONCUR WITH RECOMMENDATIONS 01 CONSENT CALENDAR 00- It was the time and place fixed for a Public Hearing on Z-428 the intent of the Baldwin Park City Council to consider changes in zone within the City of Baldwin Park to conform to the General Plan adopted by the City Council on December 5, 1979. Proper publications had been accomplished. There were no written protests. Mayor White declared the Public Hearing open. Mr. Ketty gave a brief resume of the Agenda Packet report and stated that in accordance with State Planning Law AB 1301) the City is required to make all zoning con- sistent with the General Plan. The proposed zone changes wilt cause some parcels or uses to become legal noncon- forming. An Environmental Impact Report was prepared for the General Plan and no further environmental assessment is required. Mr. Ketty said this was the second phase of a four phase plan to rezone the City. The third phase will be code amendments and the forth wilt be to rewrite the entire zoning Ordinance. The Planning Commission recommend approval of the changes except for Areas 55, portions of 70 and 71,89 and 96. Councilman Izett said he had one lot included in the zone change and would not enter into the discussion unless it was for a matter of information. He said arrangements would be made in the future that more adequate notice wilt be given to property owners. TESTIMONY was given by: AREA # 45 Pat McGuire, 1101 White Lane, Bakersfietd, Calif. Regent International) said property at 12858 W. Ramona is R-3 being changed to Commercial. They have been working with the staff for the past two years on a condominium development and this wi11 hold up plans. Mayor White said this area would be withdrawn for further study. She thanked the Planning Commission for deleting this area as down zoning will not help them interest investors. They would prefer Residential Garden Zoning. Mayor White said this area had been withdrawn for further study. 96 Charles Hartman, 932 Leorita Street, said his property at Leorita & Bess is now R-3 which he plans to develop. They would lose on R-1 as the value would go down. He had taken time from work to attend and asked that this be resolved. Mayor White said this area had been withdrawn for further study and that Mr. Hartman would be notified in writing of the decision. GO- 71 William Buys, 3741 Puente Ave., said he was not against the rezoning R-1 to R-3. He did not believe Mr. Stoper was against it either. He asked that lot 71 be reinstated in the General Plan. 71 Joseph Sanchez, 3733 & 3732 Puente, stated they would prefer R-3. Mayor White said this area w111 be reviewed. 00- Mike Garrison, 4928 Etton St. said he was not sure that his property is being rezoned. He has a 66'x307' lot. Mr. Ketty said no changes were proposed on this property. Mayor White said the staff wi11 discuss this with Mr. Garrison. 00- 70 Edward Mader, 3736 Puente, said he was concerned about the existing use if there is a zone change. Mr. Ketty said this would be a legal non conforming use and there would be no problem. 00- 21 A. Hernandez, 4416 N. Merced, said he objected to change from C-1 to R-3 as he plans to develop in the future. Discussion followed and Mr. Cunningham said this would be more valuable as R-3. Mr. Kelty said the study indicated that this large area would not develop Commercially and R-3 appears to be more compatible. This is adjacent to Commercial. He could meet and discuss this with Mr. Hernandez and possibly this can be considered with the next General Plan changes in May. As there was no further testimony either in favor of or in opposition to Z-428, Mayor White declared the Public Hearing dosed. ROLL CALL: AYES: AGUILAR, MCNEILL. KING, AND WHITE. ABSTAIN: IZELL. 00- It was the time and place fixed for a Public Hearing on AZC-78 the intent of the Baldwin Park City Council to consider amendments to the Zoning Code of the City of Baldwin Park to conform to the General Plan adopted by the City Council on December 5, 1979. Proper publications had been accomplished. There were no written protests. Mayor White declared the Public Hearing Open. Mr. Stade gave a brief resume of the Agenda Packet report and recommended approval of the amendments, including modification of a Flag Lot Ordinance. Testimony was given by: Royce Witson, 3704 Kenmore, said he was concerned with the minimum lot width of 75' on Flag Lots as most lots are 60'x 300' Providing for 60 ft. lots now would eliminate having to amend the Ordinance at a later date. Mr. Stade said lot widths had been studied and Mr. Kelty said required lot area for Flag Lots had been reduced and 5,000" was proposed for the finalized ordinance. Discussion followed that this was the first step in proving a method of development for deep lots. As there was no further testimony either in favor of or in opposition to AZC-78, Mayor White declared the Public Hearing closed. DIRECT THAT CITY ATTORNEY PREPARE FOR NEXT MEETING AN ORDINANCE AMENDING THE ZONING CODE TO CONFORM WITH THE GENERAL PLAN ADOPTED DECEMBER 15, 1979. M/S/C: MCNEILL/IZELL. There were no objections. Councilman Izett suggested that the Historical Society save one rock house from the north side of town and possibly have it moved to Morgan Park. 00- Councitman McNeilt expressed concern regarding the sale of drug paraphernalia and asked if an Ordinance could be drafted which will protect children from buying. Discussion followed. The City Council requested that the City Attorney research this subject and report to Council and if appropriate prepare an Ordinance. 00- Councilman Aguilar invited everyone to the Baldwin Park Parade, January 26, 1980. 00- Oral Communications 1979 CONTRACTORS LICENSE FOR BUILDING PERMITS ROCK HOUSE, SAVE CITY ATTORNEY TO REPORT. DRUG PARAPHERNALIA ORDINANCE BALDWIN PARK PARADE Eugene Elder, 3940 Walnut, expressed concern with the lack of open space if apartments are built on the rail- road right of way on Ramona Blvd. Mayor White explained that this property belongs to the Railroad; that this wi11 be good Planned Unit Development There wi11 be no high density and public hearings wi11 be held. Staff, Consultants and Automobile Clubs. 1979 traffic data was not complete nor available for review at the time of the study, Two way left turn lanes were proposed and elimination of a loading zone on the east side of Maine, 200 feet south of Ramona. It was recommended that west side curb parking be eliminated as there is other parking available and a downtown parking area is proposed. Staff wi11 discuss this with businessmen. A public education process was proposed to be initiated by the Police Department to educate pedestrians about pedestrian safety. Other proposals were, speed enforcement 25 MPH), signs and striping, and up- grade of street lighting. Discussion followed. CONCUR WITH RECOMMENDATIONS OF SPECIAL COMMITTEE AND ORDER IMPLEMENTATION OF ACTIONS TO BE INITIATED. M/S/C: MCNEILL/KING. There were no objections. MAINE AVENUE TRAFFIC REPORT IMPLEMENT TRAFFIC REPORT RECOMMENDATIONS 00- Councitman Izelt said that four street lights at Ramona and Baldwin Park Blvd. are not functioning. Mr. Kelly said this was being corrected. 00- Councilman McNeilt said the Lions Club has a Foreign exchange student program and Certificates had been prepared for presentation to 2 students who wi11 be leaving this week. AUTHORIZE COUNCILMAN MCNEILL TO PRESENT CERTIFICATE AWARDS TO RESIDENT STUDENTS PENNY JOY RIDGE AND TO WENDY ANN CORIFH FROM AUSTRALIA, GUESTS OF ED RICKETS. M/S/C: KING/IZELL. CERTIFICATES FOREIGN EXCHANGE STUDENTS 00- Councitman Aguitar asked that the City Manager prepare a resolution commending Bill Adrians for two years of volunteer service with the youth boxing program. There were no objections. 00- Councitman King proposed that a resolution be prepared in support of 1^ sates tax being made available to cities. Discussion followed.
