Proper postings and mailings had been accomplished. There were no written protests. Mr. Kelly gave a brief resume of the Agenda Packet report. Mayor White declared the Public Hearing open. As there was no testimony either in favor of or in opposition to 79-W-166, Mayor White declared the Public Hearing dosed. Proper postings and mailings had been accomplished, There were no written protests. Mr. Kelly gave a brief resume of the Agenda Packet report. Mayor White declared the Public Hearing open. Don Gallagher, 5724 Lemona Avenue, Van Nuys, Attorney representing Hugo Ventrona, owner, said the firt notice received was dated January 22, 1980. He felt the $375.00 plus administrative charges should have been about $150.00 and that the 25% administration cost of $93.75 was in violation of M.C. section 7609. He had had discussions with staff and was told that notices were sent out on August 3 & 30, September 12, October 17 and November 30, 1979 to Beulah Plowman, owner of record prior to the recording of the deed December 6, 1978. He quoted from M.C. section 7603" Director shall give written notice to the owners of affected properties as shown on the latest equalized assessment ro11 He said Staff had advised him that Mrs. Plowman was notified because of the County Assessment ro11 of 1978-79. He contacted the County and spoke to Joe Furukawa 974-3421 who advised him that the deed recorded December 6, 1978 became an official county record on March 22, 1979. The computer print out became available to cities about July 1, 1979. However, he said the code requires the latest equalized assessment ro11" which was effective for March 1, 1979. He said the roll used August 3, 1979 was obsolete; that the appeal provisions of the code were not available to them because of lack of notice. He said the tenant could have been contacted and asked who was the owner. He felt the City had not complied with the code. Mr. Flandrick said Mr. Ketty had advised him this date that apparently there was a transfer of title, however Mr. Gallagher neglected to mention that there was a posting notice on the property. That fact, plus the fact that Mr. Gatlagher, representing the owner is present and did not argue the fact that the property constituted a nuisance to some degree. He said Mr. Gallagher was arguing over the value of removal. The City did everything possible based on records we have and apparently Mr. Gatlagher was familiar with the condition of the property. Mr. Kelly said the City annually purchases from the County the computer print out; in this case after several letters were returned, the City contacted SAFCO Title insurance to attempt to find the correct owner. Safco verbally verified that the owner was correct. Subsequent to that Safco submitted a title report indicating that the land had transferred in 1978. The notice was posted to the property and letters were sent to the individual on record. He quoted from Municipal Code section 9603. The last sentence read, The failure of any person to receive such notice shall not affect the validity of any proceedings hereunder". In answer to Mayor White, Mr. Flandrick said the City had substantially complied with the code. Mr. Gallagher said the January 22, 1980 notice, from which there is no appeal, was the only notice they received. They had been cleaning the property since approximately September, 1978. He said, the City removed bushes, a car seat and an old rabbit hutch and a fence which the owner did not want destroyed. A fire, about June had removed debris, so the area was green. He said he had seen the property before and afterwards and denied that it constituted a nuisance. In answer to Mayor White, Mr. Flandrick said that based upon his conversation with Mr. Kelty and a review of the files the City had followed procedures to give the onwer notice, not limited to posting, and this constituted substantial compliance with notice requirements. As to whether the property constituted a nuisances is the subject of this hearing. He suggested that Council pass on the question of whether or not the manner in which the abatement was conducted was done at a reasonable cost. If Council finds that the notice given was insufficient procedures should be dismissed. If it was found that notice was in substantial compliance then it was proper to proceed and decide whether the abatement figure was reasonable. Discussion followed. Municipal Code Section 7603 was read in full by Mr. Kelly. Following a discussion with Mr. Flandrick, Mayor White said the City intends to continue enforcement of the nuisance abatement laws. This case was not singled out but this would be the general policy of the City. He suggested that the Council authorize payment to the abatement contractor and that Mr. Gallagher confer with Mr. Kelly on the disposition of this matter and it can be taken off calendar at this time. Discussion followed regarding substantial compliance with the code. In answer to Councilman King, Mr. Kelly said posting was made September 9, 1979. Further discussion. As there was no further testimony either in favor of or in opposition to 79-W-170, Mayor White declared the Public Hearing closed. NOES: MAYOR WHITE 00- In answer to Councilman McNeill regarding county tax rolls, Mr. Kelly said the City is now contracting with a computer firm for up dates every 3 or 4 months plus using Safco to try and locate owners. 00- It was the time and place fixed for a Public Hearing on Public Nuisance Case No. 79-W-171 Confirming the cost of abatement at 13538 Palm Avenue. Proper postings and mailings had been accomplished. There were no written protests. Mr. Kelly gave a brief resume of the Agenda Packet report. Mayor White declared the Public Hearing open. Mrs. Ferne Dismuke, 13538 Palm Avenue, said that upon receipt of first notice she had had a consultation with Mr. Dawson. Since she is on Social Security and a small job it was decided this was a hardship case as had no funds and her", husband had left her with many bills. Mr. Dawson had said a nuisance did exist and since she could not take care of it he suggested that the City proceed with the clean up as it would be cheaper. He suggested and she had written a letter to Mr. Kelly that this was a hardship case. She said a nasty letter from a secretary was received, saying absolutely not" and evidently they had no acknowledge of her communication with Mr. Dawson. Mrs. Dismuke said that the day after her conversation with Mr. Dawson she had received a tetter that the public hearing was postponed to a future date which she did not attend as she had already been in. She did write a letter allowing work to proceed. She continued and read a letter, dated January 18, 1980, which sha said she had directed Mr. Dawson. She read that gardeners had worked less than hour split on 2 days. They trimmed and cut and did not remove dead bush and raked a 10" x 15' plot. She read that her income in 1979 including Social Security was $6,000.00. She pays $370.00 a month on her house. In 1978 she received $1,700,00 and lived on borrowed money. Her Social Security has been cut $40.00. Her husband left her many debts; she has no heat, washes in cold water, needs new hot water tank, toilet and faucets, etc, She said she had hoped to pay off yard work in a year but cannot pay $437.00 and she did not think work was worth that. Councilman King suggested that Mrs, Dismuke see Mr. Cunningham for help on this and other problems. Councilman McNeill asked that she contact him for help from Mid-Valley Manpower. Mayor White and Council directed that if anyone was advised to use City cleanup, that this advice cease and let the people find their own help. Mayor White suggested that Mrs, Dismuke contact Mr. Cunningham and Mid-Valley Manpower. 00- Mrs. Nell Soto, U.S. Bureau of Census 1980, Community Services Specialist for the West Covina area which includes Baldwin Park. The Bureau is conducting a Community Awareness program. 200 people throughout the nation are advising citizens about the Census. The 1980 census will be conducted by mail. April 1, 1980 has been designated Census Day USA. On March 28 and 29 every type of household in the nation will receive a census form. About 90% will be contacted by mail and 10% in rural areas will be contacted at the door. This is the 20th Dicennial Census. The 1st one was taken in 1790. The purpose of the Census is to provide population totals needed to apportion seats in the U.S. House of Representatives. Data is also use for distribution of Federal, State and local funds. Short and long forms will be mailed. The long form will be used to determine the needs of conmunities, and cover transportation, energy, disabled persons, etc. She displayed a form and asked that people not discard the forms. When forms are not returned there will be personal contact. They are asking the help of all City Councils, School Districts, Organizations, etc. and asking that the City Council proclaim a particular day as Census Day, 1980 and urging resident cooperation. She said Boy Scouts will be delivering 36 million brochures and handbills house to house. She offered to send flyers to distribution to the City. Mayor White felt that 15,000 flyers delivered to Mr. Sexton win be helpful. These will go to the school district for distribution. He said Council concurred that the Census was very important. She thanked Council and said they had received packets and she was sure they were aware of the importance of the Census. 00- Mr. Kelly reviewed the report on proposed changes in Municipal Code section 7700 House Moving. Square footage will be taken into consideration and each case will be reviewed. M/S/C: IZELL/KING. There were no objections. 00- Mr. Ke11y reviewed his report on the Proposed Code Amendment on Public Nuisance Abatement procedures, Municipal Code Section 7600. This will eliminate paper work, time loss and confirmation cost hearings. An appeal provision is included. Staff will initiate an annual contract with abatement contractors. This and the additional Code Enforcement Officer on alternate weekends will speed up processing and pay- ment. Councilman McNeiTI stressed that owners be given ample time to provide cleanup themselves. He was also concerned if there were only one contractor. Mr. Kelly said only registered mail notices will be eliminated. Notices will still be mailed and property posted. He said there will be four to six contractors on a rotating basis. We have 3 now that bid. Mayor White directed that staff provide Council with an Administrative operating policy on bidding procedures on nuisance abatement. In answer to Councilman Aguilar it was clarified that Public Nuisance appeals were $50.00 for abatement costs over $1,000.00 and less than $1,000.00 is $10.00. Because of the disparity in bids he recommended that the bids be rejected, that plans and specifications be reviewed and that the project be readvertised. He said that neither contractor objected to the rejection of the bids. Councilman McNeill requested that a rendering of the proposed building be presented at the next Council meeting. There were no objections. 00- For the benefit of the Boy Scouts present. Mayor White explained that the City Council discusses items which effect the entire community and he encouraged their continued participation in and involvement in government. 00- Bertha Regus, 5013 Cutter, said there was no excuse for stray animals running in packs at night as the Animal Control Department has a full work force. They are a nuisance and thought something should be done. Mayor White said the department wilt again be contacted and ask that they try to do more. Counilman McNeill concurred and said he also wished something could be done to make people take care of their dogs and cats. He suggested more enforcement for Baldwin Park. Councilman King said that possibly more stringent laws are needed and that possibly the use of a tranquilizer gun is the answer to catching animals. He suggested pursuing the issue with the County Board of Supervisors, 00- Bess Jenkins, 13056 Amar Road, thanked Council for the Certificate awarded to Recreation and Parks Commissioners. She said Amar Road ends at the Wash and a better sign is needed for truck traffic coming from the freeway indicating that Amar Road is not a through street to La Puente. Many trucks have to back up or turn around. She said harassing noise eminating from Industry has not abated and she wondered if they had a mass neighborhood meeting could the City Attorney advise them on their rights and wordage of a suit against the City of Industry. There has been no acknowledgement of her tetters aside from a catt from the City Manager. Continued SR. Mayor White asked that a letter to the Mayor of the City of Industry be drafted for his signature. DRAFT LETTER FROM MAYOR Ernest Martinez, 5011 Bleecker Street asked why on Z-428 the zoning from R-l to M-l stopped two lots short and why were owners not notified of the January 16, 1980 meeting. He objected to M-l next to R-l. Mayor White said there were legal notices and press releases in two newspapers, and meetings were advertised and held before the Planning Commission and the City Council.
