Pacific Avenue WEDNESDAY, MARCH 19, 1980 AT 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m. 00- An invocation was given by Rev. Richard Flood, First Christian Church. City Manager Sexton led the salute to the flag. KELLY, CHIEF OF POLICE CHELLINO, DIRECTOR OF HOUSING AND ECONOMIC DEVELOPMENT CUNNINGHAM, DIRECTOR OF HUMAN SERVICES LUCAS, CITY TREASURER MONTENEGRO AND CITY CLERK BALKUS 00- City Clerk Balkus presented the Consent Calendar: CONSENT CALENDAR 1. APPROVE MINUTES OF MARCH 5, 1980 2. RECEIVE AND FILE TREASURER'S REPORT FEBRUARY 29, 1980 3. WAIVE FURTHER READING AND ADOPT RESOLUTION NO. 80-19 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 4. DENY CLAIM AGAINST THE CITY DARYLYN NAGY F-974) 5. However, it was her understanding that the letters would be introduced under Oral Communications. 00- Mr. Cunningham reviewed the bids for the Senior Citizens Center. Eight bids were received and opened March 12, 1980, ranging from a high of $296,000. to a low of $197,795. He recommended acceptance of the low bid of Jordan Development Corporation, AWARD CONTRACT FOR CONSTRUCTION OF THE SENIOR CITIZENS CENTER BUILDING TO BE ERECTED AT 14302-14306 E. PALM AVENUE TO THE LOW BIDDER. JORDAN DEVELOPMENT CORPORATION, 812 N. GRAND AVENUE, COVINA, CALIF. IN THE AMOUNT OF $197,795. M/S/C: IZELL/KING. There were no objections. Councilman Aguilar said that when the Senior Citizens Committee was initiated in 1976 they had worked very hard along with the staff and Council and through joint effort they obtained transportation, low income homes and now we have the Center. He and Mayor White commended the Commission and the Staff for their efforts. Mr. Cunningham said ground breaking for the Center will take place at 10:30 a.m., March 26, 1980. 00- Mayor White presented a specimen Residential Mortgage Revenue Bond for Councils viewing. The $2,245,000. Bond issue 1980) for the West Ramona Boulevard Redevelopment Project was approved by the City Council/ Redevelopment Agency on March 13, 1980. 00- Councilman Izett said that regarding notices sent out for the next Planning Commission Public Hearing being a little vague, he had discussed this with the Director of Community Development. Mr. Kelly was aware of this and future notices will be more informative. Councilman Izell introduced his brother Jim Izetl, Manager of Nichols Lumber Company. 00- Mrs. Sharman Ann Dunay, 4261 Monterey Avenue came forward. Mayor White said he believed he knew about the subject which was being brought up. He directed questions to the City Attorney, and asked; in the event that the Council wished to further study the matter of the future development on Center Street, would it be proper and legal to delay action on a pending development that has been currently scheduled before the Planning Commission on a Variance, and would it be proper for the staff to meet with members of the community and consider some sort of a moratorium? Mr. Flandrick said this would be proper and that council could instruct the Planning Commission to defer any action either by continuing the hearing or renoticing. Regarding a meeting with staff and interested citizens this would be proper. Mayor White said that in a matter that is quite likely to come before Council on Appeal what would be the rules for listening to any comment now and any response by the Council. Mr. Ftandrick said that on any matter that is likely to come before Council at a later date as a matter of Appeal from a Planning Commission action then any evidence relating to it, or any matters of opinion relating to it, should be deferred and presented to Council at the time of the hearing. It would be inappropriate to consider, act, discuss or participate other than at the time of the Hearing. Mayor White said that any evidence received or a discussion by a Councilman prior to a public hearing would necessitate that Councilman disqualifying himself at the time of a public hearing. Sharman Dunay said petitions signed by 124 residents in her neighborhood were delivered to City Hall today. She read the petition which protested a zone change from Rl to R3 in the Los Angeles/Palm, Filhurst/Walnut area on the basis that they did not receive adequate notice, The petitions requested a 90 day moratorium to allow further discussion. Copies in official files). She said they wished Rl for the neighborhood. Robert A. Grenades, 4265 Walnut, asked why they were not informed of this particular zone change. Sally Dunay, 4258 Center Street, questioned how many people read legal notices of zone changes in the local newspaper. She said citizens trust in their elected representatives to provide them with the proper environ- ment, and that the opinions of residents in an affected area should be sought. She did not feel this was done and asked that Council do its best for the citizens. Mayor White made a recommendation and the following motion was made. THIS MATTER ZONING) BE PUT OVER AND THAT PLANNING COMMISSION BE INSTRUCTED TO SET THIS MATTER ASIDE; THAT THE CITY STAFF UNDER THE DIRECTOR OF COMMUNITY DEVELOPMENT MEET WITH THE RESIDENTS; THAT HE COME BACK TO THIS BODY WITH A RECOMMENDATION AND THAT HE CONSIDER THE RESIDENTS WISHES AND ALL OTHER FACTORS INCLUDING A MORATORIUM AND THAT THIS BE ACTED UPON AS SOON AS PRACTICAL. In answer to Councilman McNeill, Mr. Flandrick said that if the motion carries and if Mr. Kelly recommends that a Moratorium is the proper thing to do, then an Ordinance would be presented to Council which would have the effect of declaring a Moratorium only in that given area described in the Ordinance. Mayor White said that for the last 2 years with the help of some 100 citizen members throughout the Community, Consultants and the City Staff, the Council had been presented with and adopted a new General Plan. The Council in the General Plan and the zoning ordinance intended to plan for the city for approximately the next 20 years. It was agreed at that time that if any serious problems arose, they would be reviewed by Council and Council intends to do that. 00- Bertha Regus, 5013 Cutler Street, said that due to many people not paying trash bills, garbage, etc. is piling up at the north end of Merced. Visitors especially comment on this. Rivergrade Road by the racetrack is also used as a dump. She said this is unsightly and the City should correct this. Mayor White said ground breaking for a new Commercial/ Industrial development north of Merced wilt take place March 20th at 10 a.m. and he felt this development would eliminate that problem. Nuisance enforcement has doubled and will eliminate many of these problems in the future. 00- Councilman King said it was good to see so many citizens present to add their input to Council decisions. Councilman McNeill concurred and said that although the Senior Citizen Center may not be just what was envisioned he hoped they would enjoy the facility and perhaps one day it can be enlarged. He hoped the center would be well cared for as one day he expects to use the facility too. 00- Councilman Izell said he had received a copy of a letter from Harold 0. Wynn addressed to the Los Angeles County animal shelter which he referred to staff. 00- AT 8:05 P.M. THE MEETING ADJOURNEO.
