Pacific Avenue WEDNESDAY, APRIL 2, 1980 AT 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m. 00- An invocation was given by Rev. Paul Gregory, Church of God. INVOCATION FLAG SALUTE ROLL CALL City Clerk Balkus led the salute to the flag. APPROVE REQUEST FOR BUDGET ADJUSTMENT AND WAIVER OF BID PROCEDURE THERMAL PLASTIC MELTER TO IMPLEMENT TRAFFIC DELINEATIONS AND PAVEMENT LEGENDS $10,000 CAPITAL OUTLAY COMMUNITY DEVELOPMENT) CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR. M/S/C: IZELL/AGUILAR. There were no objections CONCUR WITH RECOMMENDATIONS ON CONSENT CALENDAR 00- City Clerk Batkus read in full a petition signed by 29 individuals. The petition requested that the auditorium be refurbished and that the community be advised of future plans, the date of implementation and this be on top of the priority list. Copy in official files) Mr. Kelty explained that a special task force had been appointed to evaluate and study the needs and possibilities. The committee has met twice and they are still evaluating. A report will be made to Council within the next two months. He said that based upon the present declining condition of the auditorium and the need for modifications for proper use of the auditorium rough estimates vary from $500,000 to $1,000,000 depending upon the exact nature of the modifications. At present no funding exists, federal and private funding is being explored. The concern is that no renovation be started until it is established that the entire project can be completed Councilman McNeitt said that this facility was a cultural need for the City and he would favor using any money through grants, giving the renovation priority for use of the City. Mayor White concurred and said that if federal grants were not available it may be possible to have some sort of bond issue to improve the entire Civic Center complex. 00- Mr. Kelly reviewed the Agenda packet report on the Center Street Zoning Study. He said petitions were received March 19, 1980 requesting that the area bounded by Los Angeles, Palm, Filhurst and Walnut revert back to R-l. The staff met with petitioners on March 24, 1980 to receive citizen input. Further meetings will be held to inform citizens of what is occurring throughout the city in land development, zoning and housing. A moratorium was not necessary provided ZV-393 is held in abeyance and a building permit is not proposed. Discussion followed. INSTRUCT PLANNING COMMISSION TO CONTINUE VARIANCE APPLICATION ZV-393 FOR TWO WEEKS; INSTRUCT STAFF TO STUDY THE ISSUE AND MEET AND DISCUSS WITH RESIDENTS, DEVELOPERS AND THE HOUSING AUTHORITY AND REPORT TO COUNCIL AS SOON AS POSSIBLE WITH RECOMMENDATIONS. Copy in official files). In brief the report stated that there was no basis of fact for the presumed allegations. Mayor White said the report would be available in the City Clerk's office for citizen perusal and gave a copy to the Tribune reporter. Councilman King asked if all Council had received this information at the same time. Mayor White said he had been briefed on the report this morning. Councilman King said that Mayor White had sent a letter on March 21, 1980, soliciting the support of the school district classified employees for Councilman Izell prior to reviewing the report, He questioned that this was an in house investigation. Mayor White said he had sent a letter and the letter was completely unrelated to this investigation. Councilman King said he felt this should be an outside investigation, and he had not had time to review the report. REQUEST INVESTIGATION OF PRESUMED ALLEGATIONS BY THE DISTRICT ATTORNEY. M/KING. The motion died for lack of a second. Mayor White instructed that the City Manager forward a copy of the investigation report to the District Attorneys office and to advise him that all records were available to him for any investigation he wishes to make. 00- Harold Martin, 4309 Center Street, expressed concern that there is no moratorium proposed for development of the Center Street property. Mr. Ftandrick said no construction could commence without permits and the staff is under implied instruction from Council that action on any application for construction be held pending Councils review to determine whether or not a moratorium is necessary. It was his opinion that no development would take place without Council meeting to determine the best usage of the property. 00- Duane Shaffstall, 4250 Filhurst Avenue, asked if there was any guarantee that these would be a public hearing on the development proposed for the Center Street area and if proper notices would be given and the area staked with notices. They did not want R-3 in that area. Mayor White said a public hearing was held for rezoning from R-l to R-3 on this area. The project could have proceeded but the builder had requested a variance and a study and determination will be made. If there is rezoning a public hearing will be required. The residents will be informed. Mayor White said all required legal notices of the public hearing had been met and meetings of the Planning Commission and the Council were well attended. The entire General Plan was advertised and public hearings were held in January, 1980. Mr. Flandrick explained that the proposed report will determine Councils official action on this area.
