In conformance with Section 22932 of the Elections Code, the City Council of the City of Baldwin Park met at the above place at 7:30 p.m. to receive the City Clerk's Certification as to the results of the April 8, 1980 General Municipal Election. An invocation was given by Councilman Izetl. City Clerk Batkus led the salute to the flag. RAPHIEL AND CITY CLERK GAIR And: MANNY De DIOS AND DWIGHT FRENCH, REPRESENTING MUNICIPAL SERVICES, INC. 00- Mr. Flandrick explained to the Agency Board that pursuant to California Community Redevelopment Law a Joint Public Hearing must be held before you enter into a Disposition and Development Agreement. A Joint Public Hearing Notice was published by the Executive Director of the Baldwin Park Redevelopment Agency in the Baldwin Park Herald Press, a newspaper of general circulation, on April 3 and April 10, 1980. The Executive Director of the Baldwin Park Redevelopment Agency mailed proper Notice of said public hearing to the Southern Pacific Railroad. Mayor White said this was the time and place set for the Joint Public Hearing of the City Council of the City of Baldwin Park and the Baldwin Park Redevelopment Agency to consider a Disposition and Development Agreement with Allwest Development Corporation. Mr. French, of Municipal Services, Inc., stated that the 33433 Report has been on file in the Agency office the prescribed length of time, as well as a draft Disposition and Development Agreement. AH the minor changes in working have been reviewed by the Agency Attorney. He explained that the basis of the Agreement is that the Agency wilt purchase the property from the railroad and sell the property to the developer at fair market value. Fair market value has been determined by an appraiser. The next effect is that it wilt cost the Agency nothing to transfer the land; thedevetoper wi11 pay a11 of the costs incurred by the Agency in acquiring the property from the railroad, including land cost plus any carrying charges involved. The developer, in turn, will develop the property in accordance with the site plans and the develop- ment plans as presented. Mr. Kelly presented a brief description of the project. It MR. KELLY is basically located on the Southern Pacific Railroad property REVIEW OF starting at the westerly city limits. It is a 32 unit project; PROJECT 16 units of each phase. The property is basically between 90 and 100 feet deep, which causes significant development problems. The proposed units are primarily 1 and 2 story structures varying in square footage from 1,000 to 1,400 square feet in area. Each of the proposed units has two enclosed garage spaces per unit. The proposed architecture is Spanish in character having stucco walls and tite roofs and heavy wood timber features. The proposed landscape plan and grade plan provides for no circu- lation to be from Ramona Boulevard; alt access wilt be from Ramona Parkway. There will be heavy perimeter landscaping both along Ramona Boulevard as well as Ramona Parkway. Each of the units has a private patio and some of them have a second story balcony. The staggered design of the project provides for a pleasing urban design concept and is an attractive project, and is in compliance with the City's General Plan, the environmental analysis and the Redevelopment Plan. The Ad Hoc Committee Mr. King and Mr. Izell) reported that AD HOC they both felt the development would enhance Ramona Boulevard COMMITTEE and the total land use was in keeping with Baldwin Park's plans. Mr. Flandrick stated that there was one change to be made in the Disposition and Development Agreement. Paragraph 1000 was to be deleted and a replacement paragraph wilt be inserted indicating that the commitment of the contract earlier signed by the Agency, the trustee and developer will be referred to in this Agreement and made a part of it. This is a technical change and poses no problems. MR. FLANDRICK Mr. Sexton reported that in receiving the estimate from the MR. SEXTON water company for providing water to this project it was an incredible $130,000; approximately twice our estimates. The Agency has agreed to share this cost with the developer of $30,000 on a pro rata basis. Mr. Kelly reported that he is trying to contact the County Fire Department regarding the required fire flow. We hope to get the estimate down considerably. MR. KELLY RE FIRE FLOW As Mayor and Agency Chairman, Mr. White opened the public hearing for any testimony from the audience. Mr. John Dermain, 4260 Monterey Avenue, Baldwin Park, California, asked a definition between condominiums and townhouses. He also questioned if there would be an association for maintenance of the property. JOHN DERMAIN Mr. Ketly stated that townhouses are sold to individuals MR. KELLY and condominiums are rented or leased. He stated the project is required to have the Conditions, Covenants and Restrictions, which mandates that the property wilt be maintained. Mr. Dermain also questioned the developer regarding the individual units, if they were fire and sound separated. Mr. Dermain was assured that each unit is adequately separated. Mr. Krasik stated they would be in the low $80,000 range. It was also pointed out by Mayor White that the real advantage was the 11% interest rate that will be offered. Mr. French stated that before the hearing continued he would like to make one correction in the 33433 Report. The Report indicates a land value of $1.90 per square foot; however, the price of $2.00 per square foot, plus alt costs, stated in the Disposition and Development Agreement is the correct figure. Mr. Duane Shaffstall, 4250 Fithurst Avenue, Baldwin Park, California, questioned if the bonds had already been sold to take care of the 11% interest rate or will the citizens have to pick up the other 9%. Mayor White stated that the bonds have been sold for 9.8% and the money has been invested. There being no written communications and no further questions or testimony either in favor of or in opposition to. Mayor White declared the City Council/Redevelopment Agency Public Hearing dosed. 00- Mr. Flandrick stated that he had reviewed alt the documents and steps leading up to the signing of the Disposition and Development Agreement and alt the applicable laws and requirements had been met. He stated that the next order of business as a joint public hearing was the adoption of City Council Resolution No. 80-25.
